R. 663</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20230919">September 19, 2023</action-date><action-desc>Received</action-desc></action><legis-type>AN ACT</legis-type><official-title display="yes">To amend the Indian Child Protection and Family Violence Prevention Act.</official-title></form><legis-body id="HBD5D8403F3D5415A9659D0E442E13F70" style="OLC"><pagebreak></pagebreak><section id="HE2D52E5FF48E478FBCF534648ED275A2" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Native American Child Protection Act</short-title></quote>.</text></section><section id="H14CA9420D75742F2AEBF627912C40B79"><enum>2.</enum><header>Indian child protection and family violence prevention act amendments</header><text display-inline="no-display-inline">The Indian Child Protection and Family Violence Prevention Act (<external-xref legal-doc="usc" parsable-cite="usc/25/3202">25 U.S.C. 3202 et seq.</external-xref>) is amended as follows:</text><paragraph id="H8E13987480AC49E9871EBBDCEA9F1C55"><enum>(1)</enum><text>By amending section 403(3)(A) (<external-xref legal-doc="usc" parsable-cite="usc/25/3202">25 U.S.C. 3202(3)(A)</external-xref>) to read as follows:</text><quoted-block id="H03CA429B1D854CDC9808B11F6DA4DF21" style="OLC"><subparagraph id="H7DA04D3A43664851AAC816E80A6B6528"><enum>(A)</enum><text>in any case in which—</text><clause id="H66F1052862C14D97BE4DC3F49ED87B7C"><enum>(i)</enum><subclause commented="no" display-inline="yes-display-inline" id="H473B74A607AD4F55813663ADCBFE7B7E"><enum>(I)</enum><text>a child is dead or exhibits evidence of skin bruising, bleeding, malnutrition, failure to thrive, burns, fracture of any bone, subdural hematoma, soft tissue swelling; and</text></subclause><subclause id="H366D0D18AC224B489C950820AD1C4F87" indent="up1"><enum>(II)</enum><text>such condition is not justifiably explained or may not be the product of an accidental occurrence; or</text></subclause></clause><clause id="HE594B77E627C4BB79D8A71169DB6449E"><enum>(ii)</enum><text>a child is subjected to sexual assault, sexual molestation, sexual exploitation, sexual contact, or prostitution; and</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H17D3D9D0793242F7A2AF1AEC7BEB6301"><enum>(2)</enum><text>In section 409 (<external-xref legal-doc="usc" parsable-cite="usc/25/3208">25 U.S.C. 3208</external-xref>)—</text><subparagraph id="HC61764FCBB414C88B66D86BBC632B2F8"><enum>(A)</enum><text>in subsection (a)—</text><clause id="HBCEB9EEFE16C4EB6B1220F2541DEE515"><enum>(i)</enum><text>by striking <quote>The Secretary of Health and Human Services, acting through the Service and in cooperation with the Bureau</quote> and inserting <quote>The Service, in cooperation with the Bureau</quote>; and</text></clause><clause id="HFE35F112103E4768A0D8146135838B57"><enum>(ii)</enum><text>by striking <quote>sexual abuse</quote> and inserting <quote>abuse or neglect</quote>;</text></clause></subparagraph><subparagraph id="HA76F7310E6A649E2A7D4BBFC79689E23"><enum>(B)</enum><text>in subsection (b) through the end of the section, by striking <quote>Secretary of Health and Human Services</quote> each place it appears and inserting <quote>Service</quote>;</text></subparagraph><subparagraph id="H6965A3A45633472BB812A2F7F319C412"><enum>(C)</enum><text>in subsection (b)(1), by inserting after <quote>Any Indian tribe or intertribal consortium</quote> the following: <quote>, on its own or in partnership with an urban Indian organization,</quote>;</text></subparagraph><subparagraph id="H39038ED9772E43709F90D309CB83552C"><enum>(D)</enum><text>in subsections (b)(2)(B) and (d), by striking <quote>such Secretary</quote> each place it appears and inserting <quote>the Service</quote>;</text></subparagraph><subparagraph id="HFD764DD0A6654E08B1E77DD0329D912B"><enum>(E)</enum><text>by amending subsection (c) to read as follows:</text><quoted-block id="HCF07707728A844F2B8BDAF4DE06F0113" style="OLC"><subsection id="HFA1CD97D0CA24039BB4642352763E27E"><enum>(c)</enum><header>Culturally appropriate treatment</header><text>In awarding grants under this section, the Service shall encourage the use of culturally appropriate treatment services and programs that respond to the unique cultural values, customs, and traditions of applicant Indian Tribes.</text></subsection><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="HF100F2E4C8174EB39799ED2A285AADAD"><enum>(F)</enum><text>in subsection (d)(2), by striking <quote>the Secretary</quote> and inserting <quote>the Service</quote>;</text></subparagraph><subparagraph id="H513CB73DE02F48ACBFA0C8BCFD8B508B"><enum>(G)</enum><text>by redesignating subsection (e) as subsection (f); and</text></subparagraph><subparagraph id="H4B16728CC9AF4747B13E692334240C7A"><enum>(H)</enum><text>by inserting after subsection (d) the following:</text><quoted-block id="H68AB0D3F73BE4B7D94E6F596DF97B3BD" style="OLC"><subsection id="H7CA2F6326AB0486A8C4F71C5A3B911BE"><enum>(e)</enum><header>Report</header><text>Not later than 2 years after the date of the enactment of the Native American Child Protection Act, the Service shall submit a report to Congress on the award of grants under this section. The report shall contain—</text><paragraph id="H95067D1F191C40E8BC89FF571636722B"><enum>(1)</enum><text>a description of treatment and services for which grantees have used funds awarded under this section; and</text></paragraph><paragraph id="HB3655B27DCEC4F7B9DF72226B8CF5EE1"><enum>(2)</enum><text>any other information that the Service requires.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H7EB0F7A7F13B4F02AC47FA54C2BFB7EF"><enum>(3)</enum><text>In section 410 (<external-xref legal-doc="usc" parsable-cite="usc/25/3209">25 U.S.C. 3209</external-xref>)—</text><subparagraph id="H9018EBAC631041768195E8FBA131D8AD"><enum>(A)</enum><text>in the heading—</text><clause id="HD67BBE25A675484195001458FE414689"><enum>(i)</enum><text>by inserting <quote><header-in-text level="section" style="OLC">National</header-in-text></quote> before <quote><header-in-text level="section" style="OLC">Indian</header-in-text></quote>; and</text></clause><clause id="H3453A18D77E94D3E8D9A04903D2331C3"><enum>(ii)</enum><text>by striking <quote><header-in-text level="section" style="OLC">Centers</header-in-text></quote> and inserting <quote><header-in-text level="section" style="OLC">Center</header-in-text></quote>;</text></clause></subparagraph><subparagraph id="H45DDE6E5E7624DB7B61083DD72D11146"><enum>(B)</enum><text>by amending subsections (a) and (b) to read as follows:</text><quoted-block id="H2738D3095A284B429FF077F79DDF6C2D" style="OLC"><subsection id="H8F30F31B14D7403F952F55DCD0AE3C6D"><enum>(a)</enum><header>Establishment</header><text>Not later than 1 year after the date of the enactment of the Native American Child Protection Act, the Secretary shall establish a National Indian Child Resource and Family Services Center.</text></subsection><subsection id="H1D077267D82E4F11821F2F24ABCD1CA7"><enum>(b)</enum><header>Report</header><text>Not later than 2 years after the date of the enactment of the Native American Child Protection Act, the Secretary of the Interior, acting through the Bureau of Indian Affairs, shall submit a report to Congress on the status of the National Indian Child Resource and Family Services Center.</text></subsection><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="H7F2FE60522EB4F099438CC61EFE2929D"><enum>(C)</enum><text>in subsection (c)—</text><clause id="H95443EF1B70D4E659904D35A33670F51"><enum>(i)</enum><text>by striking <quote>Each</quote> and inserting <quote>The</quote>; and</text></clause><clause id="HBE2A24F25B9242229773F33913753A0B"><enum>(ii)</enum><text>by striking <quote>multidisciplinary</quote>;</text></clause></subparagraph><subparagraph id="HF1104144534340589236A10388593EF7"><enum>(D)</enum><text>in subsection (d)—</text><clause id="H42116FFF6D6F49869C0C0A731A27E0EA"><enum>(i)</enum><text>in the text before paragraph (1), by striking <quote>Each</quote> and inserting <quote>The</quote>;</text></clause><clause id="H1080F6397F42443F9E92E61938E3F857"><enum>(ii)</enum><text>in paragraph (1), by striking <quote>and inter-tribal consortia</quote> and inserting <quote>inter-tribal consortia, and urban Indian organizations</quote>;</text></clause><clause id="HF8DC0062B4F84430A6C360BD54A22786"><enum>(iii)</enum><text>in paragraph (2), by inserting <quote>urban Indian organizations,</quote> after <quote>tribal organizations,</quote>;</text></clause><clause id="HD335A9BD66314F13942471270D1155CF"><enum>(iv)</enum><text>in paragraph (3)—</text><subclause id="H1E64EDFFE745432A9C21671A3FC7E0D5"><enum>(I)</enum><text>by inserting <quote>and technical assistance</quote> after <quote>training</quote>; and</text></subclause><subclause id="HBA800A5F62E546829318C3551B50D4D3"><enum>(II)</enum><text>by striking <quote>and to tribal organizations</quote> and inserting <quote>, Tribal organizations, and urban Indian organizations</quote>;</text></subclause></clause><clause id="H7B6D43089E0D4B74A0FF6972E6F715E2"><enum>(v)</enum><text>in paragraph (4)—</text><subclause id="H7F10AA0F5F2648B29A7012E7121B63BE"><enum>(I)</enum><text>by inserting <quote>, State,</quote> after <quote>Federal</quote>; and</text></subclause><subclause id="H1C41C90A48574F0AB65ABBB871A864EF"><enum>(II)</enum><text>by striking <quote>and tribal</quote> and inserting <quote>Tribal, and urban Indian</quote>; and</text></subclause></clause><clause id="H43BA25068E56400EBBC003B925E28497"><enum>(vi)</enum><text>by amending paragraph (5) to read as follows:</text><quoted-block id="HE5C6CA5EA68F4ED5B7FDA0761C145E92" style="OLC"><paragraph id="HDED6D0994CEE43E19ED59C0ECC96E698"><enum>(5)</enum><text>develop model intergovernmental agreements between Tribes and States, and other materials that provide examples of how Federal, State, and Tribal governments can develop effective relationships and provide for maximum cooperation in the furtherance of prevention, investigation, treatment, and prosecution of incidents of family violence and child abuse and child neglect involving Indian children and families.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="H95B947AEA6E3452B819A6EE57CA1C564"><enum>(E)</enum><text>in subsection (e)—</text><clause id="H43E60FE5DC864C7884760EA82DB09877"><enum>(i)</enum><text>in the heading, by striking <quote><header-in-text level="subsection" style="OLC">Multidisciplinary team</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="OLC">Team</header-in-text></quote>;</text></clause><clause id="HAD261B60E0934AE39FCF8B94072A2E99"><enum>(ii)</enum><text>in the text before paragraph (1), by striking <quote>Each multidisciplinary</quote> and inserting <quote>The</quote>; and</text></clause></subparagraph><subparagraph id="HE9E145E61C47422F95233E069D283BB8"><enum>(F)</enum><text>by amending subsections (f) and (g) to read as follows:</text><quoted-block id="H9CE8FA4585E149379933862EF73BCB1B" style="OLC"><subsection id="H2C471717F6004A2BAAB0D9278353B455"><enum>(f)</enum><header>Center advisory board</header><text>The Secretary shall establish an advisory board to advise and assist the National Indian Child Resource and Family Services Center in carrying out its activities under this section. The advisory board shall consist of 12 members appointed by the Secretary from Indian Tribes, Tribal organizations, and urban Indian organizations with expertise in child abuse and child neglect. Members shall serve without compensation, but may be reimbursed for travel and other expenses while carrying out the duties of the board. The advisory board shall assist the Center in coordinating programs, identifying training and technical assistance materials, and developing intergovernmental agreements relating to family violence, child abuse, and child neglect.</text></subsection><subsection id="HBA7DD8BF07EC46FD8B930A1453E6DBE4"><enum>(g)</enum><header>Application of indian self-determination act to the center</header><text>The National Indian Child Resource and Family Services Center shall be subject to the provisions of the Indian Self-Determination Act. The Secretary may also contract for the operation of the Center with a nonprofit Indian organization governed by an Indian-controlled board of directors that have substantial experience in child abuse, child neglect, and family violence involving Indian children and families.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H8AE5D8A00B494A05BBC32C8B1D523AD1"><enum>(4)</enum><text>In section 411 (<external-xref legal-doc="usc" parsable-cite="usc/25/3210">25 U.S.C. 3210</external-xref>)—</text><subparagraph id="H59B8D836DBA149B8B3B793FAE4A1A914"><enum>(A)</enum><text>in subsection (d)—</text><clause id="HCC95B9007F7648F5AC259F48760F5713"><enum>(i)</enum><text>in paragraph (1)—</text><subclause id="H317FA45023094DF9996820847A1E3390"><enum>(I)</enum><text>in subparagraph (A), by striking <quote>abuse and child neglect</quote> and inserting <quote>abuse, neglect, or both</quote>;</text></subclause><subclause id="HE219A9EA49CA430CAFD80326C46F36F5"><enum>(II)</enum><text>in subparagraph (B), by striking <quote>and</quote> at the end; and</text></subclause><subclause id="H402C8C8E015141EDBDF9EB17A0788297"><enum>(III)</enum><text>by inserting after subparagraph (C), the following:</text><quoted-block id="HCC0AAF8B7BA249E9BEAE37580EF3F10B" style="OLC"><subparagraph id="H0A1893A1ACFC474BA2A910A2884EA4B5"><enum>(D)</enum><text>development of agreements between Tribes, States, or private agencies on the coordination of child abuse and neglect prevention, investigation, and treatment services;</text></subparagraph><subparagraph id="H56055096397D4EB49580E44DECFC1043"><enum>(E)</enum><text>child protective services operational costs including transportation, risk and protective factors assessments, family engagement and kinship navigator services, and relative searches, criminal background checks for prospective placements, and home studies; and</text></subparagraph><subparagraph id="H61CAF14C0617482EB7F365A49DA425C9"><enum>(F)</enum><text>development of a Tribal child protection or multidisciplinary team to assist in the prevention and investigation of child abuse and neglect;</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subclause></clause><clause id="H611CCBB9E67E4219AB40D8950DE3329E"><enum>(ii)</enum><text>in paragraph (2)—</text><subclause id="HABBA361340B24FB5BD71CE76DE5AFA7B"><enum>(I)</enum><text>in subparagraph (A), by inserting <quote>in culturally appropriate ways</quote> after <quote>incidents of family violence</quote>; and</text></subclause><subclause id="H65E88D640C6D4501992F0C0EF2DE121F"><enum>(II)</enum><text>in subparagraph (C), by inserting <quote>that may include culturally appropriate programs</quote> after <quote>training programs</quote>; and</text></subclause></clause><clause id="H819169535AB14C94B795A81140BB696C"><enum>(iii)</enum><text>in paragraph (3)—</text><subclause id="HC4A8F5C6AF164D66808BD47953D9FA34"><enum>(I)</enum><text>in subparagraph (A), by inserting <quote>and neglect</quote> after <quote>abuse</quote>; and</text></subclause><subclause id="H4D8B98D18ED545228817B9F84073DD4E"><enum>(II)</enum><text>in subparagraph (B), by striking <quote>cases, to the extent practicable,</quote> and inserting <quote>and neglect cases</quote>;</text></subclause></clause></subparagraph><subparagraph id="H4248533EF8E04C5893D41937563B6817"><enum>(B)</enum><text>in subsection (f)—</text><clause id="H1CA6888CC1B641DD9C8AD868BCB27346"><enum>(i)</enum><text>in paragraph (2), by striking <quote>develop, in consultation with Indian tribes, appropriate caseload standards and staffing requirements which are comparable to standards developed by the National Association of Social Work, the Child Welfare League of America and other professional associations in the field of social work and child welfare</quote> and inserting <quote>develop, not later than one year after the date of the enactment of the Native American Child Protection Act, in consultation with Indian Tribes, appropriate caseload standards and staffing requirements</quote>;</text></clause><clause id="H2EC1CFCE5AA1485A8E1ED259710161C9"><enum>(ii)</enum><text>in paragraph (3)(D), by striking <quote>sexual abuse</quote> and inserting <quote>abuse and neglect, high incidence of family violence</quote>;</text></clause><clause id="HA2FB97B7EAC342A9BBA9BCF6EB2326D9"><enum>(iii)</enum><text>by amending paragraph (4) to read as follows:</text><quoted-block id="H8BA5408A188D497BACA02D45865A3017" style="OLC"><paragraph id="HA1BEC4C5C89E4E0D937C7686D8D25EC7" indent="up1"><enum>(4)</enum><text>The formula established pursuant to this subsection shall provide funding necessary to support not less than one child protective services or family violence caseworker, including fringe benefits and support costs, for each Indian Tribe.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause><clause id="HA478537976F447E9A7E17D2DE4845CA6"><enum>(iv)</enum><text>in paragraph (5), by striking <quote>tribes</quote> and inserting <quote>Indian Tribes</quote>; and</text></clause></subparagraph><subparagraph id="H7F7423F522464AABBEF1850FB4D80B7C"><enum>(C)</enum><text>by amending subsection (g) to read as follows:</text><quoted-block id="HE1BA55FCE7074B028F98F860A52B5C35" style="OLC"><subsection id="HD014807EE12B48B89E87831B66402CE5"><enum>(g)</enum><header>Report</header><text>Not later than 2 years after the date of the enactment of the Native American Child Protection Act, the Secretary of the Interior, acting through the Bureau of Indian Affairs, shall submit a report to Congress on the award of grants under this section. The report shall contain—</text><paragraph id="HBA2D4B99A9EF4145B5BA0162F8CBE4AF"><enum>(1)</enum><text>a description of treatment and services for which grantees have used funds awarded under this section; and</text></paragraph><paragraph id="HC99520EB28984C25AF192DFFD0D899C7"><enum>(2)</enum><text>any other information that the Secretary of the Interior requires.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section><section id="H355900B767EB4B5F854051114CB6E8F7"><enum>3.</enum><header>Limitation on appropriations</header><text display-inline="no-display-inline">No additional amounts are authorized to carry out this Act or any of the amendments made by this Act. Each program, project, and activity authorized by this Act or the amendments made by this Act shall be subject to the availability of appropriations made in advance for such purposes.</text></section></legis-body><attestation><attestation-group><attestation-date date="20230918" chamber="House">Passed the House of Representatives September 18, 2023.</attestation-date><attestor display="yes">Kevin F.
