<section id="H7E4065D7D090461D80270B237FC7F620" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Program of All-inclusive Care for the Elderly Expanded Act</short-title></quote> or the <quote><short-title>PACE Expanded Act</short-title></quote>.</text></section> <section commented="no" display-inline="no-display-inline" id="HE9CE2F325C0C44B2A52BC3165EC1C36F"><enum>2.</enum><header>Anytime enrollment in PACE</header> <subsection id="H54756E08C3F443D4853E087D6BC9D5AB"><enum>(a)</enum><header>In general</header> <paragraph id="H6E1F2002A74540C4950954047ABF7AFB"><enum>(1)</enum><header>Any time enrollment and effective date</header><text>Section 1894(c)(5) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395eee">42 U.S.C. 1395eee(c)(5)</external-xref>) is amended by adding at the end the following new subparagraph:</text>

<subparagraph id="HC0039314650247A680422B02940CC4C7"><enum>(C)</enum><header>Any time enrollment and effective date of enrollment</header> 
<clause id="HC16DB0320E8647E6B3180F3B737091F2"><enum>(i)</enum><header>Any time enrollment</header><text>A PACE program eligible individual may enroll in a PACE program at any time during a month.</text></clause> <clause id="H8B682FA8381947FCB82E711A24B61BEC"><enum>(ii)</enum><header>Effective date</header><text>Subject to clause (iii), the enrollment of a PACE program eligible individual in a PACE program shall be effective on the date the PACE provider operating the PACE program receives an enrollment agreement signed by such PACE program eligible individual with respect to such PACE program.</text></clause> 
<clause id="HC3D72F31FD7949309AC7215F21C90E54"><enum>(iii)</enum><header>Special rule in the case of dual eligible beneficiaries</header><text>In the case of a PACE program eligible individual who is eligible for benefits under this title and title XIX, clause (i) shall only apply if the State in which such individual resides has made an election under section 1934(c)(5)(C) to permit PACE program eligible individuals to enroll in a PACE program at any time during a month in such State.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> <paragraph id="HBF5CD3F5D733406FB0D713F12DD11F12"><enum>(2)</enum><header>Prorated payments</header><text>Section 1894(d) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395eee">42 U.S.C. 1395eee(d)</external-xref>) is amended by adding at the end the following new paragraph:</text>

<paragraph id="HD3C6801158B5446989B7BCECBD26B05A"><enum>(4)</enum><header>Prorated payments</header><text>In the case of a PACE program eligible individual enrolled in a PACE program operated by a PACE provider with an enrollment effective date that is not the first day of a month, the capitation amount that would otherwise be made under this subsection to the PACE provider for such individual for the first month in which such individual is so enrolled shall be prorated accordingly.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="H16A84399AFF04C8C9B9BAFDA9554D508"><enum>(b)</enum><header>Conforming amendments</header> <paragraph id="H3C41C50D75F24075AE692DDB213E38C6"><enum>(1)</enum><header>Anytime enrollment and effective date</header><text>Section 1934(c)(5) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396u-4">42 U.S.C. 1396u–4(c)(5)</external-xref>) is amended by adding at the end the following new subparagraph:</text>

<subparagraph id="H5767BDAA53B94B84A19FB6FB840FAB23"><enum>(C)</enum><header>State option to permit any time enrollment and effective date of enrollment</header> 
<clause id="H5E043A0C62DB4AB588190C70FAA89C1A"><enum>(i)</enum><header>Any time enrollment</header><text>A State may elect to permit a PACE program eligible individual to enroll in a PACE program at any time during a month.</text></clause> <clause id="H9E33DD37F4434047A74A16882D61046E"><enum>(ii)</enum><header>Effective date</header><text>Pursuant to a State election made under clause (i), the enrollment of a PACE program eligible individual in a PACE program shall be effective on the date the PACE provider operating the PACE program receives an enrollment agreement signed by such PACE program eligible individual with respect to such PACE program.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H3BA7CEA59C2C44E1A9C138C08722CEA1"><enum>(2)</enum><header>Prorated payments</header><text>Section 1934(d) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396u-4">42 U.S.C. 1396u–4(d)</external-xref>) is amended by adding at the end the following new paragraph: </text> <quoted-block id="HE6C0602A4E0A4A62B48C5C4CBB322DC6" style="OLC" act-name=""> <paragraph id="HBC56D16AA67F46B6BED3275B805E80CB"><enum>(3)</enum><header>Prorated payments</header><text>If a State elects under subsection (c)(5)(C) to permit enrollment at any time during a month, in the case of a PACE program eligible individual enrolled in a PACE program operated by a PACE provider with an enrollment effective date that is not the first day of a month, the State shall prorate the capitation amount that would otherwise be made under this subsection to the PACE provider for such individual for the first month in which such individual is so enrolled.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H8C5698DE971B4F42A87463A85D0C560C" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall take effect on January 1, 2025.</text></subsection></section> <section commented="no" display-inline="no-display-inline" id="HD68284C648654165896493067D4500F2"><enum>3.</enum><header>PACE site approval and expansion</header> <subsection commented="no" display-inline="no-display-inline" id="HD215963FACE74435AD88995F05D14C3D"><enum>(a)</enum><header>In general</header><text>Sections 1894(e) and 1934(e) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395eee">42 U.S.C. 1395eee(e)</external-xref>; 1396u–4(e)) are each amended by striking paragraph (8) and inserting the following:</text> 
<quoted-block style="OLC" id="H7DF3DA137DF24BF9B0170FE7271BAF01" act-name=""> 
<paragraph id="HE76F80B671F64CEEA9EBDECFCB3604DB"><enum>(8)</enum><header>Authority to submit applications at any time; timely consideration of applications</header> 
<subparagraph id="H60AB00F1B3644D13BE5840B2F49D1F98"><enum>(A)</enum><header>Authority to submit applications at any time</header> 
<clause id="H6131EEE94F0647268EAFCFF98EE0FD65"><enum>(i)</enum><header>New PACE provider status</header><text>An entity that seeks to become a PACE provider may submit an application for PACE provider status at any time.</text></clause> <clause id="HE70936E4A4644F8E8713B5983BC340F0"><enum>(ii)</enum><header>Service area expansion and addition of PACE center site</header><text>To the extent the Secretary requires a PACE provider to submit an application to expand its service area or to add a PACE center site (or both), a PACE provider may submit such an application at any time, subject to the requirements of section 460.12(d) of title 42, Code of Federal Regulations (relating to the first trial period audit), or any successor regulation.</text></clause> 
<clause id="H87E87A5AAC9A4B5A80AE9DF58C7FDB77"><enum>(iii)</enum><header>Assurances</header><text>An application for PACE provider status under clause (i) or to add a PACE center site under clause (ii) shall include the following assurances:</text> <subclause id="HA729339568D94E3CB7A357C74A087BE0"><enum>(I)</enum><text>An assurance that the required members of the interdisciplinary team are employees or contractors of the proposed PACE center or will be employees or contractors of the proposed PACE center by the time the PACE center becomes operational.</text></subclause> 
<subclause id="HBAB683C0275E4D2192ED27B92F0110EA"><enum>(II)</enum><text>An assurance that—</text> <item id="H738B9189FCC34E02B8D20758ACB731D7"><enum>(aa)</enum><text>the PACE provider’s contracts for all contractors and contracted personnel will be executed by the time the proposed PACE center becomes operational; and</text></item> 
<item id="HFC52F84E2F8944ABB45D7E0776266B4F"><enum>(bb)</enum><text>executed contracts may include provisions for staffing levels commensurate with enrollment to full projected census.</text></item></subclause></clause></subparagraph> <subparagraph id="HDD87B2A0AC954751AF94CCE833E41DD1"><enum>(B)</enum><header>Deemed approval</header><text>An application described in subparagraph (A) shall be deemed approved unless the Secretary, within 45 days after the date of the submission of the application to the Secretary, either denies such request in writing or informs the applicant in writing with respect to any additional information that is needed in order to make a final determination with respect to the application. After the date the Secretary receives such additional information, the application shall be deemed approved unless the Secretary, within 45 days of such date, denies such request.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HC7C88D95AB374A4A941A1694F44BF023" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by subsection (a) shall take effect on January 1, 2025.</text></subsection></section> <section commented="no" display-inline="no-display-inline" id="H0EC6B6BB20764C10B8D08052A9FE33D7"><enum>4.</enum><header>PACE pilot</header><text display-inline="no-display-inline">Section 1115A(b)(2) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1315a">42 U.S.C. 1315a(b)(2)</external-xref>) is amended—</text> 
<paragraph commented="no" display-inline="no-display-inline" id="H1F09F339E11A4AD5A1640F67F5637311"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (B), by adding at the end the following new clause:</text> <quoted-block style="OLC" id="H766924D93E3F4D3387EB625CFA6A9E7C" act-name=""> <clause id="H8CB706E9F8024264A3B78DB43DB68C9A"><enum>(xxviii)</enum><text>National testing of a model for expanded eligibility for the Program of All-Inclusive Care for the Elderly as described in subparagraph (D).</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H5C62FDDEF4F744ECBFB6BAA4BE6DC7F0"><enum>(2)</enum><text>by adding at the end the following new subparagraph:</text> <quoted-block id="H25BF7883E5F3405A81A09CC82A663736" display-inline="no-display-inline" style="OLC"> <subparagraph id="H9A1916A5D31C4CB3A1C29C3AF70E1857"><enum>(D)</enum><header>National testing of model for expanded eligibility for the program of all-inclusive care for the elderly</header><text>In the case where the Secretary selects the model described in clause (ii) of this subparagraph for testing pursuant to clause (xxviii) of subparagraph (B), the following shall apply:</text> 
<clause id="H3DA06B4337594FE9A7729CA4B40DCE93"><enum>(i)</enum><header>National testing</header> 
<subclause id="H0D514686682A44BBAE642D6F7C52754D"><enum>(I)</enum><header>In general</header><text>Subject to subclause (II), the Secretary shall design a demonstration that allows each PACE provider with an executed PACE agreement to develop and submit to the Secretary an application to begin testing expanded PACE eligibility for high-need and high-cost populations that are not otherwise eligible to participate in a PACE program within 1 year of the date on which the model is selected.</text></subclause> <subclause id="HDE2D6DC33C7D460DABC95045979BE758"><enum>(II)</enum><header>No effect on ongoing models or demonstration projects</header><text>Nothing in this subparagraph shall affect the testing of any model under this subsection or any demonstration project under this Act that is implemented prior to the date of the enactment of this subparagraph.</text></subclause></clause> 
<clause id="H88E7B6444F904134A436773A3F25D5DB"><enum>(ii)</enum><header>Model described</header><text>The model described in this clause seeks to increase access to quality, integrated, care for high-need, high-cost individuals who are not otherwise eligible to participate in a PACE program in order to improve health and reduce cost. Under this model, participating PACE providers would—</text> <subclause id="H918BD7A84D5440D9B7036947E1D82AB8"><enum>(I)</enum><text>be paid fixed, monthly capitated rates from both Medicare and the applicable State Medicaid agency for all services provided to each enrollee fitting the criteria of the PACE provider’s designated population;</text></subclause> 
<subclause id="H6E51B5C726B44594952461C009D9115E"><enum>(II)</enum><text>partner with non-PACE providers, such as Area Agencies on Aging, Centers for Independent Living, local hospitals, and non-hospital providers such as physicians, behavioral health providers and other community-based organizations to effectively reach the PACE provider’s selected population;</text></subclause> <subclause id="H4A54E06F43954F78BAAB5E77B0325CD5"><enum>(III)</enum><text>adapt the PACE program model of care to appropriately serve the PACE provider’s selected population to integrate care and meet the unique needs of said population; and</text></subclause> 
<subclause id="H6A0FDF594E6640E6A7B8BB3FC9CE190F"><enum>(IV)</enum><text>if the PACE provider is located in a State that has not yet served the selected population through a PACE program under section 1934, receive an up-front fixed payment to coordinate with the State to develop a capitated payment rate, with appropriate risk adjustment, for the PACE provider’s selected population.</text></subclause></clause> <clause id="HDE24AACE408A408697D4BF40DCBA2CFF"><enum>(iii)</enum><header>Requirements for participating PACE organizations</header><text>In order to participate in the model, a PACE provider must—</text> 
<subclause id="H377033E247D643B5B0C283B84E55C762"><enum>(I)</enum><text>conduct a survey or needs assessment of their service area to determine the most appropriate population with which to expand their services;</text></subclause> <subclause id="H4FD191708321411FB1FEEBC6CBE8687B"><enum>(II)</enum><text>receive prior approval from the applicable State Medicaid agency to submit an application to participate in the model; and</text></subclause> 
<subclause id="HF168F2409D634A7F906AE4B26C35E3E1"><enum>(III)</enum><text>following such survey or needs assessment and approval from the applicable State Medicaid agency, submit and receive approval of an application of expansion from the Secretary.</text></subclause></clause> <clause id="HBFB15E8CD92F404BA579CC3FD81869D5"><enum>(iv)</enum><header>Application</header><text>A PACE provider’s application to participate in this model shall include the following information:</text> 
<subclause id="HF3BED69DDF604A7E8868B20074189ADD"><enum>(I)</enum><text>Results of the survey or needs assessment of their service area under clause (iii)(I) and an explanation of the expanded population the PACE organization will serve.</text></subclause> <subclause id="H9C950BE583954201AFD434CC19D49633"><enum>(II)</enum><text>The types of services that the expanded population will require and the PACE provider's plan to implement these services.</text></subclause> 
<subclause id="H5D9761DC0C0E47C8BB5F69F996DEE362"><enum>(III)</enum><text>How the PACE provider will achieve engagement and enrollment of the new population in the model, including how it will partner with non-PACE providers in the applicable service area.</text></subclause> <subclause id="HBCA000C5D826465AB5E75FD5331696F2"><enum>(IV)</enum><text>How the expanded population’s participation in the PACE program is intended to improve quality of care and health outcomes under the model.</text></subclause> 
<subclause id="H250CF9156264454FB4888DB76C9A9CB5"><enum>(V)</enum><text>Certification that the applicable State Medicaid agency has approved the PACE provider's application to participate in the model.</text></subclause> <subclause id="H5DA1784065C444C18BAC3171C0F3CB9A"><enum>(VI)</enum><text>Plans to coordinate with the State Medicaid agency to develop an initial capitated rate with appropriate risk adjustment.</text></subclause> 
<subclause id="HB009730FD32641C287DA52A806EE5C50"><enum>(VII)</enum><text>Plans for the PACE provider and the State Medicaid agency to review and adjust the Medicaid capitated rate on a biennial basis, as needed.</text></subclause> <subclause id="HCDA45EC4137A45DAA24E8EAFC6299081"><enum>(VIII)</enum><text>Any other information required by the Secretary.</text></subclause></clause> 
<clause id="H01EBE12E17B74D85B6B3F05E69236706"><enum>(v)</enum><header>Technical assistance</header><text>The Secretary shall provide, or designate an entity to provide, technical assistance to participating PACE providers as they apply for and implement the model.</text></clause> <clause id="H161C99EC04924804BB070AAFB2DD3B56"><enum>(vi)</enum><header>Accounting for uncertainty</header><text>In order for implementing PACE providers to receive unanticipated additional resources needed to implement the model, the Secretary shall establish procedures for the implementing PACE providers to submit to the Secretary a request for additional resources.</text></clause> 
<clause id="H4475D4C464A84243A58AF090637F5278"><enum>(vii)</enum><header>Monitoring outcomes</header><text>The Secretary, in conjunction with PACE providers and in consultation with States that have elected to expand PACE program eligibility under section 1934(l), shall develop a plan to—</text> <subclause id="HD856ABC9DB3E4D0EA650DBCFC6810A73"><enum>(I)</enum><text>annually monitor outcomes under the model, which may include financial, quality, access, and utilization outcomes;</text></subclause> 
<subclause id="HB536CC2E76C44F4AB8BB7D61DB23A104"><enum>(II)</enum><text>annually monitor the health outcomes of the PACE provider’s expanded population; and</text></subclause> <subclause id="H5A668E742B354FA39E37429D02E65947"><enum>(III)</enum><text>any other outcomes as determined by the Secretary.</text></subclause></clause> 
<clause id="H9CCB26897ECE45849E83E113901D7CEB" commented="no"><enum>(viii)</enum><header>Report to congress</header><text>Not less frequently than every 3 years (for the duration of the implementation of the model under this subparagraph), the Secretary shall submit to Congress a report on the implementation of the model under this subparagraph. The report shall include demographic information on the populations served under the demonstration, best practices for future implementation efforts and any other information the Secretary determines appropriate together with recommendations for such legislation and administrative action as the Secretary determines appropriate.</text></clause> <clause id="HE7160B6FF31E43F2B2A28002285A027B" commented="no" display-inline="no-display-inline"><enum>(ix)</enum><header>Funding</header><text>The Secretary shall allocate funds made available under subsection (f)(1) to design, implement, evaluate, and report on the model described in clause (ii) in accordance with this subparagraph.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section commented="no" display-inline="no-display-inline" id="HF51C85CCAC5E404A8D944A48AD04EB70"><enum>5.</enum><header>Coordination with the Federal Coordinated Health Care Office</header><text display-inline="no-display-inline">Section 1934 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396u-4">42 U.S.C. 1396u–4</external-xref>), as amended by sections 2 and 3, is further amended by adding at the end the following new subsection:</text> <quoted-block id="H2FFC8A4C9BAD477C9A76A24750E0CA54" display-inline="no-display-inline" style="OLC" act-name=""> <subsection id="H9AB836CF7D7A427B82A18F342F977190"><enum>(m)</enum><header>Coordination with the Federal Coordinated Health Care Office</header> <paragraph id="HE59BD08C13014B3C982D0B9D1C9F1086"><enum>(1)</enum><header>State coordination with FCHCO</header><text>The Director of the Federal Coordinated Health Care Office established under section 2602 of the Patient Protection and Affordable Care Act shall serve as a point of contact between State administering agencies and the Federal Government for purposes of implementing and operating a PACE program in a State, and shall coordinate with other relevant offices and staff of the Centers for Medicare &amp; Medicaid Services involved in carrying out this section.</text></paragraph> 
<paragraph id="H0B93E3DA0DC94A3AB2E6AEA8FD6174C0" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header>Annual report</header><text>Not later than January 1, 2025, and annually thereafter, the Director of the Federal Coordinated Health Care Office shall submit to Congress a report on the demographics of the populations served by PACE programs operated under this section and section 1894.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> <section display-inline="no-display-inline" commented="no" id="H95FF6C221F4941568C03A90EC8A209F4"><enum>6.</enum><header>Evaluation of effectiveness of PACE program in rural and underserved areas</header> <subsection display-inline="no-display-inline" commented="no" id="H22C4D84FE8FB4AE891B5C2CC2FACDF91"><enum>(a)</enum><header>In general</header><text>The Assistant Secretary for Planning and Evaluation of the Department of Health and Human Services (referred to in this section as the <term>Assistant Secretary</term>) shall conduct an evaluation of the effectiveness of the program for all-inclusive care for the elderly under sections 1894 and 1934 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395eee">42 U.S.C. 1395eee</external-xref>, 1396u–4) in rural and underserved areas, including with respect to the following factors:</text> 
<paragraph display-inline="no-display-inline" commented="no" id="H161A5DB7CCAE495681EE748D9B34EABB"><enum>(1)</enum><text>Reductions in hospitalizations and re-hospitalizations among program beneficiaries.</text></paragraph> <paragraph display-inline="no-display-inline" commented="no" id="HAC01A18106354A23B420EE0BA77ADD4E"><enum>(2)</enum><text>Reductions in emergency department use among program beneficiaries.</text></paragraph> 
<paragraph display-inline="no-display-inline" commented="no" id="H1789117B79934CF1B8F3EB8F688120FF"><enum>(3)</enum><text>Reductions in long-term nursing facility use among program beneficiaries.</text></paragraph> <paragraph display-inline="no-display-inline" commented="no" id="HF92475D4F76E443D9FA12AFDB3FF3395"><enum>(4)</enum><text>Reductions in mortality among program beneficiaries.</text></paragraph>

<subsection display-inline="no-display-inline" commented="no" id="HD2E9F0E3CA32489DA64696506F4EA11D"><enum>(b)</enum><header>Report</header><text>Not later than 60 months after the date of enactment of this Act, the Assistant Secretary shall submit a report containing the results of the evaluation required under subsection (a), an analysis of which elements of the program for all-inclusive care for the elderly under sections 1894 and 1934 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395eee">42 U.S.C. 1395eee</external-xref>, 1396u–4) should be replicated and scaled by governmental or non-governmental entities, and such recommendations for legislation and administrative action as the Assistant Secretary determines appropriate to the chairs and ranking members of the following committees:</text> <paragraph display-inline="no-display-inline" commented="no" id="HFB0D225202A34FE9AD23B43367244273"><enum>(1)</enum><text>The Special Committee on Aging of the Senate.</text></paragraph>

<subsection display-inline="no-display-inline" commented="no" id="HC40F95B151DC426CA41899491614189F"><enum>(c)</enum><header>Partners</header><text>In conducting the evaluation and completing the report required under this section, the Assistant Secretary shall provide an opportunity for partners and persons that have participated in the program for all-inclusive care for the elderly under sections 1894 and 1934 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395eee">42 U.S.C. 1395eee</external-xref>, 1396u–4) on every level, especially individuals who receive care through the program and their unpaid or family caregivers, to have an opportunity to contribute their expertise to evaluating the strategy and outcomes of the program.</text></subsection></section> </legis-body></bill>
