which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To provide that local governments may receive grants to carry out HOMES rebate programs and high-efficiency electric home rebate programs in States in which the applicable State energy office is not carrying out such a program, and for other purposes.</official-title></form><legis-body id="H318199F25BF34C69BEEF0CED995C582F" style="OLC"><section id="HEB52D5D11D2D4621949B944882630A57" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Reforming Energy-Efficient Buildings and Appliances Tax Exemptions Act</short-title></quote> or the <quote><short-title>REBATE Act</short-title></quote>.</text></section><section id="H570714D3EA7F41BFA6841DD70670B196"><enum>2.</enum><header>DOE Rebate Programs</header><subsection id="HB8C90B06E8B549A19FFFFB73991002C9"><enum>(a)</enum><header>Home energy performance-based, whole-House rebates</header><paragraph id="H9A3BA524DB2C4CDABFDEE53EA3958B08"><enum>(1)</enum><header>Allocation of funds</header><text>Section 50121(a) of the <external-xref legal-doc="public-law" parsable-cite="pl/117/169">Public Law 117–169</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/42/18795">42 U.S.C. 18795(a)</external-xref>) is amended—</text><subparagraph id="HE31304C19D054106927D55623D6B1B52"><enum>(A)</enum><text>in paragraph (1), by inserting <quote>and eligible local governments</quote> after <quote>State energy offices</quote>; and</text></subparagraph><subparagraph id="HF17DFE6CDC3F41359994749B9C54E98B"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (2)—</text><clause id="H93F63DE7EADE4905BF4073A70AF58B0E"><enum>(i)</enum><text>by striking <quote>redistributed to the State energy offices operating a HOMES rebate program using a grant received under this section in proportion to the amount distributed to those State energy offices under subparagraph (A)(ii)</quote> and inserting <quote>, subject to subparagraph (C), distributed to each eligible local government for which an application, submitted not later than December 31, 2024, by such eligible local government, under subsection (b) is approved</quote>; and</text></clause><clause id="HDA34BD8257D0480EB24EA533FC306F16"><enum>(ii)</enum><text>by adding at the end the following: </text><quoted-block style="OLC" id="H7736F34654C0461193D9D0251747992F" display-inline="no-display-inline"><subparagraph id="H46495AA30424491089513563B3B0ED80"><enum>(C)</enum><header>Distribution</header><text display-inline="yes-display-inline">The Secretary shall distribute money under subparagraph (B) so that the total amount received by all eligible local governments described in subparagraph (B) within a State is equal to the total amount reserved for the State energy office of the State under subparagraph (A).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph></paragraph><paragraph id="HAFA28ECAB0324B5E8E0A6DF01C98BB02"><enum>(2)</enum><header>Application</header><text display-inline="yes-display-inline">Section 50121(b) of the <external-xref legal-doc="public-law" parsable-cite="pl/117/169">Public Law 117–169</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/42/18795">42 U.S.C. 18795(b)</external-xref>) is amended by inserting <quote>or eligible local government</quote> after <quote>A State energy office</quote>.</text></paragraph><paragraph id="H0F51CB71FF9C40E1B83EA47712056443"><enum>(3)</enum><header>HOMES Rebate Program</header><text>Section 50121(c) of the <external-xref legal-doc="public-law" parsable-cite="pl/117/169">Public Law 117–169</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/42/18795">42 U.S.C. 18795(c)</external-xref>) is amended—</text><subparagraph id="HCFDA9E623A744223949FE3403C7C480D"><enum>(A)</enum><text>in paragraph (1), by inserting <quote>or eligible local government</quote> after <quote>State energy office</quote>;</text></subparagraph><subparagraph id="H0981D3DFF5904083A3148EBDE7FA1505"><enum>(B)</enum><text>in paragraph (3), by inserting <quote>or eligible local government</quote> after <quote>State energy office</quote>; </text></subparagraph><subparagraph id="H7F7EC324010948B1BF84595F0DFCB63E"><enum>(C)</enum><text>in paragraph (4), by inserting <quote>or eligible local government</quote> after <quote>State energy office</quote>; </text></subparagraph><subparagraph id="HB4F9C6B5964345828CD529B40CDAAFD0" commented="no"><enum>(D)</enum><text>in paragraph (5), by inserting <quote>and eligible local governments</quote> after <quote>States</quote>; and</text></subparagraph><subparagraph id="H980D3D55749B4747AFE4C3CC398703B9"><enum>(E)</enum><text>in paragraph (7), by inserting <quote>or eligible local government</quote> after <quote>State energy office</quote>.</text></subparagraph></paragraph><paragraph id="H7784342721EE4B8687E94391300E4983"><enum>(4)</enum><header>Definitions</header><text>Section 50121(d) of the <external-xref legal-doc="public-law" parsable-cite="pl/117/169">Public Law 117–169</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/42/18795">42 U.S.C. 18795(d)</external-xref>) is amended—</text><subparagraph id="H544FEF0BF1DB4D3DAB286337BA1BFB8C"><enum>(A)</enum><text>by amending paragraph (2) to read as follows:</text><quoted-block style="OLC" id="H2BB76016183E4EE081C9A2E0442960F1" display-inline="no-display-inline"><paragraph id="H10622300C86D4D55A18B6E24847DAC83"><enum>(2)</enum><header>HOMES rebate program</header><text display-inline="yes-display-inline">The term <term>HOMES rebate program</term> means a Home Owner Managing Energy Savings rebate program—</text><subparagraph id="HF5E31CDBDDB74B1399C549407B8405C6"><enum>(A)</enum><text>established by a State energy office as part of an approved State energy conservation plan under the State Energy Program; or</text></subparagraph><subparagraph id="HE27153EE0223473493163117A1132E4C"><enum>(B)</enum><text>carried out pursuant to this section by an eligible local government.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="H1B22C9AB17984EE38EA804FBCFA7A38C"><enum>(B)</enum><text>by adding at the end the following: </text><quoted-block style="OLC" id="H0C0D1A58B3F64935A2D40D0E9F5375A6" display-inline="no-display-inline"><paragraph id="H388E55F75B954006B163E2C7C4425F16"><enum>(4)</enum><header>Eligible local government</header><text display-inline="yes-display-inline">The term <term>eligible local government</term> means a unit of local government that is located in a State in which the State energy office has not established a HOMES rebate program, did not receive a grant to develop and implement a HOMES rebate program under this section, or otherwise does not plan to develop and implement a HOMES rebate program or receive a grant under this section, as indicated by the State withdrawing an application under subsection (b), a veto of funding awarded under this section by the Governor of the State, or as otherwise determined by the Secretary.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="H9FB1FFE3B2094A509229ED8A6DC747C4"><enum>(b)</enum><header>High-Efficiency electric home rebate program</header><paragraph id="H06560A326755483C85A3EF225A1DADAC"><enum>(1)</enum><header>Allocation of funds</header><text display-inline="yes-display-inline">Section 50122(a) of <external-xref legal-doc="public-law" parsable-cite="pl/117/169">Public Law 117–169</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/42/18795a">42 U.S.C. 18795a(a)</external-xref>) is amended—</text><subparagraph id="HD754314C50BB49C68D96595184D42D5F"><enum>(A)</enum><text>in paragraph (1)—</text><clause id="HC10EE26E45794100AAE3CC625240A84D"><enum>(i)</enum><text>by striking <quote><header-in-text level="paragraph" style="OLC">state energy offices and indian tribes</header-in-text></quote> and inserting <quote><header-in-text level="paragraph" style="OLC">State energy offices, eligible local governments, and Indian Tribes</header-in-text></quote>; and</text></clause><clause id="HB92A4038DA6F417DB9509F5F38A1C7BF"><enum>(ii)</enum><text>in subparagraph (A), by inserting <quote>and eligible local governments</quote> after <quote>State energy offices</quote>; and</text></clause></subparagraph><subparagraph id="H6EC8B225CA284AC19E7F46C15A9F51AF"><enum>(B)</enum><text>in paragraph (2)—</text><clause id="HA16B7A4FBF064185BA1FF4AC91D92D51"><enum>(i)</enum><text>in subparagraph (C)(i), by striking <quote>redistributed to the State energy offices operating a high-efficiency electric home rebate program in proportion to the amount distributed to those State energy offices under that clause</quote> and inserting <quote>, subject to subparagraph (D), distributed to each eligible local government for which an application, submitted not later than December 31, 2024, by such eligible local government, under subsection (b) is approved</quote>; and</text></clause><clause id="H9AF8A9390B994295BECAA1A18CEB1E7D"><enum>(ii)</enum><text>by adding at the end the following: </text><quoted-block style="OLC" id="HEC95FA9E29C64F258E33A9631C9A7F09" display-inline="no-display-inline"><subparagraph id="H31F894D6AC1B46229D4682EBEADD137B"><enum>(D)</enum><header>Distribution</header><text display-inline="yes-display-inline">The Secretary shall distribute money under subparagraph (C)(i) so that the total amount received by all eligible local governments described in subparagraph (C)(i) within a State is equal to the total amount reserved for the State energy office of the State under subparagraph (A).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph></paragraph><paragraph id="H75B3AD182E064AE8AC226582F86FE42B"><enum>(2)</enum><header>Application</header><text display-inline="yes-display-inline">Section 50122(b) of the <external-xref legal-doc="public-law" parsable-cite="pl/117/169">Public Law 117–169</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/42/18795a">42 U.S.C. 18795a(b)</external-xref>) is amended by inserting <quote>, eligible local government,</quote> after <quote>A State energy office</quote>.</text></paragraph><paragraph id="H7E1CC3B0EA924876A45E7FC6E1155376"><enum>(3)</enum><header>High-efficiency Electric Home Rebate Program</header><text display-inline="yes-display-inline">Section 50122(c) of the <external-xref legal-doc="public-law" parsable-cite="pl/117/169">Public Law 117–169</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/42/18795a">42 U.S.C. 18795a(c)</external-xref>) is amended—</text><subparagraph id="HC8CA51B0057845F79C9996AD481BD197"><enum>(A)</enum><text>in paragraph (1), by inserting <quote>, eligible local governments,</quote> after <quote>State energy offices</quote>;</text></subparagraph><subparagraph id="HC31AF903CA564D1882AD0E14FE6E6F11"><enum>(B)</enum><text>in paragraph (5)(A), by inserting <quote>, eligible local government,</quote> after <quote>State energy office</quote>;</text></subparagraph><subparagraph id="HD45901CF4DE44A869AFF64C8D0920F11"><enum>(C)</enum><text>in paragraph (8), by inserting <quote>, eligible local government,</quote> after <quote>State energy office</quote>; and</text></subparagraph><subparagraph id="HF5138E361B12472BA8F40C2F9A416A21"><enum>(D)</enum><text>in paragraph (9), by inserting <quote>, eligible local government,</quote> after <quote>State energy office</quote>.</text></subparagraph></paragraph><paragraph id="H59BB5BF42634491DAE3CFB2808277956"><enum>(4)</enum><header>Definitions</header><text>Section 50122(d) of the <external-xref legal-doc="public-law" parsable-cite="pl/117/169">Public Law 117–169</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/42/18795a">42 U.S.C. 18795a(d)</external-xref>) is amended—</text><subparagraph id="HC8B834C1FCA54ECF96647D56C80BADC5"><enum>(A)</enum><text>in paragraph (2), by inserting <quote>, eligible local government,</quote> after <quote>State energy office</quote>; and </text></subparagraph><subparagraph id="H76BC32E147C44C7AA72A2D7CC4C2904D"><enum>(B)</enum><text>by adding at the end the following: </text><quoted-block style="OLC" id="HB4381A676CEF411AA166AD6E4D46D54C" display-inline="no-display-inline"><paragraph id="HD5E52D0184B94FD69118962539D9A1E4"><enum>(7)</enum><header>Eligible local government</header><text display-inline="yes-display-inline">The term <term>eligible local government</term> means a unit of local government that is located in a which the State energy office does not have a high-efficiency electric home rebate program, did not receive a grant to develop and implement a high-efficiency electric home rebate program, or otherwise does not plan to develop and implement a high-efficiency electric home rebate program, as indicated by the State withdrawing an application under subsection (b), a veto of funding awarded under this section by the Governor of the State, or as otherwise determined by the Secretary.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection></section></legis-body></bill>
