R. 6526</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20231130">November 30, 2023</action-date><action-desc><sponsor name-id="H001067">Mr. Hudson</sponsor> (for himself and <cosponsor name-id="S001216">Ms. Schrier</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committee on <committee-name committee-id="HSY00">Science, Space, and Technology</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To facilitate the efficient licensing and deployment of advanced civilian nuclear technologies.</official-title></form><legis-body id="H506455A5281C4662A2386103301A5CA7" style="OLC"><section id="HCC453D62D71142679EBA621C1041FFCF" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Advanced Nuclear Deployment Act</short-title></quote>.</text></section><section id="HC4A93F69606347B19654092FA5A4544E"><enum>2.</enum><header>Enabling preparations for advanced nuclear reactor demonstrations on Federal sites</header><subsection id="H9EA4EF223E6E449DBC610588D9F683EA" commented="no"><enum>(a)</enum><header>In general</header><text>Section 102(b)(1)(B) of the Nuclear Energy Innovation and Modernization Act (<external-xref legal-doc="usc" parsable-cite="usc/42/2215">42 U.S.C. 2215(b)(1)(B)</external-xref>) is amended by adding at the end the following:</text><quoted-block id="H83F911E0492C46778671321F7C84DC63" style="OLC"><clause id="HBC03AD8BEFAD425580F1C00958FD6E87" commented="no"><enum>(iv)</enum><text>Costs for—</text><subclause id="HD5E35532C6444D66968D97553957D837" commented="no"><enum>(I)</enum><text display-inline="yes-display-inline">activities to review and approve or disapprove an application for an early site permit (as defined in section 52.1 of title 10, Code of Federal Regulations (or any successor regulation)) to demonstrate an advanced nuclear reactor on a Department of Energy site or any site or installation that is critical national security infrastructure (as defined in section 327(d) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019); and</text></subclause><subclause id="H6770FAE8655E4CB9981F2773AF9A5ABC" commented="no"><enum>(II)</enum><text>pre-application activities relating to an early site permit (as so defined) to demonstrate an advanced nuclear reactor on a Department of Energy site or any site or installation that is critical national security infrastructure (as defined in section 327(d) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019).</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H5A5B6B5373E44B2C83870FA183AAD39D" commented="no"><enum>(b)</enum><header>Effective date</header><text>The amendment made by subsection (a) shall take effect on October 1, 2024.</text></subsection></section><section id="H62F2772BD5B245A884BA45E349E600C1"><enum>3.</enum><header>Regulatory requirements for micro-reactors</header><subsection id="H23ECA6B86D2040A093FCF0954FCECA77"><enum>(a)</enum><header>Micro-Reactor licensing</header><text>The Nuclear Regulatory Commission (in this section referred to as the <quote>Commission</quote>) shall—</text><paragraph id="H760AB905596E463F8AA5308B09C06341" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">not later than 18 months after the date of enactment of this Act, develop risk-informed and performance-based strategies and guidance to license and regulate micro-reactors pursuant to section 103 of the Atomic Energy Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2133">42 U.S.C. 2133</external-xref>), including strategies and guidance for—</text><subparagraph id="H373AA15AA9C54C3B92FF1E9CB4B10222" commented="no"><enum>(A)</enum><text>staffing and operations;</text></subparagraph><subparagraph id="H3B8315BCDF45489DB04F814596CEFF16" commented="no"><enum>(B)</enum><text>oversight and inspections;</text></subparagraph><subparagraph id="HA5346A71DF504F16914784BE164E9BBF" commented="no"><enum>(C)</enum><text>safeguards and security;</text></subparagraph><subparagraph id="H99234C00FFD64C22A42D6DE7D4F4D245" commented="no"><enum>(D)</enum><text>emergency preparedness;</text></subparagraph><subparagraph id="H1E5D3B88CEE14810A13D1D23EFD222FF" commented="no"><enum>(E)</enum><text display-inline="yes-display-inline">risk analysis methods, including alternatives to probabilistic risk assessments;</text></subparagraph><subparagraph id="HDB7E0F1FABA54D119108465CBE28A9A6" commented="no"><enum>(F)</enum><text display-inline="yes-display-inline">decommissioning funding assurance methods that permit the use of design- and site-specific cost estimates;</text></subparagraph><subparagraph id="H0657568862554401961B23E6D9410494" commented="no"><enum>(G)</enum><text display-inline="yes-display-inline">the transportation of fueled micro-reactors; and</text></subparagraph><subparagraph id="H0D4D65B55CA047EA9994BD38488DAF38" commented="no"><enum>(H)</enum><text>siting, including in relation to—</text><clause id="HF86FA888328B4C63B066FAC78069B026" commented="no"><enum>(i)</enum><text>the population density criterion limit described in the policy issue paper on population-related siting considerations for advanced reactors dated May 8, 2020, and numbered SECY–20–0045;</text></clause><clause id="H4AD3B48CA68947EEADA4B7E259B9582D" commented="no"><enum>(ii)</enum><text>licensing mobile deployment; and</text></clause><clause id="H938531243417498792F5670CC03B330F" commented="no"><enum>(iii)</enum><text>environmental reviews; and</text></clause></subparagraph></paragraph><paragraph id="H2382A3252EB1404A927B79343345318D"><enum>(2)</enum><text display-inline="yes-display-inline">not later than 3 years after the date of enactment of this Act, implement, as appropriate, the strategies and guidance developed under paragraph (1)—</text><subparagraph id="H24FBEDF3B5224C62810A3B14915261A6" commented="no"><enum>(A)</enum><text>within the existing regulatory framework;</text></subparagraph><subparagraph id="H79AAB235BC5743A08F8C6DCD82DD0424" commented="no"><enum>(B)</enum><text>through the technology-inclusive, regulatory framework to be established under section 103(a)(4) of the Nuclear Energy Innovation and Modernization Act (<external-xref legal-doc="usc" parsable-cite="usc/42/2133">42 U.S.C. 2133</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/115/439">Public Law 115–439</external-xref>); or</text></subparagraph><subparagraph id="H8F8FCD5F1A6C4FA18B43868EC90DEC09" commented="no"><enum>(C)</enum><text>through a pending or new rulemaking.</text></subparagraph></paragraph></subsection><subsection id="H8A07DA2CFD96478CA88C43AE3A3ECEB0"><enum>(b)</enum><header>Considerations</header><text>In developing and implementing strategies and guidance under subsection (a), the Commission shall consider—</text><paragraph id="H83B2B63A053E41799285DB3F4A39FBCA"><enum>(1)</enum><text>the unique characteristics of micro-reactors, including characteristics relating to—</text><subparagraph id="H9800D397EC834D02AA172E3F5C1BBFBA"><enum>(A)</enum><text>physical size;</text></subparagraph><subparagraph id="H60F66A0FE925406585CE6DA5A42C171B"><enum>(B)</enum><text>design simplicity; and</text></subparagraph><subparagraph id="H3BE058E091CD45C7A1FAE5460080847E"><enum>(C)</enum><text>source term;</text></subparagraph></paragraph><paragraph id="HDD0881E5BE584AE58B3BAFBAE39251AC"><enum>(2)</enum><text>opportunities to address redundancies and inefficiencies;</text></paragraph><paragraph id="H92D6C6CB360C4D1E997955F5E838B9AB"><enum>(3)</enum><text>opportunities to consolidate review phases and reduce transitions between review teams; </text></paragraph><paragraph id="H8031976826C84E83BB862FEE9A52D89B"><enum>(4)</enum><text>opportunities to establish integrated review teams to ensure continuity throughout the review process; and</text></paragraph><paragraph id="H9EC718C17C764DB4B1C7C8EDADEC426C" commented="no"><enum>(5)</enum><text display-inline="yes-display-inline">other relevant considerations discussed in the policy issue paper on policy and licensing considerations related to micro-reactors dated October 6, 2020, and numbered SECY–20–0093.</text></paragraph></subsection><subsection id="HA5C74890D8304D04BFF2963FD557F30E"><enum>(c)</enum><header>Consultation</header><text>In carrying out subsection (a), the Commission shall consult with—</text><paragraph id="HC251EB6F42B245ACAE4AD26E35FD2E16"><enum>(1)</enum><text>the Secretary of Energy;</text></paragraph><paragraph id="HDFB53975C5C34AB7A146329C45E291C4"><enum>(2)</enum><text>the heads of other Federal agencies, as appropriate;</text></paragraph><paragraph id="HF7E87448119D4882BE5DE2CE6A3E5112"><enum>(3)</enum><text>micro-reactor technology developers; and</text></paragraph><paragraph id="H90F440C72B1140EEBB43A5D10255C424"><enum>(4)</enum><text>other stakeholders.</text></paragraph></subsection></section><section id="HBCC770D6D61E4DC18B7747AFA93F40C1"><enum>4.</enum><header>Expedited subsequent combined licenses</header><subsection id="HD86759BF75334DD6AA95847EBBA74E52" commented="no"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">In accordance with this section, the Nuclear Regulatory Commission (referred to in this section as the <quote>Commission</quote>) shall establish and carry out an expedited procedure for issuing a combined license pursuant to section 185 b. of the Atomic Energy Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2235">42 U.S.C. 2235</external-xref>).</text></subsection><subsection id="HD04F4D846A2B482CB331A986ED6CFAB5" commented="no"><enum>(b)</enum><header>Qualifications</header><text>To qualify for the expedited procedure under subsection (a), an applicant—</text><paragraph id="H7DEE2BE1E1AE4B5AAFCFDC992310D31C" commented="no"><enum>(1)</enum><text>shall submit a combined license application for a new nuclear reactor based off a previously licensed design;</text></paragraph><paragraph id="H524FED44563B4DCEB82513D6B219E406" commented="no"><enum>(2)</enum><text>shall propose to construct the new nuclear reactor on or adjacent to a site on which a nuclear reactor already operates or previously operated; and</text></paragraph><paragraph id="HDD252207F3C04CA29CA87CFBDEB9E5FA" commented="no"><enum>(3)</enum><text>may not be subject to an order of the Commission to suspend or revoke a license under section 2.202 of title 10, Code of Federal Regulations (or any successor regulation).</text></paragraph></subsection><subsection id="H519F7D749F3B43ADBB3302768376E279" commented="no"><enum>(c)</enum><header>Expedited procedure</header><text>With respect to a combined license for which the applicant has satisfied the requirements described in subsection (b), the Commission shall, to the maximum extent practicable—</text><paragraph id="H5F35E3D4043F4F0B8176EB23E121F46B" commented="no"><enum>(1)</enum><text>not later than 1 year after the application is accepted for docketing, issue a draft environmental impact statement;</text></paragraph><paragraph id="H7B02FC9F3B5A4B778031E4557E9AEBEE" commented="no"><enum>(2)</enum><text>not later than 18 months after the application is accepted for docketing—</text><subparagraph id="H9565429102A44FCB880E357C728F17C5" commented="no"><enum>(A)</enum><text>complete the technical review process; and</text></subparagraph><subparagraph id="H9279F63D4AF14C4594788B94134F705D" commented="no"><enum>(B)</enum><text>issue a safety evaluation report and final environmental impact statement;</text></subparagraph></paragraph><paragraph id="HD263F1DA482E45E5B0932F622FA42874" commented="no"><enum>(3)</enum><text>not later than 2 years after the application is accepted for docketing, complete any necessary public licensing hearings and related processes; and</text></paragraph><paragraph id="HC46C1E7CB5334FCE9A275E022438DF08" commented="no"><enum>(4)</enum><text>not later than 25 months after the application is accepted for docketing, make a final decision on whether to issue the combined license.</text></paragraph></subsection><subsection id="H2CEC19C1684246FFBC6F7A431159FACC" commented="no"><enum>(d)</enum><header>Performance and reporting</header><paragraph id="H4544A1E61E4E46FA868940503E7BA670" commented="no"><enum>(1)</enum><header>Delays in issuance</header><text display-inline="yes-display-inline">Not later than 30 days after the applicable deadline, the Executive Director for Operations of the Commission shall inform the Commission of any failure to meet a deadline under subsection (c).</text></paragraph><paragraph id="H42417833B65A459489DAE54433B3351D" commented="no"><enum>(2)</enum><header>Delays in issuance exceeding 90 days</header><text>If any deadline under subsection (c) is not met by the date that is 90 days after the applicable date required under such subsection, the Commission shall submit to the Committee on Environment and Public Works of the Senate and the Committee on Energy and Commerce of the House of Representatives a report describing the delay, including a detailed explanation accounting for the delay and a plan for completion of the applicable action.</text></paragraph></subsection></section><section id="H4D51A5EF16034528BABE82BE4EF96D11"><enum>5.</enum><header>Pilot program for nuclear power purchase agreements</header><subsection id="HDD37D23271F6446ABD1965F220333F55"><enum>(a)</enum><header>In general</header><text>Subtitle B of title VI of the Energy Policy Act of 2005 (<external-xref legal-doc="public-law" parsable-cite="pl/109/58">Public Law 109–58</external-xref>; 119 Stat. 782) is amended by adding at the end the following:</text><quoted-block id="HECEA93A22FED4CFC8257E46A9AE66A66" style="OLC"><section id="HD57E1C6E1ABD489A8D4F34A669A4BB61"><enum>639A.</enum><header>Long-term nuclear power purchase agreement pilot program</header><subsection id="H00C5415A652E4D7F8B6BEC76EF697F6A"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Secretary shall establish a pilot program under which the Secretary shall enter into at least one long-term power purchase agreement for power generated by a commercial nuclear reactor with respect to which an operating license is issued by the Nuclear Regulatory Commission after January 1, 2024.</text></subsection><subsection id="HBCE2B51A53AA4D708638559255BD46F9" commented="no"><enum>(b)</enum><header>Requirements</header><text>In establishing the pilot program under this section, the Secretary shall—</text><paragraph id="H78859BCFC2C94145A242788EB1145A2C" commented="no"><enum>(1)</enum><text>consult with the heads of other Federal departments and agencies that may benefit from purchasing nuclear power for a period of longer than 10 years, including the Secretary of Defense; and</text></paragraph><paragraph id="H65FF6A787EEA4768B65F62525E2FA2DD" commented="no"><enum>(2)</enum><text>not later than December 31, 2028, enter into at least one long-term agreement to purchase power from a commercial nuclear reactor described in subsection (a).</text></paragraph></subsection><subsection id="HF33D8B882C574F348A113B413808165E"><enum>(c)</enum><header>Period of agreement</header><text>Notwithstanding any other provision of law, an agreement entered into pursuant to subsection (b)(2) to purchase power from a commercial nuclear reactor shall be made for a period of at least 10 years and not more than 40 years.</text></subsection><subsection id="H952E151A93044422A70704F72896BB7A"><enum>(d)</enum><header>Priority</header><text display-inline="yes-display-inline">In carrying out this section, the Secretary shall prioritize entering into long-term power purchase agreements for power generated by first-of-a-kind or early deployment commercial nuclear reactors that will provide reliable and resilient power—</text><paragraph id="HE66CB11C805D457D8A8BE8FBEE8F180E"><enum>(1)</enum><text>to high-value assets for national security purposes; or</text></paragraph><paragraph id="H70268002080B4380B6F801C484FA6627"><enum>(2)</enum><text>for other purposes that the Secretary determines are in the national interest, including for remote off-grid scenarios or grid-connected scenarios that provide capabilities commonly known as <quote>islanding power capabilities</quote> during an emergency.</text></paragraph></subsection><subsection id="HECDD90F8245E45698F5FCD370859365B"><enum>(e)</enum><header>Rates</header><text>A long-term power purchase agreement entered into under this section may not be at a rate that is higher than the average market rate, unless the agreement is for power generated by a commercial nuclear reactor described in subsection (d).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H15FAEB46D5C74917B4128092F4A532E7"><enum>(b)</enum><header>Table of contents</header><text>The table of contents of the Energy Policy Act of 2005 (<external-xref legal-doc="public-law" parsable-cite="pl/109/58">Public Law 109–58</external-xref>; 119 Stat. 594) is amended by inserting after the item relating to section 639 the following:</text><quoted-block id="H39C0772183BB4755843A8DEBFDBC68E5" style="OLC"><toc regeneration="no-regeneration"><toc-entry level="section">Sec. 639A.
