R. 6519</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20231130">November 30, 2023</action-date><action-desc><sponsor name-id="D000624">Mrs. Dingell</sponsor> (for herself, <cosponsor name-id="F000466">Mr. Fitzpatrick</cosponsor>, and <cosponsor name-id="K000382">Ms. Kuster</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Federal Food, Drug, and Cosmetic Act to ban the use of intentionally added perfluoroalkyl or polyfluoroalkyl substances in cosmetics, and for other purposes.</official-title></form><legis-body id="H1315525E45894DD8933F62D231C6D976" style="OLC"><section id="H4F5DAA6ABBFC4DC8B0956F08C735094B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>No PFAS in Cosmetics Act</short-title></quote>.</text></section><section id="HBC930F8C43064B4ABFA01C0A9E2A4D60"><enum>2.</enum><header>Ban on perfluoroalkyl or polyfluoroalkyl substances</header><subsection id="H0726BB18F79E46118BE7D0FCCAECEE1D"><enum>(a)</enum><header>Adulteration</header><text display-inline="yes-display-inline">Section 601 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/361">21 U.S.C. 361</external-xref>) is amended by adding after paragraph (g) (as added by section 3503(a)(2) of division FF of <external-xref legal-doc="public-law" parsable-cite="pl/117/328">Public Law 117–328</external-xref>) the following:</text><quoted-block style="traditional" id="HED3F5A3F83D74F6B91A06A326BF27888" display-inline="no-display-inline"><subsection id="HDE97EDEDACB2496D8BF8C85DDD3450E8"><enum>(h)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H1DD813D9616144F9B9DA217CFEEFB3C6"><enum>(1)</enum><text>If it contains an intentionally added perfluoroalkyl or polyfluoroalkyl substance.</text></paragraph><paragraph id="HEA3A8511170B456094FC78CF59113BE1" indent="up1"><enum>(2)</enum><text>In this paragraph:</text><subparagraph id="HFAC184F7DFB9478DBD848763250A8D82"><enum>(A)</enum><text display-inline="yes-display-inline">The term <term>perfluoroalkyl or polyfluoroalkyl substance</term> means a substance in a class of fluorinated organic chemicals—</text><clause id="H105EA93343254A688604C678F8B4751A"><enum>(i)</enum><text>that is man-made; and</text></clause><clause id="HA0FCADA7FBA7401B977B780F4C7DDBFB"><enum>(ii)</enum><text>has at least 1 fully fluorinated carbon atom.</text></clause></subparagraph><subparagraph id="HB62AEE2787344E6FA51ED6D57BD02689"><enum>(B)</enum><text display-inline="yes-display-inline">The term <term>intentionally added perfluoroalkyl or polyfluoroalkyl substance</term> means a perfluoroalkyl or polyfluoroalkyl substance that—</text><clause id="HE7BC65AD7097402A89643B59967728DC"><enum>(i)</enum><text display-inline="yes-display-inline">has been intentionally added by a manufacturer or supplier to an ingredient, raw material, product, or packaging and has a functional or technical effect on the product or packaging; or</text></clause><clause id="H715F2ED338FB4E8491B84C37097A226F"><enum>(ii)</enum><text display-inline="yes-display-inline">is an intentional breakdown product of an added chemical.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H96C18A8C6A9141AB85B1CAFE01AFBDDF"><enum>(b)</enum><header>Applicability</header><text>Section 601(h) of the Federal Food, Drug, and Cosmetic Act, as added by subsection (a), shall apply beginning on January 1, 2025.</text></subsection><subsection id="H2024FCBE48774A8DB940B6EC25C4E697"><enum>(c)</enum><header>Conforming amendment</header><text>Section 3506 of the Modernization of Cosmetics Regulation Act of 2022 (subtitle E of title III of division FF of <external-xref legal-doc="public-law" parsable-cite="pl/117/328">Public Law 117–328</external-xref>) is hereby repealed.</text></subsection></section></legis-body></bill>
