<subsection id="H279D32423BB445ABB0DDF2C24E482CD6"><enum>(a)</enum><header>Gas and hazardous liquid</header> 
<paragraph id="HC2D6318C6B034815B6F9FB292525A6BD"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">From fees collected under section 60301, there are authorized to be appropriated to the Secretary to carry out section 12 of the Pipeline Safety Improvement Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/49/60101">49 U.S.C. 60101</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/107/355">Public Law 107–355</external-xref>) and the provisions of this chapter relating to gas and hazardous liquid—</text> <subparagraph id="HCAEE4625EDF94491A8448C0ABA006688"><enum>(A)</enum><text>$181,400,000 for fiscal year 2024, of which—</text> 
<clause id="H34E91C56B27542D7953FEFE01E7AF9D5"><enum>(i)</enum><text>$9,000,000 shall be used to carry out section 12 of the Pipeline Safety Improvement Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/49/60101">49 U.S.C. 60101</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/107/355">Public Law 107–355</external-xref>); and</text></clause> <clause id="HF52B7077E6844D8493FF082F8EECDE58"><enum>(ii)</enum><text>$73,000,000 shall be used for making grants;</text></clause></subparagraph> 
<subparagraph id="H8FDDC7EF72A148F1911DF5A36BBEC4C3" commented="no"><enum>(B)</enum><text>$189,800,000 for fiscal year 2025, of which—</text> <clause id="H55455FCCA5D44908971A7E2777327A9F" commented="no"><enum>(i)</enum><text>$9,000,000 shall be used to carry out section 12 of the Pipeline Safety Improvement Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/49/60101">49 U.S.C. 60101</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/107/355">Public Law 107–355</external-xref>); and</text></clause> 
<clause id="H022A69DB5E1C42C39ACA6F48B419DD64" commented="no"><enum>(ii)</enum><text>$75,000,000 shall be used for making grants;</text></clause></subparagraph> <subparagraph id="HECD40F3B00424ABF9CF6F126C49CDEC5" commented="no"><enum>(C)</enum><text>$198,200,000 for fiscal year 2026, of which—</text> 
<clause id="HD68AB89C1A5F493B9E7077276CD9A849" commented="no"><enum>(i)</enum><text>$9,000,000 shall be used to carry out section 12 of the Pipeline Safety Improvement Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/49/60101">49 U.S.C. 60101</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/107/355">Public Law 107–355</external-xref>); and</text></clause> <clause id="H65861836336F4351BA1024BA3158A828" commented="no"><enum>(ii)</enum><text>$77,000,000 shall be used for making grants; and</text></clause></subparagraph> 
<subparagraph id="HD50F3BC40E7A447BB0D9B5BA8C3CB7FF" display-inline="no-display-inline"><enum>(D)</enum><text>$206,600,000 for fiscal year 2027, of which—</text> <clause id="HEF674E2EF5834A119DA3B44CE5E0FE1E"><enum>(i)</enum><text>$9,000,000 shall be used to carry out section 12 of the Pipeline Safety Improvement Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/49/60101">49 U.S.C. 60101</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/107/355">Public Law 107–355</external-xref>); and</text></clause> 
<clause id="H5922401965E24EB0AE82C195CEA616A6"><enum>(ii)</enum><text>$79,000,000 shall be used for making grants.</text></clause></subparagraph></paragraph> <paragraph id="H23E606C8409A493393BC7BF097E41F27"><enum>(2)</enum><header>Trust fund amounts</header><text>In addition to the amounts authorized to be appropriated under paragraph (1), there are authorized to be appropriated from the Oil Spill Liability Trust Fund established by <external-xref legal-doc="usc" parsable-cite="usc/26/9509">section 9509(a)</external-xref> of the Internal Revenue Code of 1986 to carry out section 12 of the Pipeline Safety Improvement Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/49/60101">49 U.S.C. 60101</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/107/355">Public Law 107–355</external-xref>) and the provisions of this chapter relating to hazardous liquid—</text> 
<subparagraph id="HC7437F1DC050482498148F9B0C9295BC"><enum>(A)</enum><text>$30,000,000 for fiscal year 2024, of which—</text> <clause id="HCD20163D1FE3481C99C58550AA685A8C"><enum>(i)</enum><text display-inline="yes-display-inline">$2,000,000, pursuant to the authority in section 12(f) of the Pipeline Safety Improvement Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/49/60101">49 U.S.C. 60101</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/107/355">Public Law 107–355</external-xref>), shall be used to carry out section 12 of such Act; and</text></clause> 
<clause id="HAC032F52EF7D42EC8A58047A971908F5"><enum>(ii)</enum><text>$11,000,000 shall be used for making grants;</text></clause></subparagraph> <subparagraph id="HB68999C2224745918F1E94BA55248934" commented="no"><enum>(B)</enum><text>$30,500,000 for fiscal year 2025, of which—</text> 
<clause id="HA2E1B7A863634729AFCC448BBBA61C5C" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">$2,000,000, pursuant to the authority in section 12(f) of the Pipeline Safety Improvement Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/49/60101">49 U.S.C. 60101</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/107/355">Public Law 107–355</external-xref>), shall be used to carry out section 12 of such Act; and</text></clause> <clause id="HB1A7B1ACCE8F49CD82E735F8D69E3075" commented="no"><enum>(ii)</enum><text>$11,500,000 shall be used for making grants; </text></clause></subparagraph> 
<subparagraph id="H4DBA23E5BB2941A9AA7A464A8CD309E4" commented="no"><enum>(C)</enum><text>$31,000,000 for fiscal year 2026, of which—</text> <clause id="HE7ECB5117B874092A2901C9B5D3265F5" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">$2,000,000, pursuant to the authority in section 12(f) of the Pipeline Safety Improvement Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/49/60101">49 U.S.C. 60101</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/107/355">Public Law 107–355</external-xref>), shall be used to carry out section 12 of such Act; and</text></clause> 
<clause id="HE26D35AC55A34A07A939CE06939CCE8B" commented="no"><enum>(ii)</enum><text>$12,000,000 shall be used for making grants; and</text></clause></subparagraph> <subparagraph id="H885042D97CF34A6B9CE81021183C29E7"><enum>(D)</enum><text>$31,500,000 for fiscal year 2027, of which—</text> 
<clause id="HEFF87BD4316442D88D3D64649B0DA8A5"><enum>(i)</enum><text display-inline="yes-display-inline">$2,000,000, pursuant to the authority in section 12(f) of the Pipeline Safety Improvement Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/49/60101">49 U.S.C. 60101</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/107/355">Public Law 107–355</external-xref>), shall be used to carry out section 12 of such Act; and</text></clause> <clause id="H2253DC4890D04E789A961601BE2FBD6D"><enum>(ii)</enum><text>$12,500,000 shall be used for making grants.</text></clause></subparagraph></paragraph> 
<paragraph id="H065969AE0BF247AFA414D6D13829FB0B" commented="no"><enum>(3)</enum><header>Underground natural gas storage facility safety account</header><text>From fees collected under section 60302, there is authorized to be appropriated to the Secretary to carry out section 60141 $7,000,000 for each of fiscal years 2024 through 2027.</text></paragraph> <paragraph id="HB40AAF0750314F60842BA4E48539B9A8" commented="no"><enum>(4)</enum><header>Recruitment and retention</header><text display-inline="yes-display-inline">From amounts made available to the Secretary under paragraphs (1) and (2), the Secretary shall use, to carry out section 104(a) of the <short-title>PIPES Act of 2023</short-title> and section 102(c) of the Protecting our Infrastructure of Pipelines and Enhancing Safety Act of 2020 (<external-xref legal-doc="public-law" parsable-cite="pl/116/260">Public Law 116–260</external-xref>)—</text> 
<subparagraph id="H290D8DA90AA649A2BF9EC9F67A8F94EB" commented="no"><enum>(A)</enum><text>$3,400,000 for fiscal year 2024, of which—</text> <clause id="H3438236A1DB7480EA2798F0B1C0157A1" commented="no"><enum>(i)</enum><text>$2,890,000 shall be from amounts made available under paragraph (1)(A); and</text></clause> 
<clause id="HB656F2FB4BAE46198F15D74705B285A2" commented="no"><enum>(ii)</enum><text>$510,000 shall be from amounts made available under paragraph (2)(A);</text></clause></subparagraph> <subparagraph id="H67978297D7694F428EAC6F2A8694A6E6" commented="no"><enum>(B)</enum><text>$5,100,000 for fiscal year 2025, of which—</text> 
<clause id="H669739F942ED4915B94381A7EE09A0B0" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">$4,335,000 shall be from amounts made available under paragraph (1)(B); and</text></clause> <clause id="HB10DE715F43B41B4AB5C6689AFB4F29C" commented="no"><enum>(ii)</enum><text>$765,000 shall be from amounts made available under paragraph (2)(B);</text></clause></subparagraph> 
<subparagraph id="HA5A9347AFF36497F91A945B3E3CD6560" commented="no"><enum>(C)</enum><text>$6,800,000 for fiscal year 2026, of which—</text> <clause id="H1A6B5DA7520A44CBBA83D68AC9306141" commented="no"><enum>(i)</enum><text>$5,780,000 shall be from amounts made available under paragraph (1)(C); and</text></clause> 
<clause id="H029AA064FF824FBC9C8B79021BA57007" commented="no"><enum>(ii)</enum><text>$1,020,000 shall be from amounts made available under paragraph (2)(C); and</text></clause></subparagraph> <subparagraph id="HFF36DA809D7F46D3B313531D5811F90D" commented="no"><enum>(D)</enum><text>$8,500,000 for fiscal year 2027, of which—</text>

<subsection id="HE320B468C62E4580BF73506E23897E70"><enum>(b)</enum><header>Operational expenses</header><text>Section 2(b) of the PIPES Act of 2016 (<external-xref legal-doc="public-law" parsable-cite="pl/114/183">Public Law 114–183</external-xref>; 130 Stat. 515) is amended by striking paragraphs (1) through (3) and inserting the following:</text> <quoted-block style="OLC" id="HC723FEAAA8C04DC899BF764A1EC04E90"> <paragraph id="H839AC3C0C3AB45F2801D5A3710CD30F3"><enum>(1)</enum><text>$31,000,000 for fiscal year 2024.</text></paragraph>

<paragraph id="HD4F4CD24DC6B4565A5E51E8B068B930D"><enum>(4)</enum><text>$34,000,000 for fiscal year 2027.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H53ED99B3B20D4AE8B096C6DF057D73E0"><enum>(c)</enum><header>One-call notification programs</header><text>Section 6107 of title 49, United States Code, is amended by striking <quote>$1,058,000 for each of fiscal years 2021 through 2023</quote> and inserting <quote>$2,000,000 for each of fiscal years 2024 through 2027</quote>.</text></subsection> 
<subsection id="HBA550839748640EE9729EEC09CEA6D7A"><enum>(d)</enum><header>Emergency response grants</header><text>Section 60125(b)(2) of title 49, United States Code, is amended by striking <quote>fiscal years 2021 through 2023</quote> and inserting <quote>fiscal years 2024 through 2027</quote>.</text></subsection> <subsection id="HAA5BEC38D91540F9B71B8C916EBCC051"><enum>(e)</enum><header>Pipeline safety information grants to communities</header><text>Section 60130(c)(1) of title 49, United States Code, is amended by striking <quote>$2,000,000 for each of fiscal years 2021 through 2023 to carry out this section.</quote> and inserting the following:</text> 
<quoted-block style="USC" display-inline="yes-display-inline" id="H95C4F4734BD84B53ACEE4ABAB2E37304"><text display-inline="yes-display-inline">, to carry out this section, the following:</text> <subparagraph id="H43D01B07CED042CAB02E5F39AC55DEF4"><enum>(A)</enum><text display-inline="yes-display-inline">$2,250,000 for fiscal year 2024.</text></subparagraph>

<paragraph id="H22CD4FF1215A4FD58B4DBD2D26C301B0"><enum>(1)</enum><text>develop and implement pipeline safety policies and regulations; and</text></paragraph> <paragraph id="H69928BB2257F4EAD981238E5542CF9C9"><enum>(2)</enum><text>fulfill congressional rulemaking mandates.</text></paragraph></subsection> 
<subsection id="H24619A7AE6004914BB9B4FE128B0859E"><enum>(b)</enum><header>Report required</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary of Transportation shall submit to Congress a report on—</text> <paragraph id="H6627C7CEB7BE49FDAD1174A551910AD4"><enum>(1)</enum><text>any progress made on implementation of subsection (a);</text></paragraph> 
<paragraph id="H43FEEC8CE51149F8A55F1639D38DC724"><enum>(2)</enum><text display-inline="yes-display-inline">the implementation of the recruitment and retention incentives authorized in section 102 of the PIPES Act of 2020 (<external-xref legal-doc="public-law" parsable-cite="pl/116/260">Public Law 116–260</external-xref>);</text></paragraph> <paragraph id="H7C66B1774C934B099E87B08141E3CCDA"><enum>(3)</enum><text>barriers and challenges to hiring and retention at the Administration; </text></paragraph> 
<paragraph id="H837AF16FFEEB4D818DC20528D9CB22E3"><enum>(4)</enum><text>staffing levels of inspection and enforcement personnel of the Administration; and</text></paragraph> <paragraph id="H6564EB987653442E9201B45C61E9BCB1"><enum>(5)</enum><text>any additional workforce needs of the Administration.</text></paragraph></subsection> 
<subsection id="H729257328B3A488DB300C6B8EAF27A43"><enum>(c)</enum><header>Effect on existing regulation</header><text>Section 102(c) of the PIPES Act of 2020 (<external-xref legal-doc="usc" parsable-cite="usc/49/60101">49 U.S.C. 60101</external-xref> note) is amended by striking paragraph (3) and inserting the following: </text> <quoted-block style="OLC" display-inline="no-display-inline" id="HDED2D7CB4C6C43A1A519505D36D2E1AD"> <paragraph id="HE20635FF055F464B9153A79DA0AF9294"><enum>(3)</enum><header>Effect on existing regulation</header><text display-inline="yes-display-inline">In implementing the incentives described in paragraph (1), the Secretary, in consultation with the Administrator of the Pipeline and Hazardous Materials Safety Administration, may waive existing regulations.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section id="HF13153AFD1F44D9F98A925A4A51F935D" section-type="subsequent-section"><enum>5.</enum><header>Regulatory updates</header> 
<subsection id="HD5FBC2FB83774B5AA25D9AD4171EFC63"><enum>(a)</enum><header>Definition of outstanding mandate</header><text display-inline="yes-display-inline">In this section, the term <term>outstanding mandate</term> means—</text> <paragraph id="H6323C920114D4A1493109EAB88286DD7"><enum>(1)</enum><text display-inline="yes-display-inline">a final rule required to be issued under the Pipeline Safety, Regulatory Certainty, and Job Creation Act of 2011 (<external-xref legal-doc="public-law" parsable-cite="pl/112/90">Public Law 112–90</external-xref>) that has not been published in the Federal Register;</text></paragraph> 
<paragraph id="H3619975E45F54A00B717DE746DB513B3"><enum>(2)</enum><text display-inline="yes-display-inline">a final rule required to be issued under the PIPES Act of 2016 (<external-xref legal-doc="public-law" parsable-cite="pl/114/183">Public Law 114–183</external-xref>) that has not been published in the Federal Register;</text></paragraph> <paragraph id="HF1BF0366302243F6A42CE93CD57B6C05"><enum>(3)</enum><text display-inline="yes-display-inline">a final rule required to be issued under the PIPES Act of 2020 (<external-xref legal-doc="public-law" parsable-cite="pl/116/260">Public Law 116–260</external-xref>) that has not been published in the Federal Register; and</text></paragraph> 
<paragraph id="H38B87BDE9B354F5FA498B6322EDA2A83"><enum>(4)</enum><text display-inline="yes-display-inline">any other final rule regarding gas or hazardous liquid pipeline facilities that—</text> <subparagraph id="H40178FBE7EE645319C0E4D1808D6BBEB"><enum>(A)</enum><text>has not been published in the Federal Register; and</text></subparagraph> 
<subparagraph id="H8D87B0339D354DF396E2ADFAC33D0A39"><enum>(B)</enum><text>is required to be issued under this Act or any other Act.</text></subparagraph></paragraph></subsection> <subsection id="HD08202B39D0A4ABD9F0B5EBECF2FCF7C"><enum>(b)</enum><header>Requirements</header> <paragraph id="HAED48D8782ED48D2A49EFE1170F9327F"><enum>(1)</enum><header>Periodic updates</header><text display-inline="yes-display-inline">Not later than 30 days after the date of enactment of this Act, and every 30 days thereafter until each outstanding mandate is published in the Federal Register, the Secretary of Transportation shall publish on a publicly available website of the Department of Transportation an update regarding the status of each such mandate in accordance with subsection (c).</text></paragraph> 
<paragraph id="H1580BE8FF0B249368D05819D8AB32B5D"><enum>(2)</enum><header>Notification of Congress</header><text display-inline="yes-display-inline">On publication of a final rule in the Federal Register for an outstanding mandate, the Secretary shall submit to the Committee on Transportation and Infrastructure and the Committee on Energy and Commerce of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a notification of such publication.</text></paragraph></subsection> <subsection id="H85FA51E3E30440F2A85DE7EE709B915A"><enum>(c)</enum><header>Contents</header><text display-inline="yes-display-inline">An update published or a notification submitted under subsection (b)(1) shall contain, as applicable—</text> 
<paragraph id="HEDEF11F3B057462C9CE0649EFBCD9493"><enum>(1)</enum><text display-inline="yes-display-inline">with respect to information relating to the Administration—</text> <subparagraph id="H584BC1696E8F476C8DCC492235B37145"><enum>(A)</enum><text display-inline="yes-display-inline">a description of the work plan for each outstanding mandate;</text></subparagraph> 
<subparagraph id="H1035D82581D44DFE854C9ECA0C728B6A"><enum>(B)</enum><text display-inline="yes-display-inline">an updated rulemaking timeline for each outstanding mandate;</text></subparagraph> <subparagraph id="H1E5830840D62450582CD53E6B651F510"><enum>(C)</enum><text display-inline="yes-display-inline">the staff allocations with respect to each outstanding mandate;</text></subparagraph> 
<subparagraph id="HC2989E86C2A845E09872C888A9C4C88E"><enum>(D)</enum><text display-inline="yes-display-inline">any resource constraints affecting the rulemaking process for each outstanding mandate;</text></subparagraph> <subparagraph id="H13DA881EB8BE45E585EAC879DEA27849"><enum>(E)</enum><text display-inline="yes-display-inline">any other details associated with the development of each outstanding mandate that affect the progress of the rulemaking process with respect to that outstanding mandate; and</text></subparagraph> 
<subparagraph id="HBCFD5B3A9C734AB3B3CC1AE61C888D18"><enum>(F)</enum><text display-inline="yes-display-inline">a description of all rulemakings regarding gas or hazardous liquid pipeline facilities published in the Federal Register that are not identified under subsection (b)(2); and</text></subparagraph></paragraph> <paragraph id="HA27A934D7586465D8F3171FF11FB864F"><enum>(2)</enum><text display-inline="yes-display-inline">with respect to information relating to the Office of the Secretary—</text> 
<subparagraph id="HD7F7DA53A7D84F3EB503094DC62B6E2C"><enum>(A)</enum><text>the date that the outstanding mandate was submitted to the Office of the Secretary for review;</text></subparagraph> <subparagraph id="HB128045D640C4A9EACD0188FB802315D"><enum>(B)</enum><text display-inline="yes-display-inline">the reason that the outstanding mandate is under review beyond 45 days;</text></subparagraph> 
<subparagraph id="H9296F610528E4576959012F47EEB9E9C"><enum>(C)</enum><text display-inline="yes-display-inline">the staff allocations within the Office of the Secretary with respect to each outstanding mandate;</text></subparagraph> <subparagraph id="H3DCE6B12EC8442529F1DB40BA2DC2629"><enum>(D)</enum><text display-inline="yes-display-inline">any resource constraints affecting review of the outstanding mandate;</text></subparagraph> 
<subparagraph id="HE976D5E8360F4415BD4B44CF351A63C3"><enum>(E)</enum><text display-inline="yes-display-inline">an estimated timeline of when review of the outstanding mandate will be complete, as of the date of the update;</text></subparagraph> <subparagraph id="H54AC7CA9A40D4A599FC0D41F50E2DB7B"><enum>(F)</enum><text display-inline="yes-display-inline">if applicable, the date that the outstanding mandate was returned to the Administration for revision and the anticipated date for resubmission to the Office of the Secretary;</text></subparagraph> 
<subparagraph id="H37AC9D50832841BDA202D011803B10E8"><enum>(G)</enum><text display-inline="yes-display-inline">the date that the outstanding mandate was submitted to the Office of Management and Budget for review; and</text></subparagraph> <subparagraph id="H45E8ECCDB1EB4003BE8FB8BCE040FA95"><enum>(H)</enum><text display-inline="yes-display-inline">a statement of whether the outstanding mandate remains under review by the Office of Management and Budget. </text></subparagraph></paragraph></subsection></section> 
<section id="H5AEC10A9C1C8445A9796AC7084615DE9" section-type="subsequent-section"><enum>6.</enum><header>Incorporation by reference</header> 
<subsection id="H990CAC4572D54706A2C508F79F67CA03"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 60102 of title 49, United States Code, is amended by striking subsection (l) and inserting the following:</text> <quoted-block style="USC" display-inline="no-display-inline" id="H983EF848039841D8B017933D68915B4C"> <subsection id="H938CA57946194123A26F8B3675A6E5F1"><enum>(l)</enum><header>Updating standards</header> <paragraph id="H9AFBA3937B49466FA9F922AF8A2A6A31"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not less frequently than once every 4 years, or if an interested person otherwise petitions in accordance with section 190.331 of title 49, Code of Federal Regulations (or successor regulation), the Secretary shall review, and update as necessary, incorporated industry standards that have been adopted, either partially or in full, as part of the Federal pipeline safety regulatory program under this chapter that are modified and published by a standards development organization, as such term is defined in section 2(a) of the National Cooperative Research and Production Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/15/4301">15 U.S.C. 4301(a)</external-xref>).</text></paragraph> 
<paragraph id="H9A2F140BF4BA4AFCBBB49264D96E4717"><enum>(2)</enum><header>Discretion in adopting industry standards</header><text display-inline="yes-display-inline">The Secretary may decline to adopt an industry standard that is inconsistent with applicable law or otherwise impracticable, including in circumstances where the use of an industry standard would not serve the needs of the Federal pipeline safety regulatory program, or would impose undue burdens. </text></paragraph> <paragraph id="H9AC1F38ED24740FE9468E28122C3AEAE"><enum>(3)</enum><header>List of industry standards</header><text>The Secretary shall—</text> 
<subparagraph id="H3D0C7AA5BC824B3A805DE261882B2C61"><enum>(A)</enum><text display-inline="yes-display-inline">maintain a publicly available list of all industry standards considered for adoption under this chapter and the agency’s adjudication of each considered standard;</text></subparagraph> <subparagraph id="HEF02141BC7374FA0AB134F64F264C2CF"><enum>(B)</enum><text display-inline="yes-display-inline">include the reasoning for not adopting an industry standard, whether in full or in part, on the list under subparagraph (A); and</text></subparagraph> 
<subparagraph id="H4A77C61B5564482780DC88E9C60B5033"><enum>(C)</enum><text display-inline="yes-display-inline">submit to the Committee on Transportation and Infrastructure and the Committee on Energy and Commerce of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate such list not later than—</text> <clause id="HF070D03CF91141B197EDA53069CD7ED3"><enum>(i)</enum><text>30 days after completion of such list; and</text></clause> 
<clause id="HDD38227A2D78415FB20BCAA678C03F79"><enum>(ii)</enum><text>30 days after the date of any subsequent revisions to such list.</text></clause></subparagraph></paragraph> <paragraph id="HAA33CD680B6647EA87BF4CCBFD82BDA5"><enum>(4)</enum><header>Public accessibility</header><text display-inline="yes-display-inline">Any industry standards incorporated by reference, or portions thereof, shall be made available by the entity that developed such standards free of charge for viewing on a publicly available website.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H76288FE43D5B4D44B5DD571ACFA3293A"><enum>(b)</enum><header>GAO report</header><text>Not later than 2 years after the date of enactment of this Act, the Comptroller General of the United States shall—</text> <paragraph id="H187FF77BD48F4F0692F4B12D35022378" display-inline="no-display-inline"><enum>(1)</enum><text>conduct a review to determine compliance with section 60102(l)(4) of title 49, United States Code; and</text></paragraph> 
<paragraph id="HFC8A03FD63394A8B8E37A17F8D08F363"><enum>(2)</enum><text>submit to the Committee on Transportation and Infrastructure and the Committee on Energy and Commerce of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a report on the review conducted under paragraph (1).</text></paragraph></subsection></section> <section id="H8A50A293379E4306BF5BDB1D6FE1551A" section-type="subsequent-section"><enum>7.</enum><header>Inspection activity reporting</header> <subsection id="H8E5B4EB15A3345F98120D4AC75EB8E5F"><enum>(a)</enum><header>Inspection and enforcement priorities</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretary of Transportation shall establish, and make available to the public in an electronically accessible format, a report containing the inspection and enforcement priorities of the Office of Pipeline Safety of the Pipeline and Hazardous Materials Safety Administration for fiscal years 2024 through 2027. Such report shall include a description of—</text> 
<paragraph id="H6992FCD487524CE48B295DDCF929DE78"><enum>(1)</enum><text display-inline="yes-display-inline">how the Administrator will use the priorities to guide the inspection program of such Office;</text></paragraph> <paragraph id="H5D8E4FF4528347648D57D9AE27F07A2B"><enum>(2)</enum><text display-inline="yes-display-inline">how the inspection and enforcement priorities will improve pipeline safety; and</text></paragraph> 
<paragraph id="H047515BC7A3547008D5B2FB286B119EE"><enum>(3)</enum><text display-inline="yes-display-inline">how the Administrator communicates and coordinates the implementation of inspection and enforcement priorities with regional offices and State inspectors operating under delegated authority.</text></paragraph></subsection> <subsection id="H9973FDEDAC6D4CE88A956EFFA8B0884B"><enum>(b)</enum><header>Notice and comment</header><text display-inline="yes-display-inline">Prior to publication of the inspection and enforcement priorities under subsection (a), the Administrator shall solicit through notice in the Federal Register public comment on such priorities.</text></subsection> 
<subsection id="H80D95EEB9FCD4A72AF581EC4E594966D"><enum>(c)</enum><header>Summary of pipeline inspections</header><text display-inline="yes-display-inline">Not later than June 1 of each year beginning with the year after the date of enactment of this Act, the Administrator shall make available to the public in an electronically accessible format a summary of Federal and State pipeline inspections conducted under direct or delegated authority of title 49, United States Code, during the previous calendar year, to include—</text> <paragraph id="H191796A841C04201BC59B8E1A9182B90"><enum>(1)</enum><text display-inline="yes-display-inline">the date of the inspection;</text></paragraph> 
<paragraph id="H1A4AB46A546947CE98579564A007ED93"><enum>(2)</enum><text display-inline="yes-display-inline">the name of the pipeline owner or operator;</text></paragraph> <paragraph id="H9E9387D55B4D41689F7D8473D33B2717"><enum>(3)</enum><text display-inline="yes-display-inline">the pipeline system or segment inspected;</text></paragraph> 
<paragraph id="HB5F10E4E1F75458C847CC27B3A75A56B"><enum>(4)</enum><text display-inline="yes-display-inline">the region or regions of the Pipeline and Hazardous Materials Safety Administration in which the inspected system or segment operates;</text></paragraph> <paragraph id="H4989D3AF1865409E829DEF55BFF6AACC"><enum>(5)</enum><text display-inline="yes-display-inline">the State or States in which the inspected system or segment operates; and</text></paragraph> 
<paragraph id="H0B738F1E33A44D16B332D2AF7C6A9001"><enum>(6)</enum><text display-inline="yes-display-inline">any violations, or proposed violations, found as a result of pipeline inspections. </text></paragraph></subsection></section> <section id="H864586B0AEE3445B888AE58A9DAC6FEF" display-inline="no-display-inline" section-type="subsequent-section"><enum>8.</enum><header>Technical safety standards committees</header> <subsection id="HED951D004D704AE1B6538FFB94424A3D"><enum>(a)</enum><header>Committee reports on proposed standards</header><text display-inline="yes-display-inline">Section 60115(c)(1) of title 49, United States Code, is amended—</text> 
<paragraph id="HAF6E0DF681A34A289E5574BE4CE9BA1E"><enum>(1)</enum><text>in subparagraph (A) by inserting <quote>, if applicable</quote> after <quote>each proposed standard</quote>; and</text></paragraph> <paragraph id="H98523858D4CE456E90278F6FC615F87F"><enum>(2)</enum><text>in subparagraph (B) by inserting <quote>, if applicable</quote> after <quote>each proposed standard</quote>.</text></paragraph></subsection> 
<subsection id="H83CD4C6EA47B4AD1A0612AB6A84CD6CF"><enum>(b)</enum><header>Report</header><text>Section 60115(c)(2) of title 49, United States Code, is amended by inserting <quote>and provide written notification of such reasons to the Committee on Transportation and Infrastructure and the Committee on Energy and Commerce of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate at the time a final rulemaking relating to the standard is issued</quote> after <quote>publish the reasons</quote>.</text></subsection> <subsection id="HF2FD0675F73F40098BECEA76281B6CFC"><enum>(c)</enum><header>Frequency of meetings</header><text>Section 60115(e) of title 49, United States Code, is amended by striking <quote>up to 4</quote> and inserting <quote>2</quote>.</text></subsection></section> 
<section id="H42933CB245DB4DEE8576DD59401D7B84" section-type="subsequent-section"><enum>9.</enum><header>Sense of Congress on PHMSA engagement prior to rulemaking activities</header><text display-inline="no-display-inline">It is the sense of Congress that—</text> <paragraph id="HA29A20D2C72748CEA22410BFC074BA38"><enum>(1)</enum><text display-inline="yes-display-inline">the Secretary of Transportation should engage with pipeline stakeholder groups, including State pipeline safety programs with an approved certification under section 60105 of title 49, United States Code, and the public during predrafting stages of rulemaking activities and use, to the greatest extent practicable, properly docketed ex parte discussions during rulemaking activities in order to—</text> 
<subparagraph id="H03F8B0CA30864B34B15EC3D2A82FCCA2"><enum>(A)</enum><text>inform the work of the Secretary;</text></subparagraph> <subparagraph id="H48E3E98FCFC846859E8508E923551BA6"><enum>(B)</enum><text>assist the Administrator of the Pipeline and Hazardous Materials Safety Administration in developing the scope of a rule; and</text></subparagraph> 
<subparagraph id="H62B5058980C64E729BF97C77F9F3E28A"><enum>(C)</enum><text>reduce the timeline for issuance of proposed and final rules; and</text></subparagraph></paragraph> <paragraph id="HC6F181E3651E4E31B07707360FFD3C9D"><enum>(2)</enum><text>when it would reduce the time required for the Secretary to adjudicate public comments, the Administrator should publicly provide information describing the rationale behind a regulatory decision included in proposed regulations in order to better allow for the public to provide clear and informed comments on such regulations.</text></paragraph></section> 
<section id="H2073DEDD48644BC282DA92E784797D22"><enum>10.</enum><header>Office of Public Engagement</header> 
<subsection id="H9020EA50D1E34B1FB5B0BEA334869D26"><enum>(a)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary of Transportation shall rename the Community Liaison Services within the Office of Pipeline Safety of the Pipeline and Hazardous Materials Safety Administration as the Office of Public Engagement (hereinafter in this section referred to as the <quote>Office</quote>).</text></subsection> <subsection id="HC147A34DDA474CB3A4B939547C098ABD"><enum>(b)</enum><header>Duties</header><text>The duties of the Office are to—</text> 
<paragraph id="HBDA4B7B8C2ED4575BF1F3F12CEC4A710"><enum>(1)</enum><text>proactively engage with pipeline stakeholders, including the public, pipeline operators, public safety organizations, and government officials, to raise awareness of pipeline safety practices; </text></paragraph> <paragraph id="H955D440303244089A510C4E4A57C6DA1"><enum>(2)</enum><text>promote the adoption and increased use of safety programs and activities;</text></paragraph> 
<paragraph id="HC31858BE879C4F9F9EA31214A8CE0BB7"><enum>(3)</enum><text>inform the public of pipeline safety regulations and best practices; and</text></paragraph> <paragraph id="H5BF2965B4DD248ECA8D9B7675D1F0F39"><enum>(4)</enum><text>assist the public with inquiries regarding pipeline safety.</text></paragraph></subsection> 
<subsection id="HA782C28990B24E0FBD9DC816DF93D77A"><enum>(c)</enum><header>Public access</header><text>The Office shall ensure that activities carried out by the Office and information products developed by the Office are accessible to the public.</text></subsection> <subsection id="H6E553AC233394791A7FCABC2FBDC7537"><enum>(d)</enum><header>Community liaisons</header><text>The Office shall incorporate positions known as <quote>community liaisons</quote> under the Community Liaison Services.</text></subsection> 
<subsection id="H9C27478CCDCA4CAC84B19A810879B94F"><enum>(e)</enum><header>Report</header><text>Not later than 18 months after the date of enactment of this Act, the Secretary shall submit to Congress a report on the implementation of this section.</text></subsection></section> <section id="HC357168BFC9F4ECE90B77A0776F3DE47" section-type="subsequent-section"><enum>11.</enum><header>Class location changes</header><text display-inline="no-display-inline">Not later than 90 days after the date of enactment of this Act, the Secretary of Transportation shall prescribe a final rule amending the safety standards for class location changes in parts 191 and 192 of title 49, Code of Federal Regulations, based on the notice of proposed rulemaking published by the Pipeline and Hazardous Materials Safety Administration on October 14, 2020, titled <quote>Pipeline Safety: Class Location Change Requirements</quote> (85 Fed. Reg. 65142), including consideration of all documents in Docket No. PHMSA–2017–0151.</text></section> 
<section id="HB553EEDC937C4F13A7802EF417585945" section-type="subsequent-section"><enum>12.</enum><header>Pipeline operating status</header><text display-inline="no-display-inline">Section 60143(b) of title 49, United States Code, is amended—</text> <paragraph id="H88949F2E7A234C058E8FAAF413AEF05C"><enum>(1)</enum><text display-inline="yes-display-inline">by striking paragraph (1) and inserting the following:</text> 
<quoted-block style="OLC" display-inline="no-display-inline" id="HCEC6463BC98848F69F62ADD41163C47F"> 
<paragraph id="HABCB8F714ABD4BD2A317266B5A611EA7"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of the <short-title>PIPES Act of 2023</short-title>, the Secretary shall issue a notice of proposed rulemaking prescribing the applicability of the pipeline safety requirements to idled natural gas or other gas transmission and hazardous liquid pipelines.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> <paragraph id="HF7CFD7C5CB294B29BA40AE50D3F7C610"><enum>(2)</enum><text>in paragraph (2) by adding at the end the following:</text> 
<quoted-block style="OLC" display-inline="no-display-inline" id="H8789AC1309CE4A9D92AE784A0A0F0DDF"> 
<subparagraph id="HBAB84D0B8E7C4C46B305E969D66A405C"><enum>(E)</enum><header>Consideration</header><text display-inline="yes-display-inline">In promulgating regulations under this section, the Secretary shall consider the adoption of industry consensus standards.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> <section id="HF093DF19B14141D59DD84CB6563F07F9" section-type="subsequent-section"><enum>13.</enum><header>Rights-of-way management</header><text display-inline="no-display-inline">Section 60108(a) of title 49, United States Code, is amended by adding at the end the following: </text> 
<quoted-block style="USC" display-inline="no-display-inline" id="H306D47CB46624BA98911912116154A19"> 
<paragraph id="H6340537BC0164CA18A4B0C654E94E2C8" indent="up1"><enum>(4)</enum><header>Alternative method of maintaining rights-of-way</header> 
<subparagraph id="H58D587A4B6A540FB87746FD182F0F214"><enum>(A)</enum><header>In general</header><text>As part of the review conducted under paragraph (3), the Secretary shall allow for an alternative method of maintaining rights-of-way for pipelines and other pipeline facilities under a voluntary program carried out by the operator if such alternative method achieves a level of safety at least equal to the level of safety required by regulations issued under this chapter.</text></subparagraph> <subparagraph id="H14A7DC81FF0549B0956F4E03F013588D"><enum>(B)</enum><header>Purpose</header><text>An operator considering implementing an alternative method described under subparagraph (A) may consider incorporating into the plan for implementing such method 1 or more conservation practices, including—</text> 
<clause id="H20F94E720BFC417D94C5A90007EB43DE"><enum>(i)</enum><text>integrated vegetation management practices, including reduced mowing;</text></clause> <clause id="HB5646B841BEF4247A52C3F6BF17447B9"><enum>(ii)</enum><text>the development of habitat and forage for pollinators and other wildlife through seeding or planting of diverse native forbs and grasses;</text></clause> 
<clause id="H5A847A6A99CD487C8D79096490EF30CA"><enum>(iii)</enum><text>practices relating to maintenance strategies that promote early successional vegetation or limit disturbance during periods of highest use by target pollinator species and other wildlife on pipeline or facilities rights-of-way, including—</text> <subclause id="H6C107646BD78402D813AC93455EC052B"><enum>(I)</enum><text>increasing mowing height;</text></subclause> 
<subclause id="HA4AD9D639EF8494D9554C742580E5E02"><enum>(II)</enum><text>reducing mowing frequency; and</text></subclause> <subclause id="HD0E19CE4DB0A433EBB9F2D1E91D0010F"><enum>(III)</enum><text>refraining from mowing monarch and other pollinator habitat during periods in which monarchs or other pollinators are present;</text></subclause></clause> 
<clause id="H6A28C3F15CFC45119E9D9F6601893C5B"><enum>(iv)</enum><text>an integrated vegetation management plan that may include approaches such as mechanical tree and brush removal and targeted and judicious use of herbicides and mowing to address incompatible or undesirable vegetation while promoting compatible and beneficial vegetation on pipeline and facilities rights-of-way;</text></clause> <clause id="H9A7403544D474BB4ADCAF6C5495FDB14"><enum>(v)</enum><text>planting or seeding of deeply rooted, regionally appropriate perennial grasses and wildflowers, including milkweed, to enhance habitat; </text></clause> 
<clause id="H5B3854BD7FA1438E81245861C5296C5B"><enum>(vi)</enum><text>removing shallow-rooted grasses from planting and seeding mixes, except for use as nurse or cover crops; or</text></clause> <clause id="HC44D50CB69E54C6194D3E17BA284F00A"><enum>(vii)</enum><text>obtaining expert training or assistance on wildlife and pollinator-friendly practices, including—</text> 
<subclause id="H44D6CB9826AA4EEC8798A966A5075185"><enum>(I)</enum><text>native plant identification;</text></subclause> <subclause id="H3D76C83C3AEB4DA38182EE60ACA0C89C"><enum>(II)</enum><text>establishment and management of regionally appropriate native plants;</text></subclause> 
<subclause id="H23F558E9B545487E91979B985829A402"><enum>(III)</enum><text>land management practices; and</text></subclause> <subclause id="H52CF6D4FF9724112B644E73E1155BFE5"><enum>(IV)</enum><text>integrated vegetation management.</text></subclause></clause></subparagraph> 
<subparagraph id="H321DBED13A664102ADC828EBE8013965"><enum>(C)</enum><header>Savings clause</header><text display-inline="yes-display-inline">Nothing in this section exempts an operator from compliance with the applicable requirements under this chapter or any applicable regulations promulgated under this chapter.</text></subparagraph> <subparagraph id="HEDD51360054D4025BC2CC3BDFBF4ED88"><enum>(D)</enum><header>Consultation</header> <clause id="H55F5C0984795414BACA5739607DC1478"><enum>(i)</enum><header>Available guidance</header><text display-inline="yes-display-inline">In developing such alternative methods, an operator shall consult any available guidance issued by—</text> 
<subclause id="H9D8F55A2254D41239B8BEA0333C3F405"><enum>(I)</enum><text>the Secretary; or</text></subclause> <subclause id="H52C09DE077E8497ABF317ED16E473FA6"><enum>(II)</enum><text>an applicable State agency carrying out compliance activities on behalf of the Secretary in accordance with section 60105.</text></subclause></clause> 
<clause id="H94CAFB5030F448CA98887F75DD6DAF43"><enum>(ii)</enum><header>Leading industry practices</header><text>In the absence of the guidance described in clause (i), an operator may consult leading industry practices and guidance to develop and implement such alternative methods.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section> <section id="H99B092E4B7694E2E932E8C13EC7B5019" section-type="subsequent-section"><enum>14.</enum><header>Study on composite materials for pipelines</header> <subsection id="H6FE0199A57464137BD5A7E90CB62E2B8"><enum>(a)</enum><header>Study on use of composite materials</header><text display-inline="yes-display-inline">Not later than 18 months after the date of enactment of this Act, the Secretary of Transportation shall complete a study assessing the potential and existing use of pipelines constructed with composite materials to safely transport hydrogen and hydrogen blended with natural gas. </text></subsection> 
<subsection id="H25CEDAE77A024505A3AF8209EC81AC36"><enum>(b)</enum><header>Study considerations</header><text>In completing the study under subsection (a), the Secretary shall consider—</text> <paragraph id="HAACEAB17F6E144D7975101375656EAF7"><enum>(1)</enum><text>any commercially available composite pipeline materials;</text></paragraph> 
<paragraph id="H5FA40E022D174ECAB2C28F54ADD32280"><enum>(2)</enum><text>any completed or ongoing tests and data regarding composite pipeline materials available to the Secretary or other Federal agencies; and</text></paragraph> <paragraph id="HDDE014E5178B4139A130E81F4F52273D"><enum>(3)</enum><text>any recommended standards, including consensus standards, and Federal agency authorizations relating to use of composite pipeline materials. </text></paragraph></subsection> 
<subsection id="H63CEC0F90C3A40AF987BEC635C36E53B" display-inline="no-display-inline"><enum>(c)</enum><header>Public participation</header><text>To ensure adequate public participation in completing the study under subsection (a), the Secretary shall—</text> <paragraph id="HE42C99177E9D4DC69FD2C4DC830BD3E9"><enum>(1)</enum><text>hold a public meeting with interested stakeholders, including the affected industries, interest groups, and other individuals with relevant expertise; </text></paragraph> 
<paragraph id="HB112B17F1811486FB285DB8F505EC023"><enum>(2)</enum><text>release a draft version of the study for public comment for a period of not less than 60 days; and</text></paragraph> <paragraph id="HE76BB1C958954D8782613EA523B123B5"><enum>(3)</enum><text>address any substantive comments submitted by the public during the public comment period under paragraph (2) in preparing the final study.</text></paragraph></subsection> 
<subsection id="H8010D99DC4C747A6A2D79BDD96CCE759"><enum>(d)</enum><header>Public meeting</header><text>Not later than 60 days after the closing of the public comment period under subsection (c)(2), the Secretary shall hold a public meeting to present the findings of the study under this section and any responses to public comments received under such subsection. </text></subsection> <subsection id="HC6FB5DD1F73E460192951CE12126D5A6"><enum>(e)</enum><header>Rulemaking</header><text display-inline="yes-display-inline">Not later than 18 months after the meeting described in subsection (d), the Secretary shall issue a rulemaking that includes a Notice of Proposed Rulemaking to allow for the use of composite materials for pipeline transportation of hydrogen and hydrogen blended with natural gas.</text></subsection></section> 
<section id="H7E9CFA730A534E0D95DEAAF7B0D3F67B"><enum>15.</enum><header>Competitive Academic Agreement Program</header> 
<subsection id="H336F066CA7144E488AC07AD7FA148045"><enum>(a)</enum><header>Federal share</header> 
<paragraph id="H77FEE474B04D477B863E0EB7A83ACA05"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">In carrying out the Competitive Academic Agreement Program pursuant to section 60117(l) of title 49, United States Code, the Secretary of Transportation may allow for a 100-percent Federal share of financial assistance for a project carried out by small and mid-sized institutions.</text></paragraph> <paragraph id="HD88158D24BCB4ED0AB2A47F53D6B3F03"><enum>(2)</enum><header>Written request required</header><text>The Secretary may only allow the use of a 100-percent Federal share under paragraph (1) if the applicable institution has provided a written request to the Secretary prior to the award of Federal assistance under such Program.</text></paragraph> 
<paragraph id="HCB056B4A427E41A2A24069B4D9C2C108"><enum>(3)</enum><header>Small and mid-sized institutions defined</header><text>In this subsection, the term <term>small and mid-sized institutions</term> means academic institutions eligible for a grant under the Competitive Academic Agreement Program with a current total enrollment of 17,500 students or less, including graduate and undergraduate as well as full- and part-time students.</text></paragraph></subsection> <subsection id="H43E19B02CDB8482588F89B0B0A519B71"><enum>(b)</enum><header>Report</header><text>Following any award of grants under the Competitive Academic Agreement Program, the Secretary shall provide to Congress a written report detailing—</text> 
<paragraph id="H46449410AEFD4CC287EC7849F3CAD5C6"><enum>(1)</enum><text>the recipients of such grants; and</text></paragraph> <paragraph id="H16169D693DEC4253A27BA64FA20305F0"><enum>(2)</enum><text>any grantees that were provided a 100-percent Federal share under this section.</text></paragraph></subsection></section> 
<section id="H88F52C95645D4189A9449DBA7A667208" section-type="subsequent-section"><enum>16.</enum><header>Geohazard mitigation study</header> 
<subsection id="HFD2A6A81B2EE456FA987F4287CFC2E9E"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Comptroller General of the United States shall prepare a report containing—</text> <paragraph id="H599FBD1463FF4B128B984511B404A92C"><enum>(1)</enum><text>the results of a study that—</text> 
<subparagraph id="HC6486B42C2A1452480C02A18CA735CD1"><enum>(A)</enum><text>evaluates Federal and State, as applicable, requirements for gas, hazardous liquid, and carbon dioxide pipeline facility design, siting, construction, operation and maintenance, and integrity management relating to geohazards, including seismicity, land subsidence, landslides, slope instability, frost heave, soil settlement, erosion, river scour, washouts, floods, unstable soil, water currents, hurricanes, dynamic geologic conditions, tsunamis, tornados, wildfires, floods, ice storms, or other hazards that may cause a pipeline to move or be affected by abnormal external loads;</text></subparagraph> <subparagraph id="HE73246F98CF043ECADC8739D7D73FC6E"><enum>(B)</enum><text>evaluates any industry consensus standards or best practices related to the requirements described in subparagraph (A);</text></subparagraph> 
<subparagraph id="HEC38B20C0AE14E90922766E4DA1C308F"><enum>(C)</enum><text>evaluates the implementation by operators of Federal and State regulations related to geohazards and application of recommendations included in the Advisory Bulletin of the Pipeline and Hazardous Materials Safety Administration titled <quote>Pipeline Safety: Potential for Damage to Pipeline Facilities Caused by Earth Movement and Other Geological Hazards</quote>, issued on May 2, 2019 (PHMSA–019–0087);</text></subparagraph> <subparagraph id="HDA07D82AE7BD42FEA5A8CB7EE30E4964"><enum>(D)</enum><text>identifies any discrepancies in the requirements described in subparagraph (A) and advisories, industry consensus standards, or best practices for operators of gas, hazardous liquid, and carbon dioxide pipeline facilities; and</text></subparagraph> 
<subparagraph id="H142A3E324C7F439092650E518631D1B8"><enum>(E)</enum><text>identifies any areas relating to geohazards not addressed under subparagraphs (A) through (D); and</text></subparagraph></paragraph> <paragraph id="HDCDE43B88EFB4B85926EB663C382D5DA"><enum>(2)</enum><text>any recommendations of the Government Accountability Office based on the results of the study under paragraph (1).</text></paragraph></subsection> 
<subsection id="H68942F1C56E2405BBDF88F328DE58DF2"><enum>(b)</enum><header>Report to Congress</header><text>Upon completion of the report under subsection (a), the Comptroller General shall submit to the Secretary of Transportation, the Committee on Transportation and Infrastructure and the Committee on Energy and Commerce of the House of Representatives, and the Committee on Commerce, Science, and Transportation of the Senate the report.</text></subsection></section> <section id="H52B07065139D48C2A8655B26A7CD473B"><enum>17.</enum><header>Special permit program</header> <subsection id="H217DCEA8978245C4B93B1A33E1B75D7C"><enum>(a)</enum><header>Compliance and waivers</header><text display-inline="yes-display-inline">Section 60118(c)(1) of title 49, United States Code, is amended by adding at the end the following:</text> 
<quoted-block style="OLC" id="HE85605A44FAA4C2585DFEC973F998FB0"> 
<subparagraph id="H4FDB213B3C3B4854AE64DA5CD9F3574F"><enum>(C)</enum><header>Limitation on terms</header><text>The Secretary shall impose no terms on a waiver under this paragraph that do not apply to known pipeline safety risks applicable to the standard being waived under subparagraph (A).</text></subparagraph> <subparagraph id="H8CCBA86AA3964D449071C85630A2AEE7"><enum>(D)</enum><header>Publication</header><text display-inline="yes-display-inline">Upon completion of the application requirements under section 190.341 of title 49, Code of Federal Regulations, or successor regulations, the Secretary shall publish notice of the application in the Federal Register.</text></subparagraph> 
<subparagraph id="H70511FDCB5354B168D5A84834717C8F3"><enum>(E)</enum><header>Review of application</header><text>The Secretary shall complete a review of each such application not later than 18 months after publishing a notice in the Federal Register described in subparagraph (D) with respect to the application.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="HD6D7BED5CE4E4AF5849572CCF4D364B3"><enum>(b)</enum><header>Report to Congress</header> <paragraph id="H328CC1F6FCEB46FB87755081AABBD7A3"><enum>(1)</enum><header>In general</header><text>Not later than 2 years after the date of enactment of this Act, the Secretary of Transportation shall submit to the Committee on Transportation and Infrastructure and Committee on Energy and Commerce of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a report on the implementation by the Administrator of the Pipeline and Hazardous Materials Safety Administration of the amendment made by subsection (a).</text></paragraph> 
<paragraph id="HF62186E6C60745BFBAE39F032528DF99"><enum>(2)</enum><header>Contents</header><text>The report required under paragraph (1) shall include—</text> <subparagraph id="H34D57A3F988B4977B3A760D536207714"><enum>(A)</enum><text>a listing of each special permit application applied for under section 60118(c)(1) of title 49, United States Code;</text></subparagraph> 
<subparagraph id="H6FBFE6307F074099ACFC7425FCAEE0B0"><enum>(B)</enum><text>a brief summary of the purpose of each such special permit;</text></subparagraph> <subparagraph id="HF29B08E3495E48B3A6F6583E18907E1B"><enum>(C)</enum><text>the date on which each such application was received;</text></subparagraph> 
<subparagraph id="HD7CFDF8815AA4C6C9C6A64457402096A"><enum>(D)</enum><text>the date on which each such application was completed or, in the absence of completion, the status of the application;</text></subparagraph> <subparagraph id="H9D94A6BDB04D4825B5FF6DB7FE9A5BF1"><enum>(E)</enum><text>the date on which the Secretary issued a determination on the application; and</text></subparagraph> 
<subparagraph id="H0BFCC3656D724B328B7B392271BEF498"><enum>(F)</enum><text display-inline="yes-display-inline">the explanation of the Secretary for any decision made outside the review period identified in section 60118(c)(1)(E) of title 49, United States Code, if applicable.</text></subparagraph></paragraph></subsection> <subsection id="HA58DC5989DC84C0BB216A527B8775BAD"><enum>(c)</enum><header>GAO Report</header><text>Not later than 1 year after the submission of the report under subsection (b), the Comptroller General of the United States shall submit to the Committee on Transportation and Infrastructure and the Committee on Energy and Commerce of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a report assessing the Secretary’s implementation of, and compliance with, subparagraphs (C) through (E) of section 60118(c)(1) of title 49, United States Code.</text></subsection></section> 
<section id="HE5639A4FA0AD4043AF0FDCF55C5C8CEA" section-type="subsequent-section"><enum>18.</enum><header>Excavation damage prevention</header> 
<subsection id="H292593E9DB604D0088BE0E952535CCCB"><enum>(a)</enum><header>Grants to States</header><text>Section 6106 of title 49, United States Code, is amended—</text> <paragraph id="H29A3A0A4EFE1477C8FDEDFC6AA2704E0"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (b) by inserting <quote>adoption or progress toward adoption of the leading practices listed in subsection (b) and</quote> before <quote>legislative and regulatory</quote>;</text></paragraph> 
<paragraph id="H5683924068EE4258835B1727DDA68437"><enum>(2)</enum><text>by redesignating subsections (b) and (c) as subsections (d) and (e), respectively; </text></paragraph> <paragraph id="HEF66B6C59DB948D1AC679D008437A373"><enum>(3)</enum><text>by inserting after subsection (a) the following: </text> 
<quoted-block style="USC" display-inline="no-display-inline" id="HA220F5C9BF88450E886A68E0369DEE1A"> 
<subsection id="H645E49D156384946888D0B888B4E8BF0"><enum>(b)</enum><header>Leading practices</header><text display-inline="yes-display-inline">A State one-call program shall implement leading practices that—</text> <paragraph id="H46609B1CDD7B4291ADAE1ECAAFABB5BD"><enum>(1)</enum><text>identify the size and scope of a one-call ticket for standard locate requests, including process exceptions for special large project tickets;</text></paragraph> 
<paragraph id="H04666CC8C3F74A1283EB8CF04D3B03AA"><enum>(2)</enum><text>restrict the longevity of a one-call ticket for standard locate requests, which may include process exceptions for special large project tickets;</text></paragraph> <paragraph id="H8F78A60346C64F3486477E29FAA07ABB" commented="no"><enum>(3)</enum><text>examine and limit exemptions to one-call programs to prevent common excavation damage incidents, including—</text> 
<subparagraph id="HF2AEA9A151AD4F26B351EBF217E5D8EF" commented="no"><enum>(A)</enum><text>excavation or demolition performed by the owner of a single-family residential property;</text></subparagraph> <subparagraph id="HFFC511FEA2B9447AB4DD2345A0A15583" commented="no"><enum>(B)</enum><text>any excavation of 18 inches or less when maintenance activities are performed;</text></subparagraph> 
<subparagraph id="H06A7DDBBE9894DDDAAA0D6B376216824" commented="no"><enum>(C)</enum><text>repairing, connecting, adjusting, or conducting routine maintenance of a private or public underground utility facility; and</text></subparagraph> <subparagraph id="H8E76C00CB7FD4E0F8F9B7378BB524AFE" commented="no"><enum>(D)</enum><text>municipalities, public works organizations, and State departments of transportation for road maintenance; </text></subparagraph></paragraph> 
<paragraph id="H7F140188E2194BB6AE1732BD0FC83956"><enum>(4)</enum><text>specify tolerance zone horizontal dimensions and requirements for hand-dig, hydro, vacuum excavation, and other nonintrusive methods;</text></paragraph> <paragraph id="HE7ECCBFECBCD4B6C8FEFF1F3B5CC9B53"><enum>(5)</enum><text>specify emergency excavation notification requirements, including defining emergency excavation and identifying the notification requirements for an emergency excavation; </text></paragraph> 
<paragraph id="H33F73FEF89734887B30513C0989B85A0"><enum>(6)</enum><text>specify the responsibilities of the excavator, including the reporting of damages due to excavation activities;</text></paragraph> <paragraph id="H776EEF0C16774EE2A94A6B04A842604B"><enum>(7)</enum><text>define who is an excavator and what is considered excavation;</text></paragraph> 
<paragraph id="H2C18D2E3972D4D6681C1E287DAFB1D47"><enum>(8)</enum><text display-inline="yes-display-inline">require the use of white lining or electronic white lining, allowing for exceptions for special large-project tickets;</text></paragraph> <paragraph id="H5E20276C1E4C44FDBC0BD11E5166966A" commented="no"><enum>(9)</enum><text>require a positive response, such as the utility, municipality, or other entity placing the marks positively responds to the notification center and the excavator checks for a positive response before beginning excavation;</text></paragraph> 
<paragraph id="HE6A6754EA5C7401FA54C8240A2187BF5"><enum>(10)</enum><text>require newly installed underground facilities to be locatable;</text></paragraph> <paragraph id="HE1DAF8E6940E4FFE96F7E555739FA2F7"><enum>(11)</enum><text>require the marking of lines and laterals, including sewer lines and laterals;</text></paragraph> 
<paragraph id="HEC2903809F4F4746820F67BACAC31269"><enum>(12)</enum><text>require training programs and requirements for third-party excavators performing excavation activities that are not subject to pipeline construction requirements under part 192 or part 195 of title 49, Code of Federal Regulations; </text></paragraph> <paragraph id="H726DD31932FE48CA9B961D5BE522D098"><enum>(13)</enum><text>require training for locate professionals; and </text></paragraph> 
<paragraph id="H808A79A17BDC49F1A3C90DF35F35B4CF"><enum>(14)</enum><text>require the use of commercially available technologies to locate underground facilities, such as geographic information systems and enhanced positive response.</text></paragraph></subsection> <subsection id="HE9C788169C89424C816FB740F3189589"><enum>(c)</enum><header>Report to Congress</header> <paragraph id="H043A87630C004A39AA27E7770AD9A6C2"><enum>(1)</enum><header>Initial report</header><text>Not later than 3 years after the implementation of subsection (b), the Secretary shall submit to the Committee on Transportation and Infrastructure and the Committee on Energy and Commerce of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a report detailing—</text> 
<subparagraph id="H977D7708E5FE4978A355C20680F612E4"><enum>(A)</enum><text>the implementation of the leading practices described in such subsection;</text></subparagraph> <subparagraph id="H6D138E244D634D478A56042B5C08F646"><enum>(B)</enum><text>recommendations to increase the adoption of such leading practices and recommendations for the reduction of excavation damage incidents; and</text></subparagraph> 
<subparagraph id="H0A198444CC39418FA053CD1901BBD6BC"><enum>(C)</enum><text>the number of underground facility damages per 1,000 one-call tickets in each State for the reporting year.</text></subparagraph></paragraph> <paragraph id="HB726264B555840169F85B12EF4DBE112"><enum>(2)</enum><header>Additional reports</header><text>Not later than once every 2 years after the submittal of the report under paragraph (1), the Secretary shall submit to the Committee on Transportation and Infrastructure and the Committee on Energy and Commerce of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a report detailing—</text> 
<subparagraph id="HE7F6C833A972417AB42F7A7F9F49F697"><enum>(A)</enum><text>the implementation of the leading practices described in subsection (b);</text></subparagraph> <subparagraph id="H02D8D9C012E04B65B9DF9F0C9EE8FA52"><enum>(B)</enum><text>recommendations to increase the adoption of such leading practices and recommendations for the reduction of excavation damage incidents; and</text></subparagraph> 
<subparagraph id="HAA76990A8FD74E4DB0092FB9802C39A7"><enum>(C)</enum><text>the number of underground facility damages per 1,000 one-call tickets in each state for each year covered by the report.</text></subparagraph></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> <paragraph id="H0D6C2D9B83DB47269D96A938D0CFDCFC"><enum>(4)</enum><text display-inline="yes-display-inline">by adding at the end the following: </text>

<subsection id="HB9B864D2BD5C401DA066E6575D29F521"><enum>(f)</enum><header>Savings Clause</header><text>Nothing in this section shall make a grant award to a State by the Secretary pursuant to section 60107 or section 60134 for a State program certified under section 60105 or section 60106 contingent on compliance by the State with all leading practices described in subsection (b).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="H2C3DC93B73EF40A583F69975AA552A47"><enum>(b)</enum><header>State damage prevention programs</header><text display-inline="yes-display-inline">Section 60134(c) of title 49, United States Code, is amended—</text> 
<paragraph id="HB755E8DB447B4E149E2E4CCD76BB7F97"><enum>(1)</enum><text>by striking <quote>In making grants</quote> and inserting the following: </text> <quoted-block style="USC" display-inline="no-display-inline" id="H36131CFB8F174B37BBF009A9A4AEDEA2"> <paragraph id="HC7285A3B230146DC9379D463B8A683AD"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">In making grants</text></paragraph><after-quoted-block>; and </after-quoted-block></quoted-block></paragraph> 
<paragraph id="H9D5F507FBEBD41008015623D012DF800"><enum>(2)</enum><text>by adding at the end the following: </text> <quoted-block style="USC" display-inline="no-display-inline" id="H8330CB7FF3A0423AAADD0B1964097569"> <paragraph id="H8BD9735AA1F84E0FA9FBE8F994909570"><enum>(2)</enum><header>Considerations</header><text display-inline="yes-display-inline">In evaluating criteria for determining the effectiveness of the damage prevention program of a State, the Secretary shall consider whether the State has, at a minimum—</text> 
<subparagraph id="HDB12AD21949F4B5597DDF92415F1AE55"><enum>(A)</enum><text display-inline="yes-display-inline">effective, active, and consistent enforcement of State one-call laws (including consistency in the application of enforcement resources, fines, and penalties to all relevant stakeholders, such as operators, locators, and excavators);</text></subparagraph> <subparagraph id="H43A06288AA4345C3ADDFE61C443CDF2E" display-inline="no-display-inline"><enum>(B)</enum><text>data reporting requirements such as those—</text> 
<clause id="H8EBC9F925B574FB4A9F82BE224E61A99"><enum>(i)</enum><text display-inline="yes-display-inline">to the local one-call center for excavation damage events on pipelines and other underground facilities, that are not privately owned, including (if available at the time of reporting)—</text> <subclause id="HE57B00A04C3B43C58ECFE61B0169E08B"><enum>(I)</enum><text>information about the nature of the incident, including the facility damaged and the apparent cause of such damage (with supporting documentation); </text></subclause> 
<subclause id="HBBE23CF034754722840286B2630EDDAF"><enum>(II)</enum><text>the organizations or entities involved; </text></subclause> <subclause id="H6974E970F74C43709D4615BFC8C55029"><enum>(III)</enum><text>the impact to public safety, utility operations, and customer service; and </text></subclause> 
<subclause id="HA413C07F8BF74856AD9A180C9C2553B4"><enum>(IV)</enum><text>the impact to the environment; and</text></subclause></clause> <clause id="H9F6636AB33F44DFEB1B60E83832EF7A2"><enum>(ii)</enum><text>to a nationally focused nonprofit organization specifically established for the purpose of reducing construction-related damages to underground facilities, of damages and near-miss events to underground facilities from excavation damages, including potential contributing factors, facility damaged, type of excavator, work performed, equipment type, and State; </text></clause></subparagraph> 
<subparagraph id="H081B24D8DAC94B31AB2BA5EEC6B2695C"><enum>(C)</enum><text>data reporting requirements, to a nonprofit organization specifically established for the purpose of reducing construction-related damage to underground facilities, of damage and near-miss events to underground facilities from excavation damage, including root cause, facility damaged, type of excavator, work performed, equipment type, and State; and</text></subparagraph> <subparagraph id="HD20CB48DA107448AAFDC932F369F490A"><enum>(D)</enum><text>performance measures to determine the effectiveness of excavation damage prevention efforts.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section> 
<section id="H5A8B5B48CBA042428778A00241110AF1"><enum>19.</enum><header>Integrity management study</header> 
<subsection id="HDFE1C8F40A6D4A3A8323E6267250C414"><enum>(a)</enum><header>In general</header><text>Not later than 45 days after the date of enactment of this Act, the Secretary of Transportation shall enter into an agreement with the National Academies under which the National Academies shall conduct a study of the effectiveness of integrity management regulations applicable to natural gas and hazardous liquid pipeline facilities.</text></subsection> <subsection id="HE1FE08CDD5A646D888BEBAC407A85080"><enum>(b)</enum><header>Data sources</header><text display-inline="yes-display-inline">In carrying out the study under subsection (a), the National Academies shall—</text> 
<paragraph id="H4B517092C6244FE2AB03007BD1D3F208"><enum>(1)</enum><text>use publicly available data from the Pipeline and Hazardous Materials Safety Administration, State pipeline regulatory agencies, and other public sources; and</text></paragraph> <paragraph id="H79FA1BB156DA464EB081408CD30396AC"><enum>(2)</enum><text>consult with pipeline stakeholders in the development of findings under the study, including State and Federal regulators, pipeline operators, public safety organizations, and environmental organizations.</text></paragraph></subsection> 
<subsection id="H833F91502F694CDE91802E7FDDDE975A"><enum>(c)</enum><header>Elements</header><text>The study described under subsection (a) shall include—</text> <paragraph id="H325764B52547426DAD59E261B15B6FDA"><enum>(1)</enum><text>a review of previous assessments of integrity management program implementation produced by or for the Secretary or the National Transportation Safety Board;</text></paragraph> 
<paragraph id="HEAEF8CFB8C38438CA6CA1C7DBE1A8C65"><enum>(2)</enum><text display-inline="yes-display-inline">a review of the implementation and enforcement by the Secretary of integrity management regulations and any modifications of the regulations issued by the Secretary pursuant to section 60109 of title 49, United States Code;</text></paragraph> <paragraph id="HA57A42D8C8A84B0AA79ECB1FFD23CAD6"><enum>(3)</enum><text>a trend analysis and assessment of pipeline safety incidents, accidents, and repairs for high consequence and non-high consequence areas, including comparing—</text> 
<subparagraph id="H960F6DA3B9BA49A489981DEC6D04D0E7"><enum>(A)</enum><text>the frequency of such incidents, accidents, and repairs before and after the implementation of the Federal integrity management requirements described in subsection (a); and</text></subparagraph> <subparagraph id="H09708A68BC5B4E4A9B9A116465CF3E0C"><enum>(B)</enum><text>the frequency of such incidents, accidents, and repairs during the period of time such integrity management requirements have been in effect;</text></subparagraph></paragraph> 
<paragraph id="H92D708804DCF493096A7A27EB76E5B3F"><enum>(4)</enum><text>development of metrics to gauge the effectiveness of the implementation and enforcement of such integrity management regulations;</text></paragraph> <paragraph id="H53404BCB3F234487B66F143C26F6F8BF"><enum>(5)</enum><text>an assessment of how integrity management informs operator activities, including planning and completion of repairs, and whether the implementation of integrity management regulations by operators of pipeline facilities has had a demonstrable effect on improving gas and hazardous liquid pipeline safety; and</text></paragraph> 
<paragraph id="H534B5F65D7864B39999E0A78E02F44D5"><enum>(6)</enum><text>identification of areas where pipeline safety has improved and where it has not improved due to integrity management.</text></paragraph></subsection> <subsection id="H40B45685020241EDB8F04E4FF53E592F"><enum>(d)</enum><header>Report to Congress</header><text>The Secretary shall—</text> 
<paragraph id="HF6415AECAF3B42B6BED8ECA7A24BAF47"><enum>(1)</enum><text display-inline="yes-display-inline">require the National Academies to submit to the Secretary a report on the results of the study under subsection (a); and</text></paragraph> <paragraph id="H0BCC6F872D3D482ABF48B97936019F7E"><enum>(2)</enum><text>not later than 2 years after the date of enactment of this Act, submit to the Committee on Transportation and Infrastructure and the Committee on Energy and Commerce of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate such report.</text></paragraph></subsection></section> 
<section id="H9D9D1C8E2C2B4067973A25775F0A4C75" section-type="subsequent-section"><enum>20.</enum><header>Hydrogen study</header> 
<subsection id="HB219D0B9CEB14A4F8B9382EAF3F4379E"><enum>(a)</enum><header>In general</header><text>The Comptroller General of the United States shall conduct a study on existing natural gas pipeline systems that, as a result of hydrogen-natural gas blending, contain a percentage of hydrogen that is greater than 5 percent by volume to identify the changes that operators have implemented, including—</text> <paragraph id="H54793AE0F6D74EEC89BC32FA3A257A5C"><enum>(1)</enum><text>modifications or alternatives to—</text> 
<subparagraph id="H517531770D884BDE929E5BA966B91663"><enum>(A)</enum><text>odorants and leak-detection methods;</text></subparagraph> <subparagraph id="HCC2C0A9BD8754FC5BDC0064521468C4F"><enum>(B)</enum><text>pipeline materials; and </text></subparagraph> 
<subparagraph id="H816F5855489042DCB9712F78A5B4E806"><enum>(C)</enum><text>operational standards; and</text></subparagraph></paragraph> <paragraph id="H0A700040E84D4BC59DFC2AC8680EACBD"><enum>(2)</enum><text>modifications to pipeline infrastructure.</text></paragraph></subsection> 
<subsection id="H08703810B2D24D6CAC9961FED7DF21B6"><enum>(b)</enum><header>Additional contents</header><text>The study under subsection (a) shall include—</text> <paragraph id="HA51617137ECF44B580247682BA4D8DA0"><enum>(1)</enum><text>an identification of any technical challenges with repurposing existing natural gas infrastructure to allow such infrastructure to be used for hydrogen-natural gas blended service; and</text></paragraph> 
<paragraph id="HB7E0920A37B44CF4AAB762DF394347DD"><enum>(2)</enum><text display-inline="yes-display-inline">an examination of hydrogen-natural gas blended pipeline systems currently operating, including in the United States, the United Kingdom, Canada, Europe, Australia, and Hong Kong.</text></paragraph></subsection> <subsection id="H3CDEE036D36D40628B793F133DF2F330"><enum>(c)</enum><header>Considerations</header><text>In conducting the study under subsection (a), the Comptroller General shall consider—</text> 
<paragraph id="HB0F00D01C1B940418D2F0EB785192C05"><enum>(1)</enum><text>any changes that domestic and international operators of natural gas pipeline systems have implemented to the processes, pipeline materials, metering, and operational standards used by such operators to account for the operation and integrity of natural gas pipeline systems that use a hydrogen content at variable percentages above 5 percent by volume; and</text></paragraph> <paragraph id="H74B58DB149C84E0E9F5B748BC31DD965"><enum>(2)</enum><text>how such operators have taken into account the effects of hydrogen-natural gas blending on different types of—</text> 
<subparagraph id="H72158FAE6AB24F0A95FF11385728E64D"><enum>(A)</enum><text>natural gas pipeline systems materials, including cast iron, steel, composite pipe, and plastic pipe; and</text></subparagraph> <subparagraph id="H1843A987034040678C512456CEB5DCDB"><enum>(B)</enum><text>components of such systems, including valves and meters.</text></subparagraph></paragraph></subsection> 
<subsection id="HE09FB2EC8CC741739A139EA923F16DAB"><enum>(d)</enum><header>Report</header><text>Not later than 1 year after the date of enactment of this Act, the Comptroller General shall submit to the Committee on Transportation and Infrastructure and the Committee on Energy and Commerce of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a report on the results of the study conducted under subsection (a).</text></subsection> <subsection id="HCBF707F8D7E54C04834FC54BE8012CF9"><enum>(e)</enum><header>Rulemaking</header><text display-inline="yes-display-inline">The results of the study under subsection (a) should inform the rulemaking efforts of the Secretary relating to hydrogen-natural gas blending. The Secretary may determine that rulemaking efforts related to hydrogen should be advanced before completion of the study under subsection (a).</text></subsection> 
<subsection id="H3D5981D5AC884205A479E44B1B9102CB" commented="no"><enum>(f)</enum><header>Statutory construction</header><text display-inline="yes-display-inline">Nothing in this section shall be construed to prohibit or otherwise limit the authority of the Secretary to issue regulations relating to hydrogen prior to the submission of the report under subsection (d). </text></subsection></section> <section id="H12D8D82CA4BC4F27B566EBBC48BC2554" section-type="subsequent-section"><enum>21.</enum><header>Penalty for causing a defect in or disrupting operation of pipeline infrastructure</header><text display-inline="no-display-inline">Section 60123 of title 49, United States Code, is amended by adding at the end the following:</text> 
<quoted-block style="USC" display-inline="no-display-inline" id="H74FB3F17138B42648F9DF8E86856E57F"> 
<subsection id="H7ED70471A24044499452283445ED9B4C"><enum>(e)</enum><header>Penalty for causing a defect in or disrupting operation of pipeline infrastructure</header> 
<paragraph id="HB11BDB1E733744D496D81B77AB2D623E"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">A person shall be fined under title 18, imprisoned for not more than 10 years, or both, if the person knowingly and willfully—</text> <subparagraph id="H5753AE2D197743A29F9368B8DA1702E5"><enum>(A)</enum><text display-inline="yes-display-inline">causes a defect in a pipe, pump, compressor, or valve in the possession of a pipeline operator to be used in construction of any pipeline facility described in subsection (b) that would affect the integrity or safe operation of any such facility; or</text></subparagraph> 
<subparagraph id="H89E701F0C757441FBF19BD7FBC01954D"><enum>(B)</enum><text display-inline="yes-display-inline">disrupts the operation of any pipeline facility described in subsection (b) by causing or undertaking the unauthorized or unplanned turning or manipulation of a valve.</text></subparagraph></paragraph> <paragraph id="H9A6B23BF3A96442495937C29DDB36940"><enum>(2)</enum><header>Definition</header><text>In this subsection, the term <term>in the possession of a pipeline operator</term> means, with respect to a pipe, pump, compressor, or valve, that such pipe, pump, compressor, or valve is—</text> 
<subparagraph id="H4B3B0BAC3109461DB304FD66A8DBD69F"><enum>(A)</enum><text>in transit to a pipeline component staging site or construction site;</text></subparagraph> <subparagraph id="H6D4A548B189048CE854028AF3754E1B1"><enum>(B)</enum><text>at a pipeline component staging site; or</text></subparagraph> 
<subparagraph id="H58008D4E40A14CF886CBB7CBF89CD311"><enum>(C)</enum><text>at a construction site.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> <section id="H334EB88FBA8A4E7DA4DA7B21FC2F308B" section-type="subsequent-section"><enum>22.</enum><header>Civil penalties</header><text display-inline="no-display-inline">Section 60122(a)(1) of title 49, United States Code, is amended by striking <quote>$2,000,000</quote> and inserting <quote>$2,500,000</quote>.</text></section> 
<section id="HC021E21CBDC440BFA5D9B655116D0E3C" section-type="subsequent-section"><enum>23.</enum><header>Liquefied natural gas regulatory coordination</header> 
<subsection id="H6F5C55CD50DB4FF896C1147ECE8CAD8E"><enum>(a)</enum><header>Establishment and purpose</header><text display-inline="yes-display-inline">The Secretary of Transportation shall establish and convene a Liquefied Natural Gas Regulatory Safety Working Group (in this section referred to as the <quote>Working Group</quote>) through the National Center of Excellence for Liquefied Natural Gas Safety to clarify the authority of Federal agencies in the authorizing and oversight of LNG facilities, other than peak shaving facilities, and improve coordination of the authority of such agencies. </text></subsection> <subsection id="H838A37215F4D4552A661117AE4CD15EE"><enum>(b)</enum><header>Membership</header> <paragraph id="H11E99C4839994054899750F2EF4A00E6"><enum>(1)</enum><header>In general</header><text>The Working Group shall consist of certain representatives of the Federal government, as such term is defined in clauses (i) through (v) of section 111(a)(3)(F) of the PIPES Act of 2020 (<external-xref legal-doc="public-law" parsable-cite="pl/116/260">Public Law 116–260</external-xref>), as designated by the Secretary of Transportation or appropriate Federal agency leadership.</text></paragraph> 
<paragraph id="HD2973FE5556A4D75B814DDE65D28ACE1"><enum>(2)</enum><header>Chair</header><text>The Administrator of the Pipeline and Hazardous Materials Safety Administration or a designee of the Administrator shall serve as chair of the Working Group, unless an alternate member of the working group is selected by unanimous consent of the Working Group. </text></paragraph> <paragraph id="H61753E72CBA143668E323748CC3AF27C"><enum>(3)</enum><header>Responsibilities of chair</header><text display-inline="yes-display-inline">The Chair of the Working Group shall establish an agenda and schedule for the Working Group to accomplish the objectives described in subsection (c). </text></paragraph></subsection> 
<subsection id="HED5B3F3D05C245F8908ED7092C8D1DEA"><enum>(c)</enum><header>Evaluation</header> 
<paragraph id="H0ED42D9851154C59ABA2AF4ADB52C771"><enum>(1)</enum><header>In general</header><text>The Working Group shall evaluate individual Federal agency authorities pertaining to the siting and design, construction, operation and maintenance, and operational and process safety regulations of LNG facilities.</text></paragraph> <paragraph id="H9073D06CF2994D22844FB2F37561F8B6"><enum>(2)</enum><header>Negotiation</header><text>The Working Group shall negotiate Federal agency agreements pursuant to subsection (d) to establish procedures for—</text> 
<subparagraph id="H85F1F53B776148C4AA087BC07ADF6BE5"><enum>(A)</enum><text>the application of the respective authorities of each Federal agency in ensuring safety in a manner to ensure effective regulation of LNG facilities in the public interest;</text></subparagraph> <subparagraph id="HC31C152AFFAB4C968DB8CAD6A4284566"><enum>(B)</enum><text>resolving conflicts concerning overlapping jurisdiction among the Federal agencies; and</text></subparagraph> 
<subparagraph id="H613A0897692C495B83CDBB7F1A770A1A"><enum>(C)</enum><text>avoiding, to the extent possible and if appropriate, conflicting or duplicative regulation, inspection protocols, and reporting obligations.</text></subparagraph></paragraph></subsection> <subsection id="HAC5E65C579954176A4A779B7D897868F"><enum>(d)</enum><header>Memorandum of understanding and interagency agreements</header><text>Not later than 2 years after the date of enactment of this Act, the agencies represented on the Working Group shall enter into interagency agreements or memorandums of understanding regarding best practices and individual agency safety oversight enforcement responsibilities regarding LNG facilities, other than peak shaving facilities.</text></subsection> 
<subsection id="H770B17A9A9434E02AC2F8C91F8B61AF6"><enum>(e)</enum><header>Report to Congress</header><text>Not later than 1 year after entering into interagency agency agreements or memorandum of understanding under subsection (d), the Secretary shall submit to the Committee on Transportation and Infrastructure and the Committee on Energy and Commerce of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a report on the memorandum of understanding or interagency agreements and how such memorandum or agreements have contributed to improved safety and enforcement oversight coordination of LNG facilities.</text></subsection> <subsection id="H71B4504249BC4ABF92C1731F826667CD" commented="no"><enum>(f)</enum><header>LNG defined</header><text>In this section, the term <term>LNG</term> means liquefied natural gas. </text></subsection></section> 
<section id="HB9CBCE12010C4184B655621050D13BC6" display-inline="no-display-inline" section-type="subsequent-section"><enum>24.</enum><header>Pipeline safety voluntary information-sharing system</header> 
<subsection id="HF3038A5EA6B64E60A19FF0D65C7B8792"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/601">Chapter 601</external-xref> of title 49, United States Code, is amended by adding at the end the following:</text> <quoted-block style="USC" id="HD2275A8FEFC84997BF1E7CACBBB12562"> <section id="H697BB0B8BF6A41B9895AB057940090B6"><enum>60144.</enum><header>Voluntary information-sharing system</header> <subsection id="HD0B92BEBDAB54A35B45726660967F514"><enum>(a)</enum><header>Establishment</header> <paragraph id="H7232ED18292B43C3A4CD0457122CC85C"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall establish a confidential voluntary information-sharing system (referred to in this section as <quote>VIS</quote>) to encourage the sharing of pipeline safety data and information in a non-punitive context in order to improve the safety of gas, carbon dioxide, and hazardous liquid gathering, transmission, and distribution pipelines and facilities, including storage facilities.</text></paragraph> 
<paragraph id="H457E513A8DCA4A159BC160FA7F3EEBD3"><enum>(2)</enum><header>Purpose</header><text>The purpose of the VIS is to establish a comprehensive, systematic, and integrated structure to gather, evaluate, and quantify critical pipeline safety data and information and to share recommended remediation measures and lessons learned across the pipeline industry in an effort to improve pipeline safety, including damage prevention efforts, while protecting participant confidentiality. </text></paragraph> <paragraph id="H693A85DF358B419FBD2BC483EDF8A551" commented="no"><enum>(3)</enum><header>Implementation and management</header><text display-inline="yes-display-inline">In establishing the VIS under this section, the Secretary shall implement and manage such VIS based on the Pipeline Safety Voluntary Information-Sharing System Recommendation Report prepared pursuant to section 10 of the Protecting Our Infrastructure of Pipelines and Enhancing Safety Act of 2016 (<external-xref legal-doc="usc" parsable-cite="usc/49/60108">49 U.S.C. 60108</external-xref> note).</text></paragraph> 
<paragraph id="HEA39F1C80A564983ACA42E31F23868A5"><enum>(4)</enum><header>Inapplicability of FACA</header><text>The VIS shall not be considered a Federal advisory committee and shall not be subject to the requirements of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/10">chapter 10</external-xref> of title 5.</text></paragraph></subsection> <subsection id="HD47ADA5F9A154AC79857D11146BE708D" commented="no"><enum>(b)</enum><header>Governance</header> <paragraph id="H4636745DFC674D57A2A1A1FE338DB153" commented="no"><enum>(1)</enum><header>In general</header><text>A Governing Board, a Program Manager, a Third-Party Information Manager, and Issue Analysis Teams shall govern the VIS. </text></paragraph> 
<paragraph id="H7C39B9809B5A4CBC99A8CA0EEE403E46" commented="no"><enum>(2)</enum><header>Governing board</header> 
<subparagraph id="HD19685AB855641D3AAC55CD90666E9C0" commented="no"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this section, the Administrator of the Pipeline and Hazardous Materials Safety Administration shall appoint a Governing Board after consulting with public and private pipeline safety stakeholders.</text></subparagraph> <subparagraph id="H5DB64C792F0640EAA56AACDDD4B72FF9" commented="no"><enum>(B)</enum><header>Composition of the board</header><text>The Governing Board shall be comprised of at least 9 members and shall represent a balanced cross-section of pipeline safety stakeholders with pipeline safety knowledge or experience as follows: </text> 
<clause id="HE957005D900A4104B43C4C3BA75A83E8" commented="no"><enum>(i)</enum><text>At least 3 individuals shall be selected from departments, agencies, instrumentalities of the Federal Government, Territories, State governments, or local governments, 1 of which shall be the Administrator. </text></clause> <clause id="H6F1B5411944F443B8637C5A48905A262" commented="no"><enum>(ii)</enum><text>At least 3 individuals shall be selected from the gas, carbon dioxide, or hazardous liquid industries, such as operators, trade associations, inspection technology, coating, and cathodic protection vendors, and pipeline inspection organizations. </text></clause> 
<clause id="H206525874E39436C912A3A7D5D0B6299" commented="no"><enum>(iii)</enum><text>At least 3 individuals shall be selected from public safety advocate organizations, such as pipeline safety and environmental advocacy groups, public safety-focused research institutions, or labor and worker safety representatives.</text></clause></subparagraph> <subparagraph id="HF286935234C7419C94AD0F80E8D5D657" commented="no"><enum>(C)</enum><header>Board terms</header> <clause id="H5ADC3C3EAD2F48F094A1CCCCD5AB17F7" commented="no"><enum>(i)</enum><header>In general</header><text>Each member of the Governing Board shall be appointed for a term of 3 years, with the terms of 3 of the members expiring each year.</text></clause> 
<clause id="H61580E71766948F090E4C4BA67DEFC65" commented="no"><enum>(ii)</enum><header>Term expiration</header><text>The term of at least 1 member of each of the 3 stakeholder groups established in subparagraph (B) shall expire each year.</text></clause> <clause id="H84B0057CF2064183A4394AEADA488E17" commented="no"><enum>(iii)</enum><header>Initial appointment</header><text>In the initial appointment of members, terms of 1, 2, and 3 years shall be established to allow the terms of 3 members to expire thereafter each year.</text></clause> 
<clause id="HEEE786CC6A7D4BE7B4247B1C401BCB58" commented="no"><enum>(iv)</enum><header>Reappointment</header><text>Each member may be reappointed for consecutive 3-year terms.</text></clause></subparagraph> <subparagraph id="HD61EBC334470493AA21D6187BE64AB07" commented="no"><enum>(D)</enum><header>Co-chairs</header> <clause id="HEEB1E19B642B4389B206796442D647E2"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">The Governing Board shall be co-chaired by—</text> 
<subclause id="HF868FCDB858A47F89A9184DCAFE01BE7"><enum>(I)</enum><text>the Administrator;</text></subclause> <subclause id="H01BC55EAD0AF4AB3A094297982D4F2AC"><enum>(II)</enum><text>a representative of the stakeholder group described in subparagraph (B)(ii), who shall be appointed with advice and consent of the Governing Board; and </text></subclause> 
<subclause id="H5F86AD9AFC4844F2A8EBA692CE7E3047"><enum>(III)</enum><text display-inline="yes-display-inline">a representative of the stakeholder group described in subparagraph (B)(iii), who shall be appointed with advice and consent of the Governing Board.</text></subclause></clause> <clause id="HF965A3B4C8DF49D388EDEDD68F79910B"><enum>(ii)</enum><header>Responsibilities</header><text>The co-chairs of the Governing Board shall be jointly responsible for organizing and conducting meetings of the Governing Board.</text></clause></subparagraph> 
<subparagraph id="H82DC9B25A5CA46708AE9C0CA3B8E3390" commented="no"><enum>(E)</enum><header>Authority</header><text>The Governing Board shall make decisions by a super-majority of two-thirds plus 1 of the Governing Board members and shall have the authority to—</text> <clause id="H9E9ECBA8475B4B88BD6A637E4B3C243D" commented="no"><enum>(i)</enum><text>govern and provide strategic oversight to the VIS;</text></clause> 
<clause id="H2223D72F47654BD38DFBC5D0AD52CFDD" commented="no"><enum>(ii)</enum><text>develop governance documents, including a Governing Board charter that is made available to the public, and that describes the scope of the authority and objectives of the Board;</text></clause> <clause id="HFE3458E7FB074BBBA243C11EB3519912" commented="no"><enum>(iii)</enum><text display-inline="yes-display-inline">select a Third-Party Data Manager described in paragraph (4) with expertise in data protection, aggregation, and analytics and geographic information systems;</text></clause> 
<clause id="H702ABD2C47C943BD8D2173507503A272" commented="no"><enum>(iv)</enum><text>approve the criteria and procedures governing how the Third-Party Data Manager described in paragraph (4) will receive and accept pipeline safety data and information and who will have the authority to view VIS data;</text></clause> <clause id="H7ACEF6CD64C4437DACFD3ADC6D08B0B9" commented="no"><enum>(v)</enum><text>establish and appoint members to Issue Analysis Teams described in paragraph (5) that consist of technical and subject matter experts;</text></clause> 
<clause id="H03B9DDC7CCF6429B8311A31C5878448B" commented="no"><enum>(vi)</enum><text display-inline="yes-display-inline">collaborate with Issue Analysis Teams described in paragraph (5) to identify the issues and topics to be analyzed;</text></clause> <clause id="H4A193DB0FBE24EF0B0AB85A15DC14F76" commented="no"><enum>(vii)</enum><text display-inline="yes-display-inline">collaborate with Issue Analysis Teams described in paragraph (5) to specify the type of de-identified pipeline safety data and information that Issue Analysis Teams need in order to analyze the issues identified under clause (vi) and topics;</text></clause> 
<clause id="H8364DD25A86C4CA7A12EACA069F2C6D7" commented="no"><enum>(viii)</enum><text>determine the information to be disseminated;</text></clause> <clause id="H9501D02906724924B411D249B61AFC04" commented="no"><enum>(ix)</enum><text>determine the reports to be disseminated;</text></clause> 
<clause id="H4E5D84FBBA5649F3BC623499532CFF1B" commented="no"><enum>(x)</enum><text>at least once per year, issue a report to the public on VIS processes, membership of the Governing Board, issues or topics being investigated and analyzed, pipeline safety data and information that the VIS has requested for submission to the VIS, and safety trends identified; and</text></clause> <clause id="H6B355D1CC344442691A4E8FE6CA4EF0B" commented="no"><enum>(xi)</enum><text>perform other functions as the Governing Board decides are necessary or appropriate consistent with the purpose of the VIS.</text></clause></subparagraph></paragraph> 
<paragraph id="HD7B46246536946C2B1882B376E632896" commented="no"><enum>(3)</enum><header>Program manager</header><text>The Administrator shall provide the day-to-day program management and administrative support for the VIS, including oversight of the Third-Party Data Manager described in paragraph (4).</text></paragraph> <paragraph id="H14D5CE47981F4E23AD45C6B07EACA5CD" commented="no"><enum>(4)</enum><header>Third-party data manager</header> <subparagraph id="H936BD99BA6BC4953912F535B0FF9561E"><enum>(A)</enum><header>In general</header><text>A Third-Party Data Manager shall provide data management and data oversight services for the VIS.</text></subparagraph> 
<subparagraph id="H988BBD38DF1B4704BE3665FEBA7905CA"><enum>(B)</enum><header>Responsibilities</header><text>In fulfilling the responsibilities described in subparagraph (A), the Third-Party Data Manager shall—</text> <clause id="HAC30B1CB47944AA694B461FEEF6407F1" commented="no"><enum>(i)</enum><text>accept pipeline safety data and information submitted to the VIS that meets the criteria and procedures established by the Governing Board under paragraph (2)(E)(iv);</text></clause> 
<clause id="H32742B2F7020422EA9C0858172260E6F" commented="no"><enum>(ii)</enum><text>de-identify, securely store, and manage pipeline safety data and information that is accepted by the VIS;</text></clause> <clause id="HD914F0CA527D494CA26FB1370945CDFB" commented="no"><enum>(iii)</enum><text display-inline="yes-display-inline">collaborate with Issue Analysis Teams described in paragraph (5) to aggregate and analyze de-identified pipeline safety data and information that is accepted by the VIS;</text></clause> 
<clause id="H93820D3E6F57465085643D129270C760" commented="no"><enum>(iv)</enum><text>prepare reports as requested by the Governing Board regarding the type of pipeline safety data and information that is managed by the VIS; and</text></clause> <clause id="HA57795BACD9643F3973FAA30B279ADF9" commented="no"><enum>(v)</enum><text>make recommendations regarding the management of pipeline safety data and information, as appropriate.</text></clause></subparagraph></paragraph> 
<paragraph id="H3DB4E1CA94974307BE9FA26CB3839AB7" commented="no"><enum>(5)</enum><header>Issue analysis teams</header><text>Issue Analysis Teams of the VIS shall—</text> <subparagraph id="H8F1518FDA69246AC87D9E260FF5B8991" commented="no"><enum>(A)</enum><text>work with the Third-Party Data Manager described in paragraph (4) to aggregate and analyze de-identified pipeline safety data and information accepted by the VIS; </text></subparagraph> 
<subparagraph id="H8BF89790C49042178144775724187FE7" commented="no"><enum>(B)</enum><text>collaborate with the Governing Board to identify issues and topics for analysis and submit internal reports and recommendations to the Governing Board; and</text></subparagraph> <subparagraph id="H915ED29079874460858B8C6DBE6F0A04"><enum>(C)</enum><text display-inline="yes-display-inline">prepare reports as requested by the Governing Board regarding issues and topics identified for additional research by the Governing Board.</text></subparagraph></paragraph> 
<paragraph id="HE1E54AE2AE2A4F32B1B636380B972CFF" commented="no"><enum>(6)</enum><header>Participation</header> 
<subparagraph id="H2AB4FC73B97E40908353AD669C16B1CE" commented="no"><enum>(A)</enum><header>In general</header><text>The submission of pipeline safety data and information to the VIS by any person shall be voluntary, with no person compelled to participate in or submit data or information for inclusion in the VIS.</text></subparagraph> <subparagraph id="H42FAF45DA59A4105A9D0161FF4B754CE"><enum>(B)</enum><header>Acceptance of information</header><text>The VIS shall implement policies to ensure that all operator data or information submitted has been authorized by the operator for submission.</text></subparagraph> 
<subparagraph id="H6E9EBB17FCEC40AFA3503EBB9551CCBB" commented="no"><enum>(C)</enum><header>Sharing of information</header><text>The Governing Board shall encourage the voluntary sharing of pipeline safety data and information among operators of gas, carbon dioxide, and hazardous liquid gathering, transmission, and distribution pipelines and facilities, employees, labor unions, contractors, in-line inspection service providers, non-destructive evaluation experts, the Pipeline and Hazardous Materials Safety Administration, representatives of State pipeline safety agencies, local and Tribal governments, pipeline safety advocacy groups, manufacturers, research and academic institutions, and other pipeline stakeholders.</text></subparagraph></paragraph></subsection> <subsection id="H7A3E088A7FBD415B93D8D0CD6E4CFEC0" commented="no"><enum>(c)</enum><header>Information sharing</header> <paragraph id="H1B34D450ED3D463BA18258CABBE62997" commented="no"><enum>(1)</enum><header>Inclusions</header><text>Pipeline safety data and information accepted by the VIS may include—</text> 
<subparagraph id="HA8FA11D9F67147ADBA58893569CAC547" commented="no"><enum>(A)</enum><text>pipeline integrity risk analysis information;</text></subparagraph> <subparagraph id="H49BD6CC1BC7E45E0BF248C23247604DD" commented="no"><enum>(B)</enum><text>lessons learned from accidents and near misses;</text></subparagraph> 
<subparagraph id="HEDF5FD33B0A64D889139EF5281EF40CF" commented="no"><enum>(C)</enum><text>process improvements;</text></subparagraph> <subparagraph id="HB757C835211F421E827E00AC8ECCDD9E" commented="no"><enum>(D)</enum><text>technology deployment practices;</text></subparagraph> 
<subparagraph id="H810051FF270C4A9292AD636CED9202B1" commented="no"><enum>(E)</enum><text>information obtained through VIS pipeline safety surveys of pipeline operator employees, as long as such surveys are voluntarily agreed to by the pipeline operator; and</text></subparagraph> <subparagraph id="HF5B0FD8462F84BB99A7EE56B4BBE6B0C" commented="no"><enum>(F)</enum><text>pipeline safety data and information which may lead to the identification of pipeline safety risks.</text></subparagraph></paragraph></subsection> 
<subsection id="H78E6B40CD8DD4DC2810D52ADE0661CE9" commented="no"><enum>(d)</enum><header>Confidentiality</header> 
<paragraph id="H6CF117DFE71B4374899610C3439BA62D" commented="no"><enum>(1)</enum><header>In general</header> 
<subparagraph id="HA5F5D80AF6A443FA85AF2B5752BCCC20" commented="no"><enum>(A)</enum><header>Confidentiality</header><text display-inline="yes-display-inline">To facilitate the sharing of otherwise non-public pipeline safety data and information (hereinafter known as <quote>non-public information</quote>) in the VIS, non-public information accepted by the VIS and which may be analyzed, stored, or managed by the VIS shall be kept confidential by the VIS.</text></subparagraph> <subparagraph id="HD54F574D849F4D8194FB608BD4803E39" commented="no"><enum>(B)</enum><header>Rule of construction</header><text>Subparagraph (A) shall not be construed to apply to public information that may be submitted to the VIS or to non-public information that is required to be submitted to any Federal, State, local, or Tribal agency under any other provision of law. </text></subparagraph></paragraph> 
<paragraph id="H1D8584CEB9D143C2AB348DA56821E186"><enum>(2)</enum><header>Disclosure of de-identified, non-public information</header> 
<subparagraph id="H3AD1748FE7894820AD4568829DA17F85"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding subsections (e) and (f), the Governing Board may approve the disclosure of de-identified, non-public information by the VIS or by the Administrator of the Pipeline and Hazardous Materials Safety Administration based on analysis of the de-identified information and any safety findings or recommendations that the Governing Board in the sole discretion of the Board determines to publish or authorizes the Administrator to publish to improve pipeline safety.</text></subparagraph> <subparagraph id="H39AFCFE8111840A0865826AE4BD81C97"><enum>(B)</enum><header>Public reports</header><text>In issuing public reports under subsection (b)(2)(E)(x), the Governing Board shall approve the disclosure of de-identified, non-public information by the VIS that the Governing Board determines is necessary to adequately describe and illustrate the issues and topics being investigated and analyzed by the VIS.</text></subparagraph></paragraph> 
<paragraph id="H1334BE961FE7411BBF2E4ED71FAC7EAB" commented="no"><enum>(3)</enum><header>Limitation</header><text>Except as provided in paragraph (2), no person, including any VIS Governing Board member, the Program Manager, the Third-Party Data Manager described in subsection (b)(4), an Issue Analysis Team member described in subsection (b)(5), or any Federal, State, local, or Tribal agency, having or obtaining access to non-public information by virtue of the acceptance of such information to the VIS, shall release or communicate VIS held non-public information, in either an identified or de-identified form, to any person that does not have the authority to view VIS data.</text></paragraph></subsection> <subsection id="H929FB95767EE48E39CDBEB3E6CD719AF"><enum>(e)</enum><header>Applicability of FOIA</header><text>Any non-public information that is accepted by the VIS and which may be analyzed, stored, or managed by the VIS and subsequently obtained by the Secretary or the Administrator by virtue of the acceptance of such information to the VIS shall be exempt from the requirements of section 552 of title 5 and specifically exempt from release under subsection (b)(3) of such section.</text></subsection> 
<subsection id="H4C6713491B634920A94ED7089083B550"><enum>(f)</enum><header>Exclusions</header> 
<paragraph id="HA837E02C607E4980A216203D941713F2"><enum>(1)</enum><header>Excluded evidence</header><text>Except as provided in paragraph (3), non-public information accepted by the VIS and which may be analyzed, stored, or managed by the VIS shall not be obtained from the VIS—</text> <subparagraph id="H9CDD7E2B26CB48D3BF052D487FF2ED21"><enum>(A)</enum><text>for use as evidence for any purpose in any Federal, State, local, Tribal, or private litigation, including any action or proceeding; or</text></subparagraph> 
<subparagraph id="H3C324F74724844EEA8C428EDCF9272D4"><enum>(B)</enum><text>to initiate any enforcement action or civil litigation against a pipeline operator or employees or contractors of such operator relating to a probable violation under this chapter (including any regulation promulgated or order issued under this chapter).</text></subparagraph></paragraph> <paragraph id="H53CF06080C9C479092EBA728F931BC8F"><enum>(2)</enum><header>Exclusion from discovery</header><text>Except as provided in paragraph (3), non-public information accepted by the VIS and which may be analyzed, stored, or managed by the VIS shall not be subject to discovery from the VIS in any Federal, State, local, Tribal, or private litigation or other proceeding.</text></paragraph> 
<paragraph id="H4FD913863837447E86B64625B7F030DB"><enum>(3)</enum><header>Limitations on exclusions</header><text>The exclusions described in paragraphs (1) and (2) shall not apply to non-public information accepted by the VIS that is—</text> <subparagraph id="H5623C5F84E254657A03AA90AB8761A0B"><enum>(A)</enum><text>evidence of a criminal violation;</text></subparagraph> 
<subparagraph id="H09D9C6428BD74714B4EE0FA838F9BB0F" commented="no"><enum>(B)</enum><text>not related to the established purpose of the VIS described in subsection (a)(2);</text></subparagraph> <subparagraph id="HCCB9BCC0BBC040CA9C37224AB2E10D0F"><enum>(C)</enum><text>otherwise required to be reported to the Secretary under part 191 (including information about an incident or accident), part 192, part 194, part 195, or part 199 of title 49, Code of Federal Regulations (or successor regulations), or required to be reported under the requirements of a State authority; or</text></subparagraph> 
<subparagraph id="H3F805B22D3B44A97AC332F7028D00F23"><enum>(D)</enum><text>developed or obtained from a source other than the VIS, including through discovery from a person or an entity other than the VIS in an enforcement action or private litigation.</text></subparagraph></paragraph> <paragraph id="HD759F45AED78449B87BDAAC98BA2F321" display-inline="no-display-inline"><enum>(4)</enum><header>Additional limitations on exclusions</header><text display-inline="yes-display-inline">The exclusions described in paragraphs (1) and (2) shall not apply to non-public information that is submitted to but not accepted by the VIS.</text></paragraph></subsection> 
<subsection id="H4849C3E344C04ADCB72C27D69CE5E0FC"><enum>(g)</enum><header>Effect on State law</header><text>Nothing in this section shall be construed to affect Federal, State, or local pipeline safety law.</text></subsection> <subsection id="H2C4C14E99A1D45F6B4D11B0516D4298B"><enum>(h)</enum><header>No effect on discovery</header> <paragraph id="H27826B6F69EF4DA58369A54E20346420" commented="no"><enum>(1)</enum><header>Rule of construction</header><text>Nothing in this section or any rule, regulation, or amendment issued pursuant to this section shall be construed to create a defense to a discovery request or otherwise limit or affect the discovery of pipeline safety data and information arising from a cause of action authorized under any Federal, State, or local law.</text></paragraph> 
<paragraph id="H2F7E33A522D044898E65E2A2879C6529"><enum>(2)</enum><header>Exception</header><text>Paragraph (1) shall not apply to exclusions from discovery from the VIS as described in subsection (f)(2).</text></paragraph></subsection> <subsection id="H1B1C9EE7C2FD4B03A87DCB4402960C6A" commented="no"><enum>(i)</enum><header>Expenses</header> <paragraph id="HF800E6F103D043BA9F824AA220F6AA4D" commented="no"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Members of the VIS Governing Board and Issue Analysis Teams may be paid expenses under section 5703 of title 5.</text></paragraph> 
<paragraph id="H9C0B1B696EC64E7783108292F729022F" commented="no"><enum>(2)</enum><header>Rule of construction</header><text>A payment under this subsection shall not be construed to make a member of the VIS Governing Board an officer or employee of the Federal Government.</text></paragraph> <paragraph id="H46E1ED7B4BD440BB82666C6F0BF14A87" commented="no"><enum>(3)</enum><header>Federal employees</header><text>Paragraph (1) shall not apply to members of the VIS Governing Board that are employees of the Federal Government.</text></paragraph></subsection> 
<subsection id="HABB06C5D92CA464784624FC201A16209"><enum>(j)</enum><header>Report on VIS</header><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of this section, the Secretary shall submit to the Committee on Transportation and Infrastructure and the Committee on Energy and Commerce of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate, and make publicly available, a report that includes—</text> <paragraph id="H2668ADFEB4504202A308AA8E98E9D723"><enum>(1)</enum><text>a detailed accounting of the allocation and uses of expenditures authorized under this section; </text></paragraph> 
<paragraph id="HA2AC260E5E3643598B2EB4464EE0587F"><enum>(2)</enum><text>an estimate of the annual cost to maintain the VIS program, including an assessment and projection of costs associated with the Third-Party Data Manager, data sourcing and storage, data governance, data architecture, data consumption, and the VIS operations and administration by the Pipeline and Hazardous Materials Safety Administration; </text></paragraph> <paragraph id="H01E0E1B1CA8744619B5C11C084C27E4A"><enum>(3)</enum><text>the methodology for determining the estimate under paragraph (2); </text></paragraph> 
<paragraph id="H92470CA2DA07417BBD32871A7277D204"><enum>(4)</enum><text>the number of expected participants in the VIS program; </text></paragraph> <paragraph id="H1DE1954AAE854A4CACF916BD4A8169DF"><enum>(5)</enum><text>the number of Pipeline and Hazardous Materials Safety Administration positions needed to maintain the VIS program; </text></paragraph> 
<paragraph id="H2C71CE629A5347D6B87117DDF2C9CD22"><enum>(6)</enum><text>the projected timeline for the implementation of the VIS program to meet the purposes under subsection (a)(2); and </text></paragraph> <paragraph id="H4FF8A0B3EF8E479383C09A82DEA196A8"><enum>(7)</enum><text>recommendations to ensure sufficient funding for the ongoing activities of the VIS program, including a reasonable fee assessed on authorized participants in the VIS program. </text></paragraph></subsection> 
<subsection id="H5255C7F5635A4028A9E96AB89936BA10"><enum>(k)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated for the establishment of a voluntary information-sharing program under this section—</text> <paragraph id="H3658264AAFEE4328A363B21485E93121"><enum>(1)</enum><text>$1,000,000 for fiscal year 2024; </text></paragraph> 
<paragraph id="H590CA1E6A54543248E2D9CB8805F8079"><enum>(2)</enum><text>$10,000,000 for fiscal year 2025;</text></paragraph> <paragraph id="H22DF292188EC4035AF927674DEB20EED"><enum>(3)</enum><text>$10,000,000 for fiscal year 2026; and</text></paragraph> 
<paragraph id="H7CB47696DB6E4298AA9F58E9F54F4767"><enum>(4)</enum><text>$10,000,000 for fiscal year 2027. </text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H2225263B6A38453E81F04571BBD16D74"><enum>(b)</enum><header>Clerical amendment</header><text>The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/601">chapter 601</external-xref> of title 49, United States Code, is amended by adding at the end the following:</text>

<subparagraph id="H5E00178914924FCB8261D8660667A906"><enum>(A)</enum><text>in subparagraph (1)(B)(i) by inserting <quote>or carbon dioxide</quote> after <quote>hazardous liquids</quote>; and</text></subparagraph> <subparagraph id="H28417D463EA44A57A939162A0C605234"><enum>(B)</enum><text>in paragraph (2)(A)—</text>

<subparagraph id="H8307EB8FD44147E7A724C94C0981D3ED"><enum>(B)</enum><header>Inclusion of applicable standards</header><text display-inline="yes-display-inline">The Secretary shall establish the minimum safety standards in part 195 of title 49, Code of Federal Regulations, as applicable.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph> <subparagraph id="H2A3624879EA244FEA779F6CB7CDC1828"><enum>(C)</enum><text>in paragraph (3) by inserting <quote> prescribe the location of a carbon dioxide storage facility or to</quote> before <quote>regulate piping</quote>;</text></subparagraph> 
<subparagraph id="H88BCB269CDFE4532B25BE61F40614347"><enum>(D)</enum><text>by redesignating paragraph (3) as paragraph (4);</text></subparagraph> <subparagraph id="H9432CDF3F9404AFF978E3097E630E3C5"><enum>(E)</enum><text>by inserting after paragraph (2) the following: </text>

<paragraph id="HAA8D03B66CFD4C4E8D2EA48DD54AC475"><enum>(3)</enum><header>Storage of carbon dioxide</header> 
<subparagraph id="HA927D269C79C488D92A23D383990C5C9"><enum>(A)</enum><header>Minimum safety standards</header><text>The Secretary shall prescribe minimum safety standards for the injection, withdrawal, and storage of carbon dioxide incidental to pipeline transportation.</text></subparagraph> <subparagraph id="HBC512767713549F8BB621112C59FB593"><enum>(B)</enum><header>Storage of carbon dioxide incidental to pipeline transportation</header><text display-inline="yes-display-inline">In this paragraph, the term <term>storage of carbon dioxide incidental to pipeline transportation</term>—</text> 
<clause id="H3B4E52C7260C4D0F8CD9CF81A6F8FE85"><enum>(i)</enum><text>means the temporary receipt and storage of carbon dioxide transported by pipeline for continued transport; but</text></clause> <clause id="H959FF5BE15F7452E8B9DDFCBDC3FAAF2" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">does not include—</text> 
<subclause id="H2F20850142CD4252A571403ECCA0961D" commented="no"><enum>(I)</enum><text display-inline="yes-display-inline">with respect to each State, the long-term containment of carbon dioxide in subsurface geologic formations or other activity subject to the requirements of a State underground injection control program prescribed by the Administrator of the Environmental Protection Agency and applicable to the State, or adopted by the State and approved by the Administrator, under part C of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300h">42 U.S.C. 300h et seq.</external-xref>); or</text></subclause> <subclause id="H3DE76D67B98A41928B304DB8B4E33AE7" commented="no"><enum>(II)</enum><text>the temporary storage of carbon dioxide in any excepted pipelines listed in paragraph (b) of section 195.1 of title 49, Code of Federal Regulations, as of the date of enactment of the <short-title>PIPES Act of 2023</short-title>.</text></subclause></clause></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph> 
<subparagraph id="H1162A41719C7494EA18AB3BA57044DE1"><enum>(F)</enum><text>by adding at the end the following: </text> <quoted-block style="USC" display-inline="no-display-inline" id="H7A2555F2F24E41609AD1AEF3B94E7408"> <paragraph id="HF22ABFD3CE1D43789E386C1337DE03A4" commented="no"><enum>(5)</enum><header>Dispersion Modeling</header> <subparagraph id="HCF466DD63ABA41A6A2097EC8FC1737A9" commented="no"><enum>(A)</enum><header>Safety standards</header><text>The Secretary shall prescribe minimum safety standards to require each operator of a carbon dioxide pipeline facility to employ vapor dispersion modeling to identify high consequence areas, as defined at section 195.450 of title 49, Code of Federal Regulations, and paragraph (7)(I)(A) of Appendix C to part 195 of such title, that could be affected by a release from such a pipeline.</text></subparagraph> 
<subparagraph id="H9CDD86F5560C4DC6B796AC801392B7FE" commented="no"><enum>(B)</enum><header>Considerations</header><text display-inline="yes-display-inline">In performing the vapor dispersion modeling under subparagraph (A), operators of a carbon dioxide pipeline facility shall consider—</text> <clause id="H95B373240C724CF2845761430D643705" commented="no"><enum>(i)</enum><text>the topography surrounding the pipeline;</text></clause> 
<clause id="HDF183EEC0B74476C894B7AA1DB63AE1B" commented="no"><enum>(ii)</enum><text>atmospheric conditions that could affect vapor dispersion;</text></clause> <clause id="H63E36F56AE30476FA54B7D5656D50BA2" commented="no"><enum>(iii)</enum><text>pipeline operating characteristics; and</text></clause> 
<clause id="HDD1003A1249944BEBC896493B8C8DF35" commented="no"><enum>(iv)</enum><text>additional substances present in the pipeline that could affect vapor dispersion.</text></clause></subparagraph> <subparagraph id="HFBB6ABF9C834459FA29663064FA55471" commented="no"><enum>(C)</enum><header>Maintenance of files</header><text display-inline="yes-display-inline">The Secretary shall require each operator of a carbon dioxide pipeline facility to maintain records documenting the areas that could affect high consequence areas, as determined using the vapor dispersion modeling required pursuant to subparagraph (A), in the manual of written procedures for operating, maintaining, and handling emergencies for such pipeline.</text></subparagraph> 
<subparagraph id="H2CF82E59C0E6494EAEC1DC57AC0D6A16" commented="no"><enum>(D)</enum><header>Protection of sensitive information</header><text display-inline="yes-display-inline">In responding to a public request for information regarding carbon dioxide dispersion modeling, the Secretary may, taking into account public safety, security, and the need for public access, exclude from disclosure (as the Secretary determines appropriate)—</text> <clause id="H80BF030384E1409DA0DD7C241B657D2B" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">security sensitive information related to strategies for responding to worst-case carbon dioxide release scenarios;</text></clause> 
<clause id="H9830748FDDAF402083D37FE26A520FFE" commented="no"><enum>(ii)</enum><text>security sensitive information related to carbon dioxide release plumes; and </text></clause> <clause id="HA83974F886C44F25A9FA9251E68E77B2" commented="no"><enum>(iii)</enum><text>security sensitive information related to plans for responding to a carbon dioxide release.</text></clause></subparagraph> 
<subparagraph id="H0899EE6F31EE40D1AC286E5631467DC9" commented="no"><enum>(E)</enum><header>Statutory construction</header><text>Nothing in this section may be construed to require disclosure of information or records that are exempt from disclosure under section 552 of title 5.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection> <subsection id="H055C48D1EE274B4C879F184A92410448" commented="no"><enum>(b)</enum><header>Regulations required</header><text display-inline="yes-display-inline">Not later than 1 year after the date of publishing a notice of proposed rulemaking titled <quote>Pipeline Safety: Safety of Carbon Dioxide and Hazardous Liquid Pipelines</quote> (or any other notice of proposed rulemaking covering substantially similar regulatory requirements), the Secretary shall issue a final rule based on such proposed rulemaking. The final rule shall include updates to such regulations as are necessary to implement section 60102(i) of title 49, United States Code, as amended by subsection (a), and other carbon dioxide safety issues identified by the Secretary.</text></subsection>

<subsection id="H361D48D13ED04BFFA91935F1FF28E896"><enum>(b)</enum><header>Protocols for public hearings</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretary of Transportation shall publish protocols for hearings open to the public pursuant to section 60117(b)(2) of title 49, United States Code, that ensure an orderly process and protection of confidential information.</text></subsection> <subsection id="H11846BAF499848B3A739819E1460A25F"><enum>(c)</enum><header>Report on use of formal hearing process</header><text display-inline="yes-display-inline">Not later than 3 years after the date of enactment of this Act, the Secretary shall submit to the Committee on Transportation and Infrastructure and the Committee on Energy and Commerce of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a report detailing—</text> 
<paragraph id="H7BB1E12151C14893A45B9EFF17B9C42B"><enum>(1)</enum><text>the number of hearings held pursuant to subparagraph (K) of section 60117(b)(1) of title 49, United States Code; </text></paragraph> <paragraph id="HAB3E7BC437884EBF84D6BA7DF966E0F6"><enum>(2)</enum><text>the status of each such hearing; </text></paragraph> 
<paragraph id="H7CE965018AAA4D6A9E58E16618F757DE"><enum>(3)</enum><text>an analysis comparing the informal hearing process and the formal hearing process that describes—</text> <subparagraph id="H9B11AF2A86AE4EF092965C71D184A50B"><enum>(A)</enum><text>the length of time to resolve an enforcement action under section 60117 of title 49, United States Code;</text></subparagraph> 
<subparagraph id="H4EF92D92D3494A588CA0396415596869"><enum>(B)</enum><text display-inline="yes-display-inline">the cost of the enforcement action process to—</text> <clause id="H52A4B47F205A4A7595B5A6426BFC69CA"><enum>(i)</enum><text>the respondent; and</text></clause> 
<clause id="H265D775126DC46BDB113CFC0A05B414E"><enum>(ii)</enum><text>the Pipeline and Hazardous Materials Safety Administration; and</text></clause></subparagraph> <subparagraph id="H2E4ABEBCC07B49B189E4A63EAF225BA3"><enum>(C)</enum><text>the number of cases that reach settlement and the outcome of such cases; </text></subparagraph></paragraph> 
<paragraph id="HE3FBD3CAB7FD4A0B94F52B00FAF58536"><enum>(4)</enum><text>any additional resources that are needed by the Secretary in response to implementing this provision for each fiscal year to carry out the amendment made by subsection (a); and</text></paragraph> <paragraph id="HC17AB6A663374C1AB01828F6E142D5DE"><enum>(5)</enum><text display-inline="yes-display-inline">any safety improvements identified as a result of the implementation of subparagraph (K) of section 60117(b)(1) of title 49, United States Code.</text></paragraph></subsection></section> 
<section id="HF2A39738C49A4CBF9F97143FFA7F6C74" section-type="subsequent-section"><enum>27.</enum><header>State pipeline safety grants reporting</header><text display-inline="no-display-inline">Section 60107(b) of title 49, United States Code, is amended—</text> <paragraph id="HDC91E0109CF54306B81A60B46343A38C"><enum>(1)</enum><text>by striking <quote>After notifying</quote> and inserting <quote>(1) <header-in-text level="paragraph" style="USC">Withholding of payment</header-in-text>.—After notifying</quote>; and</text></paragraph> 
<paragraph id="HB692FA7629A6496BB59366E673F663AD"><enum>(2)</enum><text>by adding at the end the following: </text> <quoted-block style="OLC" display-inline="no-display-inline" id="H21B22D216A4447B7940D7B68C9DA8C33"> <paragraph id="HF4960E78D5EF451DB708C975D3CDCDD9" indent="subsection"><enum>(2)</enum><header>Budget estimate</header><text display-inline="yes-display-inline">The budget estimates of the Secretary for each fiscal year shall include—</text> 
<subparagraph id="H2F36F18662154B9885DF35C939755848"><enum>(A)</enum><text>a summary of amounts claimed, amounts reimbursed, and the percentages reimbursed in the preceding 3 fiscal years for the program under this section; and</text></subparagraph> <subparagraph id="H3D579D350C5E40F69C600D34694E9A7C"><enum>(B)</enum><text>the estimated funding necessary to fund 80 percent of the cost of the personnel, equipment, and activities under this section for the subsequent calendar year.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>

<subsection id="H8014C0A7EF4349E8A59C6CEC087D91EC"><enum>(a)</enum><header>Inspection of in-service breakout tanks</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretary of Transportation shall review and, if determined that such action will achieve an equivalent level of safety, shall amend the safety standards in part 195 of title 49, Code of Federal Regulations, relating to the internal inspection of the bottoms of in-service breakout tanks to allow for risk-based inspections.</text></subsection> <subsection id="H2F72889780F045CAB26C69E0EFA74102"><enum>(b)</enum><header>Consideration</header><text display-inline="yes-display-inline">If the Secretary amends the safety standards described in subsection (a), the Secretary shall consider the 5th edition of standard 653 published by the American Petroleum Institute issued November 2014 titled <quote>Tank Inspection, Repair, Alteration, and Reconstruction</quote>.</text></subsection> 
<subsection id="H72C333BA9854444381CD3BFC609F71C0"><enum>(c)</enum><header>Scope</header><text display-inline="yes-display-inline">If the Secretary amends the safety standards described in subsection (a), the Secretary shall ensure that such risk-based inspection standards achieve a level of safety that is equivalent to the level of safety required under such part 195, as in effect on the date of enactment of this Act.</text></subsection></section> <section id="H7224845E33214C149979F3FDDACCAF56" section-type="subsequent-section"><enum>29.</enum><header>Disclosure of safety information assessment</header> <subsection id="H983706E67FD54C478A84E0F242153173"><enum>(a)</enum><header>Assessment</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretary of Transportation shall conduct an assessment on how gas pipeline facility, hazardous liquid pipeline facility, and carbon dioxide pipeline facility owners and operators engage with, and provide safety information to, the public and State or local emergency response organizations.</text></subsection> 
<subsection id="HF29EC0C572A8456CB89F3275C6697B60"><enum>(b)</enum><header>Safety Information</header><text>In conducting the assessment required under subsection (a), the Secretary shall consider—</text> <paragraph id="H4FDAB1584EA346FFA88FE94A3DDEACB3"><enum>(1)</enum><text>pipeline safety materials that the owners and operators of pipelines described in subsection (a) voluntarily provide to the public;</text></paragraph> 
<paragraph id="H1BB82E51551544E796119A02AEB5A5AF"><enum>(2)</enum><text>methods of interaction between pipeline facility owners and operators and the public and State and local emergency response entities;</text></paragraph> <paragraph id="HA72CD22104F84FBFBEFAD49EF3495D17"><enum>(3)</enum><text>Federal, State, and local government regulations governing information that pipeline facility owners and operators are required to share with the public;</text></paragraph> 
<paragraph id="HA5F8E8D660CC44949AF0CDA0CF48A708"><enum>(4)</enum><text>industry consensus standards regarding the sharing of pipeline safety and emergency response information;</text></paragraph> <paragraph id="HFA60E4892F6643AF935240E197AEFF41"><enum>(5)</enum><text>specific data that could be shared with local and State emergency response and planning agencies, local public officials, and governing councils to enhance information sharing and pipeline safety, specifically—</text> 
<subparagraph id="HFF2978886D88455FB6A3C715731178CE"><enum>(A)</enum><text>the identification of general pipeline location, or information including location, the products transported by pipeline or stored at an underground natural gas facility, data on breakout tanks or production facilities that includes pipeline classification and impact areas, and owner or operator emergency response planning materials; and</text></subparagraph> <subparagraph id="H1A513B4E30054A5CA7CBC1BB93E036BC"><enum>(B)</enum><text>information emergency response organizations ask pipeline owners and operators to voluntarily share with the public;</text></subparagraph></paragraph> 
<paragraph id="H2FE8F1309E9F4E458103EA0A3F9AD9C6"><enum>(6)</enum><text>emergency response materials that pipeline facility owners and operators voluntarily provide to emergency response organizations;</text></paragraph> <paragraph id="H46B04D1049944FFF89928BD3F8355B9F"><enum>(7)</enum><text>how pipeline facility owners and operators communicate with emergency response organizations, including—</text> 
<subparagraph id="H94739667D7AD4FEA93FADBD7BD10D455"><enum>(A)</enum><text>the functional quality and use of data shared through the National Pipeline Mapping System; and</text></subparagraph> <subparagraph id="HBF427FD6018043A7999323FCF6205B7E"><enum>(B)</enum><text>the measures taken by emergency response organizations to secure any sensitive information shared; </text></subparagraph></paragraph> 
<paragraph id="HE94AD44D44FD4E8D8EA6ACB4FABA7E6F"><enum>(8)</enum><text>emergency response planning guidance and requirements issued by emergency response organizations for pipeline facility owners and operators; and</text></paragraph> <paragraph id="HCF52CAE69C154BDD891A2C01AD4C87BF"><enum>(9)</enum><text>changes emergency response organizations recommend to improve communication with the public and emergency response coordination organizations.</text></paragraph></subsection> 
<subsection id="HC6E1F878C02848949BFC42BF0E58EDD5"><enum>(c)</enum><header>Consultation</header><text>In conducting the assessment under subsection (a), the Secretary shall consult with both large and small pipeline facility owners and operators, urban and rural State, local, and Tribal governments, emergency response organizations, and pipeline safety organizations.</text></subsection> <subsection id="H5F0B781FE0F243A6A53DF540E1336AAB"><enum>(d)</enum><header>Report to Congress</header><text display-inline="yes-display-inline">Not later than 180 days after completion of the assessment in subsection (a), the Secretary shall submit to the Committee on Transportation and Infrastructure and the Committee on Energy and Commerce of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate, a report containing the findings of the assessment under subsection (a) and any legislative recommendations of the Secretary.</text></subsection> 
<subsection id="H2349BE9555F64F56A4782E2A6F5923F7"><enum>(e)</enum><header>Guidance</header><text>Not later than 180 days after the submission of the report under subsection (d), the Secretary may issue guidance to improve pipeline safety information sharing with the public and other interested parties to advance pipeline safety.</text></subsection> <subsection id="H495AFC33A39A4727AC598FD36511336F"><enum>(f)</enum><header>Definitions</header><text>The definitions contained in section 60101(a) of title 49, United States Code, shall apply to this section.</text></subsection></section> 
<section id="HD54EB5E3A26A4BF9AA2A91710F01D2FD" section-type="subsequent-section"><enum>30.</enum><header>Assessment of certain pipeline safety definitions</header> 
<subsection id="H23265AE936CC46319FF4357527619611"><enum>(a)</enum><header>Evaluation</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretary of Transportation shall evaluate the definition in section 192.5(b)(3)(ii) of title 49, Code of Federal Regulations, and the definition of identified site in section 192.903 of title 49, Code of Federal Regulations, to determine the adequacy for protecting buildings and occupied outdoor facilities from pipeline safety incidents.</text></subsection> <subsection id="H498471F393174360B5A4AC6EC3C71BC9"><enum>(b)</enum><header>Considerations</header><text>In carrying out the evaluation under subsection (a), the Secretary shall consider—</text> 
<paragraph id="H37F81E004B7545CEA8C0B27C0B9E00E0"><enum>(1)</enum><text>whether to revise the definition of the occupancy counts of these areas;</text></paragraph> <paragraph id="H5E307B518FB94A099692014B63002E82"><enum>(2)</enum><text>whether consistency in minimum occupancy thresholds throughout part 192 of title 49, Code of Federal Regulations, would improve safety; and</text></paragraph> 
<paragraph id="H56B486D963294B1FACE37040FF30C0BF"><enum>(3)</enum><text>whether defining the occupancy counts in these areas as 20 or more persons on at least a total of 50 days within any 12-month period would improve—</text> <subparagraph id="H5F2D1727AC8D45C1BD9925B6FBA4D2AB"><enum>(A)</enum><text>safety; and</text></subparagraph> 
<subparagraph id="H44CA374D75614A0D877424125941B8E2"><enum>(B)</enum><text>the efficiency of carrying out class determinations.</text></subparagraph></paragraph></subsection> <subsection id="H7DE3EB30CBE24924876DED8C220A27C2"><enum>(c)</enum><header>Modification of definitions</header><text display-inline="yes-display-inline">The Secretary shall issue such regulations as the Secretary determines necessary to modify the definitions in subsection (a) to increase safety for the protection of buildings and occupied outdoor facilities from pipeline safety incidents.</text></subsection></section> 
<section id="H5C84C17123E64D7584D6EAE8D96D1B20"><enum>31.</enum><header>Report assessing the costs of pipeline failures</header> 
<subsection id="H54364766E61046ADB587C76290297CCE"><enum>(a)</enum><header>Report assessing the costs of pipeline failures</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary of Transportation shall enter into an agreement with the National Academies under which the National Academies shall, not later than 3 years after such date of enactment, conduct a study of the direct and indirect costs related to the failure or shutdown of a gas, hazardous liquid, or carbon dioxide pipeline facility.</text></subsection> <subsection id="H8FF62B16DF9B4787ABDC44D8383D7350"><enum>(b)</enum><header>Elements</header><text>The study described under subsection (a) may include an analysis of—</text> 
<paragraph id="H434DD85E68094F5D9488C86B659B10D0" display-inline="no-display-inline"><enum>(1)</enum><text>the direct and indirect costs related to a failure or shutdown of a gas, hazardous liquid, or carbon dioxide pipeline facility, including local community emergency response costs, local planning for emergency response, and local community impact costs of loss of product;</text></paragraph> <paragraph id="H59BA5BC5BFFA41859F8B294BA34DA529"><enum>(2)</enum><text>the costs to an operator of such a facility of complying with enforcement actions related to a pipeline facility failure or shutdown, such as corrective action or consent orders, safety orders, and emergency orders;</text></paragraph> 
<paragraph id="H41206981E8FF4761BC0E19215A90D605"><enum>(3)</enum><text>the direct and indirect costs related to failure or shutdown of a gas, hazardous liquid, or carbon dioxide pipeline facility resulting from a cyber attack or intrusion, including any economic and supply chain impacts;</text></paragraph> <paragraph id="H2A1D13970FB24F9E9F3B5E971ADC75C0"><enum>(4)</enum><text>the impact to emergency response planning and resources of local communities, operators of gas, hazardous liquid, or carbon dioxide pipeline facilities, and the State, Federal, local, and Tribal governments in responding to and mitigating the impacts of a failure or shutdown of a gas, hazardous liquid, or carbon dioxide pipeline facility;</text></paragraph> 
<paragraph id="H15681DD883AA4E958DDEDB6855103F4D"><enum>(5)</enum><text>the costs of environmental remediation resulting from a gas, hazardous liquid, or carbon dioxide pipeline facility failure or shutdown;</text></paragraph> <paragraph id="HA097328DE0BD45A1A44433A859144E3B"><enum>(6)</enum><text>the economic impact of a gas, hazardous liquid, or carbon dioxide pipeline facility failure or shutdown, including—</text> 
<subparagraph id="H172308DF542C4F54A0FD13126D024441"><enum>(A)</enum><text>increases in product costs;</text></subparagraph> <subparagraph id="HCF41F09D80F94A059E4E9080B894DE19"><enum>(B)</enum><text>damage to public and private property; and</text></subparagraph> 
<subparagraph id="H068A7A184206430CA1E345444A884551"><enum>(C)</enum><text>the potential costs of moving gas, hazardous liquid, or carbon dioxide by other means of transportation, including by rail, truck, and barge; and</text></subparagraph></paragraph> <paragraph id="HC8ED465F65544E76886412FE1F7C9F11"><enum>(7)</enum><text>increased energy costs to households and businesses reliant on the movement of the gas, hazardous liquid or carbon dioxide due to the shutdown or failure of a pipeline facility.</text></paragraph></subsection> 
<subsection id="H835A145804584185BE20F6FFBC053FF5"><enum>(c)</enum><header>Consultation</header><text>In conducting the study under subsection (a), the National Academies shall consult with economists, State, Federal, local, and Tribal governments, emergency management officials, and pipeline stakeholders, including pipeline facility operators and public safety and environmental groups.</text></subsection> <subsection id="H9A27884E401644B987FC6381B628E506"><enum>(d)</enum><header>Report to Congress</header><text>Upon completion of the study conducted under subsection (a), the Secretary shall—</text> 
<paragraph id="H2098E2CBF4D34206BE6DED3CC5A4D87A"><enum>(1)</enum><text>require the National Academies to submit to the Secretary a report on such study; and</text></paragraph> <paragraph id="H102CA64AD7A24B369566A1C290F6A466"><enum>(2)</enum><text>submit to the Committee on Transportation and Infrastructure and the Committee on Energy and Commerce of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a report containing the results of such study.</text></paragraph></subsection></section> 
<section id="HEACFDF57BC2341D08A27863FCC2296B2"><enum>32.</enum><header>Study on localized emergency alert system for pipeline facilities incidents</header> 
<subsection id="H137F7483714F4B58BB8B1119BCA7A8C2"><enum>(a)</enum><header>GAO review</header><text>Not later than 18 months after the date of enactment of this Act, the Comptroller General of the United States shall submit to the Secretary of Transportation, the Committee on Transportation and Infrastructure and the Committee on Energy and Commerce of the House of Representatives, and the Committee on Commerce, Science, and Transportation of the Senate a study assessing—</text> <paragraph id="H1B075AE8E0164C6B862C880A88239E98"><enum>(1)</enum><text>the need and feasibility of requiring owners and operators of covered facilities to establish and maintain a localized emergency alert system; and </text></paragraph> 
<paragraph id="H7F2B8BF6EECB40AF8121D50733FFB361"><enum>(2)</enum><text>whether such an alert system would be best maintained by State or local emergency management officials or owners and operators of such facilities.</text></paragraph></subsection> <subsection id="H7032F53C351C4CBFBC1087DBBFEDB70D"><enum>(b)</enum><header>Considerations</header><text>In conducting the study under subsection (a), the Comptroller General shall—</text> 
<paragraph id="H3D1998B9929F455482530DE1D371A893"><enum>(1)</enum><text>consider the feasibility, benefits, costs, and safety impacts to affected stakeholders, including owners and operators of covered facilities, the public, and State and local emergency management officials, of requiring a localized emergency alert system;</text></paragraph> <paragraph id="HC409DDFEDF9D45D58838AAC0E9E7A524"><enum>(2)</enum><text>consider whether a localized emergency alert system can be established by such owners and operators or incorporated into existing public alert, broadcast, and electronic emergency alert systems, including by assessing—</text> 
<subparagraph id="H8397C4E7E68941E1AE3DB8113B317E1E"><enum>(A)</enum><text display-inline="yes-display-inline">whether a localized emergency alert system established and maintained by an owner or operator of a covered facility would conflict with, or impede the operation of, existing emergency alert systems;</text></subparagraph> <subparagraph id="HA189ECBC6DDF40008E0800C55BBB1D79"><enum>(B)</enum><text display-inline="yes-display-inline">the feasibility, benefits, costs, and technological needs of incorporating facility system data into existing emergency alert systems;</text></subparagraph> 
<subparagraph id="H8CC2E418BD5C43B4B147084BD5A289BF"><enum>(C)</enum><text display-inline="yes-display-inline">whether local emergency management organizations may need additional hardware, software, personnel, or communications support to incorporate a localized emergency alert system into an existing emergency alert system;</text></subparagraph> <subparagraph id="HC41AE072D44442E79AE74141B7D30430"><enum>(D)</enum><text display-inline="yes-display-inline">whether other systems could support notification to the public of an incident or accident at a covered facility, such as the National Response Center, the Reverse-911 telecommunication system, or severe weather warning systems; and</text></subparagraph> 
<subparagraph id="H9B6814F01342429790E9CB21EFCCCC2C"><enum>(E)</enum><text display-inline="yes-display-inline">whether localized emergency alert systems have been considered, studied, or implemented in other high hazard industries, such as industrial gases, chemicals, petrochemicals, and petroleum refining, and the results of any study or implementation of such systems in such industries; </text></subparagraph></paragraph> <paragraph id="H466BDE08DDD44E6EB5C60DA79C94DF93"><enum>(3)</enum><text>consult with owners and operators of large and small covered facilities, public safety advocacy groups, and urban and rural State and local emergency management officials;</text></paragraph> 
<paragraph id="HFCCCCBCBAD2E4395AD980256983132BF"><enum>(4)</enum><text display-inline="yes-display-inline">assess the adequacy of existing practices of owners and operators of covered facilities in providing timely and pertinent safety communication about an incident or accident at such facility to local communities affected by such incident or accident;</text></paragraph> <paragraph id="HB363B7447AA3445697E5899E4A9200F1"><enum>(5)</enum><text>assess whether there are legal hurdles to establishing a localized emergency alert system that uses voluntarily collected data or opt-in procedures, including any data security considerations;</text></paragraph> 
<paragraph id="HF4F49F0182384DA9A26D74D2842B80A2"><enum>(6)</enum><text>consider the feasibility, benefits, costs, and other impacts to State and Federal safety regulators who would oversee any requirement of owners and operators of covered facilities;</text></paragraph> <paragraph id="H29F1899C413046B8B175ED3CC968062F"><enum>(7)</enum><text>assess the types of incidents and accidents at covered facilities, by commodities transported and the unique characteristics of such incident or accident, that should be reported through a localized emergency alert system and the content of the information that should be provided;</text></paragraph> 
<paragraph id="HF1DBACF054BC4F918B276FAEF1BA6DBF"><enum>(8)</enum><text>assess which members of the public should receive communications from localized emergency alert systems, including individuals, persons, or organizations located in the vicinity of high consequence areas, unusually sensitive areas, and any other defining characteristics as determined by the Comptroller General; and</text></paragraph> <paragraph id="H3CBA5B4F83D043AE93DDA96D3150C7F3"><enum>(9)</enum><text>consider whether any Federal requirements or mandates are needed in order to establish an effective localized emergency alert system for incidents or accidents at covered facilities.</text></paragraph></subsection> 
<subsection id="H6E6A43E9BA55427285C459BF504ACDBE"><enum>(c)</enum><header>Recommendations</header><text>The Comptroller General shall include in the study conducted under subsection (a) any policy recommendations developed as a result of the information studied and assessed under subsection (b).</text></subsection> <subsection id="HB464ECAFB4AA4781AC22930E7826CEAB"><enum>(d)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text> 
<paragraph id="HE92E988338CE4FD8AF4EDAE535BF7ED2"><enum>(1)</enum><header>Covered facility</header><text display-inline="yes-display-inline">The term <term>covered facility</term> means a gas pipeline facility, a hazardous liquid pipeline facility, or a carbon dioxide pipeline facility, including a liquefied natural gas storage facility or an underground natural gas storage facility, as defined in section 60101 of title 49, United States Code.</text></paragraph> <paragraph id="HBCC75C887A554A15BE3126840E2B9373"><enum>(2)</enum><header>Localized emergency alert system</header><text>The term <term>localized emergency alert system</term> means a system that provides to individuals in the immediate vicinity of a covered facility an electronic notification of an incident or accident at such facility that presents an immediate risk to life or property.</text></paragraph></subsection></section> 
<section id="HE9BE24082207479E9BA81FD78520AD0C" display-inline="no-display-inline" section-type="subsequent-section"><enum>33.</enum><header>Maximum allowable operating pressure</header> 
<subsection id="H74FEF1F133F446449FC9B5D0F125B911"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 60139 of title 49, United States Code, is amended—</text> <paragraph id="H49031E1372F846678DF2C6C8D18DB00C" commented="no"><enum>(1)</enum><text>in subsection (c)(1)(A) by inserting <quote>except as provided in subsection (e),</quote> before <quote>require</quote>; </text></paragraph> 
<paragraph id="H83AD6441982C44D6AA50A16DF6511B32" commented="no"><enum>(2)</enum><text>by redesignating subsection (e) as subsection (f); and</text></paragraph> <paragraph id="HD2C4D3E6BA6348FB8A6F8DFFCB8053AF"><enum>(3)</enum><text>by inserting after subsection (d) the following: </text>

<subsection id="H93C2852E0D4A437C95295F212C4A5152"><enum>(e)</enum><header>Testing records working group</header> 
<paragraph id="H66F39056D026462BB74D70B84BB91456"><enum>(1)</enum><header>Previously tested transmission lines</header><text display-inline="yes-display-inline">Until the completion of the report of the Working Group required under paragraph (2) and the rulemaking proceeding required under paragraph (3), the Secretary shall not require an owner or operator of a pipeline facility to reconfirm the maximum allowable operating pressure of a natural gas transmission pipeline pursuant to section 192.624 of title 49, Code of Federal Regulations, if the owner or operator confirms the material strength of the pipeline through prior testing conducted to a sufficient minimum pressure in accordance with prevailing safety standards and practices, including any applicable class location factors, and documented in contemporaneous records.</text></paragraph> <paragraph id="H02A6907995AD4AA7B4FBD6AE8716CF8A"><enum>(2)</enum><header>Working group report</header> <subparagraph id="H6EF9B9742F3B4AF38F5F751530C6DCA6"><enum>(A)</enum><header>In general</header><text>No later than 30 days after the date of enactment of the <short-title>PIPES Act of 2023</short-title>, the Secretary of Transportation shall create a fairly balanced working group (hereinafter referred to as the <quote>Working Group</quote>) to produce a report containing recommendations on the minimum pressure and contemporaneous records that are sufficient to confirm the material strength of a pipeline through prior testing.</text></subparagraph> 
<subparagraph id="H086B8C0171654A0CACD169377991819C"><enum>(B)</enum><header>Composition of Working Group</header><text>The Working Group—</text> <clause id="H9FCD9B52BC6044D8BB9FBFE3A8A93EF2"><enum>(i)</enum><text display-inline="yes-display-inline">shall be comprised of the Administrator of the Pipeline and Hazardous Materials Safety Administration, State pipeline regulators, the public, and industry stakeholders active in the operation of natural gas pipelines; and</text></clause> 
<clause id="H9C8EA4F808E544B0BA22675357011DCD"><enum>(ii)</enum><text display-inline="yes-display-inline">may include members of the Technical Pipeline Safety Standards Committee or be conducted in a manner that otherwise ensures input from the public, as determined appropriate by the Secretary.</text></clause></subparagraph> <subparagraph id="H68473929D7F046F49521BC8A3163CC4F" commented="no"><enum>(C)</enum><header>Consideration</header><text>In preparing the report required under paragraph (1), the Working Group—</text> 
<clause id="HE84F7A8D7C8B467DBF9F448E0F7AB6E2" commented="no"><enum>(i)</enum><text>shall consider historical practices and all available research conducted regarding minimum pressure and contemporaneous records on transmission pipelines; and</text></clause> <clause id="HDBBC39E8CFCE4E0FA4ACD396BB0DFA6F" commented="no"><enum>(ii)</enum><text>may consider the need for any additional research or analyses needed to demonstrate the adequacy of any strength testing performed.</text></clause></subparagraph> 
<subparagraph id="H37D3E37877E1402586CC18832C4AD819" commented="no"><enum>(D)</enum><header>Applicability of FACA</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/10">Chapter 10</external-xref> of title 5 shall not apply to the Working Group.</text></subparagraph> <subparagraph id="H4918E97070EA41D0B7354DDA4D1A4A84"><enum>(E)</enum><header>Submission of report</header><text>Not later than 180 days after the date of enactment of the <short-title>PIPES Act of 2023</short-title>, the Working Group shall submit to the Secretary the report produced under paragraph (2), including any minority views.</text></subparagraph></paragraph>
