R. 6458</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20231121">November 21, 2023</action-date><action-desc><sponsor name-id="B001301">Mr. Bergman</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HED00">Committee on Education and the Workforce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To terminate the Office for Elementary and Secondary Education of the Department of Education and provide block grants to States.</official-title></form><legis-body id="H25900B20A34C4C2EBD81E3EA29CBFB9D" style="OLC"><section id="HE3BF41EB021947C6A5FE10321A945EB9" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Effective Money for Pupils: Overcoming Washington’s Educational Regulation Act</short-title></quote> or the <quote><short-title>EMPOWER Act</short-title></quote>.</text></section><section id="HD624C66A67AC46628D659D81EF98D408"><enum>2.</enum><header>Termination of the Office for Elementary and Secondary Education</header><text display-inline="no-display-inline">The Department of Education Organization Act (<external-xref legal-doc="usc" parsable-cite="usc/20/3401">20 U.S.C. 3401 et seq.</external-xref>) is amended—</text><paragraph id="HF57F756C6CEA422B9808987F24A37928"><enum>(1)</enum><text>in section 202(b)(1)—</text><subparagraph id="H80D0A82422814F6D98161F6CE6399ECC"><enum>(A)</enum><text>by striking subparagraph (A); and</text></subparagraph><subparagraph id="HC2DF5CA774E04D429B1A19F3BA88B289"><enum>(B)</enum><text>by redesignating subparagraphs (B) through (F) as subparagraphs (A) through (E), respectively; and</text></subparagraph></paragraph><paragraph id="HCA47CFB8FBE14A238215F44524CBE26A"><enum>(2)</enum><text>by repealing section 204.</text></paragraph></section><section id="H1FCA5B736915447A9C7D9F97B76B8FBC"><enum>3.</enum><header>Repeal and block grants</header><subsection id="H3FFC3AC4355A4AE4905E9752C194091C"><enum>(a)</enum><header>Repeal of applicable statutes and programs</header><text display-inline="yes-display-inline">Each applicable program and each provision in an applicable statute with respect to an applicable program is repealed.</text></subsection><subsection id="H4742B44E0FFC4619A219AA0F120B4137"><enum>(b)</enum><header>Block grants to States</header><text display-inline="yes-display-inline">Beginning with fiscal year 2024 and each succeeding fiscal year, the Secretary of Education shall award block grants to each State to make allocations to local educational agencies based on the relative number of children aged 5 to 17, inclusive, in the school district of each local educational agency. </text></subsection></section><section id="HFA373B07072E4BD9969650E8CAD48B95"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="HA00A92CD2DCF4306835819903081BAEE"><enum>(1)</enum><header>Applicable program</header><text display-inline="yes-display-inline">The term <term>applicable program</term> any program with respect to elementary or secondary education which the Secretary or the Department of Education has administrative responsibility as provided by law or by delegation of authority pursuant to law.</text></paragraph><paragraph id="H1D047E008A0341A7AC9DE89A03BE6A25"><enum>(2)</enum><header>Applicable statute</header><text display-inline="yes-display-inline">The term <term>applicable statute means</term>—</text><subparagraph id="H321C0AAD9BA04B89ABE3C961FEE89B12"><enum>(A)</enum><text>the Act or the title, part, section, or any other subdivision of an Act, as the case may be, that authorizes the appropriation for an applicable program; and</text></subparagraph><subparagraph id="H477413DBCD7242D4A01D74EAF05D3319"><enum>(B)</enum><text>any other statute that by its terms expressly controls the administration of an applicable program.</text></subparagraph></paragraph><paragraph id="HEC12A7B6C3EE40A3B186B299813FCE3D"><enum>(3)</enum><header>State</header><text display-inline="yes-display-inline">The term <term>State</term> means each of the 50 States, the District of Columbia, the Commonwealth of Puerto Rico, American Samoa, the Commonwealth of the Northern Mariana Islands, Guam, and the United States Virgin Islands.</text></paragraph></section><section id="H6398DBC2AF284005802A488895811A59"><enum>5.</enum><header>Effective date</header><text display-inline="no-display-inline">This Act, and the amendments made by this Act, shall take effect beginning on October 1, 2023.</text></section></legis-body></bill>
