which was referred to the <committee-name committee-id="HED00">Committee on Education and the Workforce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To protect borrowers of Federal student loans during the transition period following the end of the COVID–19 student loan repayment pause, and for other purposes.</official-title></form><legis-body id="HF4B82ADF27934D9F9772DD1E3BC9371E" style="OLC"><section id="HF4E536ED4D5D46F3A58A30CB05B1C3CA" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Student Loan Borrower Safety Net Act of 2023</short-title></quote>. </text></section><section id="H29AC85EE443843A592DE3E1E9E110F2D"><enum>2.</enum><header>Extension of application and recertification deadline</header><subsection id="HD98C4CF9563341C5B5B866B21222F6AB"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 3513 of the CARES Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref> note) is amended—</text><paragraph id="HED9BB327D346427CA66299037448A755"><enum>(1)</enum><text>by amending subsection (g) to read as follows:</text><quoted-block style="OLC" id="H7446BA15EA28449F9ADAD5AC3039BC65" display-inline="no-display-inline"><subsection id="HAF2E2449063C4A9EB40145D614D07B49"><enum>(g)</enum><header>Notice to borrowers of covered loans relating to transition period</header><text>Not later than the date that is 60 days prior to the first day on which a borrower’s payment obligations on a covered loan are no longer suspended, as determined by the Secretary, the Secretary shall carry out a program to provide a total of not fewer than 6 notices through a combination of postal mail, telephone, and electronic communication to such a borrower indicating—</text><paragraph id="H01C9F34112294B7B912507984EA9CDA7"><enum>(1)</enum><text>when the borrower’s normal payment obligations will resume; </text></paragraph><paragraph id="H2430E6707E3B48A08429857338CE9509"><enum>(2)</enum><text>that the borrower may be eligible to enroll in income-driven repayment, including a brief description of the most affordable and generous income-driven repayment options; and</text></paragraph><paragraph id="H908390BCC56D469DBB65EBFA3BA1058D"><enum>(3)</enum><text>the options available to a borrower who is in default, including—</text><subparagraph id="H516CC6EDC7894568A16C6F6749DB9650"><enum>(A)</enum><text>the option to participate in the Fresh Start program of the Department of Education;</text></subparagraph><subparagraph id="HB1B990F63C1B478F8D0FF94B73E7084A"><enum>(B)</enum><text>the option to rehabilitate or consolidate the borrower’s loans; and</text></subparagraph><subparagraph id="HBF88D5C1D2A84C4788C8D536670A5FDE"><enum>(C)</enum><text>a brief description of the benefits and consequences of each option.</text></subparagraph></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="HFDA860BCC4BA4C3990F38EBC6581BD7E"><enum>(2)</enum><text>by adding at the end the following: </text><quoted-block style="OLC" id="H738A5F03B21A458C92AC1141846A3629" display-inline="no-display-inline"><subsection id="H695210EED20441EC88021A00BAA8EDBC"><enum>(h)</enum><header>Priority notification</header><paragraph id="HC014E527D8D4448BB4D8E06D339CB4B1"><enum>(1)</enum><header>In general</header><text>In carrying out subsection (g), the Secretary shall give priority in accordance with paragraph (2) to notifying borrowers who—</text><subparagraph id="H27140E0B7B0D47D99C20001FB6E6CAA8"><enum>(A)</enum><text display-inline="yes-display-inline">during the 5-year period preceding March 31, 2020, missed a payment or payments for a period of not less than 60 days with respect to a covered loan; and</text></subparagraph><subparagraph id="HD784A5E839044253B3032C1A94E8F30B"><enum>(B)</enum><text>in the 5 years preceding March 31, 2020—</text><clause id="H52EAEB5840624352B29C2203461CD64B"><enum>(i)</enum><text>missed a payment in the first 3 months of entering repayment with respect to such a covered loan; </text></clause><clause id="H754E4EAC49A647E49E4E2E9723782CDF"><enum>(ii)</enum><text>entered into a non-administrative forbearance or a economic hardship deferment with respect to such a covered loan—</text><subclause id="H6F48D1A5749C488A98CB79825E77F1E1"><enum>(I)</enum><text>on 2 or more occasions; or</text></subclause><subclause id="HC9ADD8CC91A94027A5D6E6DD2F27B038"><enum>(II)</enum><text>for a period of longer than 1 year;</text></subclause></clause><clause id="H9A9C5167144A4A878D5AF51A2E8D89A9"><enum>(iii)</enum><text>were enrolled and subsequently unenrolled, or changed to less-than-half-time enrollment status, more than twice after entering repayment with respect to such a covered loan;</text></clause><clause id="H9523155A4DAE4BBDA9038B327E5ABC5A"><enum>(iv)</enum><text>defaulted on such a covered loan; or</text></clause><clause id="H3F59FE7C173945F99579C48E639BDA40"><enum>(v)</enum><text>on 3 or more occasions, missed two or more consecutive payments with respect to such a covered loan.</text></clause></subparagraph></paragraph><paragraph id="H8C9A05B82F1B4DA6AE92D7EAEB1B75CD"><enum>(2)</enum><header>Priority</header><text>In carrying out <internal-xref idref="HC014E527D8D4448BB4D8E06D339CB4B1" legis-path="(h)(1)">paragraph (1)</internal-xref>, the Secretary shall—</text><subparagraph id="HBFFD91D93E88405D9D1B19AAE3D23E7E"><enum>(A)</enum><text>notify borrowers described in such paragraph of the information specified in subsection (g) through at least 3 additional and subsequent notifications after the initial notification; or</text></subparagraph><subparagraph id="HB83290C0848543A68377579D662D22A5"><enum>(B)</enum><text display-inline="yes-display-inline">carry out other evidence-based outreach activities that are designed to assist struggling borrowers or borrowers who were otherwise at risk for default before the COVID–19 pandemic, and report to Congress on such activities.</text></subparagraph></paragraph></subsection><subsection id="HABE7185E82BA411B981C477AD11D14E7"><enum>(i)</enum><header>Application or recertification</header><paragraph id="H5978BE3464F443FDA8B35BAB69D5FFBB"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">A borrower of a covered loan may—<italic></italic></text><subparagraph id="H07C46206286247688ED249A18D4FC480" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">during the period beginning on the date of enactment of the <short-title>Student Loan Borrower Safety Net Act of 2023</short-title>, and ending on the date that is one year after the first day on which a borrower’s payment obligations on such loan are no longer suspended, submit a written, verbal, or electronic application or reapplication for an income-driven repayment plan with respect to such loan; and</text></subparagraph><subparagraph id="HA7F450400BD84C4FA937BDA108FEB5FA"><enum>(B)</enum><text>under an application described in <internal-xref idref="H07C46206286247688ED249A18D4FC480" legis-path="(i)(1)(A)">subparagraph (A)</internal-xref>, self-certify the income and family size of such borrower.</text></subparagraph></paragraph><paragraph id="H82D7202B11F64E2395A2180BC88C2A97"><enum>(2)</enum><header>Change of repayment plans</header><text display-inline="yes-display-inline">With respect to a covered loan, in the case of a borrower of such a loan who opts to change the repayment plan in which such borrower was enrolled on the date of the enactment of this section—</text><subparagraph id="HA090D9CB40DC44B6A7AA5D751E91488B"><enum>(A)</enum><text>no fee or payment shall be required during the period in which it takes such borrower to become enrolled in such repayment plan; and</text></subparagraph><subparagraph id="HD918C462EF51496B9A4EACE81A14B512"><enum>(B)</enum><text>before the borrower selects a new repayment plan, the Secretary shall notify the borrower of the most affordable and generous repayment plan available to the borrower.</text></subparagraph></paragraph><paragraph id="H18E592900EB9421BAE4894227EE5A951"><enum>(3)</enum><header>Economic hardship</header><subparagraph id="H6A45FBD4645546ED998FAD6420539245"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">A borrower of a covered loan who, due to an economic hardship, is unable to make payments with respect to such loan on or after the first day on which the borrower’s payment obligations on such loan are no longer suspended, may apply to the Secretary for an economic hardship deferment for the period beginning on the date of enactment of the <short-title>Student Loan Borrower Safety Net Act of 2023</short-title> and ending on the date that is one year after the first day on which the borrower’s payment obligations on such loan are no longer suspended. To apply for such a deferment, a borrower shall submit a written, verbal, or electronic certification of such economic hardship to the Secretary.</text></subparagraph><subparagraph id="H59C82BF1DFFF42F1B971559CCF7C5C48"><enum>(B)</enum><header>Notification</header><text display-inline="yes-display-inline">The Secretary and any other servicer of a covered loan shall notify borrowers who miss a payment on such a loan of the availability of—</text><clause id="H411FE5D9FD1C4D029C1CC9B36BFC3817" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">income-driven repayment plans available in accordance with <internal-xref idref="H5978BE3464F443FDA8B35BAB69D5FFBB" legis-path="(i)(1)">paragraph (1)</internal-xref>; and</text></clause><clause id="H109D4704542745B7918DC8D16478C378"><enum>(ii)</enum><text>an economic hardship deferment under this paragraph.</text></clause></subparagraph><subparagraph id="HFE5249757E8E4100BE1ED17E9C6D65BD"><enum>(C)</enum><header>Treatment of borrower with economic hardship</header><text display-inline="yes-display-inline">In the case of a borrower who submits certification of an economic hardship under <internal-xref idref="H6A45FBD4645546ED998FAD6420539245" legis-path="(i)(3)(A)">subparagraph (A)</internal-xref>, the Secretary shall treat such borrower in the same manner as a borrower with an economic hardship under section 435(o) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1085">20 U.S.C. 1085(o)</external-xref>).</text></subparagraph></paragraph></subsection><subsection id="H5DC59FD74A2E4A3FBBA9B9FEE7B8C0D0"><enum>(j)</enum><header>Missed payments</header><text display-inline="yes-display-inline">In the case of a borrower of a covered loan who misses a payment or payments on such a loan for the 60-day period beginning on the first day on which the borrower’s payment obligations on such loan are no longer suspended, the Secretary or the holder of a loan described in <internal-xref idref="HE673E27A7D2B4E18B6B234592610319C" legis-path="(k)(2)">subsection (k)(2)</internal-xref> shall—</text><paragraph id="H2C4B9BE464714EABA4B926C804DB8E67"><enum>(1)</enum><text display-inline="yes-display-inline">hold such loan in administrative forbearance for a 90-day period beginning on the date that is 60 days after the first day on which the borrower’s payment obligations on such loan are no longer suspended; and</text></paragraph><paragraph id="HF4844F79F019408896B07ECED1ACE6D7"><enum>(2)</enum><text display-inline="yes-display-inline">contact such borrower on at least 6 separate occasions regarding the information included in subsection (g).</text></paragraph></subsection><subsection id="H9DCE688E01A34BA8906AEBC7698BFA11" commented="no"><enum>(k)</enum><header>Covered loan</header><text>In this section, the term <term>covered loan</term> means—</text><paragraph id="H7FD0095BD67F49C1990817065BEBD82A" commented="no"><enum>(1)</enum><text>a loan described in subsection (a); or</text></paragraph><paragraph id="HE673E27A7D2B4E18B6B234592610319C" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">a loan—</text><subparagraph id="H3CD3DF763D1748DCBE5F98C6EA1FA7E5" commented="no"><enum>(A)</enum><text>made, insured, or guaranteed under part B of title IV of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1071">20 U.S.C. 1071 et seq.</external-xref>); and</text></subparagraph><subparagraph id="HC904B8651CCF44F3916DC0295CA65FF5" commented="no"><enum>(B)</enum><text>for which payments were suspended—</text><clause id="H3E4CFB2C165C4CE9BD80D782D564A1B6" commented="no"><enum>(i)</enum><text>pursuant to the Higher Education Relief Opportunities for Students Act of 2003 (<external-xref legal-doc="public-law" parsable-cite="pl/108/76">Public Law 108–76</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/20/1070">20 U.S.C. 1070</external-xref> note); and</text></clause><clause id="H14EADF4AC4EF4A53AB7F2454A3C1B038" commented="no"><enum>(ii)</enum><text>during a qualifying emergency.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></legis-body></bill>
