which was referred to the <committee-name committee-id="HAG00">Committee on Agriculture</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Farm Security and Rural Investment Act of 2002 to improve biorefinery, renewable chemical, and biobased product manufacturing assistance, and for other purposes.</official-title></form><legis-body id="H1FBD49607E7B4F098258BC297F647C60" style="OLC"><section id="HBC9AA9B87B964A798DD9F7FFAC5A0301" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Agricultural Biorefinery Innovation and Opportunity Act of 2023</short-title></quote>.</text></section><section id="HD1FF9ED98645421A9C80B6D140651689" commented="no" section-type="subsequent-section"><enum>2.</enum><header>Biorefinery, renewable chemical, and biobased product manufacturing assistance</header><text display-inline="no-display-inline">Section 9003 of the Farm Security and Rural Investment Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/7/8103">7 U.S.C. 8103</external-xref>) is amended—</text><paragraph id="HF450FE8107B84F1F92B64238C92102C6" commented="no"><enum>(1)</enum><text>in subsection (a), in the matter preceding paragraph (1), by striking <quote>to assist</quote> and inserting <quote>to develop advanced biofuels (which, for purposes of this section, shall include ultra-low-carbon bioethanol and zero-carbon bioethanol), renewable chemicals, and biobased product manufacturing and assist</quote>;</text></paragraph><paragraph id="H1C38AAAC763A4A2EB73A687F7CD81186" commented="no"><enum>(2)</enum><text>in subsection (b)(1)—</text><subparagraph id="HDE630551E25940789107EE22236E37E5" commented="no"><enum>(A)</enum><text>by striking <quote>technologically new </quote>; and</text></subparagraph><subparagraph id="H04DC3321793B4B61BECCB149CFADFB59" commented="no"><enum>(B)</enum><text>by striking <quote>end-user products</quote> and inserting <quote>end-user products, renewable chemicals, and biobased products</quote>;</text></subparagraph></paragraph><paragraph id="HF537932782B64A3FA0E9C3F125211AF2" commented="no"><enum>(3)</enum><text>in subsection (c)—</text><subparagraph id="HC46F9E37B7B94A6490D9F8B92FC07796" commented="no"><enum>(A)</enum><text>by striking <quote>The Secretary shall make available to eligible entities guarantees</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="yes-display-inline" id="HCB42A8831CB145C793708FFCCD9F11BE"><text>Subject to the availability of funding, the Secretary shall make available to eligible entities—</text><paragraph commented="no" display-inline="no-display-inline" id="H9CA4BB978AD742468D0277CD5863D238"><enum>(1)</enum><text display-inline="yes-display-inline">on a year-round basis, guarantees</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="H1055922FBC9C4FAE8A0DE78DF0C6809F" commented="no"><enum>(B)</enum><text>in paragraph (1) (as so designated), by striking the period at the end and inserting <quote>, in accordance with subsection (d); and</quote>; and</text></subparagraph><subparagraph id="H9FC8C25382BB4A2A94D0F1D1B56AECE4" commented="no"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H0EC84E64A70B4A9DB35A43C32EA35A2F"><paragraph id="H62146D84C6344871A2C27887942E943B"><enum>(2)</enum><text>grants, on a competitive basis, to develop, construct, or retrofit pilot or demonstration-scale biorefineries to demonstrate the commercial viability of 1 or more processes for converting renewable biomass to advanced biofuels, renewable chemicals, and biobased products in accordance with subsection (e).</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H19281217550E4CF9B8DE9E364CA6206D" commented="no"><enum>(4)</enum><text>in subsection (d)(1)—</text><subparagraph id="HBCD81694ACED4F27A42C8602EFE2178D" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text>by striking subparagraphs (A) and (C);</text></subparagraph><subparagraph id="HA7A410F1FE2E4F0B87312BE8F30FAB7B" commented="no"><enum>(B)</enum><text>by redesignating subparagraphs (B) and (D) as subparagraphs (A) and (B), respectively;</text></subparagraph><subparagraph id="H7CD41C8F1F6E4DBA8EE205B902A30607" commented="no"><enum>(C)</enum><text>in subparagraph (A) (as so redesignated)—</text><clause id="H382736F4CA1C417D885D6B72D9CC2113" commented="no"><enum>(i)</enum><text>by striking <quote>In approving a loan guarantee application</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H1E48C32318094990B38D0D041F254D5A"><clause id="H5CF2135A89A548D9805698A01C479734" commented="no"><enum>(i)</enum><header>In general</header><text>In approving an application for a loan guarantee under subsection (c)(1)</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></clause><clause id="HD9984E51920244BBB9E7F5534F1F6716" commented="no"><enum>(ii)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HE9A7B9FF9B77498DA26554CF1B014683"><clause id="H7E096E6ABEC245CABC42A3F7514146E7" commented="no"><enum>(ii)</enum><header>Waiver</header><text>The Secretary may waive the feasibility study under clause (i) for proven or otherwise commercially available technologies.</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="H09C30E5A6B2242FD980913862236A78C" commented="no"><enum>(D)</enum><text>in subparagraph (B) (as so redesignated), by striking <quote>loan guarantee applications</quote> and inserting <quote>applications for loan guarantees under subsection (c)(1)</quote>;</text></subparagraph></paragraph><paragraph id="HA44FC1EA7AB84AF1A449E72A7C461BD4" commented="no"><enum>(5)</enum><text>by redesignating subsection (e) as subsection (k);</text></paragraph><paragraph id="H5077BBF2076A4E46BF7726C4A0FB555C" commented="no"><enum>(6)</enum><text>by inserting after subsection (d) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HD9479A21B8A74BC1ACB58BD363E42A0E"><subsection id="HF4195C7FDB9143558D41D5A7C523C2F5" commented="no"><enum>(e)</enum><header>Grants</header><paragraph id="H682E463026F14862B08C29490550FDE5" commented="no"><enum>(1)</enum><header>Selection criteria</header><subparagraph id="H6FF52D66376F44B9922CB16BAC250A0E" commented="no"><enum>(A)</enum><header>In general</header><text>In approving applications for grants under subsection (c)(2), the Secretary shall establish a priority scoring system that assigns priority scores to each application and only approve applications that exceed a specified minimum score, as determined by the Secretary.</text></subparagraph><subparagraph id="HDADBD03EC72A4D0CB0C69ADCCB99EC87" commented="no"><enum>(B)</enum><header>Feasibility</header><clause id="H53F413BAB09B43AE9FF24BC0A0BE48DB" commented="no"><enum>(i)</enum><header>In general</header><text>In approving an application for a grant under subsection (c)(2), the Secretary shall determine the technical and economic feasibility of the project based on a feasibility study of the project described in the application conducted by an independent third party.</text></clause><clause id="HAC71D6379DE748D6AEA58DB19668449B" commented="no"><enum>(ii)</enum><header>Waiver</header><text>The Secretary may waive the feasibility study under clause (i) for proven or otherwise commercially available technologies.</text></clause></subparagraph><subparagraph id="H4EEF2BB58692433E824C709DC484C53E" commented="no"><enum>(C)</enum><header>Scoring system</header><text>The priority scoring system established under subparagraph (A) shall consider, with respect to a project proposed in an application for a grant under subsection (c)(2)—</text><clause id="H1D416C60110F47408904F50D3025261A"><enum>(i)</enum><text>the potential market for the advanced biofuel, renewable chemical, or biobased product, and the byproducts produced under the project;</text></clause><clause id="H00BDF73DAE934AEF970EE3DE70BBA235" commented="no"><enum>(ii)</enum><text>the level of financial participation by the eligible entity, including support from non-Federal and private sources;</text></clause><clause id="H604A0B785B2446D89CD4258CD5D70911" commented="no"><enum>(iii)</enum><text>whether the eligible entity is proposing to use—</text><subclause id="HF4A8C2B498FA4666BD64058632BBAC90" commented="no"><enum>(I)</enum><text>a feedstock not previously used in the production of advanced biofuels; or</text></subclause><subclause id="HC6ACB73B60334CEF8588635258C544AA" commented="no"><enum>(II)</enum><text>a feedstock, process, or technology in an innovative manner in the production of renewable chemicals or biobased products;</text></subclause></clause><clause id="H702CA6DEA0114B8CBC3E2CCA9E020DF6" commented="no"><enum>(iv)</enum><text>whether the eligible entity is proposing to work with producer associations or cooperatives;</text></clause><clause id="HC9147633F7B64BB09A086302C45FD9A5" commented="no"><enum>(v)</enum><text>whether the eligible entity has established that the adoption of the process proposed in the application will have a positive impact on resource conservation, public health, and the environment;</text></clause><clause id="HC2055ED8143546B8A78CC8350BCB5C0C" commented="no"><enum>(vi)</enum><text>the potential for rural economic development;</text></clause><clause id="H1F43699E378D4876877CCB1C7DCB84AF" commented="no"><enum>(vii)</enum><text>whether the project can be replicated; </text></clause><clause id="H2AE172CA7C3A43CD8755CCD2600698F3" commented="no"><enum>(viii)</enum><text>scalability for commercial use; and</text></clause><clause commented="no" display-inline="no-display-inline" id="H5A7B94DA425E47AA909D3270BA9358AE"><enum>(ix)</enum><text>in the case of an advanced biofuels project, the contribution of the project to domestic energy security.</text></clause></subparagraph></paragraph><paragraph id="HDFF7C1AE9F774E489BA93D635DC2982A" commented="no"><enum>(2)</enum><header>Cost sharing</header><subparagraph id="H8EE7BEB99656454897D28A171D9623F1" commented="no"><enum>(A)</enum><header>Limits</header><text>The amount of a grant awarded under subsection (c)(2) shall not exceed an amount that is 60 percent of the cost of the project carried out using the grant.</text></subparagraph><subparagraph id="H8305C63E953D45829968D06AF85C2F2D" commented="no"><enum>(B)</enum><header>Non-Federal share</header><text>The non-Federal share of the cost of a project may be provided in the form of cash or material, subject to the condition that the material provided does not exceed 30 percent of the non-Federal share.</text></subparagraph></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="H81FA2896D4C64445B74180A3F5FCF9CA" commented="no"><enum>(7)</enum><text>in subsection (g)—</text><subparagraph id="H23DBF8F51D484F07A8C26947391B4F93" commented="no"><enum>(A)</enum><text>in paragraph (1)—</text><clause id="H23EEB8C22DAF4313BF683E7896308BBC" commented="no"><enum>(i)</enum><text>in subparagraph (A)—</text><subclause id="H479C373CE1FC4E7EA1B33ABDE5B817B1" commented="no"><enum>(I)</enum><text>in the matter preceding clause (i), by inserting <quote>and grants</quote> after <quote>loan guarantees</quote>;</text></subclause><subclause id="HF5E44F13904B4E47BA473E6F9AC1750E" commented="no"><enum>(II)</enum><text>in clause (iii), by striking <quote>and</quote> at the end;</text></subclause><subclause id="H8E9E1903EBFB47E6BE9AFEC2540164F6" commented="no"><enum>(III)</enum><text>in clause (iv), by striking the period at the end and inserting <quote>; and</quote>; and</text></subclause><subclause id="H2A22FEC0515C4721B05CC2699F20BE72" commented="no"><enum>(IV)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HD373644D559B4088939DD4DB39B9E20E"><clause id="H392C8BB0CEA946678615FC1594971AC5" commented="no"><enum>(v)</enum><text>$100,000,000 for each of fiscal years 2024 through 2028.</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subclause></clause><clause id="H0B97F35D46D744AE916247F9AAE9AEAC" commented="no"><enum>(ii)</enum><text>in subparagraph (B), by striking <quote>Of the total</quote> and all that follows through <quote>subparagraph (A)</quote> and inserting <quote>Of the total amount of funds made available for each of fiscal years 2024 through 2028 under subparagraph (A)</quote>; and</text></clause></subparagraph><subparagraph id="H694F41E31E0A40219DFFD8BAC2043FFD" commented="no"><enum>(B)</enum><text>in paragraph (2), by striking <quote>2023</quote> and inserting <quote>2028</quote>;</text></subparagraph></paragraph><paragraph id="H1D1C1D882252455C876B0C99E91B0C9F" commented="no"><enum>(8)</enum><text>in subsection (h)(1), by striking <quote>subsections (a) through (e), and (g)</quote> and inserting <quote>subsections (a) through (e), (g), and (k)</quote>;</text></paragraph><paragraph id="H6E84EE79C487463788E42006094F7356" commented="no"><enum>(9)</enum><text>in subsection (i)(1), by striking <quote>subsections (a) through (e) and subsection (g)</quote> and inserting <quote>subsections (a) through (e), (g), and (k)</quote>;
