R. 6410</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20231114">November 14, 2023</action-date><action-desc><sponsor name-id="L000596">Mrs. Luna</sponsor> (for herself, <cosponsor name-id="M001211">Mrs. Miller of Illinois</cosponsor>, <cosponsor name-id="N000190">Mr. Norman</cosponsor>, and <cosponsor name-id="S001222">Mr. Santos</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To prohibit persons from storing the covered data of covered platforms in the United States in a foreign adversary or permitting governmental officials of foreign adversaries to access the covered data, and for other purposes.</official-title></form><legis-body id="HA08789EE813F40AA85AFFC54C324FD42" style="OLC"><section id="H94862161263D4790BE0E90E5F93F91B9" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>U.S. Data on U.S. Soil Act</short-title></quote>.</text></section><section id="H4BDBF74F4EA54044ADD95CC048A6E8E0"><enum>2.</enum><header>Storage and access by foreign adversary of covered data</header><subsection id="H4EE7914BA218459D9CF2824932A53ACD"><enum>(a)</enum><header>Regulations</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this Act, the Commission shall promulgate, under section 553 of title 5, United States Code, regulations in accordance with this section that prohibit a person, with respect to the covered data of any covered platform in the United States, from knowingly—</text><paragraph id="HD3DBB9C68CE94FD8B1AEA2D99231CE9A"><enum>(1)</enum><text display-inline="yes-display-inline">storing the covered data of the covered platform in a physical data center in a foreign adversary; or</text></paragraph><paragraph id="HF89C14402AA2415F9155287E2F30D029"><enum>(2)</enum><text display-inline="yes-display-inline">permitting a governmental official of a foreign adversary to access the covered data.</text></paragraph></subsection><subsection id="HA0359AC0DCC34C27B34BD45EA7821C91"><enum>(b)</enum><header>Enforcement by Commission</header><paragraph id="H96705C602F3F4703A2F953404AB4F84B"><enum>(1)</enum><header>Unfair or deceptive acts or practices</header><text display-inline="yes-display-inline">A violation of this section or a regulation promulgated under this section shall be treated as a violation of a regulation under section 18(a)(1)(B) of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/57a">15 U.S.C. 57a(a)(1)(B)</external-xref>) regarding unfair or deceptive acts or practices.</text></paragraph><paragraph id="H2C753ECA5FF744F1962AA9C92260E827"><enum>(2)</enum><header>Powers of Commission</header><text display-inline="yes-display-inline">The Commission shall enforce this section and the regulations promulgated under this section in the same manner, by the same means, and with the same jurisdiction, powers, and duties as though all applicable terms and provisions of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>) were incorporated into and made a part of this section. Any person who violates this section or a regulation promulgated under this section shall be subject to the penalties and entitled to the privileges and immunities provided in the Federal Trade Commission Act.</text></paragraph></subsection><subsection id="HA833B3798DDC458FB3C790F9F136EA76" commented="no"><enum>(c)</enum><header>Relationship to State laws</header><paragraph id="H1EAFCA9D2D3C4881922619A91245A8E9" commented="no"><enum>(1)</enum><header>Preemption</header><text display-inline="yes-display-inline">Nothing in this Act, or a regulation promulgated under this Act, shall be construed to preempt, displace, or supplant any State law, except to the extent that a provision of State law conflicts with a provision of this Act, or a regulation promulgated under this Act, and then only to the extent of the conflict.</text></paragraph><paragraph id="HF05662922E5F4690B4963977083B0A21" commented="no"><enum>(2)</enum><header>Greater protection under State law</header><text display-inline="yes-display-inline">For purposes of this subsection, a provision of State law does not conflict with a provision of this Act, or a regulation promulgated under this Act, if such provision of State law provides greater privacy protection or security of covered data than the privacy protection or security provided by such provision of this Act or such regulation.</text></paragraph></subsection><subsection id="HCB342342D3E348DB9254D6A02363D039" commented="no"><enum>(d)</enum><header>Savings clause</header><text display-inline="yes-display-inline">Nothing in this section may be construed to limit the authority of the Commission under any other provision of law.</text></subsection><subsection id="H3612685901E540818EA40236F851D07E"><enum>(e)</enum><header>Report to Congress</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this Act, the Commission, in consultation with the Attorney General, shall submit to Congress a report on the implementation and enforcement of this section.</text></subsection><subsection id="H211AFEB6DE2E4D1D829719E7A350A410"><enum>(f)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H8A2519D186094E6B9A36DE2DA4EC6BDF"><enum>(1)</enum><header>Commission</header><text>The term <term>Commission</term> means the Federal Trade Commission.</text></paragraph><paragraph id="HFF70CBF6807048189C530FA6536D55C6"><enum>(2)</enum><header>Covered data</header><text display-inline="yes-display-inline">The term <term>covered data</term> means information that identifies or is linked or reasonably linkable, alone or in combination with other information, to an individual who is a national of the United States or a device that identifies or is linked or reasonably linkable to such an individual, and may include derived data and unique persistent identifiers. </text></paragraph><paragraph id="H29E5791074B24DEE97EE7E414B6A2F4D"><enum>(3)</enum><header>Covered platform</header><text display-inline="yes-display-inline">The term <term>covered platform</term> means any website, desktop application, or mobile application that is consumer-facing, sells digital advertising space, and has more than 100,000,000 monthly active users for a majority of months during the preceding 12 months.</text></paragraph><paragraph id="HD13DABA9C8024F2A86AB20965092363E" commented="no"><enum>(4)</enum><header>Foreign adversary</header><text display-inline="yes-display-inline">The term <term>foreign adversary</term>—</text><subparagraph id="H56FC9991AD7F48E78EA796D06DD1CFB6" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">has the meaning given that term in section 8(c)(2) of the Secure and Trusted Communications Networks Act of 2019 (<external-xref legal-doc="usc" parsable-cite="usc/47/1607">47 U.S.C. 1607(c)(2)</external-xref>); and</text></subparagraph><subparagraph id="HAD8F363BB6D749628BEDCCCCC11BF641" commented="no"><enum>(B)</enum><text>includes—</text><clause id="H3BE4C989227C439F8C0B4686328F6881" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">the People’s Republic of China, including the Hong Kong Special Administrative Region (China); </text></clause><clause id="H8B2D53620B3345B1916B597309394D01" commented="no"><enum>(ii)</enum><text>the Republic of Cuba (Cuba);</text></clause><clause id="H8D9CCDCA6B164C30B8F716DDB77EF94A" commented="no"><enum>(iii)</enum><text>the Islamic Republic of Iran (Iran);</text></clause><clause id="H68FF423D07474DD4BFC50A015AFA6A1E" commented="no"><enum>(iv)</enum><text>the Democratic People’s Republic of Korea (North Korea);</text></clause><clause id="HCCDDDF138C874390B808FAB6C5A95D0B" commented="no"><enum>(v)</enum><text>the Russian Federation (Russia); and</text></clause><clause id="H52F0285FAE0D4ED29E650CAD29493830" commented="no"><enum>(vi)</enum><text display-inline="yes-display-inline">Venezuelan politician Nicolas Maduro (Maduro Regime).</text></clause></subparagraph></paragraph><paragraph id="H9E1F9529F77D44A79D3445B393D7CDC9"><enum>(5)</enum><header>National of the United States</header><text display-inline="yes-display-inline">The term <term>national of the United States</term> has the meaning given that term in section 101(a)(22) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(22)</external-xref>).</text></paragraph><paragraph id="H52EDD352AA7B4B62B6567556334ABACD" commented="no"><enum>(6)</enum><header>State</header><text display-inline="yes-display-inline">The term <term>State</term> means each State of the United States, the District of Columbia, each commonwealth, territory or possession of the United States, and each federally recognized Indian Tribe.</text></paragraph></subsection></section></legis-body></bill>
