Short title

This Act may be cited as the Grant Relief for American Children’s Elevation Act of 2023 or the GRACE Act.

Exceptional and extremely unusual hardship

Section 240A(b) of the Immigration and Nationality Act (8 U.S.C. 1229b) is amended by adding at the end the following:(7)

Exceptional and extremely unusual hardship defined

In this subsection, the term exceptional and extremely unusual hardship shall include hardship resulting from separating a family member who is a United States citizen, a lawful permanent resident or an individual lawfully admitted to the United States and a family member who is subject to deportation or removal from the United States..
