R. 635</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20230130">January 30, 2023</action-date><action-desc><sponsor name-id="R000103">Mr. Rosendale</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committee on <committee-name committee-id="HWM00">Ways and Means</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title XVIII of the Social Security Act to permanently include certain HCPCS codes as telehealth services under such title, and for other purposes.</official-title></form><legis-body id="HA64450F9C03A4D1F8AA280935B114BD9" style="OLC"><section id="H1B97DEC8CD714B1787A4509C85E7BF4A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Expanding Access to Mental Health Services Act</short-title></quote>. </text></section><section id="H57FE1323E0794360B58F1C8E6270D0AC"><enum>2.</enum><header>Permanent inclusion of certain HCPCS codes as telehealth services under Medicare</header><text display-inline="no-display-inline">Section 1834(m)(4)(F) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(m)(4)(F)</external-xref>) is amended—</text><paragraph id="HB4486AADBD4B4046BFC33839C39C2158"><enum>(1)</enum><text>in clause (i), by inserting <quote>the HCPCS codes specified in clause (iii),</quote> before <quote>, and</quote>; and</text></paragraph><paragraph id="H062FF449968542F78AD06716D10E562F"><enum>(2)</enum><text>by adding at the end the following new clause:</text><quoted-block style="OLC" id="H2F6307CE0DA84B7A8062CE3F5874EEE9" display-inline="no-display-inline"><clause id="H48F6230404764939A4D88AAF8E265763"><enum>(iii)</enum><header>Specified HCPCS code</header><text display-inline="yes-display-inline">For purposes of clause (i), beginning April 1, 2023, an HCPCS code specified in this clause is—</text><subclause id="H0AC8957FD49E4B18B901E0B44845B999"><enum>(I)</enum><text>90875, 96125, 96170, 96171, 97151, 97152, 97153, 97154, 97155, 97156, 97157, and 97158; and</text></subclause><subclause id="HC674149070E44626830054D18865B624"><enum>(II)</enum><text display-inline="yes-display-inline">96127, 96130, 96131, 96132, 96133, 96136, 96137, 96138, 96139, and 96158.</text></subclause><continuation-text continuation-text-level="clause">With respect to telehealth services identified by HCPCS codes in subclause (II), the Secretary shall waive the requirements of paragraph (1) and section 410.78(a)(3) of title 42, Code of Federal Regulations (or any successor regulation), relating to the use of interactive telecommunications systems to furnish telehealth services, to the extent such provisions require the use of video technology, to allow for the furnishing of evaluation and management services, behavioral health counseling and educational services, and other services determined appropriate by the Secretary by a qualified provider using audio-only technology, as determined by the Secretary based on whether it is clinically appropriate to furnish such services using audio-only technology and whether an in-person initial visit is required prior to the furnishing of such service using such technology.</continuation-text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
