<section id="H5E8F80B3E1144D03A7DCBA7329ABF0EC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Advanced Reactor Fee Reduction Act</short-title></quote>. </text> </section> <section id="H377C7B47C0214696AA17D72D0BA444F5"><enum>2.</enum><header>Fees for advanced nuclear reactor application review</header> <subsection id="H94B279A713C74EE5853F97256EDBF258" commented="no"><enum>(a)</enum><header>Definitions</header><text>Section 3 of the Nuclear Energy Innovation and Modernization Act (<external-xref legal-doc="usc" parsable-cite="usc/42/2215">42 U.S.C. 2215</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/115/439">Public Law 115–439</external-xref>) is amended—</text> 
<paragraph id="HC23DD83E44FB4179AE2B660B3E17E816" commented="no"><enum>(1)</enum><text>by redesignating paragraphs (2) through (15) as paragraphs (3), (5), (7), (8), (9), (10), (11), (14), (15), (16), (17), (18), (19), and (20), respectively;</text></paragraph> <paragraph id="H75D8CE87084C489DB26915DE89E0963B" commented="no"><enum>(2)</enum><text>by inserting after paragraph (1) the following:</text>

<paragraph id="HC961693A44AE49AAB012F25CEBE92CB8" commented="no"><enum>(2)</enum><header>Advanced nuclear reactor applicant</header><text>The term <term>advanced nuclear reactor applicant</term> means an entity that has submitted to the Commission an application for a license for an advanced nuclear reactor under the Atomic Energy Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2011">42 U.S.C. 2011 et seq.</external-xref>).</text></paragraph> <after-quoted-block>;</after-quoted-block></quoted-block></paragraph> <paragraph id="H839FBC9722624B7A91ABFF63CAA78C6F" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">by inserting after paragraph (3) (as so redesignated) the following:</text>

<paragraph id="H895D2EF4BB674CB480B8A9B538AE29E5" commented="no"><enum>(4)</enum><header>Advanced nuclear reactor preapplicant</header><text display-inline="yes-display-inline">The term <term>advanced nuclear reactor preapplicant</term> means an entity that has submitted to the Commission a licensing project plan for the purposes of submitting a future application for a license for an advanced nuclear reactor under the Atomic Energy Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2011">42 U.S.C. 2011 et seq.</external-xref>).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> <paragraph id="HB18C49F5324B4500B19656917F53C860" commented="no"><enum>(4)</enum><text>by inserting after paragraph (5) (as so redesignated) the following:</text>

<paragraph id="H804D024084BF454BB01763008A88B6EE" commented="no"><enum>(6)</enum><header>Agency support</header><text display-inline="yes-display-inline">The term <term>agency support</term> has the meaning given the term <term>agency support (corporate support and the IG)</term> in section 170.3 of title 10, Code of Federal Regulations (or any successor regulation).</text> </paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> <paragraph id="H6D644BDD8D0147F6A484111C6D641BA6" commented="no"><enum>(5)</enum><text>by inserting after paragraph (11) (as so redesignated) the following:</text>

<paragraph id="HEFFF0DF10D8C4418A0F70F262D914FA7" commented="no"><enum>(12)</enum><header>Mission-direct program salaries and benefits</header><text display-inline="yes-display-inline">The term <term>mission-direct program salaries and benefits</term> has the meaning given such term in section 170.3 of title 10, Code of Federal Regulations (or any successor regulation).</text> </paragraph> <paragraph id="HA2CD5F9EA4DF4C279ADE203C44F3D728" commented="no"><enum>(13)</enum><header>Mission-indirect program support</header><text display-inline="yes-display-inline">The term <term>mission-indirect program support</term> has the meaning given such term in section 170.3 of title 10, Code of Federal Regulations (or any successor regulation).</text> </paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H71B69159234149789D35726B6F065412"><enum>(b)</enum><header>Excluded activities</header><text>Section 102(b)(1)(B) of the Nuclear Energy Innovation and Modernization Act (<external-xref legal-doc="usc" parsable-cite="usc/42/2215">42 U.S.C. 2215(b)(1)(B)</external-xref>) is amended by adding at the end the following:</text> <quoted-block id="HC8C06038FF2844C2BF70C2D932196FA2" style="OLC"> <clause id="H9F6C9B35D0374355BEE90395F7BDFD72" commented="no"><enum>(iv)</enum><text display-inline="yes-display-inline">The total costs of mission-indirect program support and agency support that, under paragraph (2)(B)(ii), may not be included in the professional hourly rate charged for fees assessed and collected from advanced nuclear reactor applicants.</text> </clause> 
<clause id="HCEA3AE467B6149BBB2EC7A472B46B679" commented="no"><enum>(v)</enum><text display-inline="yes-display-inline">The total costs of mission-indirect program support and agency support that, under paragraph (2)(C)(ii), may not be included in the professional hourly rate charged for fees assessed and collected from advanced nuclear reactor preapplicants.</text> </clause><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H2C687687EBB7478284BDDC2C187C210E"><enum>(c)</enum><header>Fees for service or thing of value</header><text>Section 102(b) of the Nuclear Energy Innovation and Modernization Act (<external-xref legal-doc="usc" parsable-cite="usc/42/2215">42 U.S.C. 2215(b)</external-xref>) is amended by striking paragraph (2) and inserting the following:</text>

<paragraph id="HD7946B1AD41E4C0181DA23B033B65BAE"><enum>(2)</enum><header>Fees for service or thing of value</header> 
<subparagraph id="H61125D5CEDB74BB6B9C5B396AD75AE22"><enum>(A)</enum><header>In general</header><text>In accordance with section 9701 of title 31, United States Code, the Commission shall assess and collect fees from any person who receives a service or thing of value from the Commission to cover the costs to the Commission of providing the service or thing of value.</text></subparagraph> <subparagraph id="HD0B3C762A5364648908486F8D4833250" commented="no"><enum>(B)</enum><header>Advanced nuclear reactor applicants</header><text display-inline="yes-display-inline">The professional hourly rate charged for fees assessed and collected from an advanced nuclear reactor applicant under this paragraph relating to the review of a submitted application for an advanced nuclear reactor may not—</text> 
<clause id="H1F03E6639C744B6DBDB43A70F3D1F3F7"><enum>(i)</enum><text>exceed the professional hourly rate for mission-direct program salaries and benefits of the Nuclear Reactor Safety Program; and</text></clause> <clause id="H9267597F4CE74BE8AA4715FBF8F405B9"><enum>(ii)</enum><text display-inline="yes-display-inline">include the costs of mission-indirect program support and agency support.</text></clause></subparagraph> 
<subparagraph id="H733E0D90EA4147FEA72BF14D0A6E4E01" commented="no"><enum>(C)</enum><header>Advanced nuclear reactor preapplicants</header><text display-inline="yes-display-inline">The professional hourly rate charged for fees assessed and collected from an advanced nuclear reactor preapplicant under this paragraph relating to the review of submitted materials as described in the licensing project plan of such advanced nuclear reactor preapplicant may not—</text> <clause id="H97B8B960C9F449EAB2BDEDD0ADA69E40"><enum>(i)</enum><text>exceed the professional hourly rate for mission-direct program salaries and benefits of the Nuclear Reactor Safety Program; and</text></clause> 
<clause id="HCC86FBE3C253417A87A639682ABC80EE"><enum>(ii)</enum><text display-inline="yes-display-inline">include the costs of mission-indirect program support and agency support.</text></clause></subparagraph> <subparagraph id="HE65424113A08448F9B277A95B0B980E7"><enum>(D)</enum><header>Calculation of hourly rate</header><text display-inline="yes-display-inline">In this paragraph, the professional hourly rate for mission-direct program salaries and benefits of the Nuclear Reactor Safety Program equals the quotient obtained by dividing—</text> 
<clause id="HD1F609C8881541A387CA84FEC4D01C86" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">the full-time equivalent rate (within the meaning of the document of the Commission entitled <quote>FY 2023 Final Fee Rule Work Papers</quote> (or a successor document)) for mission-direct program salaries and benefits of the Nuclear Reactor Safety Program (as determined by the Commission) for a fiscal year; by</text></clause> <clause id="H89C5FDD60495403ABD5BE447D7D05506" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text>the productive hours assumption for that fiscal year, determined in accordance with the formula established in the document referred to in clause (i) (or a successor document).</text> </clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H4253EB260E944257A54FF95E204EC780"><enum>(d)</enum><header>Sunset</header><text>Section 102 of the Nuclear Energy Innovation and Modernization Act (<external-xref legal-doc="usc" parsable-cite="usc/42/2215">42 U.S.C. 2215</external-xref>) is amended by adding at the end the following:</text> <quoted-block id="H327FCF61FACD417E9445284745EC1BCB" style="OLC"> <subsection id="H0B6FA1E7ADA84A2181FA659506D19B97"><enum>(g)</enum><header>Cessation of effectiveness</header><text>Paragraphs (1)(B)(v) and (2)(C) of subsection (b) shall cease to be effective on September 30, 2029.</text> </subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HABE2DB29F2BD4CC6BCF41D6A28029FD5"><enum>(e)</enum><header>Effective date</header><text>The amendments made by this section shall take effect on October 1, 2024.</text></subsection></section> </legis-body></bill>
