which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committee on <committee-name committee-id="HJU00">the Judiciary</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To protect health care providers and people seeking reproductive health care services, and for other purposes.</official-title></form><legis-body id="HF32585C9D23C484D9847EA47D2FF32A1" style="OLC"><section id="H9569DF56DB254C40942F373A8FFA807B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Safeguard Healthcare Industry Employees from Litigation and Distress Act</short-title></quote> or the <quote><short-title>SHIELD Act</short-title></quote>.</text></section><section id="HF72ABC1598BD4C008580BC711D44636D" display-inline="no-display-inline"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H619AB9734EE14C1CAB3F880F41380051"><enum>(1)</enum><text display-inline="yes-display-inline">The term <term>reproductive health care service</term> includes, with respect to a current, potential, or anticipated pregnancy—</text><subparagraph id="HFC9399FF4CF34DCFAB0AD4AC7B9F5408"><enum>(A)</enum><text display-inline="yes-display-inline">a diagnosis;</text></subparagraph><subparagraph id="H0693ECD4AB0E4EC2922410B8714C8652"><enum>(B)</enum><text>an evaluation;</text></subparagraph><subparagraph id="HFA5E208E3C9744DABA8952A725AF02CC"><enum>(C)</enum><text>an assessment;</text></subparagraph><subparagraph id="HC23FA9788B0E454B8CE7D67FDD3D4486"><enum>(D)</enum><text>a consultation or the provision of advice, including with respect to decision making;</text></subparagraph><subparagraph id="H97137088F2E745169B892FB76B9F1873"><enum>(E)</enum><text>a treatment; and </text></subparagraph><subparagraph id="HA40AE41858FE4EC6AEA43ABD0D76AD44"><enum>(F)</enum><text>an abortion-related health care service. </text></subparagraph></paragraph><paragraph id="H8CBCA577FEDA4F5BA47501BE64859EEB"><enum>(2)</enum><text>The term <term>health care provider</term> means any entity or individual (including any physician, certified nurse-midwife, nurse practitioner, nurse, physician’s assistant, pharmacist, or other medical professional) that is—</text><subparagraph id="H87CBC0A4595040509825A2C368714F89"><enum>(A)</enum><text>engaged or seeks to engage in decision making related to, or the delivery of, health care services, including reproductive health care services; and</text></subparagraph><subparagraph id="H1B30A4A69A8A4C36B251FE5D09D72267"><enum>(B)</enum><text>licensed or certified to perform such service under applicable State law.</text></subparagraph></paragraph><paragraph id="H14ECFAF4637B4A7C86D0CBE93935A5F5"><enum>(3)</enum><text>The term <term>State</term> includes the several States, the District of Columbia, the Commonwealth of Puerto Rico, the United States Virgin Islands, American Samoa, Guam, the Northern Mariana Islands, each Indian tribe, and each territory or possession of the United States.</text></paragraph></section><section id="H2DA5E54883C84FFA89E2B1AB5285DB42"><enum>3.</enum><header>Restriction on certain Department of Justice law enforcement funding</header><subsection id="H8E2ADDB21815423AB833EB582C3E66F9" commented="no"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The funds that a State would otherwise receive under a covered grant program shall be reduced by 50 percent if the State has in effect a law that authorizes officers or employees of the State or of a unit of local government to prevent (including through criminal enforcement), restrict, impede, or retaliate against—</text><paragraph id="H2D965863184B4AFBB6217D95388699C2" commented="no"><enum>(1)</enum><text>a health care provider who seeks to initiate, provide, or otherwise facilitate the provision of reproductive health care services to a patient or prospective patient;</text></paragraph><paragraph id="H13E5C91C726D473680653C50016487A7" commented="no"><enum>(2)</enum><text>any person or entity that seeks to assist a health care provider who seeks to initiate, provide, or otherwise facilitate the provision of reproductive health care services to a patient or prospective patient;</text></paragraph><paragraph id="HD472EB71A0E840BD8216DFFDB407E35F" commented="no"><enum>(3)</enum><text>any person who seeks to gain access to—</text><subparagraph id="H01770E5F9CEE4E39BA1F41090C010F36" commented="no"><enum>(A)</enum><text>reproductive health care services; or </text></subparagraph><subparagraph id="H95F52D5DF428426D980D1CADE98AE524" commented="no"><enum>(B)</enum><text>a health care provider for the purpose of accessing reproductive health care services; or</text></subparagraph></paragraph><paragraph id="HDFAE86BF340A484F8864E430853CD522" commented="no"><enum>(4)</enum><text>any person or entity that seeks to assist another person who seeks to gain access to—</text><subparagraph id="H7E9021E09C1647129470D488D20C6E6A" commented="no"><enum>(A)</enum><text>reproductive health care services; or</text></subparagraph><subparagraph id="HBB471DC31F74403CAB3D5018C5156C38" commented="no"><enum>(B)</enum><text>a health care provider for the purpose of accessing reproductive health care services.</text></subparagraph></paragraph></subsection><subsection id="HA0D9E7DB8E2E4F9DB775A9AAB0D5ED1A"><enum>(b)</enum><header>Covered grant program</header><text>In this section, the term <term>covered grant program</term> means grants under—</text><paragraph id="H9CC7AAD33B8C4203A80ABFCD9DDF0C13"><enum>(1)</enum><text>part Q of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/13081">34 U.S.C. 13081 et seq.</external-xref>); and </text></paragraph><paragraph id="H9170619F43A944749E5FD4CFF4B72FCF"><enum>(2)</enum><text display-inline="yes-display-inline">subpart 1 of part E of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10151">34 U.S.C. 10151 et seq.</external-xref>). </text></paragraph></subsection></section><section id="HA16C5B0262474C9382D7F6D10DF2CDC8"><enum>4.</enum><header>Interference by officers or employees of a State or unit of local government prohibited</header><subsection id="H0E70EFA4891D420BB28C0AFA8E490B62"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">No officer or employee of a State or unit of local government may act under color of law in any manner that would have a discriminatory effect on a woman by preventing (including through criminal enforcement), restricting, impeding, or retaliating against—</text><paragraph id="HEFF8F199F92D4C73B69F89E6E3BF6ECE" commented="no"><enum>(1)</enum><text>a health care provider who seeks to initiate, provide, or otherwise facilitate the provision of reproductive health care services to a patient or prospective patient;</text></paragraph><paragraph id="H5EE34B2665714F3098E952329E971CF8" commented="no"><enum>(2)</enum><text>any person or entity that seeks to assist a health care provider who seeks to initiate, provide, or otherwise facilitate the provision of reproductive health care services to a patient or prospective patient;</text></paragraph><paragraph id="HE8ED01E55EED4696B05977004BB44EC7" commented="no"><enum>(3)</enum><text>any person who seeks to gain access to—</text><subparagraph id="H6A432CBCA90E453791ED2B516F06EB09" commented="no"><enum>(A)</enum><text>reproductive health care services; or </text></subparagraph><subparagraph id="H3E4660D4286E48F7BC7453019681E51C" commented="no"><enum>(B)</enum><text>a health care provider for the purpose of accessing reproductive health care services; or</text></subparagraph></paragraph><paragraph id="HB56496C230794DB183D14CEFE0558CD8" commented="no"><enum>(4)</enum><text>any person or entity that seeks to assist another person who seeks to gain access to—</text><subparagraph id="H3355A4FA2D7F43E69CB999655AFBE2D8" commented="no"><enum>(A)</enum><text>reproductive health care services; or</text></subparagraph><subparagraph id="H73F515892701472FB438CD53AE3E5706" commented="no"><enum>(B)</enum><text>a health care provider for the purpose of accessing reproductive health care services.</text></subparagraph></paragraph></subsection><subsection id="H333BBE67764B4D8280145CAF97816707" display-inline="no-display-inline"><enum>(b)</enum><header>Enforcement by Attorney General</header><text>The Attorney General may bring a civil action for declaratory and injunctive relief in the appropriate United States district court against any person who violates subsection (a).</text></subsection><subsection id="HDDCF51B303BE47CAB1AC23FAE478E6D0"><enum>(c)</enum><header>Private right of action</header><text>Any person who is harmed by a violation of subsection (a) may bring a civil action in the appropriate United States district court against the person who violated such subsection for—</text><paragraph id="HA0F7E7791B99461C83254765DA46A345"><enum>(1)</enum><text>declaratory and injunctive relief;</text></paragraph><paragraph id="H25B13D34B67641DC9D95260E16FFC0D0"><enum>(2)</enum><text>such compensatory damages as the court determines appropriate, including for economic losses and for emotional pain and suffering;</text></paragraph><paragraph id="H1576E923DCDF4EA4A46084F4735EFA01"><enum>(3)</enum><text>such punitive damages as the court determines appropriate; and</text></paragraph><paragraph id="HAF6793D280AE4754AD1D9B413D2F6FBA"><enum>(4)</enum><text>reasonable attorney’s fees and costs of the action that the court determines appropriate to award to a prevailing plaintiff.</text></paragraph></subsection><subsection id="H49436D6A0A794A00BB52DB923426DD9F"><enum>(d)</enum><header>Criminal penalty</header><text display-inline="yes-display-inline">Whoever, in violating subsection (a), uses a deadly or dangerous weapon or inflicts bodily injury, shall be fined under title 18, United States Code, or imprisoned not more than 20 years, or both.</text></subsection><subsection id="H88F78EDE4E1548579DD257707A8F9001"><enum>(e)</enum><header>No State immunity</header><text display-inline="yes-display-inline">A State shall not be immune under the eleventh amendment to the Constitution of the United States from an action in a Federal or State court of competent jurisdiction for a violation of this section.</text></subsection></section><section id="H80E892A12BDB4BBA84E49B9BFDD757BF"><enum>5.</enum><header>Interference by persons not officers or employees of a State or unit of local government prohibited</header><subsection id="H9B88F75579C640D98E4077B89FCBC669"><enum>(a)</enum><header>In general</header><text>No person who is not an officer or employee of a State or of a unit of local government, who, in a circumstance described in subsection (b), by operation of a provision of State law attempts to implement or enforce State law, may act or threaten to act in any manner to prevent, restrict, impede, or retaliate against—</text><paragraph id="HBD9D981A4F0C4FE7B2E471CD755C6AFC"><enum>(1)</enum><text display-inline="yes-display-inline">a health care provider who seeks to initiate, provide, or otherwise facilitate the provision of reproductive health care services to a patient or prospective patient;</text></paragraph><paragraph id="H07C3F948A20D4DE49C062FC93C1A0260"><enum>(2)</enum><text>any person or entity that assists a health care provider who seeks to initiate, provide, or otherwise facilitate the provision of reproductive health care services to a patient or prospective patient;</text></paragraph><paragraph id="H343E48481064453A96039077F47C57BF"><enum>(3)</enum><text>any person who seeks to gain access to—</text><subparagraph id="H7DDCBFF9C4074ECF8B44E50AA6AEE0C6"><enum>(A)</enum><text>reproductive health care services; or </text></subparagraph><subparagraph id="H86F73A6A4CB04863B3A6357421FB7DD0"><enum>(B)</enum><text>a health care provider for the purpose of accessing reproductive health care services; or</text></subparagraph></paragraph><paragraph id="HF661EAA6DEAA477092500D2C05950164"><enum>(4)</enum><text>any person or entity that seeks to assist another person who seeks to gain access to—</text><subparagraph id="HFF8794BA312441629782100FEB3D5BD7"><enum>(A)</enum><text>reproductive health care services; or</text></subparagraph><subparagraph id="HC2C9BBE739804E339F30743F173F004F"><enum>(B)</enum><text>a health care provider for the purpose of accessing reproductive health care services.</text></subparagraph></paragraph></subsection><subsection id="H6CB657A3452242D2B813BB5023B1B963"><enum>(b)</enum><header>Circumstances described</header><text display-inline="yes-display-inline">For the purposes of subsection (a), the circumstances described in this subsection are that—</text><paragraph id="H4C97EA2122134123B42E533871E19016"><enum>(1)</enum><text display-inline="yes-display-inline">any travel in interstate or foreign commerce, or travel enabled by a means, channel, facility, or instrumentality of interstate or foreign commerce, occurred in furtherance of or in connection with the conduct described in subsection (a);</text></paragraph><paragraph id="HA644C27CE23C408EBA2453D60A3555AA"><enum>(2)</enum><text>a means, channel, facility, or instrumentality of interstate or foreign commerce was used in furtherance of or in connection with the conduct described in subsection (a); </text></paragraph><paragraph id="HC3C19ACD7BBA4806BFBAED58213BBE7B"><enum>(3)</enum><text>any payment of any kind was made, directly or indirectly, in furtherance of or in connection with the conduct described in subsection (a) using any means, channel, facility, or instrumentality of interstate or foreign commerce or in or affecting interstate or foreign commerce; </text></paragraph><paragraph id="H8BC04858AA68485DB73B7AE7A109C91B"><enum>(4)</enum><text>any communication was transmitted in interstate or foreign commerce, relating to or in furtherance of the conduct described in subsection (a) using any means, channel, facility, or instrumentality of interstate or foreign commerce or in or affecting interstate or foreign commerce by any means or in manner, including by computer, mail, wire, or electromagnetic transmission; </text></paragraph><paragraph id="HBBCC79F2E12A4950A2D0A40B785FE7D8"><enum>(5)</enum><text>any instrument, item, substance, or other object that has traveled in interstate or foreign commerce was used to perform the conduct described in subsection (a); </text></paragraph><paragraph id="H06B69D7A5DEA4212869A47F21015E340"><enum>(6)</enum><text>the conduct described in subsection (a) occurred within the special maritime and territorial jurisdiction of the United States, or any territory or possession of the United States; or </text></paragraph><paragraph id="H5BCB2A3796214E2AA756478651D71BE3"><enum>(7)</enum><text>the conduct described in subsection (a) otherwise occurred in or affected interstate or foreign commerce.</text></paragraph></subsection><subsection id="H3F3CF3AD256E44CB91FCD195BCA3B0DE"><enum>(c)</enum><header>Enforcement by Attorney General</header><text>The Attorney General may bring a civil action for declaratory and injunctive relief in the appropriate United States district court against any person who violates subsection (a).</text></subsection><subsection id="H07DCD93875DA4D3FA62984058A1D5D57"><enum>(d)</enum><header>Private right of action</header><text>Any person who is harmed by a violation of subsection (a) may bring a civil action in the appropriate United States district court against the person who violated such subsection for—</text><paragraph id="HA4682F58789C41149B862C998BB266AA"><enum>(1)</enum><text>declaratory and injunctive relief;</text></paragraph><paragraph id="H5C9FC9E5851B4BC3A4233772442BB697"><enum>(2)</enum><text>such compensatory damages as the court determines appropriate, including for economic losses and for emotional pain and suffering;</text></paragraph><paragraph id="H38F4FFA5AC7C473986D6A804F258EF6A"><enum>(3)</enum><text>such punitive damages as the court determines appropriate; and</text></paragraph><paragraph id="HFAF98C533AA140629666BFABD5408689"><enum>(4)</enum><text>reasonable attorney’s fees and costs of the action that the court determines appropriate to award to a prevailing plaintiff.</text></paragraph></subsection><subsection id="H3FF8436A5BA746EA8CD132F69F1E83A3"><enum>(e)</enum><header>Criminal penalty</header><text display-inline="yes-display-inline">Whoever, in violating subsection (a), uses a deadly or dangerous weapon or inflicts bodily injury, shall be fined under title 18, United States Code, or imprisoned not more than 20 years, or both.</text></subsection></section><section id="HB179683F80F745CF96A5BCB8304CC777"><enum>6.</enum><header>Severability</header><text display-inline="no-display-inline">If any provision of this Act, or the application of such provision to any person, entity, government, or circumstance, is held to be unconstitutional, the remainder of this Act, or the application of such provision to all other persons, entities, governments, or circumstances, shall not be affected thereby.</text></section></legis-body></bill>
