<section id="HB7C36D76B83547D19350C84538BFC1ED" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Utilizing Space Efficiently and Improving Technologies Act of 2023</short-title></quote> or the <quote><short-title>USE IT Act of 2023</short-title></quote>. </text></section> <section id="H5A4BA06DFE114F91A73BF04BDD3D07EC"><enum>2.</enum><header>Definitions</header> <subsection id="HC4A3DE375735440BB88AB95813605DA3"><enum>(a)</enum><header>In general</header><text>In this Act:</text>
<paragraph id="HDCB7D5EBDA93440B9344227372C6DAF8"><enum>(1)</enum><header>Actual utilization rate</header><text>The term <quote>actual utilization rate</quote> means the total usable square footage of a public building or federally-leased space divided by the occupancy. </text></paragraph> <paragraph id="H60E703E968DC434B9969405B9DD89F7D"><enum>(2)</enum><header>Administrator</header><text display-inline="yes-display-inline">The term <quote>Administrator</quote> means the Administrator of General Services.</text></paragraph>
<paragraph id="HF6BCAAB300624464A425011DC393EE58"><enum>(3)</enum><header>Building utilization</header><text display-inline="yes-display-inline">The term <quote>building utilization</quote> means the percentage of utilization generated by comparing the actual utilization rate with the capacity based on a utilization benchmark of 150 useable square feet per person.</text></paragraph> <paragraph id="HCA03CC449DC44DE7A4B446E43683493F"><enum>(4)</enum><header>Capacity</header><text>The term <quote>capacity</quote> means the total usable square footage of a public building or federally-leased space divided by a utilization benchmark. </text></paragraph>
<paragraph id="H9DBBCDB62AD542128DA5FF89EFF26DAE"><enum>(5)</enum><header>Director</header><text>The term <quote>Director</quote> means the Director of the Office of Management and Budget.</text></paragraph> <paragraph id="H8DC9321BC30042C18064FEB3C468E928"><enum>(6)</enum><header>Federal agency</header><text>The term <quote>Federal agency</quote> means an executive department covered by the CFO Act of 1990 (<external-xref legal-doc="public-law" parsable-cite="pl/101/576">Public Law 101–576</external-xref>).</text></paragraph>
<paragraph id="H4DFF8F9AA850439D8095BC8902D7D1C5"><enum>(7)</enum><header>Occupancy</header><text display-inline="yes-display-inline">The term <quote>occupancy</quote> means the total number of employees actually performing duties in person in a public building or federally-leased space 40 hours per week regardless of work arrangements.</text></paragraph> </subsection></section> <section id="H1033FE0A433448828D75EBC379D62816"><enum>3.</enum><header>Identification and deployment of building usage technology</header> <subsection id="HC92BD5C0D1FB4C01B110DA135C38F915"><enum>(a)</enum><header>In general</header><text>Not later than 60 days after the date of enactment of this Act, the Administrator, in coordination with the Director, shall establish standard methodologies and identify technologies available for measuring occupancy in public buildings and federally-leased space.</text></subsection>
<subsection id="H0F0B7173A3EF4F3EBDDD2F6441AA00EA"><enum>(b)</enum><header>Measurement of utilization</header><text>Not later than 180 days after the date of enactment of this Act, the heads of Federal agencies shall work with the Administrator to identify, deploy, and use sensors, Personal Identity Verification badge swipe data isolating only the first credential use of the day for each cardholder, and other technologies in public buildings and federally-leased space, where the Federal agency occupies space to measure the occupancy of public buildings and leased space.</text></subsection> <subsection id="H253DAB1ACCDF48E2B6909165DB226313"><enum>(c)</enum><header>Protection of personally identifiable information</header><text display-inline="yes-display-inline">In carrying out subsection (b), the Administrator shall ensure any sensors used for the purposes of determining occupancy are designed to protect of all personally identifiable information.</text></subsection> </section>
<section id="HC9060C3EC87B43E4A4044D8A6E873390"><enum>4.</enum><header>Reporting on usage of real property</header> 
<subsection id="HD6034B0AE0B247C2A971A8406C884160"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, and annually thereafter, the heads of Federal agencies shall submit to the Director, the Administrator, the Committee on Transportation and Infrastructure of the House of Representatives, the Committee on Environment and Public Works of the Senate, and the Committees on Appropriations of the House of Representatives and the Senate a report on—</text> <paragraph id="H37259534EB12422FAE77EC817EDF2EAE"><enum>(1)</enum><text>the occupancy and the actual utilization rates of space in public buildings and federally-leased space occupied by the respective agency of the Federal agency head broken down by building and lease;</text></paragraph> 
<paragraph id="HEAC04421AA7B42D7A8F2C6CF05F1AE62"><enum>(2)</enum><text>the methodology used for determining occupancy, including the period of time and other parameters used to determine occupancy on a regular basis;</text></paragraph> <paragraph id="H1B97EC054A504017A81A2AA560189728"><enum>(3)</enum><text>the utilization percentage of each public building and federally-leased space by the respective agency of the Federal agency head, comparing the capacity to the actual utilization rate based on a utilization benchmark of 150 usable square feet per person; and</text></paragraph> 
<paragraph id="H62935A44F7244968906F3F6173A7D7F5"><enum>(4)</enum><text>any costs associated with capacity that exceeds occupancy with respect to the respective agency of the Federal agency head.</text></paragraph></subsection> <subsection id="H707818D8EC6B4655ABE7FBE4FE0E1F91"><enum>(b)</enum><header>Publishing requirement</header> <paragraph id="H1E3BFB8B48BE40498BBC7644D406701D"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), the heads of Federal agencies shall make each report required under subsection (a) available on a publicly accessible website of the General Services Administration.</text></paragraph> 
<paragraph id="H19C4D6B439A04F4081221FC4E9948BD6"><enum>(2)</enum><header>Exception</header><text display-inline="yes-display-inline">The publishing requirements of paragraph (1) shall not apply if the head of the respective Federal agency makes a determination that making the report required under subsection (a) available on a publicly accessible website would be detrimental to national security.</text></paragraph></subsection></section> <section id="H396348A709254774BB18ED3F6EFED126"><enum>5.</enum><header>Reducing unneeded space</header> <subsection id="HAC759CE94B3D40718DDD737E0D9BD519"><enum>(a)</enum><header>Target utilization metrics</header><text>Not later than 1 year after the date of enactment of this Act, and annually thereafter, the Director, in consultation with the Administrator, shall ensure building utilization in each public building and federally-leased space is not less than 60 percent on average over each 1-year period.</text></subsection>
<subsection id="H23C56F5B19A24ABA8AEE7714BE546F72"><enum>(b)</enum><header>Actions</header><text>In the event that building utilization is below 60 percent on average over a 1-year period described in subsection (a) for any particular public building or federally-leased space, the Administrator shall—</text> <paragraph id="H0F9F20BB70324FDAAB3B54C857669AF1"><enum>(1)</enum><text>provide notice to the tenant agency informing such agency of the excess in capacity along with associated costs of such excess; and </text></paragraph>
<paragraph id="HE7C189F0E38F4506ABC4CCB5CB338A71"><enum>(2)</enum><text>notify the Committee on Transportation and Infrastructure of the House of Representatives, the Committee on Environment and Public Works of the Senate, and the Committees on Appropriations of the House of Representatives and the Senate of such excess capacity and associated costs.</text></paragraph></subsection> <subsection id="H1F2526B142B6467D906D7E1EEAFA0A73"><enum>(c)</enum><header>Subsequent failure</header><text>If the tenant agency fails to meet the 60 percent target under subsection (a) in the reporting period subsequent to the reporting period under subsection (b), the Administrator shall, in consultation with the Director, take steps to reduce the space of the tenant agency, including consolidating the tenant agency with another agency, selling or disposing of excess capacity space, and adjusting space requirements, as appropriate, for any replacement space.</text></subsection>
<subsection id="H42CAAF6C099040D9A8C44C02A4AE1459"><enum>(d)</enum><header>Prioritization</header><text>The Administrator, in coordination with the Director, shall prioritize to the maximum extent practicable capital investments in public buildings where Federal agencies meet or exceed building utilization metrics, except that prioritization may be given to projects that will result in building utilization of 60 percent or more.</text></subsection> <subsection id="HB58A4E49163244CAA8876CE46C1380F1"><enum>(e)</enum><header>Exceptions</header> <paragraph id="H8DF6AEA9B9D149F994A82ACE6B5FB9AC"><enum>(1)</enum><header>In general</header><text>The Director may provide exceptions to building utilization metrics based on the amount of non-standard office space a Federal agency demonstrates is required to meet the mission of the agency, including warehouse space, laboratories critical to the mission of the agency, and public customer-facing spaces driven by agency missions.</text></paragraph>
<paragraph id="HF23D67907A234FC88EC57DCF86F1621C"><enum>(2)</enum><header>Reporting</header><text>The Administrator shall submit to the Committee on Transportation and Infrastructure of the House of Representatives, the Committee on Environment and Public Works of the Senate, and the Committees on Appropriations of the House of Representatives and the Senate a report on any exceptions granted, including the justification for such exception.</text></paragraph></subsection></section> <section id="HECE159F05BD94F30A5FFAB87A31FC504"><enum>6.</enum><header>Headquarters buildings</header> <subsection id="H5573F51B403143C6AECA2D70F50E3EB4"><enum>(a)</enum><header>Headquarters consolidations</header><text>Not later than 1 year after the date of enactment of this Act, the Director, in consultation with the Administrator, shall submit to the Committee on Transportation and Infrastructure of the House of Representatives, the Committee on Environment and Public Works of the Senate, and the Comptroller General of the United States a plan to consolidate department and agency headquarters buildings in the National Capital Region that will result in building utilizations of 60 percent or greater.</text></subsection>
<subsection id="H4FBE1DB9F0FA47CDA201E73B0E5CD526"><enum>(b)</enum><header>Contents</header><text>The plan submitted under subsection (a) shall include details on the following: </text> <paragraph id="H05BF88E55A384DF1B46C7E3F855A625D"><enum>(1)</enum><text>Which departments and agencies will collocate and consolidate and into which buildings and associated details before and after plan implementation related to building utilization, building capacities, and actual utilization.</text></paragraph>
<paragraph id="HC6998689F095479CB0E52EC88530D423"><enum>(2)</enum><text>Details on the strategies for the sale or disposal of buildings that will no longer be needed for Federal use.</text></paragraph> <paragraph id="H64B3B5A552FA4DBFBAE16D04338E5FFB"><enum>(3)</enum><text>A detailed breakdown of any costs associated with the proposed consolidations and collocations.</text></paragraph>
<paragraph id="HA631C8E9AEF144199C4DB1C256A2FCAF"><enum>(4)</enum><text>An estimate of future savings as a result of space reductions and consolidations, including costs associated with energy savings and building operations.</text></paragraph></subsection> <subsection id="HF186413660B045509A27C939A2C92128"><enum>(c)</enum><header>Implementation</header><text>Not later than 1 year after the submission of the plan under subsection (a), the Administrator and Director shall begin implementing such plan.</text></subsection></section>
<section id="H8056E1C7A1B646F18B4F870F38E1EE57" display-inline="no-display-inline" section-type="subsequent-section"><enum>7.</enum><header>Federal Use it or Lose it Leases Act</header> 
<subsection id="HFFD822B261CA41E6A82B450F36B82E5A"><enum>(a)</enum><header>Reporting of space utilization and occupancy data for office space</header> <text>An occupancy agreement between the Administrator of General Services and a Federal tenant for office space shall—</text> <paragraph id="H799A241A0D2449708435A1FC056A9A66"><enum>(1)</enum><text>include language that requires the Federal tenant to submit to the Administrator an annual report for the duration of the agreement containing data on—</text> 
<subparagraph id="HA094A65FFC3A4A1FA8FF8B9991F6DDAC"><enum>(A)</enum><text>monthly total occupancy of such office space;</text></subparagraph> <subparagraph id="HBB56AAB7E48D4E22A4469DC83E020262"><enum>(B)</enum><text>the actual utilization of such office space;</text></subparagraph> 
<subparagraph id="HEDFFCBB2F1E941E9926422034AEED5A6"><enum>(C)</enum><text>monthly space utilization rates; and</text></subparagraph> <subparagraph id="H6F0250FED56A458395CAB8853A32A1AC"><enum>(D)</enum><text>any other office space utilization data considered important by the Administrator; and</text></subparagraph></paragraph> 
<paragraph id="HE9517DFD825D42B69080A3AB0846DA3D"><enum>(2)</enum><text display-inline="yes-display-inline">include language that requires the Federal tenant to have written procedures in place governing the return of office space to the Administrator if the occupancy of the Federal tenant falls below a 60 percent space utilization rate for 6 months within any 1-year period, beginning on the date on which the agreement takes effect.</text></paragraph></subsection> <subsection id="H77457D1FF1C9498CB597A56623E7D178"><enum>(b)</enum><header>Requirements for Federal agencies with independent leasing authorities</header> <text>The head of any agency with independent leasing authorities with leases for office space shall submit to the Committee on Transportation and Infrastructure of the House of Representatives, the Committee on Environment and Public Works of the Senate, and each congressional committee of jurisdiction of the applicable independent leasing authority an annual report for the duration of such agreement containing data on—</text> 
<paragraph id="HE2B3BCAC0E5A437D8C258D0B3B56CC68"><enum>(1)</enum><text>monthly total occupancy of the office space;</text></paragraph> <paragraph id="HED9B60CA703C41B886A5942410456D92"><enum>(2)</enum><text>the actual utilization of such office space;</text></paragraph> 
<paragraph id="HC1DC330F9F63460EA45338977068205A"><enum>(3)</enum><text>monthly space utilization rates; and</text></paragraph> <paragraph id="H2368911DAFC140D49F51E429EDFEE401"><enum>(4)</enum><text>any other office space utilization data considered important for collection by Congress.</text></paragraph></subsection> 
<subsection id="H8526F39058E54C32A8887132663C0A83"><enum>(c)</enum><header>Exceptions to reporting and occupancy agreement requirements</header><text>This section shall not apply to properties used by an element of the intelligence community.</text> </subsection> <subsection id="H0CADC80690AE427199E9FB3840FF1684"><enum>(d)</enum><header>Applicability</header><text>The requirements of this section shall apply to any occupancy or novation agreement entered into on or after the date that is 6 months after the date of enactment of this Act.</text> </subsection> 
<subsection id="HA34A7FFE4D084495A8DC784C1E173EE0"><enum>(e)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text> <paragraph id="HFAFFE272D9014C5AA946199EA43F9959"><enum>(1)</enum><header>Federal tenant</header><text display-inline="yes-display-inline">The term <quote>Federal tenant</quote>—</text> 
<subparagraph id="HF873991AF1E3467BB5587F3B2BE689F6"><enum>(A)</enum><text>means an Federal agency that has an occupancy agreement with the Administrator of General Services to occupy a commercial lease for office space secured by the Administrator on behalf of the Federal Government; and</text></subparagraph> <subparagraph id="H6C7E7CD081874B38B3D223C2BB88084E"><enum>(B)</enum><text>does not include an element of the intelligence community.</text></subparagraph></paragraph> 
<paragraph id="HB9332AD10A124A1782325F984F11616A"><enum>(2)</enum><header>Intelligence community</header><text display-inline="yes-display-inline">The term <quote>intelligence community</quote> has the meaning given that term in section 3 of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3003">50 U.S.C. 3003</external-xref>).</text></paragraph> </subsection></section> <section id="H784B851DDB1F49EEB28332FC32322454"><enum>8.</enum><header>GAO report</header> <subsection id="H04A85ACB128543ECA7ED88D1054188AF"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Comptroller General of the United States shall submit to Congress a report on the cost to each Federal agency of measuring the occupancy and actual utilization rates of space in public buildings and federally-leased space to prepare the reports required under section 4.</text></subsection> 
<subsection id="HEC15EA242913439BB1335833FCEB7C9A"><enum>(b)</enum><header>Requirements</header><text>The Comptroller General shall include in the report required under subsection (a) the cost of deploying sensors and technologies pursuant to section 3 but shall exclude any such technologies that were in place before the date of enactment of this Act.</text></subsection></section> <section id="H92FFFE47764A4385B735A8F5DAD31EB1"><enum>9.</enum><header>Investigation of underutilized space</header> <subsection id="HA9CC094A2DE342D3AA17E42BC1EB04A8"><enum>(a)</enum><header>Reporting requirement</header><text display-inline="yes-display-inline">Not later than 90 days after the submission of each report under section 4, the head of each Federal agency shall submit to the inspector general of each respective agency a report detailing any public building or federally-leased space with a capacity of 500 or more employees under the jurisdiction of such agency that has a utilization rate below 20 percent during the reporting period that is not a vacant office building.</text></subsection> 
<subsection id="H0F52559AC50C426FAA3308EB42DA870A"><enum>(b)</enum><header>Inspector general investigation</header><text display-inline="yes-display-inline">Upon receipt of a report under subsection (a), the inspector general of the relevant Federal agency shall conduct an investigation to determine whether there is any evidence of fraud, waste, abuse, or mismanagement with respect to the use of the public building or federally-leased space identified in the report.</text></subsection> </section> </legis-body><attestation><attestation-group><attestation-date date="20240312" chamber="House">Passed the House of Representatives March 12, 2024.</attestation-date><attestor display="no">Cheryl L.
