which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To enable timely licensing reviews for nuclear reactor facilities at brownfield sites and retired fossil fuel sites, and for other purposes.</official-title></form><legis-body id="HD0ABE4E01A1F4039BED822F02AB8781F" style="OLC"><section id="H86DFB13073904A7FA066D3F8B49F5D7D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Nuclear for Brownfield Site Preparation Act</short-title></quote>.</text></section><section id="H4138FCFF98CC4363953E85CC9AD2E0B2"><enum>2.</enum><header>Regulatory issues for nuclear facilities at brownfield sites and retired fossil fuel sites</header><subsection id="HEA7D2071ACFF4A39A203CA66CC93366E"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="H72AAD195ADE449A4A6565EBBF6BF58A0"><enum>(1)</enum><header>Brownfield site</header><text>The term <term>brownfield site</term> has the meaning given the term in section 101 of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9601">42 U.S.C. 9601</external-xref>).</text></paragraph><paragraph id="HC3BD726BF9684BB7ACEE57E120706F49"><enum>(2)</enum><header>Commission</header><text>The term <term>Commission</term> means the Nuclear Regulatory Commission.</text></paragraph><paragraph id="H92F06EAADE3D443199D03CF97EC44D43" commented="no"><enum>(3)</enum><header>Covered site</header><text>The term <term>covered site</term> means a brownfield site, a retired fossil fuel site, or a site that is both a retired fossil fuel site and a brownfield site. </text></paragraph><paragraph id="H5D750D9DCC9D47E1AC703EDE38982FE0"><enum>(4)</enum><header>Production facility</header><text>The term <term>production facility</term> has the meaning given the term in section 11 of the Atomic Energy Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2014">42 U.S.C. 2014</external-xref>).</text></paragraph><paragraph id="H084A9A3894FA46C2B52A4D1B811317C3"><enum>(5)</enum><header>Retired fossil fuel site</header><text>The term <term>retired fossil fuel site</term> means the site of 1 or more fossil fuel electric generation facilities that are retired or scheduled to retire, including multiunit facilities that are partially shut down.</text></paragraph><paragraph id="HF5F58327CECA41D8AB86C9CF902A761F"><enum>(6)</enum><header>Utilization facility</header><text>The term <term>utilization facility</term> has the meaning given the term in section 11 of the Atomic Energy Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2014">42 U.S.C. 2014</external-xref>).</text></paragraph></subsection><subsection id="H42EA4B134AD84447B12D601EF67E135F"><enum>(b)</enum><header>Identification of regulatory issues</header><paragraph id="HD72C4D2B7BD041BC8D1254FBB103503B"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, the Commission shall evaluate the extent to which modification of regulations, guidance, or policy is needed to enable timely licensing reviews for, and to support the oversight of, production facilities or utilization facilities at covered sites.</text></paragraph><paragraph id="HF043E38A08154BD588806822360E7395" display-inline="no-display-inline" commented="no"><enum>(2)</enum><header>Requirement</header><text>In carrying out paragraph (1), the Commission shall consider how licensing reviews for production facilities or utilization facilities at covered sites may be expedited by—</text><subparagraph id="HD5055455C41C43C4AC77BD863644F0F4" commented="no"><enum>(A)</enum><text>siting and operating a production facility or a utilization facility at or near existing site infrastructure to support the reuse of such infrastructure, including—</text><clause id="H3FA84EC6F44D4666B7DA695498DFF3BE" commented="no"><enum>(i)</enum><text>electric switchyard components and transmission infrastructure;</text></clause><clause id="H5C6C641A3BD64249BFB82A08C90D8E6D" commented="no"><enum>(ii)</enum><text>heat-sink components;</text></clause><clause id="H71D6952DA34B4E25B2CC6EACF9E0AEB7" commented="no"><enum>(iii)</enum><text>steam cycle components;</text></clause><clause id="HB93A393A19DD410080B3FC2ECC435D01" commented="no"><enum>(iv)</enum><text>roads;</text></clause><clause id="H78D5E5CFDE614E27A56F1EA19AACCF70" commented="no"><enum>(v)</enum><text>railroad access; and</text></clause><clause id="H31D1102B9D2E4CAB97F124A2A12AA907" commented="no"><enum>(vi)</enum><text>water availability; </text></clause></subparagraph><subparagraph id="H2C686384B50141ED9C5BDBDFD0AC79A2" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>using early site permits;</text></subparagraph><subparagraph id="H68601A4C66D3402A894EB3C3405A3B88" commented="no"><enum>(C)</enum><text>using plant parameter envelopes or similar standardized site parameters on a portion of a larger site; and</text></subparagraph><subparagraph id="H509673E1E9714BE685EFE948AA304453" commented="no"><enum>(D)</enum><text>using a standardized application for similar sites.</text></subparagraph></paragraph><paragraph id="H50E40A712190474CB4D51C6364ECD577"><enum>(3)</enum><header>Report</header><text>Not later than 14 months after the date of enactment of this Act, the Commission shall submit to the appropriate committees of Congress a report describing any regulations, guidance, and policies evaluated under paragraph (1).</text></paragraph></subsection><subsection id="HE09B8C02F6B74D2CB0EC18027B000A2E"><enum>(c)</enum><header>Licensing</header><paragraph id="H8CE3B67432654389851C2D6DD7B95720" commented="no"><enum>(1)</enum><header>In general</header><text>Not later than 2 years after the date of enactment of this Act, the Commission shall, based on the evaluation under subsection (b)—</text><subparagraph id="H06EE4262FFA34A39A65A5B8B95E68738" commented="no"><enum>(A)</enum><text>develop and implement strategies to enable timely licensing reviews for, and to support the oversight of, production facilities or utilization facilities at covered sites; and</text></subparagraph><subparagraph id="H038573AB4A8D4675B768552C2217491E" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">initiate a rulemaking to enable timely licensing reviews for, and to support the oversight of, production facilities or utilization facilities at covered sites.</text></subparagraph></paragraph><paragraph id="H190E9CC6B1D4486A8BADA9EAD0940D27"><enum>(2)</enum><header>Requirements</header><text>In carrying out paragraph (1), consistent with the mission of the Commission, the Commission shall consider matters relating to—</text><subparagraph id="HA425FB998243452E874E0644D875DEEB"><enum>(A)</enum><text>the use of existing site infrastructure;</text></subparagraph><subparagraph id="H10BD201D117A466697AE9724187586A0"><enum>(B)</enum><text>existing emergency preparedness organizations and planning;</text></subparagraph><subparagraph id="H415B687964004BFABEB7C03635D799CD"><enum>(C)</enum><text>the availability of historical site-specific environmental data;</text></subparagraph><subparagraph id="H74064D0788814C8CB68212B9D87F7521"><enum>(D)</enum><text>previously completed environmental reviews required by the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>);</text></subparagraph><subparagraph id="HBE3B3F8BBA844476B0B037FBFA8B95DE"><enum>(E)</enum><text>activities associated with the potential decommissioning of facilities or decontamination and remediation at covered sites; and</text></subparagraph><subparagraph id="H2A7E32A0900F49C887B65E8D0F55861D"><enum>(F)</enum><text>community engagement and historical experience with energy production.</text></subparagraph></paragraph></subsection><subsection id="HF911112927C44FC58BC561ACAF7E6579"><enum>(d)</enum><header>Report</header><text>Not later than 3 years after the date of enactment of this Act, the Commission shall submit to the Committee on Energy and Commerce of the House of Representatives and the Committee on Environment and Public Works of the Senate a report describing the actions taken by the Commission under subsection (c)(1).</text></subsection></section></legis-body></bill>
