R. 6231</legis-num><associated-doc role="report" display="yes">[Report No. 118–322]</associated-doc><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20231106">November 6, 2023</action-date><action-desc><sponsor name-id="I000058">Mr. Ivey</sponsor> (for himself, <cosponsor name-id="B001311">Mr. Bishop of North Carolina</cosponsor>, <cosponsor name-id="C001067">Ms. Clarke of New York</cosponsor>, and <cosponsor name-id="E000235">Mr. Ezell</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HHM00">Committee on Homeland Security</committee-name></action-desc></action><action display="yes"><action-date date="20231219">December 19, 2023</action-date><action-desc> Committed to the Committee of the Whole House on the State of the Union and ordered to be printed</action-desc></action><action><action-desc><pagebreak></pagebreak></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Homeland Security Act of 2002 to require a prioritized policy issuance review process for the Department of Homeland Security, and for other purposes.<pagebreak></pagebreak></official-title></form><legis-body id="H50704F39FABF414199600E9872B359E2" style="OLC"><section id="H9936AF75918B4FF9A8F5A66F5F4B43EB" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Department of Homeland Security Policy Issuance Review Act</short-title></quote>.</text></section><section id="H48AF49E0814F4ED68197423AB895DFC5"><enum>2.</enum><header>Policy issuance review process</header><text display-inline="no-display-inline">Section 701 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/341">6 U.S.C. 341</external-xref>) is amended—</text><paragraph id="H10AABD16E2634616AF072F1E9F42E765"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="H9D29E9B345A14434BC9F8F71A87C5F91"><enum>(A)</enum><text>by redesignating paragraph (13) as paragraph (14); and</text></subparagraph><subparagraph id="H73CA3647D9F74D6897364479F9CCA0EF"><enum>(B)</enum><text>by inserting after paragraph (12) the following new paragraph:</text><quoted-block id="HD5F0F3A603124FCD8DF66BCB4F8C8D5D" style="OLC"><paragraph id="HA33E4C8868FA466DA9460A349330875D"><enum>(13)</enum><text>Overseeing the Department’s process for review and approval of policy issuance documents.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H73A1A999110248E983C322EE26B035AE"><enum>(2)</enum><text>by redesignating the second subsection (e) (relating to the definition of interoperable communications) as subsection (f); and</text></paragraph><paragraph id="H558150D05A414CCE8CD45544D1D352BC"><enum>(3)</enum><text>by adding at the end the following new subsection:</text><quoted-block id="H8B93A282DFB34676AA37C94087752F5D" style="OLC"><subsection id="H895A9B9F81CA4DCEA9B6EBD9557DF0AD"><enum>(g)</enum><header>Policy issuance review process</header><paragraph id="H9ED1F77503B942B3915C7914E84B5B72" commented="no"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date of the enactment of this subsection, the Under Secretary for Management shall require a prioritized periodic review process (in this subsection referred to as the <quote>Review Process</quote>) of Department policy issuance documents.</text></paragraph><paragraph id="H4901E4A1793A4723848AA565520155DA" commented="no"><enum>(2)</enum><header>Congressional oversight</header><text>Not later than 180 days after the date of the enactment of this subsection and annually thereafter, the Under Secretary for Management shall provide to the Committee on Homeland Security of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate a briefing on the Review Process, including relating to the Department’s record of reviewing and updating existing policy issuance documents. Each such briefing shall include information relating to the following:</text><subparagraph id="HF8DA9DD9CEFB4D03AF2B34B24A49AC50" commented="no"><enum>(A)</enum><text>All policy issuance documents, including, with respect to each such document, the title, policy number, revision number, issue date, and last reviewed date.</text></subparagraph><subparagraph id="H7F9F2FB4A354486FB8259DE015DC0C2E" commented="no"><enum>(B)</enum><text>All policy issuance documents canceled in the prior year.</text></subparagraph><subparagraph id="H6B640B79561F4981A5384DBD8BF57D5C" commented="no"><enum>(C)</enum><text>An explanation of the methodology used to prioritize the review of policy issuance documents.</text></subparagraph><subparagraph id="H77E825EB49A84EAAA712F753E30F6D1C" commented="no"><enum>(D)</enum><text>The procedures used by the Department to track and coordinate with Department components the issuance, review, and cancellations of policy issuance documents.</text></subparagraph><subparagraph id="H1E962136763C475884B2215754110DCA" commented="no"><enum>(E)</enum><text>The number of staff and vacancies within the Management Directorate responsible for supporting the Review Process.</text></subparagraph></paragraph><paragraph id="H200E1EA197A4420585E501629C50CF5E"><enum>(3)</enum><header>Definition</header><text>In this subsection the term <term>policy issuance document</term>—</text><subparagraph id="HB92A989749BC4DFD8D5A267DF51A4FCB" commented="no"><enum>(A)</enum><text>means a Department-level directive, instruction, designation, or delegation, issued in accordance with the process referred to in subsection (a)(13) or any process for issuing such documents consistent with Department policy as may be in effect; and</text></subparagraph><subparagraph id="H3CB8FC22EEA6414B9D6D5BDD53F71339"><enum>(B)</enum><text display-inline="yes-display-inline">does not include documents—</text><clause id="HBD08DD9BDFE94AD7B5CBF980D181B7F5"><enum>(i)</enum><text>issued in accordance with a process other than a process referred to in subsection (a)(13) or the Review Process; or</text></clause><clause id="H3C2ABDD1B3864403ABE6B7D54685B453"><enum>(ii)</enum><text display-inline="yes-display-inline">documents published in the Federal Register.</text></clause></subparagraph></paragraph><paragraph id="H76B15DCD75DD4205A29ACE4ABFC66379" commented="no"><enum>(4)</enum><header>Rule of construction</header><text>Nothing in this subsection may be construed to—</text><subparagraph id="H5ABBD2AF3A784046BD1B0393FB8BBC00" commented="no"><enum>(A)</enum><text>invalidate any policy issuance document created on, before, or after the date of the enactment of this subsection;</text></subparagraph><subparagraph id="H02AE5544E2824CE7B21018BAA821BD11" commented="no"><enum>(B)</enum><text>serve as a basis for action to challenge the validity of such a policy issuance document; or</text></subparagraph><subparagraph id="H93ABDFE10A4342E28B9869A9E6E6E288" commented="no"><enum>(C)</enum><text>create any right or benefit, whether substantive or procedural, enforceable by any person in any administrative or judicial proceeding.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body><endorsement display="yes"><action-date date="20231219">December 19, 2023</action-date><action-desc> Committed to the Committee of the Whole House on the State of the Union and ordered to be printed</action-desc></endorsement></bill>
