<section id="H672ADE66EA9948E997900130E17D7BC3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Office of Colonias and Farmworker Initiatives Establishment Act of 2023</short-title></quote>. </text></section> <section id="HF907E37892B74F8384699AEE02BE0A41"><enum>2.</enum><header>Establishment of Office of Colonias and Farmworker Initiatives</header> <subsection id="H3E2F10D43E264548AF74EDBC35A32722"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Title III of the Federal Crop Insurance Reform and Department of Agriculture Reorganization Act of 1994 is amended by adding after section 309 (<external-xref legal-doc="usc" parsable-cite="usc/7/6921">7 U.S.C. 6921</external-xref>) the following:</text>

<section id="H7FF6D2583503421E8687149EBCA858CC"><enum>310.</enum><header>Office of Colonias and Farmworker Initiatives</header>
<subsection id="HAA16A972620640F99EA4B40F01EB3F1C"><enum>(a)</enum><header>Establishment</header><text>The Secretary shall establish and maintain in the Department an Office of Colonias and Farmworker Initiatives (referred to in this subsection as the <quote>Office</quote>) to—</text> <paragraph id="HFB4DDF70E9BF4E48B2A7BABDC0EC0AB0"><enum>(1)</enum><text>improve engagement with, and service to, border colonias communities, farmworkers, and the family members and children of farmworkers;</text></paragraph>
<paragraph id="H6F10D921294341C69AC99ABF95ED01F4"><enum>(2)</enum><text>improve collaboration between the Department and National, State, and local colonias and farmworker programs and nonprofit organizations; and</text></paragraph> <paragraph id="H9E8A72E64BDD44239A8BC32420A15F90"><enum>(3)</enum><text>carry out other such functions as the Secretary determines appropriate.</text></paragraph></subsection>
<subsection id="H3DAE550E30CF41BB8A131D29D0F653C0"><enum>(b)</enum><header>Duties</header><text display-inline="yes-display-inline">The Office shall ensure that border colonias communities, farmworkers, the family members and children of farmworkers, and nonprofit organizations representing or assisting such communities and individuals have equitable access to, and equitable participation in, programs and services of the Department by—</text> <paragraph id="H86780F3FE7DE4CD69EE992FFFA5AE299"><enum>(1)</enum><text>establishing and monitoring the goals and objectives of the Department to increase participation of such communities, individuals, and nonprofit organizations in Department programs;</text></paragraph>
<paragraph id="H283E9140C3504BD28AD5FDF5990B237A"><enum>(2)</enum><text display-inline="yes-display-inline">assessing the effectiveness of Department outreach programs to such communities, individuals, and nonprofit organizations;</text></paragraph> <paragraph id="HC97BAD9D319B4985A9CC57F136FB8780"><enum>(3)</enum><text>developing and implementing a plan to coordinate outreach activities and services to such communities, individuals, and nonprofit organizations provided by—</text>
<subparagraph id="HE4FD50224E3E4553A75DC50624469365"><enum>(A)</enum><text>the Department; and</text></subparagraph> <subparagraph id="H72A883017FFB44FE965D95E213DB5252"><enum>(B)</enum><text>other Federal agencies, including services related to housing, education, health care, and infrastructure development;</text></subparagraph></paragraph>
<paragraph id="H9C688DFBC6E04FA2B7E6A6DE49A9BAC8"><enum>(4)</enum><text display-inline="yes-display-inline">providing input to the Department and other Federal agencies on programmatic and policy decisions relating to such communities, individuals, and nonprofit organizations, including—</text> <subparagraph id="H59A7F735961E4A419C6F9066F98CBFD9"><enum>(A)</enum><text>identifying obstacles for access to programs and resources; and</text></subparagraph>
<subparagraph id="H58FEF1F2FEBF479EAB493437313D02C0"><enum>(B)</enum><text>elevating Federal, State, and local best practices;</text></subparagraph></paragraph> <paragraph id="H1BE0B9681C384AE4AE6D6372C433BA23"><enum>(5)</enum><text display-inline="yes-display-inline">measuring outcomes of the programs and activities of the Department to serve such communities and individuals;</text></paragraph>
<paragraph id="HB799C716FD0A4240B792593D8515B994"><enum>(6)</enum><text>recommending new initiatives and programs to the Secretary;</text></paragraph> <paragraph id="HE9930C15698140C885618FB21966E25D"><enum>(7)</enum><text>providing technical assistance to such organizations with respect to Departmental programs and resources; and</text></paragraph>
<paragraph id="H8B8FED9429F4430DBC4FEDBD8645DD5F"><enum>(8)</enum><text>carrying out any other related duties that the Secretary determines appropriate.</text></paragraph></subsection> <subsection id="H2D060F81250741C4BDD4DEC7F8181084"><enum>(c)</enum><header>Colonias coordinator</header> <paragraph id="H6CCE76CBF5E44C1DB8A141D876E4CE70"><enum>(1)</enum><header>In general</header><text>The Secretary shall establish within the Office the position of Colonias Coordinator (referred to in this subsection as the <quote>Coordinator</quote>).</text></paragraph>
<paragraph id="H6F519B92DE74430AA8E291172A1061F1"><enum>(2)</enum><header>Duties</header><text display-inline="yes-display-inline">The Secretary shall delegate to the Coordinator responsibility for the following:</text> <subparagraph id="H034A4E9FE64340E1936FDED508DD0606"><enum>(A)</enum><text display-inline="yes-display-inline">Serving as a liaison to nonprofit organizations that represent and have demonstrated experience serving and working in colonias communities.</text></subparagraph>
<subparagraph id="H854E4304A19C429999CDBA15A475563B"><enum>(B)</enum><text display-inline="yes-display-inline">Coordinating with the Department, other Federal agencies, and State and local governments to ensure that the needs of colonias communities are assessed and met, including during declared disasters and other emergencies.</text></subparagraph> <subparagraph id="H258F380F6463441DAD2284910E1FB979"><enum>(C)</enum><text display-inline="yes-display-inline">Consulting within the Office and with other entities to better integrate perspectives, concerns, and interest of colonias communities into the ongoing programs of the Department.</text></subparagraph></paragraph></subsection></section>
<section id="H1563CAA44C90486AB4D9B9A03A690935"><enum>311.</enum><header>Colonias and farmworker initiatives coordinating committee</header>
<subsection id="H39E145D3D46D452F95F4F61954126F84"><enum>(a)</enum><header>Establishment of committee</header><text display-inline="yes-display-inline">The Secretary shall establish and convene a Federal coordinating committee, to be known as the Colonias and Farmworker Initiatives Coordinating Committee (referred to in this subsection as the <quote>Committee</quote>) to provide advice and guidance to the Secretary on matters relating to colonias and farmworker affairs.</text></subsection> <subsection id="H421CDC4E6238443EAD91914DDE5DC5B3"><enum>(b)</enum><header>Membership and composition</header><text display-inline="yes-display-inline">The Committee shall be composed—</text>
<paragraph id="HBCAB47E27A264AE8B64B1633E83E2CEB"><enum>(1)</enum><text>of such representatives not described in subparagraph (B) as the Secretary determines appropriate; and</text></paragraph> <paragraph id="H5BCA0A04D89942DDAACA372235926D59"><enum>(2)</enum><text>of representatives from each of the following:</text>
<subparagraph id="H0EBD5821BFEA42AE9662DF33E71CB188"><enum>(A)</enum><text>The Department of Housing and Urban Development.</text></subparagraph> <subparagraph id="H8F6DED63655F4F4EA225080751812308"><enum>(B)</enum><text>The Department of the Treasury.</text></subparagraph>
<subparagraph id="H60C3276244B74DFEA3F503B8EC4F3F76"><enum>(C)</enum><text>The Environmental Protection Agency.</text></subparagraph> <subparagraph id="H2A4B750CD2E644CFB4C0A00940422EE6"><enum>(D)</enum><text display-inline="yes-display-inline">The Department of Health and Human Services.</text></subparagraph>
<subparagraph id="H1EB4C2DF94104477AE5DD4C9CA360A96"><enum>(E)</enum><text display-inline="yes-display-inline">The Department of Education.</text></subparagraph> <subparagraph id="H4BBC65BB91CF44EEA386D757E4768E41"><enum>(F)</enum><text>The Small Business Administration.</text></subparagraph>
<subparagraph id="H3984484F3F18489EA702E75AA50641FB"><enum>(G)</enum><text>The Department of Labor.</text></subparagraph> <subparagraph id="H179ED8A4E14F40F2A085AC2BFF07A8B6"><enum>(H)</enum><text>The Federal Emergency Management Agency. </text></subparagraph></paragraph></subsection>
<subsection id="HDB99DF204B2C4B5096726DAF4B94A032"><enum>(c)</enum><header>Duties of committee</header><text>The Committee shall—</text> <paragraph id="H1F06DDE12279480CA9079088101583AA"><enum>(1)</enum><text display-inline="yes-display-inline">direct a working group composed of members of the Committee (or designees of such members) and representatives from other Federal agencies and mission areas within the Department (such as the Rural Housing Service, Rural Utilities Service, Rural Business Service, Food and Nutrition Service, and the Farm Service Agency);</text></paragraph>
<paragraph id="H1840005BEB6B45958EA1A4E860A380F5"><enum>(2)</enum><text display-inline="yes-display-inline">engage stakeholders and identify State and municipal best practices to assist colonias communities, farmworkers, and farmworkers’ family members and children;</text></paragraph> <paragraph id="HC3AABE38E4374A3E8ADA6257CB79AAB1"><enum>(3)</enum><text display-inline="yes-display-inline">submit to the Secretary recommendations or, and solutions to— </text>
<subparagraph id="HC442C5BF275448DC90FD48695FB9F3B6"><enum>(A)</enum><text>the issues identified raised under subparagraph (B); and</text></subparagraph> <subparagraph id="H5E27F20EAF684F5C851960B82082F59E"><enum>(B)</enum><text>issues raised at the local, regional, or national level; and</text></subparagraph></paragraph>
<paragraph id="HA9E9B44D96D344828738ACB96927C0FE"><enum>(4)</enum><text display-inline="yes-display-inline">identify and propose solutions to any interdepartmental barrier between the Department and other Federal agencies.</text></paragraph></subsection> <subsection id="H521E27B7DD1A446FA421FDAA6F4ABB0D"><enum>(d)</enum><header>Federal advisory committee act exemption</header><text display-inline="yes-display-inline">Section 1013 of title V, United States Code, shall not apply to the Committee.</text></subsection>
<subsection id="HABE061227EC744BBA608AE8EA08EB5E0"><enum>(e)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to the Secretary $2,500,000 for each of the fiscal years 2024 through 2029 to carry out this section. </text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="HDBD076E525F6451FB8A6DB03B425241B" commented="no"><enum>(b)</enum><header>Transfer of position of Farmworker Coordinator</header> <paragraph id="H6484E9038E2C431CAD66521572B62BC2" commented="no"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Farmworker Coordinator position established under section 226B(f) of the Department of Agriculture Reorganization Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/7/6934">7 U.S.C. 6934(f)</external-xref>) is transferred to the Office of Colonias and Farmworker Initiatives under section 310 of the Federal Crop Insurance Reform and Department of Agriculture Reorganization Act of 1994, as added by this Act.</text></paragraph>
<paragraph id="H1888A366497F4626BCBE0361CF5DABC3" commented="no"><enum>(2)</enum><header>Transfer of legal provisions</header><text display-inline="yes-display-inline">Subsection (f) of section 226B of the Department of Agriculture Reorganization Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/7/6934">7 U.S.C. 6934</external-xref>) is transferred so as to read as subsection (d) of section 310 of the Federal Crop Insurance Reform and Department of Agriculture Reorganization Act of 1994, as added by this Act. </text></paragraph></subsection></section> </legis-body> </bill>
