which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 18, United States Code, to prevent bulk sales of ammunition, promote recordkeeping and reporting about ammunition, end ammunition straw purchasing, and require a background check before the transfer of ammunition by certain Federal firearms licensees to non-licensees.</official-title></form><legis-body id="HF35B12BCF6144AB8BB9B1EBC6CA48CEB" style="OLC"><section id="H36AC01E28B874418A609ECEF6E402B3B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Ammunition Modernization and Monitoring Oversight Act</short-title></quote> or the <quote><short-title>AMMO Act</short-title></quote>.</text></section><section id="H230B55AD415F4C17944494799D68B6FF"><enum>2.</enum><header>Federal license required to deal in ammunition</header><subsection id="HB177BE067AD647C2A1E88192F1DD5595"><enum>(a)</enum><header>In general</header><text>Section 922(a)(1)(B) of title 18, United States Code, is amended—</text><paragraph id="H27858CCBD84B4BEEB6495DEEDDE618DA"><enum>(1)</enum><text>by striking <quote>or licensed manufacturer</quote> and inserting <quote>licensed manufacturer, or licensed dealer</quote>; and</text></paragraph><paragraph id="HD502F639CD9A4570B8EC6BD7D027FFCC"><enum>(2)</enum><text>by striking <quote>or manufacturing</quote> and inserting <quote>manufacturing, or dealing in</quote>.</text></paragraph></subsection><subsection id="H9E7DCE0A92E746B799455C02429CEFC3"><enum>(b)</enum><header>Conforming amendments</header><paragraph id="HB1498A373FB240059F5783ABA16B1654"><enum>(1)</enum><header>Definition of dealer</header><text>Section 921(a)(11)(A) of such title is amended by inserting <quote>or ammunition</quote> after <quote>firearms</quote>.</text></paragraph><paragraph id="H160C1EC726FF4E3E8D57ADE47B4E1978"><enum>(2)</enum><header>License fee</header><text>Section 923(a)(3)(B) of such title is amended by striking <quote>who is not a dealer in destructive devices</quote> and inserting <quote>in firearms other than destructive devices or ammunition for firearms other than destructive devices</quote>.</text></paragraph></subsection></section><section id="H1445404446844EDB9A161F4B2229FE06"><enum>3.</enum><header>Ammunition recordkeeping requirement for certain licensees</header><text display-inline="no-display-inline">Section 923(g)(1) of title 18, United States Code, is amended—</text><paragraph id="H85E68BA68A37464BBE27CEB3962A2AF1"><enum>(1)</enum><text>in subparagraph (A), by inserting <quote>or ammunition</quote> after <quote>firearms</quote>; and</text></paragraph><paragraph id="HD5B6D6EBFCBC423DA16512FF5E94CF59"><enum>(2)</enum><text>in each of subparagraphs (B)(iii) and (C)(ii), by inserting <quote>, or of ammunition,</quote> after <quote>firearms</quote>.</text></paragraph></section><section id="HBE29FFFAA6FE4617921FAA5CC4B6D06F"><enum>4.</enum><header>Prohibition on straw purchase of ammunition</header><text display-inline="no-display-inline">Section 932 of title 18, United States Code, is amended in each of subsections (b) and (c)(2), by inserting <quote>or ammunition</quote> after <quote>firearm</quote> each place it appears.</text></section><section id="HE9AD409E27C1401987B1DF7C5913399B"><enum>5.</enum><header>Restriction on bulk ammunition sales</header><subsection id="H700730A0F4D140F8A42A0162DA696200"><enum>(a)</enum><header>In general</header><text>Section 922 of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HF5BF28ED403C4D709FEA8682CB4E7F15"><subsection id="H034BFE46804945B79032D5B27D4DC411"><enum>(aa)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H126CD2A834974D8BBD6033DC22B84D59"><enum>(1)</enum><text>It shall be unlawful for any person licensed under this chapter to transfer to a person not so licensed—</text><subparagraph id="H82E0A7E1A5804CC6A0EB26CB76B2B7F7" indent="up1"><enum>(A)</enum><text>more than 100 rounds of .50 caliber ammunition or more than 1,000 rounds of any other caliber of ammunition in any period of 5 consecutive days; or</text></subparagraph><subparagraph id="H3AD1DB57B9C04C0793FD62E41EB4D101" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">any ammunition if—</text><clause id="H0CE937B6CF5D403E9C545FCCA95E1A27" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">the transferee has not provided to the transferor a written certification, signed by the transferee, attesting that the purchase of the ammunition would not result in the transferee having acquired more than 100 rounds of .50 caliber ammunition or more than 1,000 rounds of any other caliber of ammunition, in the 5-day period ending with the date of the transfer; or</text></clause><clause id="HEDBFCA8681F240D9B00C7F5C78A7075B"><enum>(ii)</enum><text>the transferor knows or has reason to believe that the transfer would result in the transferee having acquired more than 100 rounds of .50 caliber ammunition or more than 1,000 rounds of any other caliber of ammunition, in the 5-day period ending with the date of the transfer.</text></clause></subparagraph></paragraph><paragraph id="H62827071B2A641DAAC007A50EB3F3482" indent="up1"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HED24359328A34B76B2555D2D05CA5850"><enum>(A)</enum><text>It shall be unlawful for a person licensed under this chapter to transfer ammunition to a person not so licensed, unless the transferee—</text><clause id="H1F2965F91CBB473F928FA2834ACB7F3E" indent="up1"><enum>(i)</enum><text>has presented to the licensee a valid identification document (as defined in section 1028(d)) on which appears—</text><subclause id="H1C7B62B02B0344A5BACB2143EA9B00C1"><enum>(I)</enum><text>the name and address of the transferee;</text></subclause><subclause id="HD65D3D0FB08449C991F1A3A12276E85B"><enum>(II)</enum><text>a number unique to the transferee; and</text></subclause><subclause id="HD303469EB5354D5ABB1DF35D7740F703"><enum>(III)</enum><text>the signature of the transferee; and</text></subclause></clause><clause id="H9D896B7101BF4406A2F4FF57338FC1B9" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">has entered the name, address, and signature of the transferee on, and otherwise completed, such form as the Attorney General shall prescribe, which shall include the written certification described in paragraph (1)(B), and a statement of the penalties for violating this subsection.</text></clause></subparagraph><subparagraph id="H9134B27D8FDB4D3E9DBAA48D8DB9E9E3" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">It shall be unlawful for any person in connection with the purchase or attempted purchase of ammunition to knowingly make any false or fictitious oral or written statement or to furnish or exhibit any false, fictitious, or misrepresented identification, intended or likely to deceive the seller with respect to any fact material to the lawfulness of the sale of the ammunition under this chapter.</text></subparagraph><subparagraph id="H13245173A3414B1B8E2B30A7B3F6884D" indent="up1" display-inline="no-display-inline"><enum>(C)</enum><clause commented="no" display-inline="yes-display-inline" id="H252B22481C1A4DC8A01B2E53FF0DB058"><enum>(i)</enum><text>Within 30 calendar days after the date a person licensed under this chapter transfers ammunition in a transaction subject to paragraph (1), the licensee shall transmit to the Attorney General a paper or electronic copy of the form completed by the transferee pursuant to subparagraph (A) of this paragraph.</text></clause><clause id="H5BFC3C7850414C6BABF44C78E6E1A863" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">The Attorney General shall determine, on the basis of the forms transmitted pursuant to clause (i) of this subparagraph, whether a transfer of ammunition has been made in violation of paragraph (1)(A).</text></clause><clause id="H74B7CAC3D8614A57B83CF83070005BC4" indent="up1"><enum>(iii)</enum><text display-inline="yes-display-inline">Within 60 days after receipt of a form pursuant to clause (i), the Attorney General shall destroy the form unless the form is needed in an ongoing bona fide criminal investigation or prosecution.</text></clause></subparagraph><subparagraph id="H21EE81786CCC44789BED11DE5AC1195E" indent="up1"><enum>(D)</enum><text display-inline="yes-display-inline">A licensee who transfers ammunition in a transaction subject to paragraph (1) shall keep the form referred to in subparagraph (C) of this paragraph in paper or electronic form for not fewer than 2 years.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HD5F08F95A9614E66BE8482761FDC5F07"><enum>(b)</enum><header>Penalties</header><text>Section 924(a) of such title is amended by adding at the end the following:</text><quoted-block style="OLC" id="HC403B672A25341A986EE65E136A07AE4" display-inline="no-display-inline"><paragraph id="H4877D5F680AD4945AF8BC9E524B0762B" indent="up1"><enum>(9)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H0DE6CC4986064CF99D65FADAE66A32E6"><enum>(A)</enum><text>A person licensed under this chapter who knowingly violates paragraph (1) or (2)(A) of section 922(aa) shall be fined not less than $50,000 and not more than $250,000, and—</text><clause id="HD8A9CFBC303E4779BDD7F6AFD4A1863A" indent="up1"><enum>(i)</enum><text>in the case of the 2nd such violation by the person, the person shall be prohibited from selling a firearm or ammunition for 60 days; or</text></clause><clause id="H4BCBADE611BE464BAE47E94251D63138" indent="up1"><enum>(ii)</enum><text>in the case of the 3rd such violation by the person, all licenses issued to the person under this chapter shall be revoked.</text></clause></subparagraph><subparagraph id="H0873338D287E497C98D8A1CD38BE50F0" indent="up1"><enum>(B)</enum><text>A person who knowingly violates section 922(aa)(2)(B) shall be—</text><clause id="HA60FC0AE80144E83B762273EE55B7814"><enum>(i)</enum><text>fined not more than—</text><subclause id="H35F247409238446B81A653C02FD8B4BA"><enum>(I)</enum><text>$20,000, in the case of the 1st such violation by the person; or</text></subclause><subclause id="H48DDE20B8BF342F79B63E05AE8E4ED66"><enum>(II)</enum><text display-inline="yes-display-inline">$50,000, in the case of any subsequent such violation by the person;</text></subclause></clause><clause id="HAF0C40664B5446A38B75AE921FC19025"><enum>(ii)</enum><text>imprisoned not more than 5 years; or</text></clause><clause id="H879C0C3DDFD04B5C824BC81C3B3759CA"><enum>(iii)</enum><text>both.</text></clause></subparagraph><subparagraph id="HE0DAA8F4B2C84155A1B90E607FC8A9AB" indent="up1"><enum>(C)</enum><text>Whoever knowingly violates subparagraph (C)(i) or (D) of section 922(aa)(2) shall be fined not more than $10,000.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HBEE1AB2CBF2941CF93ABB484D4A60091"><enum>(c)</enum><header>Signage requirement</header><paragraph id="HD5D0CF2514E3476E8A80B92F94D6D33E"><enum>(1)</enum><header>In general</header><text>Section 923(g) of such title is amended by adding at the end the following:</text><quoted-block style="OLC" id="H04D0EBA60265477AB33808A12B98BCC4" display-inline="no-display-inline"><paragraph id="H3CC55E2A84D4424FB0F5CA7EA337097B" indent="up1"><enum>(8)</enum><text display-inline="yes-display-inline">Each person licensed under this chapter shall post at the premises of the licensee subject to the license a sign on which there is set forth, in accordance with regulations prescribed by the Attorney General—</text><subparagraph id="H471DE3EA5EDF4347ABD4DBED4788ED2B"><enum>(A)</enum><text display-inline="yes-display-inline">a summary of paragraphs (1) and (2)(B) of section 922(aa), and the penalties for making false statements on a written certification made pursuant to section 922(aa)(1)(B)(i); and</text></subparagraph><subparagraph id="H45339801FFF640FD9CD2927AAFEAA408"><enum>(B)</enum><text display-inline="yes-display-inline">a summary of the provisions of section 932 relating to ammunition, and the penalties for violating those provisions.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H49C83044665C4DEB8CE1DAD1D186C064"><enum>(2)</enum><header>Penalty</header><text>Section 924 of such title is amended by adding at the end the following:</text><quoted-block style="OLC" id="H983BD6D70DC641598DEC3B859BB103C8" display-inline="no-display-inline"><subsection id="H9566E090B8E047E2B5F64F97A78CCD76"><enum>(q)</enum><header>Civil penalty for failure of licensee To post sign about restrictions on ammunition sales</header><paragraph id="HD0075B22108643578BBFEC1607917C15"><enum>(1)</enum><header>In general</header><subparagraph id="H728CD5031D7C475191F5F7756F9BF07D"><enum>(A)</enum><header>Civil penalty</header><text>With respect to each violation of section 923(g)(8) by a person licensed under this chapter, the Attorney General may, after notice and opportunity for hearing, subject the licensee to a civil penalty in an amount equal to $10,000.</text></subparagraph><subparagraph id="H2BF194EDD5194AD6BE981765B88D2ADD"><enum>(B)</enum><header>Review</header><text>An action under this paragraph may be reviewed only as provided under section 923(f).</text></subparagraph></paragraph><paragraph id="HF9A5CD1EE06F4DF0B37A200A46B3782A"><enum>(2)</enum><header>Administrative remedies</header><text>The imposition of a civil penalty under paragraph (1) shall not preclude any administrative remedy that is otherwise available to the Attorney General.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="HF85E02E11CCC4398A39F894E36051C8E"><enum>6.</enum><header>Background check required before transfer of ammunition by certain Federal firearms licensees to non-licensees</header><subsection id="H8656AADB4A484963AD22D91A7453FFF0"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 922 of title 18, United States Code, is amended—</text><paragraph id="HF16BB2C9FF394E7EB2BCFEE7ECFB0E7C"><enum>(1)</enum><text display-inline="yes-display-inline">by striking subsection (s) and redesignating subsection (t) as subsection (s);</text></paragraph><paragraph id="H71FBA1C54775435AA4CB5503A8F53C38"><enum>(2)</enum><text>in subsection (s) (as so redesignated)—</text><subparagraph id="HF159EEEE50AE4E9BB0BD5ABD910C33DC"><enum>(A)</enum><text>in paragraph (1)(B)(i), by inserting <quote>indicating that the receipt of a firearm or ammunition by such other person would not violate subsection (g) or (n) of this section, or State, local, or Tribal law</quote> before the semicolon;</text></subparagraph><subparagraph id="HB641500FD4014BA3A3A3D9A4BF95BE9C"><enum>(B)</enum><text>in paragraph (3)(C)(ii), by striking <quote>(as defined in subsection (s)(8))</quote>; and</text></subparagraph><subparagraph id="HE014CB3296F94C32AEA43C55BA97CB2A"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H384E3C13AE774207958EA66DB5A95BF8" style="OLC"><paragraph id="H80F4FBDC03A043928BE98E99C511D507" indent="up1"><enum>(7)</enum><text display-inline="yes-display-inline">In this subsection, the term <term>chief law enforcement officer</term> means the chief of police, the sheriff, or an equivalent officer or the designee of any such individual.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H67A76373144E42BD861B7D2BC8F6117B"><enum>(3)</enum><text>by inserting after subsection (s) (as so redesignated) the following:</text><quoted-block style="OLC" id="H47C4E10F795B4888AC5E8B62D4E83245" display-inline="no-display-inline"><subsection id="H78820ACF3C074B009CF11F29627C18CA"><enum>(t)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H452DDE5F575D4880A8644C2DC20C7FDC"><enum>(1)</enum><text>A licensed importer, licensed manufacturer, or licensed dealer shall not transfer ammunition to another person not licensed under this chapter, unless—</text><subparagraph id="HEBA66D375553437FBFEA0666D2996B0B" indent="up1"><enum>(A)</enum><text>before the completion of the transfer, the licensee contacts the national instant criminal background check system established under section 103 of the Brady Handgun Violence Prevention Act;</text></subparagraph><subparagraph id="H98F4535580CD4DC7803C2A9D753B141F" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">the system provides the licensee with a unique identification number indicating that—</text><clause id="HDEF7FB208D184E4485026D365CCE7E7D"><enum>(i)</enum><text>the receipt of a firearm or ammunition by such other person would not violate subsection (g) or (n) of this section, or State, local, or Tribal law; and</text></clause><clause id="H775706CD2C56448BBD8CBA50A871B5C6"><enum>(ii)</enum><text>if such other person has not attained 21 years of age, that a transfer of a firearm or ammunition to such other person would not violate subsection (d) of this section; and</text></clause></subparagraph><subparagraph id="HD114247FB75D45689272FAC7FCBFF489" indent="up1"><enum>(C)</enum><text>the licensee has verified the identity of such other person by examining a valid identification document (as defined in section 1028(d) of this title) of such other person containing a photograph of such other person.</text></subparagraph></paragraph><paragraph id="H30B09622C7BA49BDB4C6970C78388E63" indent="up1" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">Paragraph (1) shall not apply to an ammunition transfer between a licensee and another person if—</text><subparagraph id="HB94AAFFD933D4076A5A7F6A602AAF074"><enum>(A)</enum><text>such other person has presented to the licensee a permit that—</text><clause id="HFC0BA3E6C67446239F7993EAA32481DB"><enum>(i)</enum><text>allows such other person to possess or acquire ammunition, or to possess or acquire a firearm; and</text></clause><clause id="H10555A743DEF4C119D3DD1451602C7CE"><enum>(ii)</enum><text>was issued not more than 5 years earlier by the State in which the transfer is to take place; and</text></clause></subparagraph><subparagraph id="H786062F334324B2FA71BF4F0DA2B4A36"><enum>(B)</enum><text>the law of the State provides that such a permit is to be issued only after an authorized government official has verified that the information available to such official does not indicate that possession of ammunition by such other person would be in violation of law.</text></subparagraph></paragraph><paragraph id="HF4A41630C81C445DAE437FAF0833F88C" indent="up1"><enum>(3)</enum><text>Paragraphs (2) and (4) through (7) of subsection (s) shall apply with respect to ammunition transfers pursuant to this subsection in the same manner in which such paragraphs apply with respect to firearm transfers.</text></paragraph><paragraph id="H9B05686A30694F389467E3AE58165313" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">It shall be unlawful for a licensed importer, licensed manufacturer, or licensed dealer to transfer possession of ammunition to another person not so licensed unless the licensee has provided such other person with a notice of the prohibition under paragraph (1), and such other person has certified that such other person has been provided with this notice on a form prescribed by the Attorney General.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H311B4491DAEA41518E4A05513DD99B3A"><enum>(b)</enum><header>Technical and conforming amendments</header><paragraph id="H6264970E8313430BB2BCD75C04404AA5"><enum>(1)</enum><header>Section 922</header><text>Section 922(y)(2) of title 18, United States Code, is amended, in the matter preceding subparagraph (A), by striking <quote>, (g)(5)(B), and (s)(3)(B)(v)(II)</quote> and inserting <quote>and (g)(5)(B)</quote>.</text></paragraph><paragraph id="HE1BFDFF772A645CE978961AEA38E63F8"><enum>(2)</enum><header>Consolidated and further continuing appropriations act, 2012</header><text>Section 511 of title V of division B of the Consolidated and Further Continuing Appropriations Act, 2012 (<external-xref legal-doc="usc" parsable-cite="usc/34/40901">34 U.S.C. 40901</external-xref> note) is amended by striking <quote>subsection 922(t)</quote> each place it appears and inserting <quote>subsection (s) or (t) of section 922</quote>.</text></paragraph></subsection><subsection id="HE63F1E5F45CF4D5A97653DD26324DA61"><enum>(c)</enum><header>Rules of construction</header><text>Nothing in this section, or any amendment made by this section, shall be construed to—</text><paragraph id="HCFE33F3FE935474FBD8CE61C46863F47"><enum>(1)</enum><text>authorize the establishment, directly or indirectly, of a national firearms or ammunition registry; or</text></paragraph><paragraph id="HC25CE8D35A144ABE8A2DF350342EB608"><enum>(2)</enum><text>interfere with the authority of a State, under section 927 of title 18, United States Code, to enact a law on the same subject matter as this section.</text></paragraph></subsection><subsection id="H934051EC6B25477188CF50053925ED50"><enum>(d)</enum><header>Authorization of increased funding for the NICS system</header><text>In addition to any amount otherwise authorized to be appropriated for the background check system established under section 103 of the Brady Handgun Violence Prevention Act, there are authorized to be appropriated not more than $150,000,000 for upgrading and maintaining the system.</text></subsection></section><section id="H1EBEA4D0D99C4A799F65FA33B196617B"><enum>7.</enum><header>Reporting requirement</header><text display-inline="no-display-inline">Within 6 months after the effective date of this Act and annually thereafter, the Director of the Bureau of Alcohol, Tobacco, Firearms, and Explosives shall prepare, publish in the Federal Register, and otherwise make available to the public a report on the violations of section 922(aa) of title 18, United States Code, that occurred during the period covered by the report, and the information reported pursuant to paragraph (2)(C) of such section (including geographic data, total sales data, crime statistics, information on repeat offenders, or caliber types involved) during the period covered by the report, which shall include an identification of any trend in the violations or information that Federal, State, or local law enforcement authorities may find useful.</text></section><section id="HF004CCB869854EDB83453A74B9ACCBA4"><enum>8.</enum><header>Effective date</header><text display-inline="no-display-inline">This Act and the amendments made by this Act shall take effect on the 120th day after the date of the enactment of this Act.</text></section></legis-body></bill>
