jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To encourage local educational agencies to inform parents about gun safety, and for other purposes.</official-title></form><legis-body id="HBADEF50F22A649808B5A8437F958693B" style="OLC"><section id="H71D188DCF4F742658E0726DF1996B926" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Incentivize Motivated Parents with Responsible Options for Vital Education Safety for Schools Act</short-title></quote> or the <quote><short-title>IMPROVE Safety for Schools Act</short-title></quote>.</text></section><section id="H403B703041304592B95289B355B6FFB4" section-type="subsequent-section"><enum>2.</enum><header>Encourage local educational agencies to inform parents about gun safety</header><subsection id="HC4D8F0357E4542AFB3317048ED8E7D0B"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Director of the United States Secret Service shall provide guidance to local educational agencies that receive Federal funds on preparing a notice to advise parents on purchasing and using a gun safety device.</text></subsection><subsection id="HF6F52F3A4889438CB34F1803E82255BE"><enum>(b)</enum><header>Contents of guidance</header><text>The guidance provided pursuant to subsection (a) shall include—</text><paragraph id="H2E815F4BCB4946ABA039AAA0918EA2CE"><enum>(1)</enum><text>a proposed deadline for the local educational agency to prepare the notice described in subsection (a);</text></paragraph><paragraph id="HB8BDED8345834D8D89916E5E040090D3"><enum>(2)</enum><text>recommendations on the size of the gun safety device that should be purchased based on the type of firearm in a parent’s possession; and</text></paragraph><paragraph id="H2BE67110B3AD4358A83D01CEB6AAFDCD"><enum>(3)</enum><text>information on the tax credit described in section 25F of the Internal Revenue Code, as added by section 3.</text></paragraph></subsection><subsection id="H7893397882FD4911937C90B3E887C244"><enum>(c)</enum><header>Notice distribution</header><text display-inline="yes-display-inline">Each local educational agency that receives Federal funds shall submit the notice described in subsection (a) to each parent with a child attending a school served by such local educational agency.</text></subsection><subsection id="H3487E14B66E245AE8A577A72AE1D82AC"><enum>(d)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="H1B8C49EF7F084222A1644392C659489B"><enum>(1)</enum><header>ESEA terms</header><text display-inline="yes-display-inline">The terms <term>local educational agency</term> and <term>parent</term> have the meanings given the terms in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text></paragraph><paragraph id="H3FAC9B2C8148438FBB96419B2DAEC172"><enum>(2)</enum><header>Gun safety device</header><text>The term <term>gun safety device</term> has the meaning given the term <term>secure gun storage or safety device</term> in section 921 of title 18, United States Code.</text></paragraph></subsection></section><section id="HA8B5E40223694795A2C685F5D82468C0" display-inline="no-display-inline" section-type="subsequent-section"><enum>3.</enum><header>Secure firearm credit</header><subsection id="HDE69751CFEAC49ECAADEDE555FCBFCAC"><enum>(a)</enum><header>In general</header><text>Subpart A of part IV of subchapter A of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 is amended by inserting after section 25E the following new section:</text><quoted-block id="H24787878FD6E409AB5F0666919FD6849"><section id="H576DAF2EE02A4F36B158CBA0FCDE0FB0"><enum>25F.</enum><header>Secure firearm credit</header><subsection id="H6DC568B35FE342D4AD02DFC62E5346F5"><enum>(a)</enum><header>Allowance of credit</header><text display-inline="yes-display-inline">In the case of an individual with a qualifying child or dependent, there shall be allowed as a credit against the tax imposed by this chapter for the taxable year an amount equal to 75 percent of amounts paid during such taxable year by the taxpayer for the purchase of any firearm safety device.</text></subsection><subsection id="HD91443C2DB57462CA0F7E47404738F11"><enum>(b)</enum><header>Limitations</header><paragraph id="H222B69F1ECF445B0AB88E49C16A32672"><enum>(1)</enum><header>Credit amount</header><text>The amount allowed as a credit under subsection (a) for a taxpayer for a taxable year shall not exceed $300.</text></paragraph><paragraph id="H86B807105A494F7DA00C710991A6A9D2"><enum>(2)</enum><header>Limitation based on adjusted gross income</header><subparagraph id="HA22F89B112724DB48E30A9CE666770D6"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The amount of the credit allowed by subsection (a) (determined without regard to this subsection) shall be reduced (but not below zero) by the amount which bears the same ratio to such credit (as so determined) as—</text><clause id="H0A207B00C2D641DE86B04A9294073F6F"><enum>(i)</enum><text>the excess of—</text><subclause id="HE72E7FF9EE184B1CAD23432EBCA01A27"><enum>(I)</enum><text display-inline="yes-display-inline"> the taxpayer's adjusted gross income for such taxable year, over</text></subclause><subclause id="H82E7D0EF68FF4E34B61243B75BAD13D0"><enum>(II)</enum><text>$75,000, bears to</text></subclause></clause><clause id="HCF5CFB3969FC4B679DFBAA3B84A29FCF"><enum>(ii)</enum><text>$5,000.</text></clause></subparagraph><subparagraph id="HA86B85319F4644949DBA6324984F1F58"><enum>(B)</enum><header>Special rules</header><clause id="H3672CDCBFEAC45A693777717EEF05201"><enum>(i)</enum><header>Joint return or surviving spouse</header><text display-inline="yes-display-inline">In the case of a joint return or a surviving spouse (as defined in section 2(a)), paragraph (1) shall be applied by substituting <quote>$150,000</quote> for <quote>$75,000</quote> and <quote>$10,000</quote> for <quote>$5,000</quote>.</text></clause><clause id="H461D0E8E12E847B58E17D5DD984ECF6A"><enum>(ii)</enum><header>Head of household</header><text display-inline="yes-display-inline">In the case of a head of household (as defined in section 2(b)), paragraph (1) shall be applied by substituting <quote>$112,500</quote> for <quote>$75,000</quote> and <quote>$7,500</quote> for <quote>$5,000</quote>.</text></clause></subparagraph></paragraph></subsection><subsection id="H5A16B98566C04232968D7A241627B8C3" display-inline="no-display-inline"><enum>(c)</enum><header>Definitions</header><text display-inline="yes-display-inline">For purposes of this section—</text><paragraph id="H3AF7B5AD76EF4D3281DF100168359BE9"><enum>(1)</enum><header>Firearm safety device</header><text display-inline="yes-display-inline">The term <term>firearm safety device</term> means a secure gun storage or safety device which—</text><subparagraph id="HA39215B12E9B4FBFB46A38E276265477"><enum>(A)</enum><text>is described in section 921(a)(34)(C) of title 18, United States Code, and</text></subparagraph><subparagraph id="HFE8C5E23FCB14A2DBB146C019F6D1517"><enum>(B)</enum><text>bears a unique serial number. </text></subparagraph></paragraph><paragraph id="H38E6B72EB5BE4839A43E32F6F13A34E7"><enum>(2)</enum><header>Qualifying child or dependent</header><text>The term <term>qualifying child or dependent</term> means—</text><subparagraph id="H7BE8F77313B247BAAC06766BE6887BD3"><enum>(A)</enum><text>a qualifying child (as defined in section 24(c)), or</text></subparagraph><subparagraph id="H8D9F361F776847C5B3A3EE46773CFA0A"><enum>(B)</enum><text>a dependent of the taxpayer with respect to whom a partial credit is allowed under section 24(h)(4) for the taxable year.</text></subparagraph></paragraph></subsection><subsection id="H727DB83581734C3D9946CB55CEA8ACF9"><enum>(d)</enum><header>Substantiation</header><paragraph id="H4336CA8B1E6B4F3988AF8717E38CDBB2"><enum>(1)</enum><header>In general</header><text>No credit shall be allowed under subsection (a) with respect to any firearm safety device unless the taxpayer includes the receipt or serial number of such device with the return of tax for the taxable year.</text></paragraph><paragraph id="H05F1A5F72D23467DA77E4D81A7FCF0CF"><enum>(2)</enum><header>Regulations and guidance</header><text display-inline="yes-display-inline">The Secretary shall issue such regulations or other guidance as the Secretary determines necessary to carry out the purposes of this subsection, including regulations or other guidance prohibiting inquiries which violate the privacy of gunowners (as determined by the Secretary), including inquiries relating to ownership of, or types of, guns, ammunition, modifications, or accessories stored in such device. </text></paragraph></subsection><subsection id="HC5CC5D5762794D55BF0B355F1A992D81"><enum>(e)</enum><header>Termination</header><text display-inline="yes-display-inline">No credit shall be allowed under this section with respect to any firearm safety device acquired after December 31, 2028.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H20D41472B89A4EE2AC78D62CE7B2B54A"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections for subpart A of part IV of subchapter A of chapter 1 of such Code is amended by inserting after the item relating to section 25E the following new item:</text><quoted-block style="OLC" id="H1CADF37B68A34A8894BE3B715157B0AE"><toc regeneration="no-regeneration"><toc-entry level="section">Sec. 25F. Secure firearm credit.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H889E290C26DF4069874B5FF4E033C524"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply to taxable years beginning after December 31, 2023.</text></subsection></section><section id="H25B0CE2FFB4E496EB96C55B2BDB57388" display-inline="no-display-inline"><enum>4.</enum><header>Prohibition on disclosure of credit for purchase of firearm safety device to any Federal Agency</header><subsection id="H5780F6B33F22486D9D073D1B9EABA33C"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/6103">Section 6103</external-xref> of the Internal Revenue Code of 1986 is amended—</text><paragraph id="H9A3A9423ED7D4B6ABAE53C334192B467"><enum>(1)</enum><text>in subsection (i)—</text><subparagraph id="HF8CAA1143513427EA465D5B452A28F5E"><enum>(A)</enum><text>by inserting <quote>or paragraph (9)</quote> after <quote>Except as provided in paragraph (6)</quote> each place it appears, and </text></subparagraph><subparagraph id="H1BB4D97A3C46465A8A9B1E669E0CD5C2"><enum>(B)</enum><text>by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HEFC281B8198A449DBB9C4CD7649BCDDC"><paragraph id="HE381FADF30524697BAA7EAC313D322BD"><enum>(9)</enum><header>Prohibition on disclosure of return information relating to secure firearm credit</header><text display-inline="yes-display-inline">The Secretary shall not disclose return information relating to the credit under section 25F to any officer or employee of a Federal agency. </text></paragraph><after-quoted-block>, and </after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H0B643EF4884A4D87ACC5FFB86ED73EAE"><enum>(2)</enum><text>by redesignating subsection (q) as subsection (r) and by inserting after subsection (p) the following new subsection: </text><quoted-block style="OLC" id="H013EEEBAAAB741EA94C7F2F52FC761E8" display-inline="no-display-inline"><subsection id="HD66B55A1E46C4600B31BA260011A9BD2"><enum>(q)</enum><header>Prohibition on non-Anonymized disclosures relating to firearm safety credit</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this section, the Secretary shall not compile or disclose any list of return information relating to the credit under section 25F unless such list is in a form which cannot be associated with, or otherwise identify, directly or indirectly, a particular taxpayer.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H8D743D729E7D4778B214FE8176A3F82D"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this section shall apply to disclosures after the date of the enactment of this Act.</text></subsection></section><section id="H796245C143B9477AA0217B8A731BFCD2"><enum>5.</enum><header>School and local safety actions</header><subsection id="HBEF3C6BB41CE49BF947AA344919474A4"><enum>(a)</enum><header>State activities</header><text display-inline="yes-display-inline">Section 4104(b)(3)(B) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7114">20 U.S.C. 7114(b)(3)(B)</external-xref>) is amended—</text><paragraph id="HD1C70A3C6CBB4A1CA6C85A7E41773CCA"><enum>(1)</enum><text>by striking <quote>and</quote> at the end of clause (iii);</text></paragraph><paragraph id="H83F79B9127BC43C0B3307B40CA04860F"><enum>(2)</enum><text>by striking <quote>and</quote> at the end of clause (iv); and</text></paragraph><paragraph id="HB676763769A549DCB82B000BA8BAD6AE"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="H9F4949B0036C4A15A84C7A16CE666069" display-inline="no-display-inline"><clause id="H25154A680D6148B7817EDAB5D971DDE2"><enum>(v)</enum><text display-inline="yes-display-inline">supporting local educational agencies in providing de-escalation training through a certified entity (such as Federal, State, or local law enforcement or an entity that has been certified by Federal, State, or local law enforcement to provide de-escalation training) to teachers, administrators, and other staff; and</text></clause><clause id="HB568CC6085FF401E9F7336D99FFD7176"><enum>(vi)</enum><text display-inline="yes-display-inline">establishing a school safety specialist position (on a full-time or part-time basis) or training a school resource officer to fulfill the role and responsibilities of a school safety specialist at each local educational agency, and at each public elementary school and secondary school, in the State to—</text><subclause id="H51FB4D43557F4C408C9B6479C4D2ADEB"><enum>(I)</enum><text display-inline="yes-display-inline">serve as a liaison between the State and Federal agencies relevant to school safety</text></subclause><subclause id="H4649DBD48F5B443C81E6696F1FE29D06"><enum>(II)</enum><text display-inline="yes-display-inline">help identify and apply for State and Federal grants to bolster physical safety in schools; and</text></subclause><subclause id="HA00B201AAA3D48DCADEA217DA8AC871E"><enum>(III)</enum><text display-inline="yes-display-inline">develop a relationship with local law enforcement on best practice to keep schools safe; and</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H2F00EEC38DA048EAA4CB6C1EF2714C81"><enum>(b)</enum><header>Definitions</header><text>Section 4102 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7112">20 U.S.C. 7112</external-xref>) is amended by adding at the end the following:</text><quoted-block id="HFBE68CBAEA1A4F0D8304D187FE90E948" style="OLC"><paragraph id="HFE36FBEB4FAB42F6A88DC67EC9B5D567"><enum>(9)</enum><header>De-escalation training</header><text>The term <term>de-escalation training</term> means instruction or guidance on the use of communication or other techniques during a violent, or potentially violent, encounter to stabilize, slow, or reduce the intensity of such an encounter without using physical force or with a reduction in force.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H20E054CE3D0342019CBAFA0DF34B57A5"><enum>(c)</enum><header>Required services</header><text display-inline="yes-display-inline">Section 8561(b) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7961">20 U.S.C. 7961(b)</external-xref>) is amended by adding at the end the following: </text><quoted-block style="OLC" id="H056292D18CF9453881E9EE844E651CB5" display-inline="no-display-inline"><paragraph id="HC30FBDA641C547DEA50FF9AF96F46F90"><enum>(4)</enum><header>Services</header><text display-inline="yes-display-inline">In addition to the requirements of paragraph (1), each State receiving Federal funds under any title of this Act shall, in the case of a student expelled from school pursuant to paragraph (1), provide confidential mental health services by telephone or virtually for such student and the parents of such student if the parents do not have the financial means to provide such services for the student.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="HF3DA3F87EC224109B892D92C2A0698D8"><enum>6.</enum><header>Eligibility for standardized training for school resource officers</header><subsection id="HAABC9CFFC0F6457D94A9256D137F4661"><enum>(a)</enum><header>Sense of Congress</header><text display-inline="yes-display-inline">It is the sense of Congress that any State that receives Federal assistance for law enforcement programs to assist local jurisdictions should develop a standardized training program for school resource officers, the requirements of which should be determined by the Governor of a State and a State law enforcement agency.</text></subsection><subsection id="H4E9AC3CDC7734D0EBB533CB544CF7A6A"><enum>(b)</enum><header>Use of funds</header><text>Section 1701 of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10381">34 U.S.C. 10381</external-xref>) is amended—</text><paragraph id="HF7B814515B4C4F53BAE66C5CCC16AD68"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (22) and (23) as paragraphs (23) and (24), respectively;</text></paragraph><paragraph id="HA585E72188BA4D66AFA96F92E65E3902"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (23), as so redesignated, by striking <quote>(21)</quote> and inserting <quote>(22)</quote>; and</text></paragraph><paragraph id="HF6014FF052574EBFA77A0A482F22706C"><enum>(3)</enum><text>by inserting after paragraph (21) the following:</text><quoted-block style="OLC" id="HA099EEEBDB0B4FB1B4C8A2B29A961459" display-inline="no-display-inline"><paragraph id="HD48BF4B044424F2C9F2003E1F8527EF1"><enum>(22)</enum><text display-inline="yes-display-inline">to provide for the implementation of a standardized training program for school resource officers, the requirements of which shall be determined by the Governor of a State and a State law enforcement agency for local educational agencies in any State that does not have a standardized training program;</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="H15D0ED3134774125929BF09B07A91045" commented="no"><enum>7.</enum><header>Social media outreach</header><subsection id="H0FE1FC866949458C9C25435AC4D2A0C0"><enum>(a)</enum><header>Requirement</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Secretary of Education, the Secretary of Homeland Security, the Secretary of Health and Human Services, and the Attorney General shall, with respect to the social media of presence of SchoolSafety.gov—</text><paragraph id="HB8F81EA4BDC940DEA06B2774FE6AA5DC"><enum>(1)</enum><text display-inline="yes-display-inline">expand such social media presence to Facebook, Snapchat, YouTube, Discord, and Instagram, and other social media platforms determined to be appropriate by the Secretaries; and</text></paragraph><paragraph id="HA3DB0C9D97EF4645B4708AA4DF96632B"><enum>(2)</enum><text display-inline="yes-display-inline">include the information provided in the guidance used by local educational agencies to prepare notices pursuant to section 2(a).</text></paragraph></subsection><subsection id="H3FC9FFEC091D4FC6BBFE62011E2C4181"><enum>(b)</enum><header>Secretaries defined</header><text>In this section, the term <term>Secretaries</term> means the Secretary of Education, the Secretary of Homeland Security, the Secretary of Health and Human Services, and the Attorney General. </text></subsection></section></legis-body></bill>
