which was referred to the <committee-name committee-id="HED00">Committee on Education and the Workforce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Higher Education Act of 1965 to require certain institutions of higher education to provide notice of tuition levels for students.</official-title></form><legis-body id="HDD41D7E5509E425D91A860DFC5E20AB3" style="OLC"><section id="H7D3AAB9497C04CAF90B091F5A9E94A40" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Truth in Tuition Act of 2023</short-title></quote>.</text></section><section id="H634F5C13FB464DBAA6512E8D55F6F4E4"><enum>2.</enum><header>Notice of tuition levels</header><subsection id="H61F588375FB44E46810D9DAB3EE7CB47"><enum>(a)</enum><header>Amendment</header><text display-inline="yes-display-inline">Section 487(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1094">20 U.S.C. 1094(a)</external-xref>) is amended by adding at the end the following new paragraph:</text><quoted-block display-inline="no-display-inline" id="H682D2192B4354AF2889B63B61150B2E6" style="OLC"><paragraph id="H5385D56CCB2F4B84B2ED5CBDB50DFAB8"><enum>(30)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H05A3FBEB20E44E7695188ECB64F9F9AF"><enum>(A)</enum><text display-inline="yes-display-inline">The institution will provide to each student admitted to an undergraduate or graduate program—</text><clause id="H8309E8CECDB847ACB9AB39009B331A11" indent="up1"><enum>(i)</enum><text>a multi-year tuition and fee schedule; or</text></clause><clause id="HB757796848A148D09C041A0A4C7FD6ED" indent="up1"><enum>(ii)</enum><text>a single-year tuition and fee schedule, and a nonbinding, multi-year estimate of net costs after all financial aid is awarded, assuming constant family and student income, assets, and relevant circumstances.</text></clause></subparagraph><subparagraph id="HFFD6448CF03C414A97523009BF3E3949" indent="up1"><enum>(B)</enum><text>Multi-year schedules and estimates required by <internal-xref idref="H05A3FBEB20E44E7695188ECB64F9F9AF" legis-path="(30)(A)">subparagraph (A)</internal-xref>—</text><clause id="H933EA41CAF0C4DDD9C3F94EE3FCC43C6"><enum>(i)</enum><text>may include a percentage or dollar increase or decrease of any size the institution determines to be appropriate from one year to the next; and</text></clause><clause id="H7D882E3F5FC04A5994CD647DFAC78C18"><enum>(ii)</enum><text>shall indicate, on a year-by-year basis, costs for the normal duration of such student's undergraduate or graduate program.</text></clause></subparagraph><subparagraph id="H419A238D012743908953F35803C7AA0B" indent="up1"><enum>(C)</enum><text>Institutions that elect a single-year tuition and fee schedule under <internal-xref idref="HB757796848A148D09C041A0A4C7FD6ED" legis-path="(30)(A)(ii)">subparagraph (A)(ii)</internal-xref> shall include with each multi-year estimate provided under such subparagraph the average deviation, in percentage terms, between previous year estimates and actual net costs for students at their institution.</text></subparagraph><subparagraph id="H2D7CB583E92748B29625802B3D46EF2A" indent="up1"><enum>(D)</enum><text>The Secretary shall waive the requirements of <internal-xref idref="H05A3FBEB20E44E7695188ECB64F9F9AF" legis-path="(30)(A)">subparagraph (A)</internal-xref> if the institution demonstrates to the Secretary that the requirements of <internal-xref idref="H05A3FBEB20E44E7695188ECB64F9F9AF" legis-path="(30)(A)">subparagraph (A)</internal-xref> are not practicable because of the occurrence of one or more events causing the institution severe economic distress, dramatic reduction of State or Federal aid, or any other circumstance determined to be appropriate by the Secretary.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H8173C0A6086443B2B05B62FD2884147A"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendment made by <internal-xref idref="H61F588375FB44E46810D9DAB3EE7CB47" legis-path="2.(a)">subsection (a)</internal-xref> shall be effective on the date that is 120 days after the date of enactment of this Act.</text></subsection></section></legis-body></bill>
