<official-title display="yes">To terminate certain contracts relating to the construction of the border fence and to transfer unused border fence materials to the States along the southwest border of the United States.</official-title>

<section section-type="section-one" id="H44AA70CBBB1B490E998D4F3AA38C5933"><enum>1.</enum><header>Short titles</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Border's Unused Idle and Lying Dormant Inventory Transfer Act</short-title></quote> or the <quote><short-title>BUILD IT Act</short-title></quote>.</text></section> <section section-type="subsequent-section" id="HE8E01494F4C04313857C19CA04F08332"><enum>2.</enum><header>Transfer of unused border fence material to border States</header> <subsection id="H62DE4BB73BE24F39B3E68D6DF6A2258E"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, not later than 90 days after the date of the enactment of this Act, the Federal Government shall deliver to the Governments of Arizona, of California, of New Mexico, and of Texas, upon request, any materials associated with the construction of the physical barrier along the international border between the United States and Mexico that—</text>
<paragraph id="H8DC671443E154A1BB74793247D118EF3"><enum>(1)</enum><text display-inline="yes-display-inline">are in the possession of the Department of Homeland Security, the Department of Defense, or any other Federal agency; or</text></paragraph> <paragraph id="HC6B998C5712F4DB2A469F4333207A1E3"><enum>(2)</enum><text display-inline="yes-display-inline">have been purchased by the Federal Government, but remain in the possession of any contractor or vendor.</text></paragraph></subsection>
<subsection id="H6037E7F05EF44B51980A726A137D6B0B"><enum>(b)</enum><header>Prohibition of fees and delivery charges</header><text>The Federal Government may not charge any fee or other delivery charge to any of the States referred to in subsection (a) for the delivery of the materials described in such subsection. </text></subsection> <subsection id="H552CA5D9F34A4585A6249C4E653F753D"><enum>(c)</enum><header>Use of materials</header><text>Any State receiving materials from the Federal Government pursuant to subsection (a) shall use such materials for the purpose of constructing, repairing, or reinforcing the construction of a barrier along the international border between such State and Mexico.</text></subsection>
<subsection id="HCA4B75D017C8446E89DE20FDB693BC11"><enum>(d)</enum><header>Termination of existing contracts</header><text>The Federal Government shall terminate, at the convenience of the Federal Government, any contract relating to the maintenance and security of the materials intended for the construction referred to in subsection (a) that—</text> <paragraph id="H6F84FCA81EB04F8788334477680859B6"><enum>(1)</enum><text>is in effect on the date of the enactment of this Act; and</text></paragraph>
<paragraph id="H820D847DEF904D88AF5D24FF4CCE6D8F"><enum>(2)</enum><text>must be terminated in order to comply with subsection (a).</text></paragraph></subsection></section> </legis-body> </bill>
