<section id="H3A1AC35BAA5B4A70B2CA878B9245D0D6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Requiring Integrity in Conservation Efforts Act</short-title></quote> or as the <quote><short-title>R.I.C.E.’s Whale Act</short-title></quote>.</text></section> <section id="HF46D741DABFF425880257B1600715185" section-type="subsequent-section"><enum>2.</enum><header>Prohibition on implementation of certain actions until issuance of documents relating to Rice’s whale</header> <subsection id="H30D7BC740BBD4FCBBCFF5F944B7C4946"><enum>(a)</enum><header>In general</header> <paragraph id="H8DB51EC49F5B4055AC411D2AB937877F"><enum>(1)</enum><header>Compliance with Biological Opinion</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, with respect to current and future federally regulated oil and gas program activities in the Gulf of Mexico, compliance with the Biological Opinion shall serve to fully satisfy the requirements of applicable Federal environmental laws, including the Endangered Species Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>) and the Marine Mammal Protection Act (16 U.S.C.1371 et seq.).</text></paragraph> 
<paragraph id="H4EF19E41847F41DD8366CBA848D060C7"><enum>(2)</enum><header>BOEM Actions</header><text display-inline="yes-display-inline">The Assistant Administrator and the Director may not implement, administer, or enforce the BOEM Actions until the Assistant Administrator issues a revised Biological Opinion as a result of reinitiated consultation with the Director under section 7 of the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1536">16 U.S.C. 1536</external-xref>) and in accordance with this section.</text></paragraph></subsection> <subsection id="H4F740E3C66B84CB48C6420D808E20467"><enum>(b)</enum><header>Reinitiated consultation on Biological Opinion</header> <paragraph id="H07C76DB52A8B4A97A7B249A9FA64885E"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Assistant Administrator and the Director may not request, commence, carry out, or complete reinitiated consultation on the Biological Opinion under this section until—</text> 
<subparagraph id="HFE7ACF5F825D49A6B4145315E371C423"><enum>(A)</enum><text>the Assistant Administrator issues a final rule designating critical habitat for the Rice’s whale (<italic>Balaenoptera ricei</italic>) that is consistent with—</text> <clause id="HD8F9379C0B43487A9ECFA33C54C6CF21"><enum>(i)</enum><text>the results of the study conducted pursuant to subsection (c);</text></clause> 
<clause id="H5723055ABBCE4107838F37A047EECD43"><enum>(ii)</enum><text display-inline="yes-display-inline">the requirements of the rulemaking process pursuant to subchapter II of chapter 5, and chapter 7, of title 5, United States Code (commonly known as the <quote>Administrative Procedure Act</quote>);</text></clause> <clause id="H890EC0237DDA43FA9CE1058AEAD788ED"><enum>(iii)</enum><text display-inline="yes-display-inline">the requirement to conduct an economic impact analysis pursuant to Executive Order 12866 (<external-xref legal-doc="usc" parsable-cite="usc/5/601">5 U.S.C. 601</external-xref> note; relating to regulatory planning and review);</text></clause> 
<clause id="HEC0F9F518BCA4471A7971D3D3B7C3D34" commented="no"><enum>(iv)</enum><text display-inline="yes-display-inline">section 307 of the Coastal Zone Management Act of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/16/1456">16 U.S.C. 1456</external-xref>);</text></clause> <clause id="H8F40C2701DA149E6BCF019CECF258F5F"><enum>(v)</enum><text display-inline="yes-display-inline">the Paperwork Reduction Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/44/3501">44 U.S.C. 3501 et seq.</external-xref>); and</text></clause> 
<clause id="HA2AC37413C3F4D6689061F349590C31C"><enum>(vi)</enum><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/6">chapter 6</external-xref> of title 5, United States Code (commonly known as the <quote>Regulatory Flexibility Act</quote>); and</text></clause></subparagraph> <subparagraph id="H93B2E81B0DF04BAC8E765580759AE279"><enum>(B)</enum><text>the Assistant Administrator revises and finalizes the proposed rule titled <quote>Taking and Importing Marine Mammals; Taking Marine Mammals Incidental to Geophysical Surveys in the Gulf of Mexico</quote> (88 Fed. Reg. 916; January 5, 2023) to include a correction of the erroneous estimates of incidental take of marine mammals anticipated from the activities analyzed in the final rule titled <quote>Taking and Importing Marine Mammals; Taking Marine Mammals Incidental to Geophysical Surveys Related to Oil and Gas Activities in the Gulf of Mexico</quote> (86 Fed. Reg. 5322; January 19, 2021).</text></subparagraph></paragraph> 
<paragraph id="HF7EC3ECA9EBA4D649A845BC805D42B70"><enum>(2)</enum><header>Cooperation with States</header><text display-inline="yes-display-inline">In carrying out this section, the Assistant Administrator and the Director shall cooperate with each State to resolve issues that threaten to impair the exploration, development, production, transportation, servicing, or processing of offshore energy resources and related activities.</text></paragraph> <paragraph id="H8808F7DBEA804FD9A84F09E97EC69D56"><enum>(3)</enum><header>Publication and review</header><text>In carrying out any consultation or reinitiated consultation on the Biological Opinion under this section, the Assistant Administrator and the Director shall take steps to ensure—</text> 
<subparagraph id="H8D4CE63F7A19480B9D448B17DBC4BFEB"><enum>(A)</enum><text display-inline="yes-display-inline">that any scientific evidence considered and relied upon as a part of the consultation or reinitiation of consultation is—</text> <clause id="H935F681918204404A18BF7FE3DC0BF3E"><enum>(i)</enum><text>made publicly available; and</text></clause> 
<clause id="H7D4CA6E1A62A4A7285A6E0A6C33498BE"><enum>(ii)</enum><text>peer reviewed by the National Academies of Science, Engineering, and Medicine to ensure scientific rigor and independence; and</text></clause></subparagraph> <subparagraph id="H4627525933394581BAD4BA3EC96D94D2"><enum>(B)</enum><text display-inline="yes-display-inline">that any party directly impacted by the BOEM Actions shall—</text> 
<clause id="H660A40821C324D0F91E84D249354ED84"><enum>(i)</enum><text display-inline="yes-display-inline">have routine and continuing opportunities to discuss and submit information to the action agency for consideration during the development of any biological assessment or proposed action;</text></clause> <clause id="HC1ACAEB730D849959EA3CC9113D41462"><enum>(ii)</enum><text>be informed by the action agency of the schedule for preparation of a biological assessment or proposed action;</text></clause> 
<clause id="H79CCB5AC4F2B4D36BA90F4E61E94D9C8"><enum>(iii)</enum><text>receive a copy of any proposed action and have the opportunity to review that document and provide comment to the action agency (which shall be afforded due consideration during development);</text></clause> <clause id="H8BFF3B05B93740508DF53AF036330298"><enum>(iv)</enum><text>be informed by the consulting agencies, the Bureau of Ocean Energy Management, or the National Marine Fisheries Service, of the schedule for preparation of the biological opinion when the biological assessment is submitted to the consulting agency by the action agency;</text></clause> 
<clause id="H6F54103590B2400A82A74804D70BFEF1"><enum>(v)</enum><text display-inline="yes-display-inline">receive a copy of any draft biological opinion and have the opportunity to review that document and provide comment to the action agency (which shall be afforded due consideration during development);</text></clause> <clause id="H21FF3058D20D40B4AD9E129C36D50E4F"><enum>(vi)</enum><text>have the opportunity to confer with the action agency regarding reasonable and prudent alternatives prior to the action agency identifying 1 or more reasonable and prudent alternatives for consideration by the consulting agency; and</text></clause> 
<clause id="H756AA8A07E8A4E66BF0D1EBC434901D8"><enum>(vii)</enum><text>where the action agency proposes a proposed action or a consulting agency suggests a reasonable and prudent alternative, be informed of—</text> <subclause id="HBEBFA69204C84C2A90B928A39C0F849C"><enum>(I)</enum><text display-inline="yes-display-inline">how each component of such proposed action or alternative will contribute to avoiding jeopardy or adverse modification of critical habitat and the scientific data or information that supports each component of the proposed action or alternative; and</text></subclause> 
<subclause id="H3B672D63DE204E0EAB0AE6A9DC51105F"><enum>(II)</enum><text>why other proposed alternative actions that would have fewer impairments to the supply of offshore energy and economic impacts are inadequate to avoid jeopardy or adverse modification of critical habitat.</text></subclause></clause></subparagraph></paragraph> <paragraph id="H8D2078A75711486FB7F25185F5B712FF"><enum>(4)</enum><header>Meetings</header> <subparagraph id="H9944395A54824A50B87EA43D5DA5EE43"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">During any consultation or reinitiated consultation on the Biological Opinion carried out under this section, the Assistant Administrator and the Director shall, on a quarterly basis, hold stakeholder meetings to provide updates on the development of a new or revised biological assessment or biological opinion.</text></subparagraph> 
<subparagraph id="H015E8F7B0E9E4521961E199961B7D3BC"><enum>(B)</enum><header>Participants</header><text>Each stakeholder meeting held under subparagraph (A) shall—</text> <clause id="H607E428D06054EC0956A51C51CBB1E9E"><enum>(i)</enum><text>be open to stakeholders identified by the Assistant Administrator and the Director; and</text></clause> 
<clause id="H75A0F4B4531A4F54B52D8DC740A90B6B"><enum>(ii)</enum><text>include stakeholders that—</text> <subclause id="HB827DC29A19148B7B8E4D3B51220FB6B"><enum>(I)</enum><text>represent a broad range of interests, including environmental, recreational and commercial fishing, conventional and renewable energy, ports, and other regional interests; and</text></subclause> 
<subclause id="HF6731828C57E4FD4A10283D6F4F23196"><enum>(II)</enum><text>are not State or local agencies.</text></subclause></clause></subparagraph></paragraph> <paragraph id="H2B1FDAB4D605469C9438059BBC88645A"><enum>(5)</enum><header>Clarification</header><text>The Assistant Administrator and the Director may not use stakeholder meetings held under paragraph (3) to fulfill the requirements of paragraph (2).</text></paragraph></subsection> 
<subsection id="HCA1447C1748A43D6979A9C22EC4CC60E"><enum>(c)</enum><header>Rice’s whale study</header><text>The Assistant Administrator shall enter into an agreement with the National Academies of Science, Engineering, and Medicine to conduct a study to determine the occurrence and range of the Rice’s whale (<italic>Balaenoptera ricei</italic>) in the Central, Eastern, and Western Gulf of Mexico Planning Areas.</text></subsection> <subsection id="H5176CD2EB9654EB59FAA2284D8A41A1D"><enum>(d)</enum><header>Leasing activities</header><text display-inline="yes-display-inline">The Secretary of the Interior may not rely on or implement the BOEM Actions in carrying out offshore oil and gas leasing activities under the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1331">43 U.S.C. 1331 et seq.</external-xref>).</text></subsection> 
<subsection id="HEA062AC01C0346D49824F25ED860DD02"><enum>(e)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="H44508FE193C94BB4BFEFA3E7271D130B"><enum>(1)</enum><header>Assistant Administrator</header><text>The term <term>Assistant Administrator</term> means the Assistant Administrator for Fisheries of the National Marine Fisheries Service.</text></paragraph> 
<paragraph id="H9E79F3FA91B448729CCF6E507D535F83"><enum>(2)</enum><header>Biological Opinion</header><text display-inline="yes-display-inline">The term <term>Biological Opinion</term> means the document titled <quote>Biological Opinion on the Federally Regulated Oil and Gas Program Activities in the Gulf of Mexico</quote> (OPR–2017–00002; March 13, 2020).</text></paragraph> <paragraph id="HD6A4A5ECCB794AD89627D48EB316EAC1"><enum>(3)</enum><header>BOEM Actions</header><text>The term <quote>BOEM Actions</quote> means—</text> 
<subparagraph id="H1CF3005E7CCE4ED2B71EDB2644C9C965"><enum>(A)</enum><text display-inline="yes-display-inline">the exclusion from leasing in the Gulf of Mexico Outer Continental Shelf Oil and Gas Lease Sale 261 of acreage between the 100 meter and 400 meter isobaths across the northern Gulf of Mexico, as identified in the document titled <quote>Gulf of Mexico Outer Continental Shelf Oil and Gas Lease Sale 261</quote> (88 Fed. Reg. 58300; published August 25, 2023);</text></subparagraph> <subparagraph id="H94F03135EFFE468B99AB8627E30E40D3"><enum>(B)</enum><text display-inline="yes-display-inline">the imposition in the Gulf of Mexico Outer Continental Shelf Oil and Gas Lease Sale 261 of lease stipulations that limit vessel operation pursuant to section IV(4) of such document; and</text></subparagraph> 
<subparagraph id="HE74AB2AAD08F420588808519467B0BC9"><enum>(C)</enum><text>the Notice to Lessees.</text></subparagraph></paragraph> <paragraph id="H4469CF6154E640EE9B85C398DB293D23"><enum>(4)</enum><header>Director</header><text>The term <term>Director</term> means the Director of the Bureau of Ocean Energy Management.</text></paragraph> 
<paragraph id="H0B4112F1085C417DB93E774FEAC02D73"><enum>(5)</enum><header>Notice to Lessees</header><text>The term <term>Notice to Lessees</term> means the document titled <quote>Notice to Lessees and Operators of Federal Oil and Gas, and Sulphur Leases in the Gulf of Mexico Outer Continental Shelf; Expanded Rice’s Whale Protection Efforts During Reinitiated Consultation with NMFS</quote> (BOEM NTL No. 2023–G01; August 17, 2023), or a substantially similar document.</text></paragraph> <paragraph id="H13FAEF0599F649ADAE38CBD289D32A11"><enum>(6)</enum><header>State</header><text>The term <term>State</term> means each of the States of Alabama, Louisiana, Mississippi, and Texas.</text></paragraph></subsection></section>
