R. 5960</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20231016">October 16, 2023</action-date><action-desc><sponsor name-id="K000391">Mr. Krishnamoorthi</sponsor> (for himself and <cosponsor name-id="J000307">Mr. James</cosponsor>) introduced the following bill</action-desc></action><action display="yes"><action-date date="20231025">October 25, 2023</action-date><action-desc>Referred to the <committee-name committee-id="HED00">Committee on Education and the Workforce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Fair Labor Standards Act of 1938 to impose restrictions relating to prospective employees’ educational credentials, and for other purposes.</official-title></form><legis-body id="HC3FC61DC1A2C4B03A01E64F9910CF37C" style="OLC"><section id="H179AFFC80BA040119D2C7CB8B3738F63" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Opportunity to Compete Act</short-title></quote>. </text></section><section id="H6231ED3FE6FD464BBFDDF5C01DA016CD"><enum>2.</enum><header>Restrictions relating to prospective employees’ educational credentials</header><text display-inline="no-display-inline">The Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/201">29 U.S.C. 201 et seq.</external-xref>) is amended by inserting after section 7 the following new section:</text><quoted-block id="H0C2BA5D5A23E4AD1AC40DBA4F0C1C8EA" style="OLC"><section id="H29826BCF339D46428DB97FDF1A2BB06D"><enum>8.</enum><header>Guidance relating to educational credentials</header><subsection id="HE2E63E47C62C46B4AAC77487DFC2C53E"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in subsection (b), an employer may only use, in the consideration of prospective employees for a position of employment, a computerized hiring system if such system—</text><paragraph id="HA03F8D7460B54A8DA708A6DC3B385FBD"><enum>(1)</enum><text display-inline="yes-display-inline">discloses to the prospective employee the median years or expected years of experience required for a position, which may include experience received through military service, community college, training programs, and some college; and</text></paragraph><paragraph id="HC3AE1E1CEB2C474FAF362EC1492ECAE4"><enum>(2)</enum><text display-inline="yes-display-inline">if the employer requires a bachelor’s degree for the position, considers a prospective employee who has the required years of experience described in paragraph (1) as meeting the degree requirement.</text></paragraph></subsection><subsection id="HD08E70A2894F4DA787F9494DEA6EF419"><enum>(b)</enum><header>Waiver of requirement</header><paragraph id="H33B24CEB14874437837DEA6380B86428"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Labor shall provide an exemption to the requirements under paragraph (2) of subsection (a) with respect to certain positions of employment with an employer if such employer demonstrates to the satisfaction of the Secretary that—</text><subparagraph id="H54CF614F16CF4A20984C15F1C606DCB0"><enum>(A)</enum><text display-inline="yes-display-inline">the skills and knowledge required for such position of employment cannot reasonably be obtained without a bachelor’s degree; and</text></subparagraph><subparagraph id="H878409C1357A420FA09345A149CC0B51"><enum>(B)</enum><text>the employer discloses the requirement of a bachelor’s degree to all prospective employees in a timely manner.</text></subparagraph></paragraph><paragraph id="H3C9C41BF150147EFBE57D6A684A50FD9"><enum>(2)</enum><header>Application for exemption</header><text>An employer seeking an exemption under this subsection shall submit an application for such exemption to the Secretary of Labor at such time and in such manner as the Secretary may require.</text></paragraph><paragraph id="H0ED6B2DE268744A1AECEF998DB2B1D16"><enum>(3)</enum><header>Timeline for exemption application</header><text>The Secretary of Labor shall—</text><subparagraph id="HAD889BF474224707AA61B43F1EEE4FF3"><enum>(A)</enum><text>not later than 7 days after receiving an application for an exemption, notify the employer submitting such application that the Secretary of Labor has received their application; and</text></subparagraph><subparagraph id="H57788E9584334CA8814DF785A0C2048E"><enum>(B)</enum><text>not later than 14 days after receiving such an application, notify such employer whether the application has been accepted or denied.</text></subparagraph></paragraph></subsection><subsection id="H669508606A5A4458B22BA43F682C7E0F"><enum>(c)</enum><header>Exemption for certain employers</header><text display-inline="yes-display-inline">An employer that employs less than 500 employees shall not be subject to the requirements of this section.</text></subsection><subsection id="HAAE04F00CBBE428CB0E0E14FFC0D7597"><enum>(d)</enum><header>Enforcement</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of the Opportunity to Compete Act, the Secretary of Labor shall establish appropriate procedures for the enforcement of this section.</text></subsection><subsection id="H412D84F5A715424ABEA9C9CAA3296921"><enum>(e)</enum><header>Computerized hiring system defined</header><text display-inline="yes-display-inline">For the purposes of this section, the term <term>computerized hiring system</term> means a recruitment management system, recruitment marketing system, applicant tracking system, or any other computer-based system that receives, manages, tracks, evaluates, or responds to applications for employment.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
