<official-title display="yes">To require the Secretary of Agriculture to establish and maintain a training program for Department of Agriculture personnel and third-party providers on the rapidly evolving methodologies, science, and practices of biological soil health management systems on agricultural land, and for other purposes.</official-title>

<section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Soil Conservation And Regeneration Education Act of 2023</short-title></quote> or the <quote><short-title>Soil CARE Act of 2023</short-title></quote>.</text></section> <section commented="no" display-inline="no-display-inline" id="id9921adcf0add47eeae1be7ea2e17db22"><enum>2.</enum><header>Training for regenerative agriculture in NRCS programs</header> <subsection id="id330513a5212f47f1a6d3a5e7bb3f8006"><enum>(a)</enum><header>Establishment of Training Program</header><text>Section 1242 of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3842">16 U.S.C. 3842</external-xref>) is amended—</text> 
<paragraph commented="no" display-inline="no-display-inline" id="id74a1420d443748e8a16c1eaa22e8c9d3"><enum>(1)</enum><text>in subsection (a)—</text> <subparagraph commented="no" display-inline="no-display-inline" id="ida002c8d4ccf1412f9074cec5f57c4fa7"><enum>(A)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (1) and (2) as paragraphs (3) and (5), respectively;</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="ida650e310502a44bab98a3c58b682d6df"><enum>(B)</enum><text>by inserting before paragraph (3) (as so redesignated) the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="id45C46DBF29474C48B6282CDE94F3E7B8"> <paragraph commented="no" display-inline="no-display-inline" id="id3beb0a57dff24b12bfb76b8c6edc01bd"><enum>(1)</enum><header>Biological soil health management</header><text>The term <term>biological soil health management</term> means land management methods that are employed to increase and balance soil biology, such as microbial biomass and macrofauna, for the purpose of improving biological functions, including forming and stabilizing soil structure, cycling nutrients, controlling pests and disease, and degrading or detoxifying contaminants.</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="idc8eb0797ba564d64a0a7ee2a776554e3"><enum>(2)</enum><header display-inline="yes-display-inline">Department</header><text>The term <term>Department</term> means the Department of Agriculture.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="id8ffa520a1899434ebe5d1df6893af25a"><enum>(C)</enum><text>by inserting after paragraph (3) (as so redesignated) the following:</text> 
<quoted-block style="OLC" display-inline="no-display-inline" id="id7E087A25DB924509AAD96A9A0F061FA6"> 
<paragraph commented="no" display-inline="no-display-inline" id="idca671a42c3384c9ea502b89f80ab6264"><enum>(4)</enum><header>Soil biology</header><text>The term <term>soil biology</term> includes the collective biomass and activities of soil-dwelling organisms from an array of trophic levels.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="id4e0027580d07494ca96021f5a585ea18"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text> 
<quoted-block style="OLC" display-inline="no-display-inline" id="ide5c2a951141d45ce89b2ba5cc9a5b222"> 
<subsection id="id836f7842eca64e168feb3803b18243a5"><enum>(j)</enum><header>Training for biological soil health management in NRCS programs</header> 
<paragraph id="idd5271c31b2f04b4b9d2aaba01a54077e"><enum>(1)</enum><header>Establishment of training program</header><text>Not later than 1 year after the date of enactment of the <short-title>Soil CARE Act of 2023</short-title>, the Secretary shall establish a training program (referred to in this subsection as the <term>training program</term>)—</text> <subparagraph id="id514e5d6097a44b8bae505e9ddee71e4a"><enum>(A)</enum><text>to provide education, resources, and technical support to Department personnel and third-party providers on the rapidly evolving methodologies, science, and practices for improving soil health; and</text></subparagraph> 
<subparagraph id="id67253c79c24f4e87b67274d59ca3df99"><enum>(B)</enum><text>to assist Department personnel and third-party providers in supporting agricultural producers in understanding and implementing biological soil health management systems that regenerate farmland.</text></subparagraph></paragraph> <paragraph id="idb5b7049533e5450fbf9d680800df85a0"><enum>(2)</enum><header>Program development and delivery</header> <subparagraph commented="no" display-inline="no-display-inline" id="idd9d5d8d38e644c2abc0cee92f4ff016c"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>The training program shall—</text> 
<clause commented="no" display-inline="no-display-inline" id="id410dee0b7bf046219c5d73b805cc49a2"><enum>(i)</enum><text display-inline="yes-display-inline">be made available in each Natural Resources Conservation Service region twice every 2 years; and</text></clause> <clause commented="no" display-inline="no-display-inline" id="id5b1de17c4a424bbaac20a0c5e54624b3"><enum>(ii)</enum><text display-inline="yes-display-inline">include—</text> 
<subclause id="idf85ab1ef0b2e4f358da00284acb474c5"><enum>(I)</enum><text>a nationally available online curriculum on biological soil health management systems that is—</text> <item commented="no" display-inline="no-display-inline" id="idd700a32d0f5d4034a3e33d88c520851a"><enum>(aa)</enum><text display-inline="yes-display-inline">developed through cooperative agreements with entities described in subparagraph (B); and </text></item> 
<item commented="no" display-inline="no-display-inline" id="id8fd41ecee4284d4b871000ebdbbe11be"><enum>(bb)</enum><text display-inline="yes-display-inline">delivered by the Natural Resources Conservation Service; and</text></item></subclause> <subclause id="id3516455f4d924a6b902f655c950e0ca1"><enum>(II)</enum><text>in-person training workshops on biological soil health management systems that regenerate farmland, that—</text> 
<item commented="no" display-inline="no-display-inline" id="id81333caac5364e1aa867a8b50c525a7f"><enum>(aa)</enum><text display-inline="yes-display-inline">include coverage across regions and geography types;</text></item> <item commented="no" display-inline="no-display-inline" id="idd786c4de95c74eda97e9af9e26e675f0"><enum>(bb)</enum><text>are developed through cooperative agreements with entities described in subparagraph (B); and</text></item> 
<item commented="no" display-inline="no-display-inline" id="idc8f183ca8be64fe1ada2aa2f5d8212a0"><enum>(cc)</enum><text>are delivered by the Natural Resources Conservation Service.</text></item></subclause></clause></subparagraph> <subparagraph id="id0f2a7af5ffe841dc915af94037ce372f"><enum>(B)</enum><header>Cooperative agreements</header> <clause commented="no" display-inline="no-display-inline" id="id4fea2e1bd156450180937782943cdc91"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">The training program shall be developed and delivered through cooperative agreements with entities with biological soil health management systems expertise and experience working with and training producers, including—</text> 
<subclause id="id334e6f1a041946f1b8af4e24b1d80389"><enum>(I)</enum><text>farming consultants, including producers and producer cooperatives;</text></subclause> <subclause id="id5b0994fd6a284453899a9c7382967ad0"><enum>(II)</enum><text>nonprofit organizations serving organic, agroecological, and other regenerative producers;</text></subclause> 
<subclause id="id3c695c3fd6ab40a7a5ddb67c5e96287b"><enum>(III)</enum><text>conservation districts;</text></subclause> <subclause commented="no" display-inline="no-display-inline" id="id758d6dfd6d74491f89e9288fb947fca0"><enum>(IV)</enum><text>land-grant colleges and universities (as defined in section 1404 of the National Agricultural Research, Extension, and Teaching Policy Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/7/3103">7 U.S.C. 3103</external-xref>));</text></subclause> 
<subclause id="id3576691eadd74c7f8e55127deffb24a1"><enum>(V)</enum><text>Long-Term Agroecosystem Research sites; and</text></subclause> <subclause id="id0732209204964bf699aac6b24cac0c6d"><enum>(VI)</enum><text>other entities with adequate expertise in biological soil health management systems, as determined by the Secretary.</text></subclause></clause> 
<clause commented="no" display-inline="no-display-inline" id="ida35be9382c0741dca8b8f99a3c6a5025"><enum>(ii)</enum><header>Initial agreements</header><text>Not later than 1 year after the date of enactment of the <short-title>Soil CARE Act of 2023</short-title>, the Secretary shall enter into cooperative agreements under clause (i) for the initial development and delivery of the training program.</text></clause></subparagraph> <subparagraph id="id334f4ba3a93e4548b39c4801e85c3e59"><enum>(C)</enum><header>Participation</header> <clause commented="no" display-inline="no-display-inline" id="idde0e3be20dd1464a943b83aa10bf0714"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall encourage relevant Department personnel and third-party providers—</text> 
<subclause commented="no" display-inline="no-display-inline" id="ida9fa1a5c4fdf497ea6965dfbfe0c6bd6"><enum>(I)</enum><text display-inline="yes-display-inline">to complete the online curriculum described in subparagraph (A)(ii)(I); and</text></subclause> <subclause commented="no" display-inline="no-display-inline" id="id779d4348cb644e52a8a477f988db82f7"><enum>(II)</enum><text display-inline="yes-display-inline">to the extent practicable, to attend at least 1 in-person training workshop described in subparagraph (A)(ii)(II).</text></subclause></clause> 
<clause commented="no" display-inline="no-display-inline" id="idcc8d9f8c6ce14820b90dce0a0225a9c5"><enum>(ii)</enum><header>Relevant Department personnel</header><text>For purposes of clause (i), relevant Department personnel shall include, at a minimum, Department personnel involved in conservation planning activities with, and the delivery of technical assistance to, producers, including field office staff of the Natural Resources Conservation Service.</text></clause> <clause id="id9b72751d24da4cab9b60d8a63af6cf51"><enum>(iii)</enum><header>Completion schedules for third-party providers</header> <subclause commented="no" display-inline="no-display-inline" id="idc70186fdf12b40cf8352ba35edc6c2d0"><enum>(I)</enum><header>Establishment of schedules</header><text display-inline="yes-display-inline">The Secretary shall establish—</text> 
<item commented="no" display-inline="no-display-inline" id="id85b38faa9205495898d7f2068a70084d"><enum>(aa)</enum><text display-inline="yes-display-inline">a schedule for the completion by third-party providers of the online curriculum described in subparagraph (A)(ii)(I); and</text></item> <item commented="no" display-inline="no-display-inline" id="idc66da2a4d5bb43b9bf32717b33630d24"><enum>(bb)</enum><text display-inline="yes-display-inline">a schedule of in-person training workshops that will be provided in accordance with subparagraph (A)(ii)(II).</text></item></subclause> 
<subclause commented="no" display-inline="no-display-inline" id="id7847f9d315434a4995eaf8c931910d84"><enum>(II)</enum><header>Use of schedules</header><text display-inline="yes-display-inline">The Secretary shall encourage each third-party provider—</text> <item commented="no" display-inline="no-display-inline" id="id7e659e3076c1476892ad8bdece74289b"><enum>(aa)</enum><text display-inline="yes-display-inline">to complete the online curriculum in accordance with the schedule established under subclause (I)(aa); and</text></item> 
<item commented="no" display-inline="no-display-inline" id="ida2d2ce815fa04f70881f638da977a6ba"><enum>(bb)</enum><text display-inline="yes-display-inline">to the extent practicable, to attend at least 1 training workshop identified on the schedule established under subclause (I)(bb).</text></item></subclause></clause></subparagraph> <subparagraph id="idc21888c0761841f5bd0155c404aa9104"><enum>(D)</enum><header>Continuing education</header><text>The Secretary shall provide continuing education for relevant Department personnel and third-party providers, with a focus on the use of new conservation practice standards related to soil health.</text></subparagraph> 
<subparagraph id="idb945cdac43bf452a80ead9ce17197e80"><enum>(E)</enum><header>Materials for producers</header><text>The Secretary shall require relevant Department personnel and third-party providers to provide soil health education materials to producers through the programs and conservation activities of the Natural Resources Conservation Service, including materials relating to the topics covered by the curriculum described in paragraph (3).</text></subparagraph></paragraph> <paragraph id="ide33740e16eee4f6685cb9ab7ecb469ba"><enum>(3)</enum><header>Curriculum</header> <subparagraph commented="no" display-inline="no-display-inline" id="id436f1a914a1d424396e472e63d3c7fd6"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>The training program shall include the following minimum curriculum components:</text> 
<clause id="id75760e476a354bfca932121560dc01d7"><enum>(i)</enum><text>A unit on the principles of soil health published by the Natural Resources Conservation Service, with a focus on biological function and regional context.</text></clause> <clause id="ide865605c67034a83a0554aa5f2df6d47"><enum>(ii)</enum><text>A unit on—</text> 
<subclause commented="no" display-inline="no-display-inline" id="id3ebcf53c27a9410aa2b908da4f50efbf"><enum>(I)</enum><text display-inline="yes-display-inline">the transition to agriculture management systems that build soil health, including operations, infrastructure, regulations, finance, and marketing needs; and</text></subclause> <subclause commented="no" display-inline="no-display-inline" id="ide5eb457682b64150b3181abb33c0de3e"><enum>(II)</enum><text display-inline="yes-display-inline">associated risks and opportunities, including reducing input costs by building on-farm and ranch fertility.</text></subclause></clause> 
<clause commented="no" display-inline="no-display-inline" id="idf7ccca72bd404a99bb2a8fbdd7f95f5e"><enum>(iii)</enum><text>A unit on organic production and soil health systems.</text></clause> <clause id="id614fc11e9fc243639b8149037d6e4a7c"><enum>(iv)</enum><text>A unit on diversified production systems, including—</text> 
<subclause commented="no" display-inline="no-display-inline" id="id4e72968335214e629951dd6691476dcc"><enum>(I)</enum><text display-inline="yes-display-inline">perennial cropping systems;</text></subclause> <subclause commented="no" display-inline="no-display-inline" id="id53ab69fd4a0a474099231ebde23e32fb"><enum>(II)</enum><text display-inline="yes-display-inline">agroforestry or silvopasture systems;</text></subclause> 
<subclause commented="no" display-inline="no-display-inline" id="ida2c2d1a1172c477da5a886a02ad0ba5c"><enum>(III)</enum><text display-inline="yes-display-inline">livestock integration into cropping systems; and</text></subclause> <subclause commented="no" display-inline="no-display-inline" id="id1cf286df240c4ef0bfbb0cc7e8db1add"><enum>(IV)</enum><text display-inline="yes-display-inline">prescribed grazing.</text></subclause></clause> 
<clause id="id0aa354da47bd41a9a5a37477e0d65da2"><enum>(v)</enum><text>A unit on the body of research on soil biology and agriculture that regenerates farmland, including potential impacts on soil health, water quality and security, biodiversity, ecosystem function, resilience to extreme weather, carbon sequestration, and agricultural profitability.</text></clause> <clause id="id291f8ed21b7b420faf7bcc2d0b639156"><enum>(vi)</enum><text>A unit on key conservation practices that maximize soil health and mitigate climate impacts by implementing soil health principles.</text></clause> 
<clause id="idf0811e33a6484d4e806a77293d72d7fb"><enum>(vii)</enum><text>A unit on—</text> <subclause commented="no" display-inline="no-display-inline" id="id03351f4268a24a1e8811eaa126b15408"><enum>(I)</enum><text display-inline="yes-display-inline">issues specific to Indian Tribes; and</text></subclause> 
<subclause commented="no" display-inline="no-display-inline" id="id7bcdc5ee13b144ee9fa386ae58649640"><enum>(II)</enum><text display-inline="yes-display-inline">traditional ecological knowledge.</text></subclause></clause> <clause id="id0c03783757b449f489bbae5dc2253889"><enum>(viii)</enum><text>A unit on—</text> 
<subclause commented="no" display-inline="no-display-inline" id="id1fa45bbcc14445a98da60858112f5894"><enum>(I)</enum><text display-inline="yes-display-inline">the special needs of new, small scale, and underserved producers; and</text></subclause> <subclause commented="no" display-inline="no-display-inline" id="id99890bc9081e492daa3549696d6ee62c"><enum>(II)</enum><text display-inline="yes-display-inline">how best to meet those needs.</text></subclause></clause> 
<clause id="iddf4f358ee5e34eb38bb9039bbba04bc2"><enum>(ix)</enum><text>A unit on approaches, tools, and skills to support farmers in performing soil health tests.</text></clause> <clause id="idfd44e09dc9c346ef97cdc8f8953f9df4"><enum>(x)</enum><text>A unit on all conservation programs available to producers that improve soil health, reduce production inputs, and regenerate soil, farmland, and nearby ecosystems.</text></clause></subparagraph> 
<subparagraph id="id8424e69cd3ad474cb1dbbf547a7f7314"><enum>(B)</enum><header>Updates</header><text>The Secretary shall review and update the curriculum of the training program every 2 years based on the latest—</text> <clause commented="no" display-inline="no-display-inline" id="id2fef764d816e42bf9f712e1a619af4b8"><enum>(i)</enum><text display-inline="yes-display-inline">biological soil health management innovations; and</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="idb28be45b83b0486f9ca21b5880cb887c"><enum>(ii)</enum><text display-inline="yes-display-inline">scientific and technological advancements.</text></clause></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="idd07e811cb6634158b0625d6881bc26d4"><enum>(4)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to the Secretary to carry out this subsection $10,000,000 for the period of fiscal years 2024 through 2028.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section>
