<section section-type="section-one" id="HF73C9E4D96ED41EC9E5F02463B81B006"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Science-based Equitable Aquaculture Food Act</short-title></quote> or the <quote><short-title>SEAfood Act</short-title></quote>. </text></section> <section id="H99DC8C3802C04E36A404015E6CC63819"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act: </text> 
<paragraph id="H7BD90F7FF6AF44F9B3556FCB0894CCDF"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the National Oceanographic and Atmospheric Administration.</text></paragraph> <paragraph id="H75BAE8AE93AF4CB9B0FCBE5A46EB7E67"><enum>(2)</enum><header>Appropriate committees of Congress</header><text display-inline="yes-display-inline">The term <term>appropriate committees of Congress</term> means—</text> 
<subparagraph id="H08E18404ECC44566A93D9D76353B3975"><enum>(A)</enum><text display-inline="yes-display-inline">the Committee on Commerce, Science, and Transportation of the Senate; </text></subparagraph> <subparagraph id="HA2729187BA504926A47E737DA913A669"><enum>(B)</enum><text>the Committee on Environment and Public Works of the Senate; </text></subparagraph> 
<subparagraph id="HE2E07B0CF84741FBAE884610A5BB520E"><enum>(C)</enum><text>the Committee on Agriculture, Nutrition, and Forestry of the Senate; </text></subparagraph> <subparagraph id="H155CD4E2F09742F3A2DB6EC39357BB73"><enum>(D)</enum><text>the Committee on Natural Resources of the House of Representatives; </text></subparagraph> 
<subparagraph id="H5E6084AB4DCC4BB28A384FC818A2CD64"><enum>(E)</enum><text>the Committee on Agriculture of the House of Representatives; and </text></subparagraph> <subparagraph id="H0B910F84C7D649ABBCCDBCFB36FCAC50"><enum>(F)</enum><text>the Committee on Transportation and Infrastructure of the House of Representatives. </text></subparagraph></paragraph> 
<paragraph id="HB011910028224595BE4F7C4083356959"><enum>(3)</enum><header>Community with environmental justice concerns</header><text>The term <term>community with environmental justice concerns</term> means a community with significant representation of any of the following:</text> <subparagraph commented="no" id="H0CF6173590FA4F279AC9E5C5DE1D7455"><enum>(A)</enum><text>Individuals who reside in a census block group in which 30 percent or more of the population are individuals with an annual household income that does not exceed the greater of—</text> 
<clause commented="no" display-inline="no-display-inline" id="H26A7AB8B47944FC0B03AB5B3A78685F2"><enum>(i)</enum><text>an amount equal to 80 percent of the median income of the area in which the household is located, as reported by the Secretary of Housing and Urban Development; or</text></clause> <clause commented="no" id="HE67C934D0FA94450B1223E4127FC9ABD"><enum>(ii)</enum><text>200 percent of the Federal poverty line.</text></clause></subparagraph> 
<subparagraph commented="no" id="H0896212E669B47828CAA2E9733AF7945"><enum>(B)</enum><text>Individuals who reside in a geographically distinct area in which the population of any of the following categories of individuals is higher than the average population of that category for the State in which the community is located:</text> <clause commented="no" display-inline="no-display-inline" id="H5574C2003E774AA3AEC15BB93B955886"><enum>(i)</enum><text>Black.</text></clause> 
<clause commented="no" id="H1011A599EA8E4179AFDF4455850E6F5A"><enum>(ii)</enum><text>African American.</text></clause> <clause commented="no" id="H60FBA75675D64F958032F75B9808B5AA"><enum>(iii)</enum><text>Asian.</text></clause> 
<clause commented="no" id="H6BFF1D475ECC4A60A9932A907160BF5C"><enum>(iv)</enum><text>Pacific Islander.</text></clause> <clause commented="no" id="HFDBE54874E3541ABA6AD0EC2E574C492"><enum>(v)</enum><text>Other non-White race.</text></clause> 
<clause commented="no" id="H686E99A5F3EA4AD6841F1FC3CD9EE52E"><enum>(vi)</enum><text>Hispanic.</text></clause> <clause commented="no" id="HE45F0900651D4CA48BEBD813A2471AE6"><enum>(vii)</enum><text>Latino.</text></clause> 
<clause commented="no" id="HFE3B1D8538AA45EB96B29FC1AC276AF2"><enum>(viii)</enum><text>Linguistically isolated.</text></clause></subparagraph> <subparagraph commented="no" id="HCB4A034FC5834794804AE11894BEA541"><enum>(C)</enum><text>Members of a Tribal or Indigenous community.</text></subparagraph></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H8160A9CA869646B290F3BDD0C0A9CE1D"><enum>(4)</enum><header>Council Coordination Committee</header><text>The term <term>Council Coordination Committee</term> means the committee established under section 302(l) of the Magnuson-Stevens Fishery Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1852">16 U.S.C. 1852(l)</external-xref>). </text></paragraph> <paragraph id="H2965D76B831A42F9A8B797E8DBE7E137"><enum>(5)</enum><header>Covered institution</header><text>The term <term>covered institution</term> means—</text> 
<subparagraph id="H9E407E7CD5144BEEA46741AA6F46CBF8"><enum>(A)</enum><text>a minority-serving institution;</text></subparagraph> <subparagraph id="HAA17C7466A1E46B4BD929302A4CD13E4"><enum>(B)</enum><text>a historically Black college or university; or</text></subparagraph> 
<subparagraph id="HBF6C9B7BDE5543889E44AA1891B2D8DF"><enum>(C)</enum><text>a Tribal College or University. </text></subparagraph></paragraph> <paragraph id="H3D55683B258E441CA936151053B5790D"><enum>(6)</enum><header>Escape</header><text>The term <term>escape</term> means the escape of juvenile- or adult-farmed organisms, viable gametes, or fertilized eggs spawned by farmed organisms from offshore aquaculture facilities.</text></paragraph> 
<paragraph id="H73C50A8FD3904B6A9FF2C2FD27812EA2"><enum>(7)</enum><header>Exclusive economic zone</header><text>The term <term>exclusive economic zone</term> has the meaning given that term in section 3 of the Magnuson-Stevens Fishery Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1802">16 U.S.C. 1802</external-xref>).</text></paragraph> <paragraph id="H797F79F999584E989B60FA71A435A933"><enum>(8)</enum><header>Historically Black college or university</header><text>The term <term>historically Black college or university</term> has the meaning given the term <term>part B institution</term> in section 322 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1061">20 U.S.C. 1061</external-xref>).</text></paragraph> 
<paragraph commented="no" id="H0D480900CB7A4D2793751212B4C98EE5"><enum>(9)</enum><header>Indian Tribe</header><text display-inline="yes-display-inline">The term <term>Indian Tribe</term> has the meaning given that term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></paragraph> <paragraph id="H1D64D737D56943D9B6DF488E48E5EF6A"><enum>(10)</enum><header>Institution of higher education</header><text>The term <term>institution of higher education</term> has the meaning given that term in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>).</text></paragraph> 
<paragraph commented="no" id="H1491F9F82E77459CBFD2FB8A27D57A3B"><enum>(11)</enum><header>Minority-serving institution</header><text>The term <term>minority-serving institution</term> means an eligible institution described in paragraph (2), (4), (5), (6), or (7) of section 371(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1067q">20 U.S.C. 1067q(a)</external-xref>). </text></paragraph> <paragraph id="HE5972E685AFB4B998D7F7F0CF59606FC"><enum>(12)</enum><header>Offshore aquaculture</header><text>The term <term>offshore aquaculture</term> means aquaculture conducted in the exclusive economic zone. </text></paragraph> 
<paragraph commented="no" id="H1F521E9075DF4EAD9667C9975A570591"><enum>(13)</enum><header>Specially affected adjacent coastal jurisdiction</header><text display-inline="yes-display-inline">The term <term>specially affected adjacent coastal jurisdiction</term> means, with respect to any activity proposed, conducted, or approved by the Administrator under section 4, any coastal State land or coastal Tribal land—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H569F146A3B9D44A3B0F8FF88A33BA85A"><enum>(A)</enum><text display-inline="yes-display-inline">that is adjacent to, or the waters of which are adjacent to, the Federal waters in which such activity is conducted; </text></subparagraph> 
<subparagraph id="HCD76540D50E54CC494CC09C34E0AF152"><enum>(B)</enum><text display-inline="yes-display-inline">that is used, or is scheduled to be used, as a support base for such activity; and</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HEBA43F0B4A964EF082667878BAA7BA94"><enum>(C)</enum><text display-inline="yes-display-inline">for which there is a reasonable probability of significant effect on uses of land or water from such activity. </text></subparagraph></paragraph> 
<paragraph id="H405774315ECA4646B541D989B9814BBC"><enum>(14)</enum><header>State</header><text>The term <term>State</term> means each of the several States, the District of Columbia, and each commonwealth, territory, or possession of the United States. </text></paragraph> <paragraph id="H2B61713B98814F4798A3EBCFEF90E52B" commented="no" display-inline="no-display-inline"><enum>(15)</enum><header>Tribal College or University</header><text display-inline="yes-display-inline">The term <term>Tribal College or University</term> means an institution described in section 316(b) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1059c">20 U.S.C. 1059c(b)</external-xref>) that is chartered by the governing body of the applicable Indian Tribe or by the Federal Government. </text></paragraph> 
<paragraph id="H3DA7547461A94BACA8984A2522F4E053"><enum>(16)</enum><header>Tribal land</header><text>The term <term>Tribal land</term> means land that is subject to the jurisdiction of an Indian Tribe.</text></paragraph> <paragraph commented="no" id="HC33113AB09DA43DFA41688B3EA417B82"><enum>(17)</enum><header>Tribal or Indigenous community</header><text>The term <term>Tribal or Indigenous community</term> means a population of people who are—</text> 
<subparagraph commented="no" id="HE8A392A65202491CA3FC0D9FB882DAD4"><enum>(A)</enum><text>enrolled members of an Indian Tribe;</text></subparagraph> <subparagraph commented="no" id="H9856A0BBA2274612A6F1DACF76AEFD59"><enum>(B)</enum><text>members of an Alaska Native or Native Hawaiian community or organization; or</text></subparagraph> 
<subparagraph commented="no" id="H3EC5513DE6C948AC8F499AFF529A469F"><enum>(C)</enum><text>members of any other community of Indigenous people located in a State.</text></subparagraph></paragraph> <paragraph commented="no" id="H01380B3A3E024FB58BF96A245B91FF00"><enum>(18)</enum><header>Underserved communities</header> <subparagraph id="H7168E1F30B0F4334B7C1DB78C58C2B90"><enum>(A)</enum><header>In general</header><text>The term <term>underserved communities</term> means—</text> 
<clause id="HD24F8CEA6FA845E7BD6C4DAB9CD5B5AE"><enum>(i)</enum><text>women; and</text></clause> <clause id="H4909312489A74A6EA2F595B44CBCAD99"><enum>(ii)</enum><text>individuals belonging to communities that have been denied consistent and systematic fair, just, and impartial treatment and have been systematically denied a full opportunity to participate in all aspects of economic, social, and civic life, including—</text> 
<subclause id="HB4A4B90C4B5B470BA29FD3E63F541918"><enum>(I)</enum><text>Black, Latino, Indigenous, and Native American individuals; </text></subclause> <subclause id="H623853099F0A4A2783134E0A260E3F55"><enum>(II)</enum><text>Asian Americans and Pacific Islanders; and </text></subclause> 
<subclause id="H2D8218628FEE438E85C20BA8CFD6196F"><enum>(III)</enum><text>other persons of color.</text></subclause></clause></subparagraph> <subparagraph id="HC8C8830BE6CC4A66A8EF20D50A1A9B3C"><enum>(B)</enum><header>Inclusions</header><text>In the context of the offshore aquaculture industry, the term <term>underserved communities</term>, within fishing communities, may include—</text> 
<clause id="H7D48B5F8A09841A285014B4ED7DE0850"><enum>(i)</enum><text>subsistence fishery participants and their dependents;</text></clause> <clause id="HD63E216B4B954B548A011CB59F362C62"><enum>(ii)</enum><text>fishing vessel crews; </text></clause> 
<clause id="HF7B9C90603214AFB8BCB9B08779DED64"><enum>(iii)</enum><text>fish processor and distribution workers; and</text></clause> <clause id="HA90E34CF0EA140479E3BB8FC72456898"><enum>(iv)</enum><text>territorial fishing communities, including such communities in American Samoa, Guam, the Commonwealth of the Northern Mariana Islands, Puerto Rico, and the United States Virgin Islands. </text></clause></subparagraph></paragraph> 
<paragraph id="H273D9FFC06814042AB246B4E8A23E434"><enum>(19)</enum><header>Veteran</header><text>The term <term>veteran</term> has the meaning given that term in section 101 of title 38, United States Code. </text></paragraph></section> <section id="HA469143C0D46452EBFF199E90A6F80CE"><enum>3.</enum><header>Study on offshore aquaculture by Ocean Studies Board of the National Academies of Sciences, Engineering, and Medicine</header> <subsection commented="no" id="H4A268816A2894622BD32805A234C27E5"><enum>(a)</enum><header>Study</header><text display-inline="yes-display-inline">The Administrator shall seek to enter into a contract with the Ocean Studies Board of the National Academies of Sciences, Engineering, and Medicine (in this section referred to as the <quote>Board</quote>) under which the Board shall, not later than 30 months after the date of the enactment of this Act—</text> 
<paragraph commented="no" display-inline="no-display-inline" id="H837BDAADA21B4FB7B34DB7ECA4D63CFB"><enum>(1)</enum><text display-inline="yes-display-inline">complete a study—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H90E690E307594BB8BAEC5AB9CD0D54E4"><enum>(A)</enum><text>to determine whether the Board recommends the pursuit of offshore aquaculture; and</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H2B2DD3086E9E472E89AB2D6FC70F096D"><enum>(B)</enum><text>if the Board recommends the pursuit of offshore aquaculture, to develop the scientific basis for efficient and effective regulation of offshore aquaculture; and</text></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H02B08B858C4248C1B4F68D224B822F46"><enum>(2)</enum><text>submit to Congress and make publicly available the results of the study. </text></paragraph></subsection> 
<subsection id="H4B6BAF4C9BF240DAA9D4599B72511B19"><enum>(b)</enum><header>Elements</header><text>The study completed pursuant to subsection (a) shall, with respect to offshore aquaculture—</text> <paragraph id="H6AA3238479474E74AA4FE612477F6FF7"><enum>(1)</enum><text>identify—</text> 
<subparagraph id="H6F5ECEF7D8C94BBC9CE21457F488606D"><enum>(A)</enum><text>optimal methods of operation of offshore aquaculture facilities to limit adverse effects on the environment, wildlife, and human well-being, including—</text> <clause id="H1A4D2BB1E4F14F13A7FE5B0D763D4EC0"><enum>(i)</enum><text>considerations to guide siting decisions of such facilities; </text></clause> 
<clause id="H847DE645680D4C2EB12CC1BE09DDB549"><enum>(ii)</enum><text>appropriate stocking densities; and</text></clause> <clause commented="no" display-inline="no-display-inline" id="HDA536B4D80C34FB2ACC7363EB5490B90"><enum>(iii)</enum><text>opportunities for selective breeding;</text></clause></subparagraph> 
<subparagraph id="H044D5FEEE6824CD8AA53497069A29758"><enum>(B)</enum><text display-inline="yes-display-inline">a science-based definition of <quote>responsible offshore aquaculture feed or other inputs</quote>, including guidance on sourcing feed or other inputs to address long- or short-term concerns, including the availability and scalability of such inputs;</text></subparagraph> <subparagraph id="HF01613D607674262876FACEE0A9E68F4"><enum>(C)</enum><text>potential adverse effects on the environment, wildlife, and human well-being, including from—</text> 
<clause id="H6BCD6B6D5C69486C8691CB9435F5DEEC"><enum>(i)</enum><text display-inline="yes-display-inline">the use of antibiotics and other pharmaceuticals by offshore aquaculture facilities, including through analyses necessary to establish acceptable rates, impact levels, and risk thresholds, such as analyses of organism antibiotic consumption or metabolization versus excretion to the surrounding environment;</text></clause> <clause id="H55463356BBD8465797A0F8F939FD5D94"><enum>(ii)</enum><text display-inline="yes-display-inline">assimilation of pollution originating from such facilities on marine organisms;</text></clause> 
<clause id="HFFBF993170F046E6976746D410469BF3"><enum>(iii)</enum><text>the risk posed by misplaced or damaged equipment;</text></clause> <clause id="H43C93182B1C846B6A5396FB784E6BA34"><enum>(iv)</enum><text>the risk of harmful interactions with wildlife;</text></clause> 
<clause id="H901BBD799128452686471FACD2D18618"><enum>(v)</enum><text>interbreeding and the spread of disease;</text></clause> <clause id="H5B706A7572EE4BB0AD07B73E46F8A164"><enum>(vi)</enum><text>the source and environmental impacts associated with the collection and removal of brood stock for offshore aquaculture operations and impacts of hatcheries and prestocking rearing operations that are specific to offshore aquaculture;</text></clause> 
<clause id="HE017EECE43DA4446A20FD3F64730B634"><enum>(vii)</enum><text>large-scale cultivation of filter-feed bivalve organisms and seaweed on the marine food webs; </text></clause> <clause id="HEEA66561B9B1487182D8140FE2FA5314"><enum>(viii)</enum><text>offshore aquaculture facilities acting as aggregating devices and increasing the vulnerability of wild fisheries and wildlife populations to fishing or other sources of mortality;</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="H00082F3A1E1F4FB793DA2DDEB42517E3"><enum>(ix)</enum><text>predator control devices and methods; and</text></clause> <clause id="H2264FBD23FED43BB91AF305A6726D57E"><enum>(x)</enum><text>the use of nonsustainable sources of feed or other inputs, including the use of globally limited marine resources for feed ingredients, environmental impacts, and scalability of alternatives, including—</text> 
<subclause commented="no" display-inline="no-display-inline" id="HCE3DF9BE04A746ABAF3ED2B76675D076"><enum>(I)</enum><text display-inline="yes-display-inline">novel ingredients (for example, insect, single cell protein, and algae); </text></subclause> <subclause commented="no" display-inline="no-display-inline" id="H2685021BB1654B27838CD1DD5BA87BE7"><enum>(II)</enum><text display-inline="yes-display-inline">traditional ingredients (for example, soya); and </text></subclause> 
<subclause commented="no" display-inline="no-display-inline" id="H50A27110DC0B419D8189A50B96B058BD"><enum>(III)</enum><text display-inline="yes-display-inline">other inputs;</text></subclause></clause></subparagraph> <subparagraph id="H6450D07FAFA94C0781FA3446FBFA6D34"><enum>(D)</enum><text>potential methods and technologies to mitigate adverse effects, including the effects identified under subparagraph (C);</text></subparagraph> 
<subparagraph id="H65A1A0EE47BC430BA33F4ED48D8E0844"><enum>(E)</enum><text>potential conflicts and solutions to mitigate such conflicts between offshore aquaculture facilities and other users of the offshore environment;</text></subparagraph> <subparagraph id="H15A47C9BD9F2471792CA416C7ABD36B3"><enum>(F)</enum><text>the types of data and qualitative information necessary for the optimal operation of such facilities and appropriate methods of procuring such data and information, including from—</text> 
<clause id="HF7C6D4BD0ADF47ABA39007F08A75B847"><enum>(i)</enum><text>citizen science (as defined in section 402(c) of the Crowdsourcing and Citizen Science Act (<external-xref legal-doc="usc" parsable-cite="usc/15/3724">15 U.S.C. 3724(c)</external-xref>)); and </text></clause> <clause id="H892169640A394660B1C115C9B6FE4077"><enum>(ii)</enum><text>the traditional offshore aquaculture knowledge of Tribal and Indigenous communities; and</text></clause></subparagraph> 
<subparagraph id="H84237A148E5946B189181E6C65E098B3"><enum>(G)</enum><text>the considerations necessary to account for the effects of climate change predictive assessments on the siting and operation of offshore aquaculture facilities; and</text></subparagraph></paragraph> <paragraph id="H6F9A396416DC429D97864A873B9E4C77"><enum>(2)</enum><text>provide recommendations for legislative or administrative action with respect to—</text> 
<subparagraph id="H8C9C02F147EE458EB7D4DB0B7F3619D2"><enum>(A)</enum><text>methods of operation identified under paragraph (1)(A); </text></subparagraph> <subparagraph id="H3CA28EC0E2D24202915BF0B8881E8BA8"><enum>(B)</enum><text>mitigating adverse effects identified under paragraph (1)(C);</text></subparagraph> 
<subparagraph id="H519440C9CF3541EE8F13F84E49CD4144"><enum>(C)</enum><text>environmental standards, control rules, or reference points that build upon the existing public and private standards for the sustainability of offshore aquaculture; and</text></subparagraph> <subparagraph id="H373753C269854A2CA41A275E9242361F" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">ensuring that operators of offshore aquaculture facilities adhere to international standards for social responsibility, public health, and equitable labor practices, including with respect to sourcing inputs for such facilities. </text></subparagraph></paragraph></subsection></section> 
<section id="H799428F54B3942509C782279E53C2CAE"><enum>4.</enum><header>Assessment program for offshore aquaculture</header> 
<subsection id="H07BDBE26EC574747AE0756A952076FDF"><enum>(a)</enum><header>Establishment of program</header><text>Not earlier than 180 days after the date on which the Administrator enters into a contract under section 3(a) and not later than 2 years after such date, the Administrator shall establish an assessment program (in this section referred to as the <quote>assessment program</quote>) to evaluate the following with respect to offshore aquaculture:</text> <paragraph id="H050F77D4E6314C719F00376F8C2FED55"><enum>(1)</enum><text>The ability of different commercial-scale facility designs and operational methods—</text> 
<subparagraph id="H0FC1CCCF9BA64A93ACEAE7AF6E264BC0"><enum>(A)</enum><text>to survive various atmospheric and ocean conditions, including high wind speeds or high-energy ocean conditions associated with severe weather, without—</text> <clause id="H75FA92F6D991489E9E10E5F93FA5D0C4"><enum>(i)</enum><text>allowing escapes;</text></clause> 
<clause id="H65BCFD8B4BA04084BECD483B1AAF7547"><enum>(ii)</enum><text>loss of infrastructure; or</text></clause> <clause id="H7FBD0CC9C67C4114A746B50C1A25455F"><enum>(iii)</enum><text display-inline="yes-display-inline">wildlife entanglement resulting from loss or damaged infrastructure;</text></clause></subparagraph> 
<subparagraph id="H267AA57D38E642F2A8ED5AF0899EC62C"><enum>(B)</enum><text>to prevent adverse wildlife impacts, including entanglements of large whales, sea turtles, and other species protected under—</text> <clause id="HA019D418A4764C1FB36FBBD4DADCE324"><enum>(i)</enum><text>the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>); and </text></clause> 
<clause id="H82A5D43D3A1B4488B5D5AD30A8CE334F"><enum>(ii)</enum><text>the Marine Mammal Protection Act of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/16/1361">16 U.S.C. 1361 et seq.</external-xref>);</text></clause></subparagraph> <subparagraph id="H0CB3BBFA43344C979C47F78B529B531B"><enum>(C)</enum><text display-inline="yes-display-inline">to prevent adverse impacts on the marine environment, including impacts to habitat, water chemistry, and wildlife; and</text></subparagraph> 
<subparagraph id="HC93E09ED22D04B64A47F566C5A6A651E"><enum>(D)</enum><text display-inline="yes-display-inline">to avoid adverse impacts on navigation and safety to existing ocean users due to offshore aquaculture facilities, including requirements for operations, navigation, and transit associated with such facilities. </text></subparagraph></paragraph> <paragraph id="HB93C8F2564064011831EF8EE3A3CE844"><enum>(2)</enum><text display-inline="yes-display-inline">The ability of different technologies to provide reliable and timely data on offshore aquaculture facilities, including visual data and other relevant data types, on a regular basis to enable the Administrator to monitor—</text> 
<subparagraph id="HAFED422E3D374C11820144254BE7F812"><enum>(A)</enum><text>the compliance of projects with the requirements under subsection (b)(4)(5);</text></subparagraph> <subparagraph id="H6D14829812294BCB819ED3DECE5382AB"><enum>(B)</enum><text>impacts on the marine environment; and</text></subparagraph> 
<subparagraph id="H00A8E5256D4D4BD5A66AA7A4A9EC7A3F"><enum>(C)</enum><text>interference with existing uses of the water body in which the project is located.</text></subparagraph></paragraph> <paragraph id="H29443059226E47F8901A01446417B7A3"><enum>(3)</enum><text>The relative risks, benefits, and cost of various types of offshore aquaculture, including different species of finfish in different geographies and under varying climactic and ecological conditions.</text></paragraph> 
<paragraph id="H730C191812BF416893658C69BE8E2FF5"><enum>(4)</enum><text>The development of performance standards for offshore aquaculture operations.</text></paragraph></subsection> <subsection id="H99E524F70DB44CC59C7A2117DA5EFA6A"><enum>(b)</enum><header>Selection of demonstration projects</header> <paragraph id="HA30D4B799EA543D985EE849975F3648F"><enum>(1)</enum><header>Solicitation and acceptance of applications</header><text display-inline="yes-display-inline">The Administrator shall solicit and accept applications for inclusion in the assessment program from owners and operators of offshore aquaculture demonstration projects, including commercial-scale demonstration projects, that—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="H58FEBD20C84F48BB8CA1362DF803E998"><enum>(A)</enum><text display-inline="yes-display-inline">would advance the objectives described in subsection (a) and involve objective analyses of data; and </text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HC61854533BF24776AEFDBA7CC6068164"><enum>(B)</enum><text>are operating on the date on which the application is submitted, were operated in offshore waters of the United States or other countries at any time during the 15-year period preceding the date on which the application is submitted (including such projects that are ongoing as of such date), or are proposed to be operated. </text></subparagraph></paragraph> 
<paragraph id="H022619BD5B364989A1522A29456F6302"><enum>(2)</enum><header>Notice and public comment</header><text display-inline="yes-display-inline">The Administrator shall—</text> <subparagraph id="HEB1F8DB514364AE4A725AD7D1161E394"><enum>(A)</enum><text display-inline="yes-display-inline">publish in the Federal Register a notice summarizing each application received under this subsection; and</text></subparagraph> 
<subparagraph id="HF8F9C35CA933492881D24CE2177F9228"><enum>(B)</enum><text display-inline="yes-display-inline">invite public comments regarding the projects proposed in those applications for inclusion in the assessment program. </text></subparagraph></paragraph> <paragraph id="H719F370F0E35446CB6E51587A57472D1"><enum>(3)</enum><header>Specially affected adjacent coastal jurisdictions</header> <subparagraph id="H80DAD71583584A0C8ADFBCE67AE5E3C8"><enum>(A)</enum><header>Designation</header><text display-inline="yes-display-inline">The Administrator shall establish a mechanism for identifying and designating, with respect to each application for a demonstration project received under this subsection, the specially affected adjacent coastal jurisdiction or jurisdictions.</text></subparagraph> 
<subparagraph id="H328902C226074EAD9DB60BD1373D0E99"><enum>(B)</enum><header>Notice</header><text>For each application for a demonstration project received under this subsection, the Administrator shall provide a copy of the application to the Governor or executive of the State or Tribal government of each specially affected adjacent coastal jurisdiction designated with respect to the application under subparagraph (A). </text></subparagraph> <subparagraph id="H3B1D627A66F646BE8AFEC6D7709B68F7"><enum>(C)</enum><header>Rejection at the request of specially affected adjacent coastal jurisdictions</header><text>If, during the 60-day period beginning on the date on which a specially affected adjacent coastal jurisdiction receives notice of an application under subparagraph (B), the Governor or executive of the State or Tribal government of the jurisdiction requests that the Administrator reject the application, the Administrator shall reject the application.</text></subparagraph></paragraph> 
<paragraph id="H62F6977FCAF341058468551991D6C86E" commented="no"><enum>(4)</enum><header>Approval of demonstration projects</header><text>The Administrator may approve not more than 4 applications for demonstration projects under this subsection for inclusion in the assessment program.</text></paragraph> <paragraph id="HFE6539CC004D4ADB8AC3CED9AD659874"><enum>(5)</enum><header>Requirements</header> <subparagraph commented="no" display-inline="no-display-inline" id="H7CF87CD5192644B3B4F87B91FFEDFCB7"><enum>(A)</enum><header>All demonstration projects</header> <clause commented="no" display-inline="no-display-inline" id="H674C4A1FA3D34CD192DC94F8DEA8ACDC"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Each demonstration project approved for inclusion in the assessment program—</text> 
<subclause commented="no" display-inline="no-display-inline" id="H2F1559A2AD8C405FAE572AB1CEAEF956"><enum>(I)</enum><text display-inline="yes-display-inline">shall—</text> <item id="H703152F70F66470F91B6780B1E0DBF2E"><enum>(aa)</enum><text>cultivate only native species that pose a minimal threat of harm to wildlife and the ecosystem in which the project is located;</text></item> 
<item id="H0B6A20F331474E0DA2D04DA0A7252A8E"><enum>(bb)</enum><text>incorporate design and operational characteristics that minimize the risk of escape, wildlife entanglement, and adverse pollution impacts;</text></item> <item id="H47C97AE5EB0D4A14A2FE42A4825870E1"><enum>(cc)</enum><text>have developed and be able to implement an escape response and infrastructure loss or damage plan that minimizes the impact of any escapes or infrastructure loss or damage on the marine environment and on other uses of the water body in which the project is located;</text></item> 
<item id="H90CAA41B0FCB4D708356669721CA658D"><enum>(dd)</enum><text>comply with all applicable requirements of—</text> <subitem commented="no" display-inline="no-display-inline" id="H1199DD90269F4575B611B310DE1FE3CA"><enum>(AA)</enum><text display-inline="yes-display-inline">the <act-name parsable-cite="FWPCA">Federal Water Pollution Control Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/33/1251">33 U.S.C. 1251 et seq.</external-xref>) (commonly referred to as the <quote>Clean Water Act</quote>); </text></subitem> 
<subitem commented="no" display-inline="no-display-inline" id="H8B1D3D64B6E34E3E9578717B5DD42F45"><enum>(BB)</enum><text display-inline="yes-display-inline">the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>); </text></subitem> <subitem commented="no" display-inline="no-display-inline" id="HC98706922AC24E2994A1CB89E02F676E"><enum>(CC)</enum><text display-inline="yes-display-inline">the Marine Mammal Protection Act of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/16/1361">16 U.S.C. 1361 et seq.</external-xref>); and </text></subitem> 
<subitem commented="no" display-inline="no-display-inline" id="HF047B0291F6F48A9803491F9F32A08AB"><enum>(DD)</enum><text display-inline="yes-display-inline">the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>);</text></subitem></item> <item commented="no" display-inline="no-display-inline" id="H8669336AFFED42F789F5554DDE6A1161"><enum>(ee)</enum><text display-inline="yes-display-inline">be compatible with, and prevent or minimize displacement of, existing uses and users of the marine environment in which the project is located;</text></item> 
<item commented="no" display-inline="no-display-inline" id="H8425C62E556E4ADDA0C44E875D1D5B78"><enum>(ff)</enum><text display-inline="yes-display-inline">conform to best practices to avoid or minimize the use of antibiotics and other pharmaceuticals and minimize the release of such pharmaceuticals into the environment; and </text></item> <item commented="no" display-inline="no-display-inline" id="HDFB9A4F984CD49E2837442500F427733"><enum>(gg)</enum><text display-inline="yes-display-inline">except as provided in clause (ii), be conducted over a period of 5 years; and</text></item></subclause> 
<subclause commented="no" display-inline="no-display-inline" id="HB35957731B8C46AA87CE4BAD5035E0C4"><enum>(II)</enum><text>shall not—</text> <item commented="no" display-inline="no-display-inline" id="H3C3B294C89104CEC9528E9799CECBD17"><enum>(aa)</enum><text display-inline="yes-display-inline">cultivate or otherwise use salmon, including king, chinook, coho, chum, sockeye, pink, masu, amago, or Atlantic salmon, even if such salmon is considered a native species; or</text></item> 
<item id="H4FE2C8D805C44E0BA694F1CDF4C98341"><enum>(bb)</enum><text>be sited in any area designated by the National Marine Fisheries Service as critical habitat for endangered or critically endangered wildlife. </text></item></subclause></clause> <clause commented="no" display-inline="no-display-inline" id="H0584A7CF21514C279BC7B8CCFB4A81FD"><enum>(ii)</enum><header>Extensions</header> <subclause commented="no" display-inline="no-display-inline" id="H99CBD2B7B2A842BFA51C1FCB8B03EEF0"><enum>(I)</enum><header>In general</header><text display-inline="yes-display-inline">As the Administrator determines appropriate, a demonstration project approved for inclusion in the assessment program may be conducted for a period exceeding 5 years. </text></subclause> 
<subclause commented="no" display-inline="no-display-inline" id="HC375F1EB2E7F4C288EDC01334F6CF2C8"><enum>(II)</enum><header>Proposals</header><text display-inline="yes-display-inline">In order to be considered for an extension under this clause, the owner or operator of a demonstration project shall submit to the Administrator a proposal explaining the need for the extension. </text></subclause> <subclause id="HF963F40D78154582A4874F4CAC657FE7"><enum>(III)</enum><header>Notice and public comment</header><text display-inline="yes-display-inline">The Administrator shall—</text> 
<item id="H6BED3AFC886C44F4B9D1BEBA729CB56E"><enum>(aa)</enum><text display-inline="yes-display-inline">publish in the Federal Register a notice summarizing each proposal received under subclause (II); </text></item> <item id="H31B0AE64E2674691806ED0D68B39A7D0" commented="no" display-inline="no-display-inline"><enum>(bb)</enum><text display-inline="yes-display-inline">invite public comments regarding each such proposal; and </text></item> 
<item commented="no" display-inline="no-display-inline" id="H05C2F2982BC54A34AAE4EA4B72CAB0A1"><enum>(cc)</enum><text display-inline="yes-display-inline"> consider such comments in determining whether to authorize any extension for a demonstration project under this clause. </text></item></subclause></clause></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H2C9517D11FB546FAB589D205CE2B97F5"><enum>(B)</enum><header>New demonstration projects</header><text>Any new demonstration project approved for inclusion in the assessment program shall—</text> 
<clause commented="no" display-inline="no-display-inline" id="H22082C31EB104715AC9AD3CF194C68A8"><enum>(i)</enum><text display-inline="yes-display-inline">be designed and managed in partnership with—</text> <subclause id="H54E4EB61EDB14DD5A5311E941AF7BC4A"><enum>(I)</enum><text>a land-grant college or university (as defined in section 1404 of the National Agricultural Research, Extension, and Teaching Policy Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/7/3103">7 U.S.C. 3103</external-xref>));</text></subclause> 
<subclause id="HCE42973D2FB9429D9F6048D4C4D0DC79"><enum>(II)</enum><text>a 1994 Institution (as defined in section 532 of the Equity in Educational Land-Grant Status Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/7/301">7 U.S.C. 301</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/103/382">Public Law 103–382</external-xref>)); or</text></subclause> <subclause id="HF7091110E18D43B5BC6BABD4A225063D" commented="no" display-inline="no-display-inline"><enum>(III)</enum><text>a sea grant college (as defined in section 203 of the National Sea Grant College Program Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1122">33 U.S.C. 1122</external-xref>)); and </text></subclause></clause> 
<clause commented="no" display-inline="no-display-inline" id="H6ECB7F1CDCA74B77A3CCE551410666B0"><enum>(ii)</enum><text>consult and coordinate with the relevant Regional Fishery Management Council. </text></clause></subparagraph></paragraph> <paragraph id="H33C9E2EB5E5541BCB0E300C62F50C432" commented="no"><enum>(6)</enum><header>Priority consideration</header><text>In considering applications for demonstration projects under this section, the Administrator shall give priority consideration to demonstration projects owned or operated by—</text> 
<subparagraph id="H7FCB9821621A4588A1197BD6D912F54F" commented="no"><enum>(A)</enum><text>veterans, or entities in which a veteran or veterans have a majority ownership interest;</text></subparagraph> <subparagraph id="H1601EC202AFD4483B43F73BAA15297E0" commented="no"><enum>(B)</enum><text>members of a community with environmental justice concerns or underserved community, or entities in which a member or members of a community with environmental justice concerns or underserved community have a majority ownership interest;</text></subparagraph> 
<subparagraph id="H1582588EBE2C4E5E8D7013C59A83A912" commented="no"><enum>(C)</enum><text>entities that primarily serve or employ members of a community with environmental justice concerns or underserved community; or</text></subparagraph> <subparagraph id="HDD6B4499A5E34EA890D35C74E4932F8A" commented="no"><enum>(D)</enum><text>applicants who can demonstrate that the demonstration project will directly benefit individuals who are already participating in the agricultural, wild-caught fishery, or offshore aquaculture industries who have been negatively impacted by the COVID–19 pandemic, natural disasters, or disaster declarations.</text></subparagraph></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H676242E544C947A08608EA1A572A3A6C"><enum>(7)</enum><header>Public comments</header><text>In considering applications for demonstration projects under this section, the Administrator shall consider and weigh the public comments received pursuant to paragraph (2)(B). </text></paragraph></subsection> <subsection id="HC5F48D1B9E0A437892DD1E5FD8C6B707"><enum>(c)</enum><header>Aquaculture Opportunity Areas</header><text>The Administrator may elect to site a demonstration project approved for inclusion in the assessment program in an Aquaculture Opportunity Area identified by the Secretary of Commerce in accordance with section 7 of Executive Order 13921 (<external-xref legal-doc="usc" parsable-cite="usc/16/1801">16 U.S.C. 1801</external-xref>; relating to promoting American seafood competitiveness and economic growth). </text></subsection> 
<subsection id="HF08211A4FD8441DDB706D40BE6937B4F"><enum>(d)</enum><header>Permits</header> 
<paragraph commented="no" display-inline="no-display-inline" id="H6FA0D08013FD4C4ABEF96953A5E5DFE8"><enum>(1)</enum><header>Federal agencies</header><text>The owner or operator of each demonstration project approved for inclusion in the assessment program shall obtain all necessary and relevant permits issued by Federal agencies to conduct activities under the project. </text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H73B435F19E5C4ABEB15457DBD93F5D33"><enum>(2)</enum><header display-inline="yes-display-inline">National Oceanic and Atmospheric Administration</header><text display-inline="yes-display-inline">After the owner or operator of a demonstration project obtains the permits described in paragraph (1), the Administrator shall issue the appropriate permits to allow the project to conduct offshore aquaculture activities in accordance with this Act. </text></paragraph></subsection> 
<subsection id="HE5385C5348C047E99ED0D17A27362EFF"><enum>(e)</enum><header>Reporting by assessment program participants</header> 
<paragraph id="H7F58C056BA9046FAB943B2457C397504"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The owner or operator of each demonstration project approved for inclusion in the assessment program shall submit such information, at such time, in such place, and in such manner as the Administrator determines appropriate, including the following: </text> <subparagraph id="H80BD61D6F1674ECCA60B9CCEF84678E0"><enum>(A)</enum><text>Production data.</text></subparagraph> 
<subparagraph id="H969CA2269EA4492A85AC27FFE1BFD5F8"><enum>(B)</enum><text>Information on interactions with wild species, mitigation measures taken, and the results of such interactions and measures.</text></subparagraph> <subparagraph id="HE3473EF3E457417A943208564593FB29"><enum>(C)</enum><text>Information on technology and operational practices used to measure and monitor—</text> 
<clause id="HC3ECDD03834F47EF9712B1E399DE183B"><enum>(i)</enum><text>effluent; </text></clause> <clause id="HE66355E46A8B43D2A3391B7E9211F810"><enum>(ii)</enum><text>integrity of cage materials and other gear; and </text></clause> 
<clause id="H69757750CABC4589BFBAFA6D337FCC87"><enum>(iii)</enum><text>health of the cultivated species.</text></clause></subparagraph> <subparagraph id="H9792639C7DDD431DA1D0B4F10EA58B88"><enum>(D)</enum><text>Information on environmental and ecosystem impacts. </text></subparagraph> 
<subparagraph id="H229C36B4C2754664942FB5ADDDBC1DD0"><enum>(E)</enum><text>Data necessary for the Ocean Studies Board of the National Academies of Sciences, Engineering, and Medicine to complete the study required by section 3.</text></subparagraph> <subparagraph commented="no" id="HDB0D06691AD84CFAA97C2274B2EBCD08"><enum>(F)</enum><text>Information necessary for the Administrator to exercise the authority of the Administrator under subsection (f).</text></subparagraph> 
<subparagraph id="H99733D3BEBFE438CBB644C3647703A30"><enum>(G)</enum><text>Owner, operator, and employee demographic data and other relevant data as determined by the Administrator for purposes of assessing—</text> <clause id="H5722D8ECC8BE4784A909E14D824CF091"><enum>(i)</enum><text>the direct benefits of the project to communities with environmental justice concerns; and</text></clause> 
<clause id="H730CE0BB36B84AEF9582E873DAF533C4"><enum>(ii)</enum><text>the economic and social benefits for nearby coastal communities.</text></clause></subparagraph> <subparagraph id="HBC6CC746F7AD43BB84A7B07EE564E25A"><enum>(H)</enum><text>Information on navigation and safety impacts to existing ocean users. </text></subparagraph> 
<subparagraph id="H390573E9134A4E84B08A3AAF70155CB1"><enum>(I)</enum><text>Such additional information as the Administrator requires to fulfill the goals and objectives of the assessment program.</text></subparagraph></paragraph> <paragraph id="H1AD7317D604540D7AAD1E225E506E982"><enum>(2)</enum><header>Technical assistance</header><text>The Administrator shall, upon request, provide technical assistance to owners and operators of demonstration projects approved for inclusion in the assessment program to comply with the reporting requirements of this subsection. </text></paragraph> 
<paragraph id="H038E618AEE924FBDBFD9526DD182A2DF"><enum>(3)</enum><header>Emergency reporting</header><text display-inline="yes-display-inline">The Administrator shall establish an emergency reporting process for each owner or operator of a demonstration project approved for inclusion in the assessment program to immediately report suspected or known interactions between project facilities or vessels and protected wild species. </text></paragraph></subsection> <subsection id="HABB689BAEA8C4382A8035E2789911A8E"><enum>(f)</enum><header>Authority To modify or terminate participation of demonstration projects and order removal of facilities</header><text>The Administrator may require modifications to a demonstration project approved for inclusion in the assessment program, terminate the participation of such a project in such program, and order the removal of an offshore aquaculture facility authorized to operate under this section if—</text> 
<paragraph id="H0675ADC132A74D3DBCE4FEE2A1382D0F"><enum>(1)</enum><text>the project incurs an incident involving a death or serious personal injury and the Administrator determines that project operator negligence was the cause or a contributing factor to such incident;</text></paragraph> <paragraph id="H48375C9EAD5C41F78A0CA59E8428D5EE"><enum>(2)</enum><text>operation of the project results in a violation of—</text> 
<subparagraph id="H9A56FE0BEC2C4E0581BC038CECBC8EC2"><enum>(A)</enum><text>the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>); or </text></subparagraph> <subparagraph id="HCE1635FB00C44E8A9EECCD62B41942FA"><enum>(B)</enum><text>the Marine Mammal Protection Act of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/16/1361">16 U.S.C. 1361 et seq.</external-xref>);</text></subparagraph></paragraph> 
<paragraph id="HA22FC8EDBE9043EF9530D9034C6651F9"><enum>(3)</enum><text>the owner or operator of the project fails to comply with all of the terms and conditions of—</text> <subparagraph id="H74FDB0AF39F84D448D6D9662638E0E2D"><enum>(A)</enum><text>the approval of the project; or </text></subparagraph> 
<subparagraph id="HE1D58D7D24BC4EA88FEE3068D32BC64C"><enum>(B)</enum><text>modifications required by the Administrator under this subsection; or</text></subparagraph></paragraph> <paragraph commented="no" id="HD794448EC8CE44BCB2B9556AD1D31235"><enum>(4)</enum><text>the Administrator determines that continued participation in the assessment program by the project would be unsafe or result in unacceptable negative impacts to—</text> 
<subparagraph commented="no" id="H2FCB0544AAF942DEBDD1A95E62375CF0"><enum>(A)</enum><text>the marine environment; </text></subparagraph> <subparagraph commented="no" id="H519D7ED04AFF4CEEBE653286F33D9EA3"><enum>(B)</enum><text>nearby communities; or </text></subparagraph> 
<subparagraph commented="no" id="H89C2AE33DF784E1CBBA13ADCD49787A1"><enum>(C)</enum><text>other users of the water body in which the project is located.</text></subparagraph></paragraph></subsection> <subsection commented="no" id="HE41A26223A0F4646A416E7DC6C6E0DC7"><enum>(g)</enum><header>Interim final rule</header><text display-inline="yes-display-inline">The Administrator may issue an interim final rule to implement the requirements under this section. </text></subsection> 
<subsection id="HFBE120C48BCD4DAA9CC8CAD691A2270D"><enum>(h)</enum><header>Reports</header> 
<paragraph id="HB9D4B06510FB43DB9044189AB8631EF8"><enum>(1)</enum><header>Annual reports</header> 
<subparagraph id="H36D1148BE9B74AB7B3801BEF45D2C405"><enum>(A)</enum><header>In general</header><text>Not later than 2 years after the date on which the Administrator establishes the assessment program, and annually thereafter for the duration of the assessment program, the Administrator shall publish, make available to the public, and submit to offshore aquaculture stakeholders a report that includes the following: </text> <clause id="H1D0568A03F3B449E9548A01E0E60DE68"><enum>(i)</enum><text>A description of each project approved for inclusion in the assessment program.</text></clause> 
<clause id="HA046DBA7339D4D039D5DB6237BD0ACF4"><enum>(ii)</enum><text>In the first report, documentation supporting selection of each such project.</text></clause> <clause id="H46E90A16EFD046A98D8DC0CCF54D8722"><enum>(iii)</enum><text>A summary of the information submitted to the Administrator under subsection (e) for each such project.</text></clause> 
<clause id="H240EDC9DD6AB47A08259F47CF12F19CD"><enum>(iv)</enum><text>A description of the progress made toward meeting the objectives described in subsection (a).</text></clause></subparagraph> <subparagraph id="H29C6998BA1FA498E9566BDF728CF11DD"><enum>(B)</enum><header>Definition of offshore aquaculture stakeholders</header><text>In this paragraph, the term <term>offshore aquaculture stakeholders</term> includes—</text> 
<clause id="H3B7B4A8D642945DE9CCD75C6F7900D2B"><enum>(i)</enum><text>each specially affected adjacent coastal jurisdiction; and </text></clause> <clause id="HC5E09FF90E9E4302B3CE7246A98D5DC8"><enum>(ii)</enum><text>each affected—</text> 
<subclause id="H6BEE8BF86CEB40CE950B743ACFAE6ED2"><enum>(I)</enum><text>Tribal or Indigenous community; </text></subclause> <subclause id="HAA3F217B429E482E9A5A45985759E8BB"><enum>(II)</enum><text>regional fishery management council; </text></subclause> 
<subclause id="H2507CCF70DF140F79FCB84F9B07DE77D"><enum>(III)</enum><text>interstate fisheries commission; </text></subclause> <subclause id="H36A00A91B6024AD4B8165ECBE954207B"><enum>(IV)</enum><text>conservation organization; and </text></subclause> 
<subclause id="H45B91794E6D24460B74B25BAE2454A59"><enum>(V)</enum><text>fisheries association. </text></subclause></clause></subparagraph></paragraph> <paragraph id="H67377B97E8964A2DAF7A510848735B63"><enum>(2)</enum><header>Final report</header> <subparagraph id="HBED9E7382A2E476A9315C950CB0088B6"><enum>(A)</enum><header>In general</header><text>Not later than 1 year after the date of the completion of the assessment program, the Administrator shall submit to the appropriate committees of Congress a report describing the results of the assessment program. </text></subparagraph> 
<subparagraph id="H7CFD6E8C781248CA9AEB94890C1631B5"><enum>(B)</enum><header>Elements</header><text>The report required by subparagraph (A) shall include the following: </text> <clause id="H6B048FD22D784932BA8440F7F4AED10A"><enum>(i)</enum><text>An evaluation based on data from the assessment program of the opportunities and risks of offshore aquaculture regarding—</text> 
<subclause id="H5D24112A183D4114AB783D4BB5127864"><enum>(I)</enum><text>marine ecosystems;</text></subclause> <subclause id="H1DE86C78509548509F2D701A578638F8"><enum>(II)</enum><text>other users of the exclusive economic zone;</text></subclause> 
<subclause id="H79E56F82E1914749875F56CCBD8B5FC6"><enum>(III)</enum><text>other ecosystems goods and services;</text></subclause> <subclause id="H6E9F0EDFF95A4519817C8708F517AA14"><enum>(IV)</enum><text>social and economic impacts to nearby communities, including cumulative impacts and impacts on communities with environmental justice concerns, low-income communities, and communities of color;</text></subclause> 
<subclause id="HE186BAB5F3394AB9A2427CFCF0963394"><enum>(V)</enum><text>best practices to mitigate risks; and</text></subclause> <subclause id="H5156A0B8F37F455999782E0A00FBC041"><enum>(VI)</enum><text>best practices to prevent disparate impacts.</text></subclause></clause> 
<clause id="HDFE31BFC64AC4560AB0927FFB21D4561"><enum>(ii)</enum><text>Such recommendations as the Administrator may have for legislative or administrative action and the establishment of performance standards for offshore aquaculture siting and operations that—</text> <subclause id="H727D48844C95485180A29425E0527F05"><enum>(I)</enum><text>would minimize risks posed by offshore aquaculture operations to marine ecosystems;</text></subclause> 
<subclause id="HEDC43E59E6304B2280DF958CF6D41415"><enum>(II)</enum><text>would enhance the safe operation of offshore aquaculture facilities, service vessels, and associated activities;</text></subclause> <subclause id="H4B79F0C55BB44898B6C6712E5DDC6390"><enum>(III)</enum><text>would prevent displacement of existing uses and users; and</text></subclause> 
<subclause id="HCE6FAC1B15AC43E08C2DFB83A3DD468D"><enum>(IV)</enum><text>are technically, operationally, and economically feasible.</text></subclause></clause></subparagraph></paragraph></subsection></section> <section id="H625567F7C5834929A273A224323FAA1A"><enum>5.</enum><header>Aquaculture Centers of Excellence</header> <subsection id="HA0C2B8014C0649DBA980E3A595384378"><enum>(a)</enum><header>Aquaculture curriculum grants</header> <paragraph id="HDA860B9A05314152BE4253D33CF8DBB6"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date of the enactment of this Act, the Administrator shall establish a program to award grants to covered institutions to assist in establishing or enhancing an aquaculture curriculum for undergraduate or graduate courses of study at such covered institutions.</text></paragraph> 
<paragraph id="H052E4862126645D8AE3D04D7D314415A"><enum>(2)</enum><header>Aquaculture Centers of Excellence</header><text>A covered institution that receives a grant under this section shall be known as an <quote>Aquaculture Center of Excellence</quote>. </text></paragraph> <paragraph id="HC36EA4474757406D9A2A2F6824B18008"><enum>(3)</enum><header>Applications</header><text>To be eligible to receive a grant under this section, a covered institution shall submit to the Administrator an application in such form, at such time, and containing such information as the Administrator determines appropriate, including any plans to partner with 1 or more other institutions of higher education as authorized under paragraph (5).</text></paragraph> 
<paragraph id="H0F556A0E33944897A5E8EFEDA53824E7"><enum>(4)</enum><header>Use of grant amounts</header> 
<subparagraph id="H9A02C3352EB644B1BAB974EE068D4E06"><enum>(A)</enum><header>In general</header><text>A covered institution receiving a grant under this section shall use the grant amounts to establish or enhance an aquaculture curriculum for undergraduate or graduate courses of study that includes the following: </text> <clause id="HA926771FC4B644C7B4D333A9B511A416"><enum>(i)</enum><text>Training in various skill sets needed by successful aquaculture entrepreneurs, including—</text> 
<subclause id="H230C7558D5B941D38E0AF5A4A8E75EFC"><enum>(I)</enum><text>business management, strategic planning, business plan development, capital financing and fundraising, financial management and accounting, market analysis and competitive analysis, and market entry and strategy execution; and</text></subclause> <subclause id="HC5BE83CCFD33422BA75F3134EC7D724D"><enum>(II)</enum><text>any other skill sets specific to the needs of the student population and the surrounding community, including with respect to social and environmental sustainability, as determined by the institution.</text></subclause></clause> 
<clause id="HE502D2FE51DA4BE3956D1BCE5BBAC3EF"><enum>(ii)</enum><text>Natural and social science research programs in aquaculture and natural fisheries, including offshore aquaculture.</text></clause> <clause id="H55D48248A45C423E8BC8DF002D49F062"><enum>(iii)</enum><text>Development of extension programs (or cooperation with existing extension programs) that—</text> 
<subclause id="HE602C12EE7664479A37D6DE018BDCD51"><enum>(I)</enum><text>educate and engage community members, including elementary and secondary school students, on aquaculture and aquaculture career pathways; and </text></subclause> <subclause id="HEB3F9B6DBB4B4E8089497B06D6A2F969"><enum>(II)</enum><text>transfer newly developed techniques and research information developed or collated at the covered institution to aquaculture practitioners.</text></subclause></clause> 
<clause id="H330FDFF83324409AA5AC0873EE8DC624"><enum>(iv)</enum><text>Career development, such as the establishment of cooperatives, apprenticeships, mentorships, accelerators, or grant competitions. </text></clause></subparagraph> <subparagraph id="H761E3FF34B324F50BDEC4738AA9004FA"><enum>(B)</enum><header>Limitations on use of grant amounts</header><text>Amounts from a grant awarded under this section may be used only for expenses directly related to the implementation of the curriculum or activities authorized under this section. </text></subparagraph></paragraph> 
<paragraph id="HA1CB8FB808E74DAAB3B348EDD3F157A1"><enum>(5)</enum><header>Partnerships</header><text display-inline="yes-display-inline">In applying for grants and carrying out activities with grant amounts under this section, a covered institution may partner with 1 or more other institutions of higher education with established aquaculture programs, including institutions of higher education not otherwise eligible for grants under this section, to facilitate the sharing of resources and knowledge necessary for the development or enhancement of aquaculture curriculum at the covered institution. </text></paragraph></subsection> <subsection id="HC4003606FFF24FB3AEC526628A9B4A55"><enum>(b)</enum><header>Authorization of Appropriations</header><text>There is authorized to be appropriated to carry out this section $25,000,000 for each of fiscal years 2024 through 2027, to remain available until expended.</text></subsection></section> 
<section id="H19A12F217890448C9C0CB191DB56EEB1"><enum>6.</enum><header>Report by Government Accountability Office</header> 
<subsection id="HF7063BBBE1CE48509421819AB8713C6C"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 2 years after the date of the enactment of this Act, the Comptroller General of the United States shall submit to the appropriate committees of Congress a report examining the permitting, monitoring, and regulation of offshore aquaculture during the 15-year period ending on such date of enactment. </text></subsection> <subsection id="HED680C91CAD04624880883D0B08064E2"><enum>(b)</enum><header>Bases of report</header><text>The Comptroller General shall base the report required by subsection (a) on available literature, case studies, and stakeholder input. </text></subsection> 
<subsection id="HD38CEA199A604076B771371A3C6FE072"><enum>(c)</enum><header>Elements of report</header><text>The report required by subsection (a) shall—</text> <paragraph commented="no" id="HFDABC6ADE3B444569211CE8C2886702F"><enum>(1)</enum><text display-inline="yes-display-inline">assess the feasibility and potential positive and negative implications of designating a lead agency to issue offshore aquaculture permits in a timely manner;</text></paragraph> 
<paragraph id="H6F0AC3DAA00247F5B17E9A0D34E0D84D"><enum>(2)</enum><text>identify lessons learned during the period described in subsection (a) with respect to—</text> <subparagraph commented="no" id="HD0273A68A873484E95E5017A5C91A43E"><enum>(A)</enum><text display-inline="yes-display-inline">the implications of offshore aquaculture type, location, and regulatory framework on the success of offshore aquaculture projects;</text></subparagraph> 
<subparagraph commented="no" id="HEB52A29ACEB14328BBA25A72B13007F1"><enum>(B)</enum><text>the degree of involvement of coastal or adjacent States, Tribal groups, underserved communities, or communities with environmental justice concerns in consultation, planning, or operations of offshore aquaculture operations;</text></subparagraph> <subparagraph commented="no" id="HDEC7EC82855D43569B45870657183DF9"><enum>(C)</enum><text>safety protocols and risk mitigation measures for the permit and oversight processes for offshore aquaculture, including—</text> 
<clause id="H06CF73D49D594972B3CD69F3FE9F8A0D"><enum>(i)</enum><text>escape prevention measures;</text></clause> <clause id="H0E55055618D64B9CB37D75E7FF4B1978"><enum>(ii)</enum><text>emergency event response planning;</text></clause> 
<clause id="H79ED93E5130F4672A7FEC7CF2310E751"><enum>(iii)</enum><text>compliance monitoring, particularly in remote locations;</text></clause> <clause id="HC5A81F1372CC4D08BA009905F4B5F604"><enum>(iv)</enum><text>compliance with Federal laws;</text></clause> 
<clause id="HB4B17F36C8AE4973BFC773B573C80A11"><enum>(v)</enum><text>reporting mechanisms to appropriate Federal authorities; and</text></clause> <clause id="H0E1C5AAABB904484A7C4F4E7145D2A13"><enum>(vi)</enum><text>vessel navigation aids to ensure navigational safety;</text></clause></subparagraph> 
<subparagraph commented="no" id="HB19000A68191490DB00507FB0F2FF2AC"><enum>(D)</enum><text>the effect of incentives to reduce adverse effects or disparate impacts from offshore aquaculture operations;</text></subparagraph> <subparagraph commented="no" id="HE9BB0DC014C64972BD4732A8BEB238F0"><enum>(E)</enum><text>building and optimizing synergies between offshore aquaculture and wild-caught fishing activities, or offshore, nearshore, and onshore aquaculture activities, including market development, increasing seafood consumption, and shared infrastructure;</text></subparagraph> 
<subparagraph id="H9E00FCDB26574EBC8F387A04393F1644"><enum>(F)</enum><text>the environmental effects of offshore aquaculture operations, including mechanisms to prevent harm to the environment, wildlife, or human well-being;</text></subparagraph> <subparagraph commented="no" id="H32C9704979644DECBC89EA1C16D9D69A"><enum>(G)</enum><text>in consultation with the Council Coordination Committee, the net economic and social benefits of offshore aquaculture projects, particularly for nearby communities, including underserved communities and communities with environmental justice concerns, based on project size, regulatory structures, and financing structures;</text></subparagraph> 
<subparagraph commented="no" id="H0A33616688F441018FB8A044AF9786B1"><enum>(H)</enum><text>the impact of introducing offshore aquaculture products to the marketplace on supply and demand for wild-capture fisheries products, and methods for ensuring resiliency and growth for both offshore aquaculture and wild-capture fisheries products;</text></subparagraph> <subparagraph commented="no" id="HDF8AA0C98B8440B5B8F0EF319535380F"><enum>(I)</enum><text>mechanisms to enhance capital investment, workforce development, and equitable opportunity requirements or assistance programs in the permit process for offshore aquaculture, or to diversify permit applicants; </text></subparagraph> 
<subparagraph commented="no" id="HB51F00599B714432AB2881F930191657"><enum>(J)</enum><text>outstanding needs for continued research, development, education activities, programs, and funding regarding offshore aquaculture projects and development of the domestic workforce and entrepreneurship related to offshore aquaculture;</text></subparagraph> <subparagraph commented="no" id="H25A965A168FC4F9A862380664F78E30B"><enum>(K)</enum><text>the economic potential for both large- and small-scale offshore aquaculture operations to generate a positive return on investment under various regulatory and financing structures;</text></subparagraph> 
<subparagraph id="HB28242B9A56D47C4A2C2A6CB18FE406F" commented="no"><enum>(L)</enum><text display-inline="yes-display-inline">the applicability and sufficiency of existing regulatory systems for offshore aquaculture; and</text></subparagraph> <subparagraph id="H1FFA78CCBF294364A6DEC2E09BAD093E" commented="no" display-inline="no-display-inline"><enum>(M)</enum><text>existing local, State, Federal, and foreign regulatory standards that may serve as models for efficient and effective regulation of offshore aquaculture; and </text></subparagraph></paragraph> 
<paragraph commented="no" id="HF637D47119E8429D8D889E83C8E01BE2"><enum>(3)</enum><text>include such recommendations as the Comptroller General may have with respect to future offshore aquaculture operations, including with respect to—</text> <subparagraph commented="no" id="H6408C32862094E609D04E894914FFBC6"><enum>(A)</enum><text>regulatory processes necessary for permitting, monitoring, and oversight, including processes and techniques related to siting, deployment, operations, and decommissioning;</text></subparagraph> 
<subparagraph commented="no" id="H81117611FA3247B58F1982AC86DD731E"><enum>(B)</enum><text>potential safeguards, data collection, or monitoring required to minimize disparate impacts on communities with environmental justice concerns, local economies, marine environments, and existing domestic economic sectors;</text></subparagraph> <subparagraph commented="no" id="H6560B159477B4C81B7B24EA7CD3CD351"><enum>(C)</enum><text>mechanisms for optimizing the coordination among Federal agencies with a role in permitting or supporting offshore aquaculture without compromising the goals of such permitting;</text></subparagraph> 
<subparagraph commented="no" id="H3B5AA060114C4B6A93FF24B1ECC45371"><enum>(D)</enum><text>methods for effectively involving stakeholders, including—</text> <clause id="H0CAF11CBED264279818FAE7C623EB45F"><enum>(i)</enum><text>specially affected adjacent coastal jurisdictions;</text></clause> 
<clause id="H06FE7AA38A9F4127A96D03836CE03702"><enum>(ii)</enum><text>local communities;</text></clause> <clause id="H9DE1EAE10E9240D8B361DE2B4B2030AE"><enum>(iii)</enum><text>regional offshore waters users and management groups, including regional fishery management councils; and</text></clause> 
<clause id="HFB154CF7F6C7471E80C7837455F3F109"><enum>(iv)</enum><text>users of local, State, Tribal, and Federal waters and coastal resources, including underserved communities and communities with environmental justice concerns;</text></clause></subparagraph> <subparagraph id="H979524B88BC148F2966F5A4E27A8A40E"><enum>(E)</enum><text>best practices for incorporating local knowledge, including from Tribal or Indigenous communities; </text></subparagraph> 
<subparagraph commented="no" id="HB4B6DFD12E9E4BCFB41713700C438717"><enum>(F)</enum><text>capabilities of Federal agencies that are necessary for effective regulation of the offshore aquaculture sector; and</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H4DF7E6273EE54E5DA19D34F9724FE2AE"><enum>(G)</enum><text display-inline="yes-display-inline">how creating private rights of action or waiving sovereign immunity would facilitate or hinder the development of offshore aquaculture projects and the acceptance of such projects by nearshore and offshore waters user groups and coastal communities. </text></subparagraph></paragraph></subsection></section> 
<section id="H979DDD5262DC438586B9E16BC634B72B"><enum>7.</enum><header>Rule of construction</header><text display-inline="no-display-inline">Any requirement in this Act to identify or consider an impact or effect on human health, the environment, or the climate shall be construed as including a requirement to make such identification or consideration while taking into account—</text> <paragraph id="HD277F22C9C494E98853E8258726F2BEF"><enum>(1)</enum><text>the cumulative impact of such impact or effect in the context of all sources of emissions, discharges, or releases from any source, past, present, or in the reasonably foreseeable future, on the affected environment and population;</text></paragraph> 
<paragraph id="HA6BA9ECAAF2C4C879CB47C1F0C4E63B2"><enum>(2)</enum><text>any characteristics of such environment and population that may heighten vulnerability to environmental pollution and related health risks; and</text></paragraph> <paragraph id="HA83A2391E8E5444FAE58B9260878972A"><enum>(3)</enum><text>any action or practice that, even if appearing neutral, has the effect of subjecting individuals to discrimination on the basis of race, color, or national origin.</text></paragraph></section>
