<section id="HB5FE9DEB067442469BD9F293B07B55B4" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Ensuring Kids Have Access to Medically Necessary Dental Care Act</short-title></quote>.</text></section> <section id="H6546D70D6E1F47A6A08A0B30A280333F"><enum>2.</enum><header>Prohibition of lifetime or annual limits on dental benefits under the Children's Health Insurance Program</header> <subsection id="HCEB67B96A0FC46FA8A3080499AA94409"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 2103(c)(6) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1397cc">42 U.S.C. 1397cc(c)(6)</external-xref>) is amended—</text> 
<paragraph id="HB975E1AA371A416DAD9A662DD94CF2CB"><enum>(1)</enum><text>in subparagraph (A), by inserting <quote>, subject to subparagraph (D),</quote> after <quote>shall include</quote>;</text></paragraph> <paragraph id="HDF38B179231E4FEC879A152705561D19"><enum>(2)</enum><text>in subparagraph (B), by striking <quote>A State</quote> and inserting <quote>Subject to subparagraph (D), a State</quote>; and</text></paragraph> 
<paragraph id="H0AD27CEED7164CF793D0C667AC972A8C"><enum>(3)</enum><text>by adding at the end the following new subparagraph: </text> <quoted-block id="HE371AE9959CF4FD482AEB2D2BB4F5FA0" style="OLC" act-name=""> <subparagraph id="HA1A618F207A9437DB5EA5A699EBC2B07"><enum>(D)</enum><header>No lifetime or annual limits on dental benefits</header><text>A State shall not establish lifetime or annual limits on the dollar value of benefits for dental services provided under the State child health plan to a targeted low-income child, and, in the case that the State elects to provide pregnancy-related assistance pursuant to section 2112, to a targeted low-income pregnant woman (as defined in section 2112(d)), including benefits for such services that are provided through dental coverage that is otherwise equivalent to a benchmark dental package described in subparagraph (C).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H495D79C8A765485B9FC915387CFC8802"><enum>(b)</enum><header>Effective date</header><text>The amendments made by this section shall take effect on the date that is 6 months after the date of enactment of this Act.</text></subsection></section> <section id="H48C74127BDD04B51AA584F05ACAA7C22"><enum>3.</enum><header>Requiring wraparound coverage of dental services for certain children under CHIP</header> <subsection id="H7CBC67E718834AFC9ED3273B594EE4BD"><enum>(a)</enum><header>In general</header><text>Section 2110(b)(5) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1397jj">42 U.S.C. 1397jj(b)(5)</external-xref>) is amended—</text> 
<paragraph id="HCBE3883B972C493B859B51E86F5E62D8"><enum>(1)</enum><text>in the paragraph header, by striking <quote><header-in-text style="OLC" level="paragraph">Option</header-in-text></quote> and inserting <quote><header-in-text style="OLC" level="paragraph">Requirement</header-in-text></quote>;</text></paragraph> <paragraph id="HB15B2703C8864FEF8ECCC74A2A99E837"><enum>(2)</enum><text>in subparagraph (A), by striking <quote>may waive</quote> and inserting <quote>shall waive</quote>; and</text></paragraph> 
<paragraph id="H025EE4537F224162871E1CFB3CF8DF91"><enum>(3)</enum><text>in subparagraph (C)—</text> <subparagraph id="H19C4B8BD5B904613842DECB98154A5FC"><enum>(A)</enum><text>in the subparagraph header, by striking <quote><header-in-text style="OLC" level="subparagraph">Conditions</header-in-text></quote> and inserting <quote><header-in-text style="OLC" level="subparagraph">Requirements</header-in-text></quote>; and</text></subparagraph> 
<subparagraph id="H5557D67C14154338817244D46422EC8F"><enum>(B)</enum><text>by striking <quote>may not offer dental-only supplemental coverage under this paragraph unless the State satisfies the following conditions</quote> and inserting <quote>shall offer dental-only supplemental coverage under this paragraph in accordance with the following requirements</quote>.</text></subparagraph></paragraph></subsection> <subsection id="H6260374C24C3453F8204C1F6F3D5CAFF"><enum>(b)</enum><header>Effective date</header><text>The amendments made by this section shall take effect on the date that is 6 months after the date of enactment of this Act.</text></subsection></section>
