R. 5887</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20240522">May 22, 2024</action-date><action-desc>Received; read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>AN ACT</legis-type><official-title display="yes">To amend <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/3">chapter 3</external-xref> of title 5, United States Code, to improve Government service delivery, and build related capacity for the Federal Government, and for other purposes.</official-title></form><legis-body id="HD3C0033EA7AB4B6299BBC174E756AD56" style="OLC"><pagebreak></pagebreak><section id="HFEE8ED6DFE7C49E6879766A878F36FAC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Government Service Delivery Improvement Act</short-title></quote>.</text></section><section id="HA317F08FB80746BF8FB9719F6AFF4406"><enum>2.</enum><header>Federal Government service delivery</header><subsection id="H11491AA5CB444954B0436488967BC165"><enum>(a)</enum><header>Amendment</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/3">Chapter 3</external-xref> of title 5, United States Code, is amended by adding at the end the following: </text><quoted-block style="USC" id="H3A4B312B9D514142B6895315CF3D11F6" display-inline="no-display-inline"><subchapter id="H21EF1AF6EAA341CCA290414D867AE501"><enum>III</enum><header>Federal Government Service Delivery</header><section id="H7C75D6B28300457D8BE211BDCD734276"><enum>321.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subchapter:</text><paragraph id="H7EB0A2B2C6E346D099B58ACB0E91FBF1"><enum>(1)</enum><header>Agency</header><text display-inline="yes-display-inline">The term <term>agency</term> has the meaning given that term in section 3502 of title 44.</text></paragraph><paragraph id="H2225F11DF40F4AA8BDBDE52D55D72177"><enum>(2)</enum><header>Director</header><text>The term <term>Director</term> means the Director of the Office of Management and Budget.</text></paragraph><paragraph id="HEAF3A14A756347F292E29F8B3D9ECD10"><enum>(3)</enum><header>Government service delivery</header><text display-inline="yes-display-inline">The term <term>Government service delivery</term> means any action by an agency related to providing a benefit or service to an individual, business, or organization (such as a grantee or State, local, or Tribal entity), including any such action of a contractor or nonprofit organization acting on behalf of the agency or administering a federally-funded program. </text></paragraph><paragraph id="H52EC8D1322FF4C3BB5E6A1763B4E8CE3" commented="no"><enum>(4)</enum><header>Government service delivery channel</header><text display-inline="yes-display-inline">The term <term>Government service delivery channel</term> means the format or medium of an interaction or transaction with the Federal Government, including in-person, through the mail, through a digital service, by telephone, through a contact center, on a website, through outreach and communication, and through collaboration with a third party, or through other ways in which an individual or entity significantly interacts with the Federal Government.</text></paragraph><paragraph id="HDDA227E17BA6478DBA641D847F5C64D0"><enum>(5)</enum><header>High impact service provider</header><text display-inline="yes-display-inline">The term <term>high impact service provider</term> means an agency program identified by the Director due to the scale and impact of the public-facing services of the program.</text></paragraph></section><section id="HADA2BEE819E24CF19AD28DE8A96E24E9"><enum>322.</enum><header>Federal Government service delivery</header><subsection id="HACA8B48335CB49E981DD4EB3B291994B"><enum>(a)</enum><header>Federal Government Service Delivery Lead</header><text>The Director shall designate or appoint a senior official as the Federal Government Service Delivery Lead within the Office of Management and Budget whose responsibility is to coordinate governmentwide efforts to improve Government service delivery by agencies. The individual shall have the following duties and authorities:</text><paragraph id="H7E09C639D16B4EC889A2E38F56FE3AE1"><enum>(1)</enum><text>Facilitate and coordinate governmentwide efforts to improve Government service delivery provided by agencies, particularly with respect to high impact service providers.</text></paragraph><paragraph id="H82A4B301121D4A248248DB6FE2FC6272"><enum>(2)</enum><text>Carry out the duties and powers prescribed by the Director.</text></paragraph><paragraph id="H4A01498AE2D14738880954E18F4F168A"><enum>(3)</enum><text display-inline="yes-display-inline">Serve as the lead, governmentwide official responsible for supporting Government service delivery.</text></paragraph><paragraph id="HC71B15A78D67439F8E30D4A7F62125F5"><enum>(4)</enum><text>Advise the Director concerning the improvement of Government service delivery provided by agencies.</text></paragraph><paragraph id="H2C3E0B193BAF4B92A5C7E779F5D1E8F4"><enum>(5)</enum><text display-inline="yes-display-inline">In consultation with each lead agency service delivery official and any other agency stakeholder as appropriate, develop and oversee the implementation of governmentwide Government service delivery standards, policies, and guidelines for services and programs provided by agencies, including standards, policies, and guidelines to—</text><subparagraph id="HF92D508B5A254A3B8CCA293AFA43A47F" display-inline="no-display-inline"><enum>(A)</enum><text>understand the needs of an individual, business, or organization interacting with an agency;</text></subparagraph><subparagraph id="H47838004F5CF4A51BDE6039C3773A6C6"><enum>(B)</enum><text display-inline="yes-display-inline">solicit and consider voluntary feedback on the Government service delivery by the agency;</text></subparagraph><subparagraph id="H766ABF810ADA4DD6B3D77A0F0F58B355"><enum>(C)</enum><text>assess Government service delivery processes;</text></subparagraph><subparagraph id="H394637897D3A4FC9BCA7CC8DAA414638"><enum>(D)</enum><text>consider the factors of ease, efficiency, transparency, accessibility, fairness, burden (as defined in section 3502 of title 44), and duration, including wait and processing times, with respect to Government service delivery; and</text></subparagraph><subparagraph id="H2331848ECD1144FDBEE468589776F12D" commented="no"><enum>(E)</enum><text>encourage the adoption of commercial products and services in accordance with section 3307 of title 41.</text></subparagraph></paragraph><paragraph id="HC61910B03C8A40EF8763C47809E2BABF"><enum>(6)</enum><text display-inline="yes-display-inline">Collect and report qualitative and quantitative information or data on Government service delivery through existing reporting mechanisms. </text></paragraph><paragraph id="H61481701F9084115A5BDF9B70A4DF64E"><enum>(7)</enum><text display-inline="yes-display-inline">Evaluate the quality of Government service delivery, including through the establishment of performance metrics developed using the standards, policies, and guidelines developed pursuant to paragraph (5) and the information or data collected and reported pursuant to paragraph (6). </text></paragraph><paragraph id="H0EF3D4DF59874F0FB69949280040445D"><enum>(8)</enum><text>Engage with stakeholders to identify leading practices in service design and delivery that would improve Government service delivery across and within agencies.</text></paragraph><paragraph id="HCAA809FD25884CAF8E9AE5215507CD41"><enum>(9)</enum><text display-inline="yes-display-inline">Ensure agency service delivery initiatives, including those related to the 21st Century Integrated Digital Experience Act (<external-xref legal-doc="usc" parsable-cite="usc/15/3501">15 U.S.C. 3501</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/115/336">Public Law 115–336</external-xref>), are identified in agency congressional budget justifications.</text></paragraph><paragraph id="H01464A3E5EFB43D98CFE8E21990A5D39"><enum>(10)</enum><text>Coordinate with Office of Management and Budget stakeholders and other agency stakeholders on Government service delivery.</text></paragraph><paragraph id="H94E72190B57D44F682C5EA9DEB84C228"><enum>(11)</enum><text display-inline="yes-display-inline">In collaboration with relevant agency officials as appropriate, and in coordination with relevant Office of Management and Budget stakeholders, ensure that websites of agencies, including those associated with high impact service providers, are consistent with the objectives of this subchapter, the 21st Century Integrated Digital Experience Act, and any other applicable law.</text></paragraph></subsection></section><section id="HC77B4B0EE01243878544619DEAD3698E"><enum>323.</enum><header>Lead agency officials for Government service delivery</header><subsection id="H367CA90491E846B4B73FE2B1E0F50FB5"><enum>(a)</enum><header>Responsibility for Government service delivery</header><text display-inline="yes-display-inline">The head of each agency shall be responsible for the Government service delivery of the agency which shall, at a minimum, include improving and enhancing Government services to better achieve the mission of the agency and build and maintain trust, transparency, and accountability.</text></subsection><subsection id="HF76BE513360E474087EBA77E7F8E7801"><enum>(b)</enum><header>Lead agency service delivery officials</header><text display-inline="yes-display-inline">Not later than one year after the date of the enactment of this subchapter, the head of each agency shall designate or appoint a senior official of the agency (who may be the deputy head of the agency) to implement this subchapter who shall have the following duties and authorities:</text><paragraph id="H88220D773AE4465E9F5D6E6B0D9743A2"><enum>(1)</enum><text>Report directly to the head or deputy head of the agency.</text></paragraph><paragraph id="H9E0BC08DCD72403DAECA1A602371C3FF"><enum>(2)</enum><text display-inline="yes-display-inline">Possess sufficient operational authority to effectuate implementation of Government service delivery improvements within the agency, particularly with respect to high impact service providers.</text></paragraph><paragraph id="H11FF6E1771F248A79CCF7F6A6D21F463"><enum>(3)</enum><text display-inline="yes-display-inline">Coordinate and execute, as appropriate, under the direction of the head of the agency, and in collaboration with relevant agency officials as appropriate, efforts to improve and enhance the Government service delivery and Government service delivery channels of the agency.</text></paragraph><paragraph id="HFEDA9317F6F94E5D82C7D2B31B99BECF"><enum>(4)</enum><text display-inline="yes-display-inline">At the direction of the Federal Government Service Delivery Lead, submit an implementation plan for improving agency Government service delivery.</text></paragraph><paragraph id="H3B3EFEDA86E34E58AAE27045357D0589"><enum>(5)</enum><text display-inline="yes-display-inline">Coordinate the collection and reporting of the data and information required pursuant to section 322 and use such data and information to improve Government service delivery.</text></paragraph><paragraph id="H47F06DB5A332422F821DE982185C36F5"><enum>(6)</enum><text display-inline="yes-display-inline">Facilitate collaboration among and between offices, and components within the agency and with other agencies as appropriate, in coordination with the Federal Government Service Delivery Lead, to improve and enhance Government service delivery.</text></paragraph><paragraph id="HDB79048E7B464A1ABEF876121D21237D"><enum>(7)</enum><text>Assist with the implementation by the agency of the 21st Century Integrated Digital Experience Act (<external-xref legal-doc="usc" parsable-cite="usc/15/3501">15 U.S.C. 3501</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/115/336">Public Law 115–336</external-xref>).</text></paragraph><paragraph id="HE2159DCD5A1249B0811C461EFEBFB262"><enum>(8)</enum><text display-inline="yes-display-inline">Assist in the incorporation of the Government service delivery requirements established under this subchapter in agency plans (such as strategic plans or annual performance plans).</text></paragraph></subsection></section><section id="H5454049C547F40519A704E8236BD5785" commented="no"><enum>324.</enum><header>Rule of construction</header><text display-inline="no-display-inline">Nothing in this subchapter may be construed to diminish or reduce the authority of agency Chief Information Officers for information resources management provided in section 11315 of title 40 or those authorities to manage information resources to accomplish agency missions as established in section 3502 of title 44. </text></section></subchapter><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HFC23FEB707B04B57839889E5C3B55FA8" commented="no"><enum>(b)</enum><header>Clerical Amendment</header><text display-inline="yes-display-inline">The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/3">chapter 3</external-xref> of title 5, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" id="H0DD4E80EF73446299A2383E924CDF987" display-inline="no-display-inline"><toc container-level="quoted-block-container" quoted-block="no-quoted-block" lowest-level="section" idref="H3A4B312B9D514142B6895315CF3D11F6" regeneration="yes-regeneration" lowest-bolded-level="division-lowest-bolded"><toc-entry idref="H21EF1AF6EAA341CCA290414D867AE501" level="subchapter">Subchapter III—Federal Government Service Delivery</toc-entry><toc-entry idref="H7C75D6B28300457D8BE211BDCD734276" level="section">321. Rule of construction</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H9E4265EC90254390A24E7EAEBD4AA901" display-inline="no-display-inline"><enum>(c)</enum><header>GAO report</header><text display-inline="yes-display-inline">Not later than 2 years after the date of the enactment of this Act, the Comptroller General of the United States shall submit to the relevant congressional committees a report that includes the following:</text><paragraph id="H7314620818B8487EBDF5868A7ABC253D"><enum>(1)</enum><text>An assessment of the implementation and effectiveness of subchapter III of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/3">chapter 3</external-xref> of title 5, United States Code, as added by subsection (a).</text></paragraph><paragraph id="H97647B99E8DB4D7688A53572D41EF7E4"><enum>(2)</enum><text>Specific recommendations to further the implementation and effectiveness of such subchapter.</text></paragraph></subsection><subsection id="HA32715D657394DB9A713544FF6A517A8"><enum>(d)</enum><header>Agency report</header><text>Not later than 1 year after the date of the enactment of this Act, the Director of the Office of Management and Budget, in coordination with the Federal Government Service Delivery Lead, shall submit to the relevant congressional committees a report that includes the following:</text><paragraph id="HE0E6FA2736CF4B99988D8E319F3442D3"><enum>(1)</enum><text>An assessment on the implementation and effectiveness of subchapter III of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/3">chapter 3</external-xref> of title 5, United States Code, as added by subsection (a).</text></paragraph><paragraph id="HE576A02445584C0C969D260D5C489D17"><enum>(2)</enum><text>Specific recommendations to further the implementation and effectiveness of such subchapter.</text></paragraph><paragraph id="HC12A35250ECF46C19FB7BBFD61CC78D9"><enum>(3)</enum><text display-inline="yes-display-inline">A summary and assessment of the usefulness of the metrics such subchapter requires the Federal Government Service Delivery Lead to establish and report for the purpose of assessing the quality of Government service delivery provided by agencies, including metrics to assess the efforts of high impact service providers in improving services.</text></paragraph></subsection><subsection id="HD7EDE18C31F04B9CAEF504EB9CA5B163"><enum>(e)</enum><header>No new funds authorized</header><text>No new funds are authorized to be appropriated by this Act or any amendment made by this Act and the head of each agency shall comply with this Act and any amendment made by this Act using existing funds.</text></subsection><subsection id="H4059E0FCEAFC4F838F43EA2CBF03BC63"><enum>(f)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="H290A59F0D98B49F984DA51EB8362BDB5"><enum>(1)</enum><header>Agency</header><text display-inline="yes-display-inline">The term <term>agency</term> means each agency listed in section 3502 of title 44, United States Code.</text></paragraph><paragraph id="HD905B37A337044C18981D55AD2895D7C" commented="no"><enum>(2)</enum><header>Government service delivery; high impact service provider</header><text>The terms <term>Government service delivery</term> and <term>high impact service provider</term> have the meaning given those terms in section 321 of title 5, United States Code, as added by subsection (a). </text></paragraph><paragraph id="H8F7A4841436045CEB12CCB33A4905426"><enum>(3)</enum><header>Relevant congressional committees</header><text display-inline="yes-display-inline">The term <term>relevant congressional committees</term> means the Committee on Oversight and Accountability of the House of Representatives and the<pagebreak></pagebreak> Committee on Homeland Security and Governmental Affairs of the Senate. </text></paragraph></subsection></section></legis-body><attestation><attestation-group><attestation-date date="20240521" chamber="House">Passed the House of Representatives May 21, 2024.</attestation-date><attestor display="yes">Kevin F.
