<section id="HDEDA2507E84D44FA991DFF244B84D1ED" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Copyright Clause Restoration Act of 2023</short-title></quote>.</text></section> <section id="HD5A4029A45F04DAAAA9A72A44468EB56"><enum>2.</enum><header>Duration of copyright</header> <subsection id="HFA0ACA0C90A645188C2217D14DB243B3"><enum>(a)</enum><header>In general</header> <paragraph id="H2276009412E64ECF9CE893DFF8E9A095"><enum>(1)</enum><header>Original term</header><text>Notwithstanding any provision of title 17, United States Code, or any other provision of law, copyright in any work shall endure for 28 years from the date it was originally secured.</text></paragraph> 
<paragraph id="H51EA886187B345ADB5429792F8A85E1E"><enum>(2)</enum><header>Extension</header><text>The holder of a copyright under paragraph (1) shall be entitled to a renewal and extension of the copyright in the applicable work for a further term of 28 years if the holder applies for that renewal and extension during the 1-year period before the expiration of the original term of the copyright under that paragraph.</text></paragraph></subsection> <subsection id="H38D99DA76BEB41CFB454BA261D5558C0"><enum>(b)</enum><header>Application</header> <paragraph id="H25E81037713B43B387D62A56AAE929D7"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), subsection (a) shall apply with respect to copyright protection for any work fixed on or after the date of enactment of this Act.</text></paragraph> 
<paragraph id="H84A5683FA9B342CD8BC401D741A90861"><enum>(2)</enum><header>Retroactive effect</header> 
<subparagraph id="HF87B04A790014161BC3A5ACF72E4D70F"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), subsection (a) shall apply with respect to a copyright that, on any date on or after May 1, 2023, is owned by a person that— </text> <clause id="H8A2F27F28C2F4BE8801B14AC5DD54A9C"><enum>(i)</enum><text>has a market capitalization of more than $150,000,000,000; and</text></clause> 
<clause id="HA02464967AC0497B815773FC8CD0049F"><enum>(ii)</enum> 
<subclause commented="no" display-inline="yes-display-inline" id="HBA0A65140AF64DED89D54B277DFD7E53"><enum>(I)</enum><text>is classified under North American Industry Classification System code 5121 or 71; or</text></subclause> <subclause indent="up1" id="HC869E7350E584EFB8B98BA0C7A17B863"><enum>(II)</enum><text>engages in substantial activities for which a code described in subclause (I) could be assigned. </text></subclause></clause></subparagraph> 
<subparagraph id="HA89FCA556E4D4A21BB500751BA1CDF30"><enum>(B)</enum><header>Licensing</header><text>If, as of May 1, 2023, a person is operating under a license with respect to a copyright that is subject to subparagraph (A) and that, because of the application of that subparagraph, would expire during the 10-year period beginning on May 1, 2023, that person shall continue to hold the rights contained in that license (to the exclusion of any person not granted those rights by a license before May 1, 2023) for a period that is the shorter of— </text> <clause id="H53B08C43F01A4E7F94B8FDD3594ABA48"><enum>(i)</enum><text>50 percent of the remaining license term, as of May 1, 2023; or </text></clause> 
<clause id="H9A9FA713D8464170B95E6B19B62EC50C"><enum>(ii)</enum><text>10 years, beginning on May 1, 2023.</text></clause></subparagraph></paragraph></subsection></section> </legis-body></bill>
