which was referred to the <committee-name committee-id="HAG00">Committee on Agriculture</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Food Security Act of 1985 to increase payments for drought-resilient or water-saving practices and to provide additional payments for perennial production systems, and for other purposes.</official-title></form><legis-body id="HDA28CB314FD54CB0AD31EDFED21BF210" style="OLC"><section id="H9A080753341647EEAF63CD10C6D06247" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Support Water-Efficient Strategies and Technologies Act of 2023</short-title></quote>.</text></section><section id="HAD700843FB4D4243A1F099C1B1241F52"><enum>2.</enum><header>Support for drought-resilient and water-saving practices</header><subsection id="H231D52354A854B74A26BCE0C1B99C41A"><enum>(a)</enum><header>Increased payments for drought-Resilient or water-Saving practices</header><text display-inline="yes-display-inline">Section 1240B(d) of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3839aa-2">16 U.S.C. 3839aa–2(d)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H486BABAAAF87406F844B613CD1C0DC78" display-inline="no-display-inline"><paragraph id="H644FD114D30446D083ECB42DAF07985D"><enum>(8)</enum><header>Increased payments for drought-resilient or water-saving practices</header><subparagraph id="H958C5BA7D21948BAAA7D4CC0FDA88013"><enum>(A)</enum><header>In general</header><text>Notwithstanding paragraph (2), in the case of a practice described in subparagraph (B), the Secretary may increase the amount that would otherwise be provided for a practice under this subsection to not more than 85 percent of the costs associated with planning, design, materials, equipment, installation, labor, management, maintenance, or training.</text></subparagraph><subparagraph id="H9C263B6DF2E046D0B8BDC2AC0FCC0A45"><enum>(B)</enum><header>Practices</header><text>The practices eligible for increased payment amounts under subparagraph (A) are the following:</text><clause id="H12986F185BB74B368A79F1763B556380"><enum>(i)</enum><text>Drought-resilient practices that have the capacity to develop and produce on water-deficient environments on eligible lands, as determined by the Secretary.</text></clause><clause id="HB3E34F0DC98B48BEB70C21161DB418CF"><enum>(ii)</enum><text>Water-conserving practices that—</text><subclause id="H33DD7B3DDC6F4BA7B148CA2772B5511B"><enum>(I)</enum><text>conserve surface water or groundwater that result in a reduction of water use in the agricultural operation of an eligible land; or </text></subclause><subclause id="H6018BD3F0E4540199340B29533EC4680"><enum>(II)</enum><text>offer support to reduce runoff and increase the absorption of rain on eligible land.</text></subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="HFA9BE8BF148944E9B10F84E0216B97AC"><enum>3.</enum><header>Supplemental payments for resource-conserving management</header><subsection id="HBC3C4B5D735C40AFA93D68B418B87138"><enum>(a)</enum><header>Conservation stewardship payments</header><text display-inline="yes-display-inline">Section 1240L(c) of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3839aa-24">16 U.S.C. 3839aa–24(c)</external-xref>) is amended—</text><paragraph id="HF18F1563542E4CA5B7969A81CFCAB950"><enum>(1)</enum><text>in paragraph (1)—</text><subparagraph id="HE6F77C59BC314D18B1C0780917222035"><enum>(A)</enum><text>in subparagraph (A), by inserting <quote>on 1 or more land uses covered by the contract</quote> after <quote>activities</quote>; and</text></subparagraph><subparagraph id="HE0799FDCB1B94F7E93A41E4AD0B99A96"><enum>(B)</enum><text>in subparagraph (B), by striking <quote>improving, maintaining, and managing</quote> and inserting <quote>maintaining, actively managing, and improving</quote>; and</text></subparagraph></paragraph><paragraph id="H6D10728684074C3F85840D1CE081B20D"><enum>(2)</enum><text>in paragraph (2)—</text><subparagraph id="HB71923F3BF9E47089638FBE9EBEA52AF"><enum>(A)</enum><text>by amending subparagraph (B) to read as follows:</text><quoted-block style="OLC" id="H1CD2F11D71024607B2F74F3559756D16" display-inline="no-display-inline"><subparagraph id="HFA099FCB8CE84E35BCBD2A1D3DC47011"><enum>(B)</enum><text display-inline="yes-display-inline">Income forgone by the producer, including amounts that reflect—</text><clause id="HD2C08A3D536B4ECF8032C4F3AA7FB636"><enum>(i)</enum><text>increased economic risk; and</text></clause><clause id="HFD7F9752B3D54841AF07152622472FF9"><enum>(ii)</enum><text>loss in revenue due to—</text><subclause id="HF4F4B4F44A1C467A9CB631DBE7836ED5"><enum>(I)</enum><text>production changes;</text></subclause><subclause id="H4433EB6AD4FD45A7AA2A6CAAFF4B8AE2"><enum>(II)</enum><text>anticipated reductions in yield;</text></subclause><subclause id="H429CFFE1CF6245429C189355E891A162"><enum>(III)</enum><text>transitions to a resource-conserving cropping or grazing, or perennial production systems; or </text></subclause><subclause id="H96C93DAFCC0044B8AB2DE1C231FF077E"><enum>(IV)</enum><text>acreage converted to conserving uses.</text></subclause></clause></subparagraph><after-quoted-block>; and </after-quoted-block></quoted-block></subparagraph><subparagraph id="H05FC1680A0C445F2A459BE168C3030C8"><enum>(B)</enum><text>in subparagraph (E), by inserting <quote>, actively managed, and, where applicable, improved</quote> after <quote>maintained</quote>.</text></subparagraph></paragraph></subsection><subsection id="HE637EEF2E4764D2F94E25092478C8BDA"><enum>(b)</enum><header>Supplemental payments for resource-Conserving crop rotations and advanced grazing management</header><text display-inline="yes-display-inline">Section 1240L(d) of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3839aa-24">16 U.S.C. 3839aa–24(d)</external-xref>) is amended—</text><paragraph id="HF54088ABD9C94B3C89CF35BAF3BA5729"><enum>(1)</enum><text>in the subsection heading, by inserting <quote><header-in-text level="subsection" style="OLC">, perennial production systems,</header-in-text></quote> after <quote><header-in-text level="subsection" style="OLC">rotations</header-in-text></quote>;</text></paragraph><paragraph id="HA8AFC231B10C47F0B6BD2C607D694282"><enum>(2)</enum><text>in paragraph (1)—</text><subparagraph id="HC1C22CA7358C4CBBAB402EF87FE5B36E"><enum>(A)</enum><text>by redesignating subparagraph (C) as subparagraph (D); and</text></subparagraph><subparagraph id="H69A5A35C3057432EAB6F14C75D60ADCF"><enum>(B)</enum><text>by inserting after subparagraph (B) the following:</text><quoted-block style="OLC" id="H6349BE8DB0B7466B9B1D5CC64121CE68" display-inline="no-display-inline"><subparagraph id="H3A546CF2AA3343408C28BDEBDB8839CB"><enum>(C)</enum><header>Perennial production system</header><text display-inline="yes-display-inline">The term <term>perennial production system</term> means—</text><clause id="H27ED1870A92D44B59C2F11C529AD7B41"><enum>(i)</enum><text display-inline="yes-display-inline">the use of cropland for agroforestry, including alley cropping, silvopasture, and related perennial production systems, as determined by the Secretary;</text></clause><clause id="HE3C94CBF81F14AF499287074B366AA06"><enum>(ii)</enum><text display-inline="yes-display-inline">the use of woodland acres for agroforestry, including forest farming, multi-story cropping, and related perennial production systems, as determined by the Secretary; and</text></clause><clause id="HB26F23163B1546EF8B94FE3E5FD89A76"><enum>(iii)</enum><text display-inline="yes-display-inline">the use of cropland for perennial forages or perennial grain crops.</text></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H4AE296D8CEBB4762B5734F63A5D7F20B"><enum>(3)</enum><text>in paragraph (2)—</text><subparagraph id="HD992CB4877404EF2999E4F6CD80FFC77"><enum>(A)</enum><text>in subparagraph (A), by striking <quote>or</quote> at the end;</text></subparagraph><subparagraph id="HA2B0C14A1C824C3E908A5301DA0F90BF"><enum>(B)</enum><text>by redesignating subparagraph (B) as subparagraph (C); and</text></subparagraph><subparagraph id="H533262B23C9B46CEAA07A49381A2484E"><enum>(C)</enum><text>by inserting after subparagraph (A) the following:</text><quoted-block style="OLC" id="HFC24575A902B4AD2BCF663698C5A94C0" display-inline="no-display-inline"><subparagraph id="HA8B36E349EC84EAF890B018B00007BC2"><enum>(B)</enum><text display-inline="yes-display-inline">perennial production systems; or</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HB63107D003274882936024C0BC6C809E"><enum>(4)</enum><text>in paragraph (3), by inserting <quote>, perennial production systems,</quote> after <quote>rotations</quote>.</text></paragraph></subsection><subsection id="HFAC8A2BB0E754AB69A9B8DB15C744EF0"><enum>(c)</enum><header>Payment limitations</header><text display-inline="yes-display-inline">Section 1240L(f) of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3839aa-24">16 U.S.C. 3839aa–24(f)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" id="HDCC943CA09F2454A9199937F800D68BF" display-inline="no-display-inline"><subsection id="H9A10F113B89845E9ACAC15719512D0F4"><enum>(f)</enum><header>Payment limitations</header><text display-inline="yes-display-inline">A person or legal entity (including a joint venture and general partnership) may not receive, directly or indirectly, payments under the program that, in the aggregate, exceed $200,000 under all contracts entered into during any consecutive 5-year period, excluding funding arrangements with Indian tribes, regardless of the number of contracts entered into under the program by the person or legal entity.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H7AA9691BEF344C0EB700FA96899090C8"><enum>(d)</enum><header>Soil health</header><text display-inline="yes-display-inline">Section 1240L(k) of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3839aa-24">16 U.S.C. 3839aa–24(k)</external-xref>) is amended to read as follows: </text><quoted-block style="OLC" id="H15204ED60F094339AAAEF2D6EE5B1FF7" display-inline="no-display-inline"><subsection id="H77F0BE62175F48D9BDDED33DDC3D2FAC"><enum>(k)</enum><header>Soil health</header><text display-inline="yes-display-inline">To the maximum extent feasible, the Secretary shall manage the program to enhance soil health, including by—</text><paragraph id="H69D0FD955B994CB1BD3E94522AFD39A9"><enum>(1)</enum><text>conducting outreach to encourage the use of contracts to improve soil health and sequester carbon in the soil; and </text></paragraph><paragraph id="H4BDC112C0197471C92BC2076BF94FB05"><enum>(2)</enum><text>offering payments for soil testing to provide participants and the Secretary with information on the soil health and carbon sequestration impacts of conservation activities.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
