R. 5638</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20230921">September 21, 2023</action-date><action-desc><sponsor name-id="H001085">Ms. Houlahan</sponsor> (for herself and <cosponsor name-id="M001204">Mr. Meuser</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name>, and in addition to the Committee on <committee-name committee-id="HIF00">Energy and Commerce</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Secretary of Transportation to take certain actions with respect to Aldyl A Polyethylene piping, and for other purposes.</official-title></form><legis-body id="H0B289DADE8504EA8BA0C79CF2B6F9573" style="OLC"><section id="HA01284D256644F0484FFB5407D8F7749" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Aldyl A Hazard Reduction and Community Safety Act</short-title></quote>.</text></section><section id="H932EA406DC6946309404DBF6F5D8BD9C" section-type="subsequent-section"><enum>2.</enum><header>Identification and removal of Aldyl A Polyethylene piping</header><subsection id="H253D9EB1EED543568EA52F7C23A3A079"><enum>(a)</enum><header>Verification of aldyl A polyethylene piping</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary of Transportation shall require each owner or operator of a gas pipeline facility in class 3 and class 4 locations and class 1 and class 2 high consequence areas to conduct an assessment of pipeline facility records to determine the presence of Aldyl A polyethylene piping in active or inactive service.</text></subsection><subsection id="HEDC390B26B9F4A6984D2AEB70A4868F2"><enum>(b)</enum><header>Reporting</header><paragraph id="H84DDA38B438440F1A052468B0065B728"><enum>(1)</enum><header>Documentation of certain pipelines</header><text>Not later than 3 years after the date of enactment of this Act, the Secretary shall require each owner or operator of a pipeline facility described in subsection (a) to submit to the Secretary documentation of the total pipeline mileage and number of components identified by the owner or operator as Aldyl A polyethylene piping.</text></paragraph><paragraph id="H932F75FFF6E140B89106CF5093BE0409"><enum>(2)</enum><header>Insufficient documentation</header><text>The Secretary shall prescribe the methodology by which each owner or operator of a pipeline facility described in subsection (a) shall mitigate insufficient records necessary to identify each pipeline segment containing Aldyl A polyethylene piping. Such mitigation shall be completed not later than 3 years after the date of enactment of this Act.</text></paragraph></subsection><subsection id="H2354EF3C5A9E4BBAA8089D58438BA2C7"><enum>(c)</enum><header>Removal of aldyl A polyethylene piping</header><paragraph id="H3A3E13BE5DD44440BDF01F61C6F0AC32"><enum>(1)</enum><header>In general</header><text>Not later than 4 years after the date of enactment of this Act, the Secretary shall issue standards for the removal of Aldyl A polyethylene piping at all pressurized locations in gas pipeline facilities located in class 3 and class 4 locations and class 1 and class 2 high consequence areas.</text></paragraph><paragraph id="H1494C1AAACFC4E17A1EFAD4E5ABB8E9C"><enum>(2)</enum><header>Timing</header><text>In issuing standards under paragraph (1), the Secretary shall require the removal of Aldyl A polyethylene piping at all pressurized locations identified in paragraph (1) not later than 5 years following the date of enactment of this Act.</text></paragraph><paragraph id="H570F2C78FC584E1FA6B3A3A3811CC3F9"><enum>(3)</enum><header>Considerations</header><text>In developing the standards under paragraph (1), the Secretary shall coordinate with State regulators, as appropriate, to establish timeframes for the completion of the requirement in paragraph (1) that take into account potential consequences to public safety and the environment and that minimize costs and service disruptions.</text></paragraph></subsection><subsection id="HA7894C51104D4A639D0DB0764C99A412"><enum>(d)</enum><header>High-Consequence area defined</header><text>In this section, the term <quote>high consequence area</quote> means an area described in section 60109(a) of title 49, United States Code.</text></subsection></section></legis-body></bill>
