R. 5583</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20230920">September 20, 2023</action-date><action-desc><sponsor name-id="B001285">Ms. Brownley</sponsor> (for herself and <cosponsor name-id="C001061">Mr. Cleaver</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HAG00">Committee on Agriculture</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To establish an advisory panel to study the development of a climate-friendly certification for agricultural products, and for other purposes.</official-title></form><legis-body id="HDDC90B12216049239565406E43C37415" style="OLC"><section id="H111A0B665F584C82AE69596C40DE4CA6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Climate-Friendly Food Label Task Force Act</short-title></quote>. </text></section><section id="HD716D9E58DAC4C34B288D9733BDDACFD"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="H66E3A84A9B7743FE988DC7C3294FCDFC"><enum>(1)</enum><text display-inline="yes-display-inline">10 percent of the greenhouse gas emissions emitted by the United States come from the agricultural sector.</text></paragraph><paragraph id="H06058F967B8C404D94C1B849D3238390"><enum>(2)</enum><text>Sustainable agricultural practices that reduce greenhouse gas emissions and prevent deforestation will be critical to preventing the Earth from reaching 1.5 degrees Celsius warmer than pre-industrial levels, the threshold that would result in catastrophic climate-related effects.</text></paragraph><paragraph id="HA32285B7827D4EC2B23B6A6E2791AE55"><enum>(3)</enum><text>Improving the agricultural sector’s impact on the climate is a vital component of efforts by the U.S. to meet its contributions to the Paris Agreement.</text></paragraph><paragraph id="H200BC3A171A64C9AB1DDF57D3439D3B0"><enum>(4)</enum><text>The USDA Organic label represents a successful model for using voluntary, market-based approaches to driving innovation in the agricultural sector and successfully created a robust organic market in the United States.</text></paragraph><paragraph id="HF259813B3CD64812A0AD9A6738718BE3"><enum>(5)</enum><text>Market-based approaches like USDA Organic can spark significant economic benefits including jobs, and new, higher revenues for farmers.</text></paragraph><paragraph id="HB6F0A6080C974CC780A08F77183EB613"><enum>(6)</enum><text>In 2021, organic farming totaled $11,200,000,000 in sales, created opportunity for 17,445 organic farms, and 28 percent of organic farmers planned to continue to grow their level of organic production. A similar voluntary, market-based approach to climate-friendly agricultural practices could create comparable economic benefits for farmers and workers.</text></paragraph></section><section id="HB7302D935AAE4A3286379991FE7334AC"><enum>3.</enum><header>Study of climate-friendly certification for agricultural products</header><subsection id="H788CBD24BB76427B8B12BDB2247F3578"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">There is established an advisory panel to carry out the study described in subsection (c).</text></subsection><subsection id="H0BDC8DD006D84840B31A0503A6D8B731"><enum>(b)</enum><header>Members</header><text display-inline="yes-display-inline">The advisory panel established under subsection (a) shall be composed of members appointed by the Secretary of Agriculture and shall include—</text><paragraph id="H6C0F7481E27E4459A716EA116A583273"><enum>(1)</enum><text>representatives—</text><subparagraph id="HC05E5CFFA9714864BAA41BB5A7614354"><enum>(A)</enum><text display-inline="yes-display-inline">that are scientists, including experts on climate science and nutrition science;</text></subparagraph><subparagraph id="HC93F505A70A04877B25C51D48411ECD6"><enum>(B)</enum><text>of environmental advocacy organizations;</text></subparagraph><subparagraph id="H0AEEA2E1D26049F28A2999B2BE65E109"><enum>(C)</enum><text>of industry, including food manufacturing and farming; and</text></subparagraph><subparagraph id="H89D44283A51141DAA9F022F503D56DCF"><enum>(D)</enum><text>of other stakeholders, as the Secretary of Agriculture determines appropriate; and</text></subparagraph></paragraph><paragraph id="H7F1C4873CCC648CD8CAC8DE24D8EFED2"><enum>(2)</enum><text>at least one representative from each of the following:</text><subparagraph id="H9753F587423B427FBE2E12F2295108F1"><enum>(A)</enum><text>The Department of Agriculture.</text></subparagraph><subparagraph id="HB747C956C3E748E2AE1B12D7119B60CA"><enum>(B)</enum><text display-inline="yes-display-inline">The Environmental Protection Agency.</text></subparagraph><subparagraph id="H3D26D7F4A3924AF297E6B1DBF7855F05"><enum>(C)</enum><text display-inline="yes-display-inline">The Centers for Disease Control and Prevention.</text></subparagraph><subparagraph id="HCA6112F16B8E4710A1CF76F91234E7BB"><enum>(D)</enum><text>The Food and Drug Administration.</text></subparagraph><subparagraph id="HFAF18EFA8A114FA18B24B87C98FE50E9"><enum>(E)</enum><text>The National Academy of Sciences.</text></subparagraph><subparagraph id="H92999B2ECB7C41F6A2C40FB8EA22C329"><enum>(F)</enum><text>Any other Federal agency the Secretary of Agriculture determines appropriate.</text></subparagraph></paragraph></subsection><subsection id="HCF24609D744749319B589E5E83A47868"><enum>(c)</enum><header>Report required</header><text>Not later than 1 year after the date of the enactment of this Act, the panel shall submit to the Secretary of Agriculture and Congress a report that includes—</text><paragraph id="H8095C82A1A0F4D36883642B960B668E6"><enum>(1)</enum><text>recommendations regarding the development of a climate-friendly certification for agricultural products that—</text><subparagraph id="HB195998F552D43129720C5875D4B518B"><enum>(A)</enum><text display-inline="yes-display-inline">moves agricultural producers toward reducing greenhouse gas emissions on a life-cycle basis; and</text></subparagraph><subparagraph id="HFF3BAE33BFDB4D9589181C1B831AE3A5"><enum>(B)</enum><text display-inline="yes-display-inline">uses market-based approaches that allows for greater consumer choice and education; and</text></subparagraph></paragraph><paragraph id="H3BEEBDD280F5478593C37B0595BFD655"><enum>(2)</enum><text>how such a certification would measure—</text><subparagraph id="H3C13121C437442FE9E4FD70120C93066"><enum>(A)</enum><text>the life-cycle greenhouse gas emissions of agricultural products;</text></subparagraph><subparagraph id="H83F53F19F7734E6791F16E7827296678"><enum>(B)</enum><text>the water usage in production of agricultural products;</text></subparagraph><subparagraph id="H219273EA84C24892BBA9B3D6D0480021"><enum>(C)</enum><text>the land use effects of agricultural products; and</text></subparagraph><subparagraph id="H489DDA33F9A84614A13BB9ADD8D413CE"><enum>(D)</enum><text>any additional criteria the panel determines appropriate.</text></subparagraph></paragraph></subsection><subsection id="HC90E7A2DAE51490CA22D491C2F4EE240"><enum>(d)</enum><header>Publication</header><text>The Secretary of Agriculture shall make the report required under subsection (c) publicly available on the website of the Department of Agriculture.</text></subsection><subsection id="H93014973ACFA4D86BBAA01F7B81D44C7"><enum>(e)</enum><header>Moratorium on use of climate-Friendly certification during study</header><text>The Secretary of Agriculture may not issue any regulations or guidance or otherwise certify or advertise any agricultural product as climate-friendly before the date on which the report required under subsection (c) is submitted to Congress. </text></subsection></section></legis-body></bill>
