<section id="H6038086EDB5D46A38337F094553BFF97" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Child Care Assistance for Maternal Health Act</short-title></quote>.</text></section> <section id="HDF69E39506DC401DB5EA6416281505CD"><enum>2.</enum><header>Demonstration projects for child care to improve maternal health</header><text display-inline="no-display-inline">Subtitle A of title XX of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1397">42 U.S.C. 1397 et seq.</external-xref>) is amended by inserting after section 2009 the following:</text>

<section id="H0884F70EC1404D4AAA317AE138020EA1"><enum>2009A.</enum><header>Demonstration projects for child care to improve maternal health</header> 
<subsection id="HE8EDF886E6A14DE18CF83C93518B57FE"><enum>(a)</enum><header>In general</header> 
<paragraph id="HF5D7EE9583944D93ACEBF9B0E27239B4"><enum>(1)</enum><header>Establishment</header><text>The Secretary shall carry out a program of awarding grants, on a competitive basis, to eligible entities to conduct demonstration projects designed to support mothers and families during pregnancy, childbirth, and the postpartum period by increasing access to short-term child care (such as through crisis nurseries) in order to improve the physical health, mental health, and wellness of the mother and her family.</text></paragraph> <paragraph id="HAB597DED64714E239ABB12034961AB20"><enum>(2)</enum><header>Advisory group</header><text>The Secretary shall establish an advisory group to advise the Secretary on carrying out the program established under paragraph (1). The advisory group shall be composed of the following members:</text> 
<subparagraph id="HF052B8012A0240AB9ABD82A222C04837"><enum>(A)</enum><text>At least 1 representative of the Administration for Children and Families.</text></subparagraph> <subparagraph id="HD28D33E28572427CA4484CA9154D8897"><enum>(B)</enum><text>At least 1 representative of the Administration for Native Americans.</text></subparagraph> 
<subparagraph id="HECD1E7AFD7D24F3382B2044A905C6016"><enum>(C)</enum><text>At least 1 representative of the Centers for Medicare &amp; Medicaid Services.</text></subparagraph> <subparagraph id="HCBA7ECDCF8874B959CB443E2794BF0D4"><enum>(D)</enum><text>At least 1 representative of the Health Resources and Services Administration.</text></subparagraph> 
<subparagraph id="H80AAEFEBF88A41A9891EC3114C9B7E17"><enum>(E)</enum><text>At least 1 representative of the Substance Abuse and Mental Health Services Administration.</text></subparagraph> <subparagraph id="H7B49FD85248740A39EE8F7D0FA0BE4AB"><enum>(F)</enum><text>Representatives of such other Federal entities, as the Secretary determines appropriate.</text> </subparagraph></paragraph></subsection> 
<subsection id="H5F76C52A9C3043D0BEDF76C9B9599827"><enum>(b)</enum><header>Eligible entities</header><text>To be eligible to receive a grant under this section, an entity shall be—</text> <paragraph id="HE824CD8EFA9343ABADD248753781A5F8"><enum>(1)</enum><text>a State, a territory, or the District of Columbia;</text></paragraph> 
<paragraph id="HD9330F215B71486782733656CF16ED61"><enum>(2)</enum><text>an Indian Tribe or Tribal organization;</text></paragraph> <paragraph id="H104451627D08482B85F57E7048F6EB1E"><enum>(3)</enum><text>an Urban Indian organization;</text></paragraph> 
<paragraph id="H51D60770BE964F919E5E53D7411F0F63"><enum>(4)</enum><text>a public health department;</text></paragraph> <paragraph id="HC63A8993AFDD4CCDB589C96051EDA9AE"><enum>(5)</enum><text>a nonprofit community-based organization; or</text></paragraph> 
<paragraph id="HCE484A1C08FB4D73ADBA9AEF1C13D21E"><enum>(6)</enum><text>a consortium of entities described in any of paragraphs (1) through (5).</text></paragraph></subsection> <subsection id="HFAC12C7E18804D2C86E971D28C46552E"><enum>(c)</enum><header>Priority for awarding grants</header><text>In selecting grant recipients under this section, the Secretary shall—</text> 
<paragraph id="H5F78DFF9248049CCA599DE14B8607656"><enum>(1)</enum><text>give priority to—</text> <subparagraph id="HEB83973D88804431A0DFD2F2661B665E"><enum>(A)</enum><text>eligible entities that, in addition to the activities proposed to be funded through the grant, will provide families with assistance in attaining a long-term child care option;</text></subparagraph> 
<subparagraph id="H6DDFC026A89C46409ABEB54C01235713"><enum>(B)</enum><text display-inline="yes-display-inline">eligible entities proposing to serve an area with high rates of maternal mortality and poverty; and</text></subparagraph> <subparagraph id="H6B21AF6043054BBEB4A64473C3FA188D"><enum>(C)</enum><text>eligible entities proposing to serve a maternity care health professional target area identified under section 332(k) of the Public Health Service Act; and</text></subparagraph></paragraph> 
<paragraph id="HC7FCAE7AE74D426296239D601143D2E8"><enum>(2)</enum><text display-inline="yes-display-inline">award at least 1 grant to an Indian Tribe, a Tribal organization, or an Urban Indian organization.</text> </paragraph></subsection> <subsection id="H1FC8AC64C35645B8959DCA7B73DFF66C" commented="no"><enum>(d)</enum><header>Number</header> <paragraph id="H14FC73EDF98B4EED815E4E71B7AC64AE" commented="no"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to paragraph (2), the Secretary shall award at least 10 grants under this section.</text></paragraph> 
<paragraph id="HF70A51DB6B84479DBB7E19C4E07A29AF" commented="no"><enum>(2)</enum><header>Exception for insufficient appropriations</header><text>The Secretary may award fewer than 10 grants if the Secretary determines that the amounts made available to carry out this section are less than the total amounts authorized to be appropriated by subsection (i).</text> </paragraph></subsection> <subsection id="H7DF5DC9EBDED46208EFA1C64FA4C8382"><enum>(e)</enum><header>Demonstration project requirements</header> <paragraph id="HAB490E8E6A614E0C9855D10438075913" commented="no"><enum>(1)</enum><header>Use of funds</header><text>A grant awarded under this section may be used—</text> 
<subparagraph id="H52C64CE851C54430B04DC33A5E560744" commented="no"><enum>(A)</enum><text>to conduct a demonstration project described in subsection (a);</text></subparagraph> <subparagraph id="H469BBF12D04E44178EC52DC630F161F3" commented="no"><enum>(B)</enum><text>to assess community needs in preparation for such demonstration project; and</text></subparagraph> 
<subparagraph id="HB3EBA328F8FA4E398B8DB08A0102F563" commented="no"><enum>(C)</enum><text>to fund outreach related to such demonstration project.</text> </subparagraph></paragraph> <paragraph id="H88B66B2F7B084C669AF51AAE72D3CBAA"><enum>(2)</enum><header>Duration</header><text>A demonstration project under this section shall be for a period of not less than 3 years.</text></paragraph> 
<paragraph id="H772969173EDD4FAEADF9D6EC9BDD82C6"><enum>(3)</enum><header>Reports by grantees</header> 
<subparagraph id="HAB48487E4C734A89A4C8C8AE491666B3"><enum>(A)</enum><header>Interim and final reports</header><text>A grantee under this section shall agree to submit to the Secretary—</text> <clause id="H0624C06E1803429BAF6916A91DA31421"><enum>(i)</enum><text>interim reports on the demonstration project funded through the grant; and</text></clause> 
<clause id="H60A38DC5DF8A4A31B009AD4D21A29F1D"><enum>(ii)</enum><text>a final report on such demonstration project.</text></clause></subparagraph> <subparagraph id="H0268D8732AA942309259C5C44CBA2B07"><enum>(B)</enum><header>Contents</header><text>The interim and final reports of a grantee under subparagraph (A) shall include assessments of the effectiveness of the grantee’s demonstration project with respect to—</text> 
<clause id="H38CF2FDF3C854F46A1F29FF8CECA08FD"><enum>(i)</enum><text>maternal and child health outcomes;</text></clause> <clause id="HB45DD64F7A1945668287DB9C58B851E9"><enum>(ii)</enum><text>child care quality; and</text></clause> 
<clause id="H04FA94BDB7F74B988AC1D80C95F01738"><enum>(iii)</enum><text>such other metrics as may be determined by the Secretary.</text></clause></subparagraph></paragraph> <paragraph id="H21F7602ED1FA4EBF8A47798390A25D7F"><enum>(4)</enum><header>Priority for providing services</header><text display-inline="yes-display-inline">In providing services through a demonstration project under this section, a grantee shall give priority to vulnerable populations, such as—</text> 
<subparagraph id="H144E8A6E1B45426DA63ECD5B66E223FC"><enum>(A)</enum><text>low-income families;</text></subparagraph> <subparagraph id="H7BC4E3571504477FB48AF811B1E0C373"><enum>(B)</enum><text>families experiencing homelessness;</text></subparagraph> 
<subparagraph id="HC3D0D2723DF646D3902320F25B2F6E7F"><enum>(C)</enum><text>single-parent households;</text></subparagraph> <subparagraph id="H58443B67A6EB4E8496A0CF3B99198835"><enum>(D)</enum><text>families who have children with disabilities or special health care needs; and</text></subparagraph> 
<subparagraph id="HB2B73CFA87CA4043A3692A2F48ABEBBB"><enum>(E)</enum><text>other vulnerable populations as may be determined by the Secretary.</text></subparagraph></paragraph> <paragraph id="H806A8E31A7E048439EBDDFA39B8D2426" commented="no"><enum>(5)</enum><header>Subgrants and contracts</header> <subparagraph id="HF9AF423D60AB46959941C0CECFFB5D68" commented="no"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">A grantee under this section may coordinate with entities described in subparagraph (B) in carrying out a demonstration project under this section, including by awarding subgrants to, or entering into contracts with, such entities.</text></subparagraph> 
<subparagraph id="HB514F932160D44F4863063FC44F623CC" commented="no"><enum>(B)</enum><header>Entities</header><text>The entities described in this subparagraph are the following:</text> <clause id="H24CCEE83309E4B6F825BD18AC6C561B5" commented="no"><enum>(i)</enum><text>State or local child care resource and referral agencies.</text></clause> 
<clause id="HF328D1D3051441798F7C049D0C607151" commented="no"><enum>(ii)</enum><text>Prenatal, perinatal, pediatric, family medicine, and other relevant health care providers.</text></clause> <clause id="HE356DAA6B8724DD0839C074695AA9577" commented="no"><enum>(iii)</enum><text>Doula support services.</text> </clause></subparagraph></paragraph> 
<paragraph id="HE942CC8D47E849C6A8661D8D69A66C85" commented="no"><enum>(6)</enum><header>State and local requirements</header> 
<subparagraph id="H071CA3E392134278A5CB8A2F75544496" commented="no"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), services provided through a demonstration project under this section shall meet the applicable requirements of State and local law in the jurisdiction in which such services are provided, including any applicable licensure and quality of care requirements.</text></subparagraph> <subparagraph id="H878526A548144DC4997B230E16CF7F9F" commented="no"><enum>(B)</enum><header>Exception</header><text>Child care may be provided through a demonstration project under this section to children younger than the minimum age allowed under applicable State or local licensing requirements, so long as the grantee providing such child care (either directly or through a subgrant or contract under paragraph (5)) coordinates with the applicable jurisdiction to ensure appropriate quality of care standards.</text> </subparagraph></paragraph></subsection> 
<subsection id="HFD62E930AF8248BBA853EF6D46C98DC0"><enum>(f)</enum><header>Evaluation</header><text>The Secretary shall—</text> <paragraph id="H1B2D3187A5674BFDAF82B04586C3FB35"><enum>(1)</enum><text>evaluate the demonstration projects funded under this section; and</text></paragraph> 
<paragraph id="H76B4D0B5EE4744E08109A5A0AE070443"><enum>(2)</enum><text>as part of such evaluation—</text> <subparagraph id="H856139FF7EB44647AC68B05E11E66980"><enum>(A)</enum><text>identify successful activities for improving maternal health outcomes and health outcomes for the birthed child and any other children in the family; and</text></subparagraph> 
<subparagraph id="H9671FB9594414D38BC08698A02131C84"><enum>(B)</enum><text>formulate recommendations for reauthorizing the program under this section.</text></subparagraph></paragraph></subsection> <subsection id="H1F04FFE22470430AA8AEB2948B64A28E"><enum>(g)</enum><header>Reports to Congress</header><text>The Secretary shall submit reports to the Congress on the program under this section, including—</text> 
<paragraph id="H55E5A4E0B82945FDB6956ADC93380243"><enum>(1)</enum><text>interim reports; and</text></paragraph> <paragraph id="H624A4BE4E5864D0A90242E7524496BAB"><enum>(2)</enum><text>based on the evaluation under subsection (f), a final report.</text></paragraph></subsection> 
<subsection id="H90122AA1DDED4EEAA4289BA19BEF83B6" commented="no"><enum>(h)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="H5D8473ED238343AEAB4CF9934FE7646B" commented="no"><enum>(1)</enum><header>IHCIA terms</header><text display-inline="yes-display-inline">The terms <term>Indian Tribe</term>, <term>Tribal organization</term>, and <term>Urban Indian organization</term> have the meanings given the terms <term>Indian tribe</term>, <term>tribal organization</term>, and <term>Urban Indian organization</term>, respectively, in section 4 of the Indian Health Care Improvement Act.</text></paragraph> 
<paragraph id="H16DE6BCE4F254BE0BFA17CD51A2CBBDC" commented="no"><enum>(2)</enum><header>Postpartum period</header><text>The term <term>postpartum period</term> means the first year after an individual has given birth.</text></paragraph> <paragraph id="HBC159E606D0D49888C0FAC99FD44EC1F" commented="no"><enum>(3)</enum><header>Short-term child care</header><text>The term <term>short-term child care</term>—</text> 
<subparagraph id="H55617337B22345D3AA4B55C928A3342F"><enum>(A)</enum><text display-inline="yes-display-inline">means child care provided during pregnancy, childbirth, or the postpartum period—</text> <clause id="HBCF4CBC898E8437E8F1018432263C1B5" commented="no"><enum>(i)</enum><text>for a limited duration; and</text></clause> 
<clause id="HE1DF2B16C7E04331893880E31F101330" commented="no"><enum>(ii)</enum><text>for the birthed child or any other child in the family; and</text></clause></subparagraph> <subparagraph id="H080442A88DA24758BE3ED671F2BF1954"><enum>(B)</enum><text>includes respite child care.</text></subparagraph></paragraph> </subsection> 
<subsection id="H283FE6EC38B145CABCCD065E121536C2"><enum>(i)</enum><header>Authorization of appropriations</header> 
<paragraph id="HF2CDCEC713C94DDB92DBCA72D5CEADD5"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), there is authorized to be appropriated to carry out this section $5,000,000 for each of fiscal years 2024 through 2026.</text></paragraph> <paragraph id="HF667B40BF51C4AE485E382E134C967CB"><enum>(2)</enum><header>Evaluation</header><text>Of the funds appropriated to carry out this section under paragraph (1), not more than 5 percent may be used to fund the evaluation under subsection (f).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </section>
