<section id="HDE9E2211F5404508873BCE9D6F74FC81" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Native American Health Savings Improvement Act</short-title></quote>.</text></section> <section commented="no" display-inline="no-display-inline" id="H60B5BBB07B514003B8DB82B609F9C9BA"><enum>2.</enum><header>Individuals eligible for Indian Health Service assistance not disqualified from health savings accounts</header> <subsection commented="no" display-inline="no-display-inline" id="H095BC476B54F44FDA140F92BF6B6A055"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/223">Section 223(c)(1)</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new subparagraph:</text>

<subparagraph id="HF02667D9987243AF88A4F8B52F285B10"><enum>(D)</enum><header>Special rule for individuals eligible for assistance under Indian Health Service programs</header><text>For purposes of subparagraph (A)(ii), an individual shall not be treated as covered under a health plan described in such subparagraph merely because the individual receives hospital care or medical services under a medical care program of the Indian Health Service or of a tribal organization.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection commented="no" display-inline="no-display-inline" id="H02B57F941D724B609F312CDBDE322544"><enum>(b)</enum><header>Effective date</header><text>The amendment made by this section shall apply to taxable years beginning after December 31, 2023.</text></subsection></section>
