Chafee Coastal Barrier Resources System maps.<enum>I</enum><header>Coastal Barrier Resources Act Amendments</header><section id="H0054898F6C9941928A338830BBCB77FD" section-type="subsequent-section"><enum>101.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 3 of the Coastal Barrier Resources Act (<external-xref legal-doc="usc" parsable-cite="usc/16/3502">16 U.S.C. 3502</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HFE44EA51E63740FA8612342B9CBDF75F" changed="added" reported-display-style="italic" committee-id="HII00"><section id="H08AB95700CA14BBAA8A8BAB2C36C66D3"><enum>3.</enum><header>Definitions</header><subsection id="H4F9479844B8241D2ACB4CC644836E5BD"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">For purposes of this Act:</text><paragraph id="HD6A395F1C953405E9422C9F3C9F5992F"><enum>(1)</enum><header>Coastal barrier</header><text>The term <term>coastal barrier</term> means—</text><subparagraph id="HAB80E520C54F447AAA1F2E790337B887"><enum>(A)</enum><text display-inline="yes-display-inline">a depositional geologic feature (such as a bay barrier, tombolo, barrier spit, bluff, or barrier island) that—</text><clause id="HFF3EDB59A6694CAEBD3E1C7E456B359A"><enum>(i)</enum><text>is subject to wave, tidal, and wind energies; and</text></clause><clause id="H8E71700D1D8F484694E88F89444D7116"><enum>(ii)</enum><text>protects landward aquatic habitats from direct wave attack; and</text></clause></subparagraph><subparagraph id="HC58DD8E1026840DC84ED98852A20F2ED" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">all associated aquatic habitats including the adjacent wetlands, marshes, estuaries, inlets, and nearshore waters.</text></subparagraph></paragraph><paragraph id="H24B831FCE9DD4F559B133EE73085A1DA"><enum>(2)</enum><header>Committees</header><text>The term <term>Committees</term> means the Committee on Natural Resources of the House of Representatives and the Committee on Environment and Public Works of the Senate.</text></paragraph><paragraph id="H2D836FA7F76C425F90670573A6FCE743"><enum>(3)</enum><header>Financial assistance</header><subparagraph id="H20FAC05ADC55439D8D28F23E5E838436"><enum>(A)</enum><header>In general</header><text>The term <term>financial assistance</term> means any form of loan, grant, guaranty, insurance, payment, rebate, subsidy, or any other form of direct or indirect Federal assistance other than—</text><clause id="HBF5AF65DF8CD4A37B1F7A6D27DCAF9A3"><enum>(i)</enum><text>deposit or account insurance for customers of banks, savings and loan associations, credit unions, or similar institutions;</text></clause><clause id="HA2D2D681F58A430EAAF6918B110B6F3D"><enum>(ii)</enum><text>the purchase of mortgages or loans by the Government National Mortgage Association, the Federal National Mortgage Association, or the Federal Home Loan Mortgage Corporation;</text></clause><clause id="H410A0F95CC244C5CB27797B921D113D2"><enum>(iii)</enum><text>assistance for environmental studies, planning, and assessments that are required incident to the issuance of permits or other authorizations under Federal law; and</text></clause><clause id="H4B35432E89BE4EA4AB2B3DE5B1495227"><enum>(iv)</enum><text>assistance pursuant to programs entirely unrelated to development, such as any Federal or federally assisted public assistance program or any Federal old-age survivors or disability insurance program.</text></clause></subparagraph><subparagraph id="H5F78528ED54F4772A574B210D7C3F325"><enum>(B)</enum><header>Flood insurance</header><text>The term <term>financial assistance</term> includes flood insurance described in section 1321 of the National Flood Insurance Act of 1968, as amended (<external-xref legal-doc="usc" parsable-cite="usc/42/4028">42 U.S.C. 4028</external-xref>).</text></subparagraph></paragraph><paragraph id="H7CEB781E736D47B3B015D1E66C333D43"><enum>(4)</enum><header>Great Lakes</header><text>The term <term>Great Lakes</term> means Lake Ontario, Lake Erie, Lake Huron, Lake St. Clair, Lake Michigan, and Lake Superior, to the extent that those lakes are subject to the jurisdiction of the United States.</text></paragraph><paragraph id="H57133ED46C8949AEB22F8E864F92C739"><enum>(5)</enum><header>Otherwise Protected Area</header><subparagraph id="HD8AE909F4907466BB0A546A3C6D6B524"><enum>(A)</enum><header>In general</header><text>The term <term>Otherwise Protected Area</term> means any unit of the System that, at the time of designation, was predominantly composed of areas established under Federal, State, or local law, or held by a qualified organization, primarily for wildlife refuge, wildlife sanctuary, recreational, or natural resource conservation purposes.</text></subparagraph><subparagraph id="H965A6A4AE7ED42D9AE9551C0E5A33790"><enum>(B)</enum><header>Qualified organization</header><text>For purposes of subparagraph (A), the term <term>qualified organization</term> has the meaning given the term in <external-xref legal-doc="usc" parsable-cite="usc/26/170">section 170(h)(3)</external-xref> of the Internal Revenue Code of 1986.</text></subparagraph></paragraph><paragraph id="H76F6F2F8C61C4FA1B8DBBD26F3465D8D"><enum>(6)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph><paragraph id="H9F1FA0B405824F1896967AA8E16DF43B"><enum>(7)</enum><header>System</header><text>The term <term>System</term> means the John H. Chafee Coastal Barrier Resources System established under section 4(a). </text></paragraph><paragraph id="H9B29A14C576F4D3A9B2C4A11E99C24A4"><enum>(8)</enum><header>System unit</header><text>The term <term>System unit</term> means any undeveloped coastal barrier, or combination of closely-related undeveloped coastal barriers, included within the John H. Chafee Coastal Barrier Resources System established under section 4(a).</text></paragraph><paragraph id="HEE01F7BEE9D9457BA1E04DC02E0B0B4A"><enum>(9)</enum><header>Undeveloped coastal barrier</header><text>The term <term>undeveloped coastal barrier</term> means a coastal barrier the features and associated habitats of which contain few manmade structures and these structures, and man’s activities on such features and within such habitats, do not significantly impede geomorphic and ecological processes.</text></paragraph></subsection><subsection id="H1AF14E6C838941D18094F6189FC81633"><enum>(b)</enum><header>Savings clause</header><text display-inline="yes-display-inline">Nothing in this section supersedes the official maps described in section 4(a).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H247315227A3C43F7B0A2DA3083B4634F"><enum>102.</enum><header>John H. Chafee Coastal Barrier Resources System</header><text display-inline="no-display-inline">Section 4 of the Coastal Barrier Resources Act (<external-xref legal-doc="usc" parsable-cite="usc/16/3503">16 U.S.C. 3503</external-xref>) is amended—</text><paragraph id="H4B2ECC9CF77D4D6BA1DE64D72D4DBF31"><enum>(1)</enum><text>in subsection (a), to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HB301535FE3D044E3A4AA6F85AC26FCA1" changed="added" reported-display-style="italic" committee-id="HII00"><subsection id="H8FAD1B05A40F479AA093EA6F96A6B995"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">There is established the John H. Chafee Coastal Barrier Resources System, which shall consist of those undeveloped coastal barriers and other areas located on the coasts of the United States that are identified and generally depicted as System units or Otherwise Protected Areas—</text><paragraph id="HA366751CB970417FA0EC5E4DBE8069DA"><enum>(1)</enum><text>on the maps on file with the Secretary entitled <quote>Coastal Barrier Resources System</quote>, dated October 24, 1990;</text></paragraph><paragraph id="H5A5F99134D7A4CA2AC73A1C4320A1A1D"><enum>(2)</enum><text>on a map described in section 201(b) of the <short-title>Bolstering Ecosystems Against Coastal Harm Act</short-title>; or</text></paragraph><paragraph id="HDB2BF29F1D82407EBA99387A0566756E"><enum>(3)</enum><text>on a map described in paragraph (1) or (2) as such map may be replaced, modified, revised, or corrected under—</text><subparagraph id="HBE3F3A75340244EF8432353979037BFA"><enum>(A)</enum><text display-inline="yes-display-inline">subsection (f)(3);</text></subparagraph><subparagraph id="HE1E57288150C411EAD7BC97D3F1D5297"><enum>(B)</enum><text>section 4 of the Coastal Barrier Improvement Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/16/3503">16 U.S.C. 3503</external-xref> note); or</text></subparagraph><subparagraph id="H36F359D95A8D4FA4BEA6218079AA44BF"><enum>(C)</enum><text>any other provision of law enacted on or after November 16, 1990, that specifically replaces or authorizes the modification, revision, or correction of such a map.</text></subparagraph></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="H84EC3ECE6F114DAF89F8B255E046D009"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (e), by striking <quote>undeveloped</quote> each place it appears; and</text></paragraph><paragraph id="H68F9C7529A224D73ABD1C4706D754E9D"><enum>(3)</enum><text display-inline="yes-display-inline">in subsection (f)(2), in the matter preceding subparagraph (A), by striking <quote>copy of the map</quote> and inserting <quote>notification of the availability of the map</quote>.</text></paragraph></section><section id="HBA39C28EEC004481995251B56D7CE1F8"><enum>103.</enum><header>Require disclosure to prospective buyers that property is in System</header><text display-inline="no-display-inline">Section 5 of the Coastal Barrier Resources Act (<external-xref legal-doc="usc" parsable-cite="usc/16/3504">16 U.S.C. 3504</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="HA2A0EFE13AA941CFA137D49A309EFF2E" changed="added" reported-display-style="italic" committee-id="HII00"><subsection id="H1F0C2817A1964FF99E8988058A0E44A2"><enum>(c)</enum><header>Disclosure of limitations</header><text display-inline="yes-display-inline">Not later than 2 years after the date of the enactment of the <short-title>Bolstering Ecosystems Against Coastal Harm Act</short-title>, the Secretary, in consultation with the Secretary of Housing and Urban Development, shall issue regulations requiring the owner or lessor of real property located in a community affected by this Act, as determined by the Director of the United States Fish and Wildlife Service, to disclose to a prospective buyer or lessee such location of such real property.</text></subsection><after-quoted-block>. </after-quoted-block></quoted-block></section><section id="HE4E7F7F76E304B42B99119155A0CBFA2"><enum>104.</enum><header>Exceptions to limitations on expenditures</header><text display-inline="no-display-inline">Section 6 of the Coastal Barrier Resources Act (<external-xref legal-doc="usc" parsable-cite="usc/16/3505">16 U.S.C. 3505</external-xref>) is amended—</text><paragraph id="H72C885CA70E14BD9887C88C3AE9C9779"><enum>(1)</enum><text>in subsection (a)(6)(E), to read as follows:</text><quoted-block style="OLC" id="H4FA40D4F908E46B9BA8391F99581178A" changed="added" reported-display-style="italic" committee-id="HII00"><subparagraph id="H103B5114830149B39FEF9D4E2309F637"><enum>(E)</enum><text>Emergency actions necessary to the saving of lives and the protection of property and the public health and safety, if such actions are performed pursuant to sections 402, 403, 407, and 502 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170a">42 U.S.C. 5170a</external-xref>, 5170b, 5173, 5192) and are limited to actions that are necessary to alleviate the applicable emergency.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H92B93664026B46C3B4EAAA6B41800EC8"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HA541A522B01D41278896825C9ADC2168" changed="added" reported-display-style="italic" committee-id="HII00"><subsection id="HB1DF49D5B48A4E70BEBFFEBE8AACB7E9"><enum>(e)</enum><header>Applicability to Otherwise Protected Areas</header><paragraph id="HD6F1A6B6F57C4B24ADB95B78E791CB5C"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The prohibitions on new Federal expenditures and financial assistance described in section 5(a) do not apply within Otherwise Protected Areas except with respect to limitations on new flood insurance coverage described in section 1321 of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4028">42 U.S.C. 4028</external-xref>).</text></paragraph><paragraph id="HD720BF10C0734530A89D04403CA6C406"><enum>(2)</enum><header>Exception</header><text display-inline="yes-display-inline">Notwithstanding paragraph (1), new Federal flood insurance may be provided for a structure in an Otherwise Protected Area that is used in a manner consistent with the purpose for which such Otherwise Protected Area is protected.</text></paragraph></subsection><subsection id="H367D96B3EA014449B0A8ABE1DAB9DC98"><enum>(f)</enum><header>Applicability to additions and insurable structures</header><paragraph id="HDE2F44486C474435854B0BD2B4AB7E76"><enum>(1)</enum><header>Additions</header><text display-inline="yes-display-inline">With respect to an addition to the System made under section 4 on or after the date of the enactment of the <short-title>Bolstering Ecosystems Against Coastal Harm Act</short-title>, subject to paragraph (2), the prohibitions on new Federal expenditures and financial assistance described in section 5(a) and section 1321 of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4028">42 U.S.C. 4028</external-xref>) shall take effect on the date that is 1 year after the date on which such addition is made.</text></paragraph><paragraph id="H2CF4FAF5C5D140EAA57DAF6EE83BB18E"><enum>(2)</enum><header>Insurable structures</header><subparagraph id="HA721F04BB4834BF2A79AF81200ED61AA"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The prohibitions on new Federal expenditures and financial assistance described in section 5(a) and section 1321 of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4028">42 U.S.C. 4028</external-xref>) do not apply to an insurable structure.</text></subparagraph><subparagraph id="HB2EA05B2BF0C4072BA61E4D608816B98"><enum>(B)</enum><header>Insurable structure defined</header><text>In this subsection, the term <term>insurable structure</term> means an insurable structure that is—</text><clause id="H04F7D7AB3A85468C83E04BC3711F9CAE"><enum>(i)</enum><text>located within an addition described in paragraph (1); and</text></clause><clause id="H28B99B0BA69F4B83B1FF3273FC9CD5E8"><enum>(ii)</enum><text>in existence before the expiration of the applicable 1-year period described in paragraph (1).</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H28820FC5527F412795CA3AE7EF7ED61F"><enum>105.</enum><header>Improve Federal agency compliance with Coastal Barrier Resources Act</header><text display-inline="no-display-inline">Section 7(a) of the Coastal Barrier Resources Act (<external-xref legal-doc="usc" parsable-cite="usc/16/3506">16 U.S.C. 3506(a)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" id="HB601F409DFEA4CA6A977A4556C97D1A1" changed="added" reported-display-style="italic" committee-id="HII00"><subsection id="H9106D9FF681F40EDBED9D6D8D5A5DD00"><enum>(a)</enum><header>Regulations</header><text>Not later than 1 year after the date of the enactment of the <short-title>Bolstering Ecosystems Against Coastal Harm Act</short-title>, the head of each Federal agency affected by this Act shall revise or issue regulations and guidance as necessary to ensure compliance with the provisions of this Act.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HC47DFF530E2C4FBCB457C1057D7E71FF"><enum>106.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">Section 10 of the Coastal Barrier Resources Act (<external-xref legal-doc="usc" parsable-cite="usc/16/3510">16 U.S.C. 3510</external-xref>) is amended by striking <quote>2010</quote> and inserting <quote>2031</quote>.</text></section><enum>II</enum><header>Changes to John H. Chafee Coastal Barrier Resources System Maps</header><section id="HA4497375D5C74478B829921C8F86A43A"><enum>201.</enum><header>Changes to John H. Chafee Coastal Barrier Resources System maps</header><subsection id="H656891A2FFEE41AEA04C575FF42D0D68"><enum>(a)</enum><header>Replacement maps described</header><text display-inline="yes-display-inline">Each map included in the set of maps referred to in section 4(a) of the Coastal Barrier Resources Act (<external-xref legal-doc="usc" parsable-cite="usc/16/3503">16 U.S.C. 3503(a)</external-xref>), as amended by this Act, that relates to a unit of the John H. Chafee Coastal Barrier Resources System established by section 4 of the Coastal Barrier Resources Act (<external-xref legal-doc="usc" parsable-cite="usc/16/3503">16 U.S.C. 3503</external-xref>) (in this section referred to as the <quote>System</quote>) referred to in this subsection is replaced in such set with the map described in the following list with respect to that unit and any other new,
