Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5133">42 U.S.C. 5133</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="HD2B1DFDC527C46B6911FEA9AA4B5F225" display-inline="no-display-inline" changed="deleted" reported-display-style="strikethrough" committee-id="SSGA00"><subsection id="HDBF66233B2F049E5B6F1C492DBAF5700"><enum>(m)</enum><header>Latest published editions</header><text display-inline="yes-display-inline">For purposes of subsections (e)(1)(B)(iv) and (g)(10), the term <quote>latest published editions</quote> means, with respect to relevant consensus-based codes, specifications, and standards, the 2 most recently published editions.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HCCA7343A2FC1497A85B822D7A8C22630" changed="deleted" reported-display-style="strikethrough" committee-id="SSGA00"><enum>3.</enum><header>Hazard mitigation revolving loan fund program</header><text display-inline="no-display-inline">Section 205(f)(5) of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5135">42 U.S.C. 5135(f)(5)</external-xref>) is amended—</text><paragraph id="HC2B91C0A9504413A8DC4A16802C9F386"><enum>(1)</enum><text>in the paragraph heading by striking <quote><header-in-text level="paragraph" style="OLC">Establishing</header-in-text></quote> and insert <quote><header-in-text level="paragraph" style="OLC">Implementing</header-in-text></quote>;</text></paragraph><paragraph id="H04F374A59FD94AB9B505222B2AB4A437"><enum>(2)</enum><text>by striking <quote>establish</quote> and insert <quote>implement</quote>;</text></paragraph><paragraph id="HD793FBE097D34A1189C409D0096C37DF"><enum>(3)</enum><text>by inserting <quote>2</quote> after <quote>latest</quote>; and</text></paragraph><paragraph id="H24DE304D08D54DEAA7DEAD6F020D9757"><enum>(4)</enum><text>by inserting <quote>, including any amendments made by State, local, Tribal, or territorial governments to such codes, specifications, and standards,</quote> after <quote>standards</quote>. </text></paragraph></section><section id="H7443CF3E9F0A453384DEB364776D9296" commented="no" section-type="subsequent-section" display-inline="no-display-inline" changed="deleted" reported-display-style="strikethrough" committee-id="SSGA00"><enum>4.</enum><header>Residential retrofit and resilience pilot program</header><subsection id="H1EE63D9F748E49FE9F32C1464DCB7B4A" commented="no"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Administrator of the Federal Emergency Management Agency shall carry out a residential resilience pilot program through the program established under section 203 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5133">42 U.S.C. 5133</external-xref>) to make available assistance to States and local governments for the purpose of providing grants to individuals for residential resilience retrofits.</text></subsection><subsection id="H8AA9866B69D047E4AAA89AB6E9C985AF" commented="no"><enum>(b)</enum><header>Amount of funds</header><text display-inline="yes-display-inline">The Administrator may use not more than 10 percent of the assistance made available to applicants on an annual basis under section 203 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5133">42 U.S.C. 5133</external-xref>) to provide assistance under this section. </text></subsection><subsection id="H60D74F4463A84BCEA3D6BBA8CF8B81BD"><enum>(c)</enum><header>Timeline</header><text display-inline="yes-display-inline">The Administrator shall establish the pilot program under this section not later than 1 year after the date of enactment of this Act and the program shall terminate on September 30, 2026.</text></subsection><subsection id="HE70DD2E5A58C471DA66B492C9AC3373F"><enum>(d)</enum><header>Priority</header><text display-inline="yes-display-inline">In carrying out the pilot program under this section, the Administrator shall ensure that a State or local government receiving assistance under the program provides grants to individuals that demonstrate financial need.</text></subsection><subsection id="H5ACDBF49280A4BB48992ECEDCABE9450"><enum>(e)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 4 years after the date of enactment of this Act, the Administrator shall submit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate a report that includes—</text><paragraph id="H91CDDA3D8AE940BC97AAF14644A7B2F6"><enum>(1)</enum><text display-inline="yes-display-inline">a summary of the grant awards and projects carried out under this section;</text></paragraph><paragraph id="H9B87B908E62E438F909C3345027B41A4"><enum>(2)</enum><text display-inline="yes-display-inline">a detailed compilation of results achieved by the grant awards and projects carried out under this section, including the number of homes receiving retrofits, the types and average costs of retrofits, demographic information for participants in the program, and estimate avoidance in disaster impacts and Federal disaster payments as a result of the grant investments; and</text></paragraph><paragraph id="HB1652C5A518642749E1BFC5991518A2C"><enum>(3)</enum><text display-inline="yes-display-inline">any identified implementation challenges and recommendations for improvements to the pilot program.</text></paragraph></subsection><subsection id="HE352CA0B97564422A8455BA95673CD63" display-inline="no-display-inline"><enum>(f)</enum><header>Applicability</header><text>This section shall only apply to amounts appropriated on or after the date of enactment of this Act.</text></subsection><subsection id="H84EC756FBE0744008107A28E86EEA6B1"><enum>(g)</enum><header>Residential resilient retrofits defined</header><paragraph id="H176FDA214CD74AF3BA50DF42F2E7E9D9"><enum>(1)</enum><header>In general</header><text>In this section, the term <quote>residential resilient retrofits</quote> means a project that—</text><subparagraph id="HCE603C15084F4C3C854452D8E3E2FFF9"><enum>(A)</enum><text display-inline="yes-display-inline">is designed to increase the resilience of an existing home or residence using mitigation measures which the administrator determines reduce damage and impacts from natural disaster hazards and risks that are most likely to occur in the area where the home is located; and</text></subparagraph><subparagraph id="H67CF42BF8A504CC88D51EE77E1643B98"><enum>(B)</enum><text display-inline="yes-display-inline">to the extent applicable, are consistent with the 2 most recently published editions of relevant consensus-based codes, specifications, and standards, including any amendments made by State, local, tribal, or territorial governments to such codes, specifications, and standards that incorporate the latest hazard-resistant designs and establish criteria for the design, construction, and maintenance of residential structures and facilities that may be eligible for assistance under the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5121">42 U.S.C. 5121 et seq.</external-xref>) for the purpose of protecting the health, safety, and general welfare of the buildings’ users against disasters.</text></subparagraph></paragraph><paragraph id="HB668F0EB24F4464EB900866259702638"><enum>(2)</enum><header>Inclusion</header><text display-inline="yes-display-inline">In this section, the term <quote>residential resilient retrofits</quote> includes—</text><subparagraph id="HB2FA95F6FC49473DB4BA06DB42B4B512"><enum>(A)</enum><text>elevations of homes and elevations of utilities within and around structures to mitigate damages;</text></subparagraph><subparagraph id="H30993EE22A69427EA15524DDE8B09F4B"><enum>(B)</enum><text>floodproofing measures;</text></subparagraph><subparagraph id="HCE7FE2F4FAD449B4A501DA668E59204E"><enum>(C)</enum><text>the construction of tornado safe rooms;</text></subparagraph><subparagraph id="H21C7AE4BFBDD422D8716D55D4A7046CC"><enum>(D)</enum><text>seismic retrofits;</text></subparagraph><subparagraph id="HC03358DCAD04499AACB3564D9708550B"><enum>(E)</enum><text>wildfire retrofit and mitigation measures;</text></subparagraph><subparagraph id="H25ACE976FE954AECB2580272D9C56928"><enum>(F)</enum><text>wind retrofits, including roof replacements, hurricane straps, and tie-downs; and</text></subparagraph><subparagraph id="HA183B2AE3C9E4DBC93CC07D894764ACF"><enum>(G)</enum><text>any other measures that meet the requirements of paragraph (1), as determined by the Administrator.</text></subparagraph></paragraph></subsection></section></legis-body><legis-body style="OLC" display-enacting-clause="no-display-enacting-clause"><section id="idd7b2b1c3-175f-49f3-b66e-9c7c733a11f0" section-type="section-one" changed="added" reported-display-style="italic" committee-id="SSGA00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Promoting Resilient Buildings Act of 2024</short-title></quote>.</text></section><section id="id1ee59b9b-e943-4577-8007-5b1dbf0a407a" section-type="subsequent-section" changed="added" reported-display-style="italic" committee-id="SSGA00"><enum>2.</enum><header>Predisaster hazard mitigation</header><text display-inline="no-display-inline">Section 203 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5135">42 U.S.C. 5135(f)</external-xref>) is amended—</text><paragraph id="id0a18cdcc-d0d6-4df8-801e-2d7a52f981f7"><enum>(1)</enum><text>by striking paragraph (5); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8ca71d2e6ef14baf9fe981cff5962240"><enum>(2)</enum><text>by redesignating paragraphs (6), (7), and (8) as paragraphs (5), (6), and (7), respectively.</text></paragraph></section><section id="idd96635758dd640419072d2b6dcbb4b97" changed="added" reported-display-style="italic" committee-id="SSGA00"><enum>4.</enum><header>Residential retrofit and resilience pilot program</header><subsection commented="no" display-inline="no-display-inline" id="ida9e9251c10fc49a9b3279e485491ab5b"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text>In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="id79832fb081b24f1892ffdb101a6c36d7"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the Federal Emergency Management Agency.</text></paragraph><paragraph id="id9aa8f033d4414e19bf07e2dbc7c40bf4"><enum>(2)</enum><header>Residential resilient retrofits</header><text>The term <term>residential resilient retrofits</term>—</text><subparagraph commented="no" display-inline="no-display-inline" id="id83dfed18a87448069f069c727df5b672"><enum>(A)</enum><text display-inline="yes-display-inline">means a project that—</text><clause id="id2578ac38763e4acaa6e1137828c54dcb"><enum>(i)</enum><text>is designed to increase the resilience of an existing home or residence using mitigation measures that the Administrator determines reduce damage and impacts from natural disaster hazards and risks that are most likely to occur in the area where the home is located; and</text></clause><clause id="id45bbcf9ceaab418795bd3a9146e9ec44"><enum>(ii)</enum><text>to the extent applicable, are consistent with the 2 most recently published editions of relevant consensus-based codes, specifications, and standards, including any amendments made by State, local, Tribal, or territorial governments to those codes, specifications, and standards that incorporate the latest hazard-resistant designs and establish criteria for the design, construction, and maintenance of residential structures and facilities that may be eligible for assistance under the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5121">42 U.S.C. 5121 et seq.</external-xref>) for the purpose of protecting the health, safety, and general welfare of users of the buildings against disasters; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc84220f6bc0a4a2494b2b6a76f39c790"><enum>(B)</enum><text>includes—</text><clause id="idc8b127524edd413ab4ffc9bfc2e4f277"><enum>(i)</enum><text>elevations of homes and elevations of utilities within and around structures to mitigate damages;</text></clause><clause id="id3c6995515afb4e1c8193d0c6ea81b39a"><enum>(ii)</enum><text>floodproofing measures;</text></clause><clause id="ide12540bec3cc4ad18974ee826769de68"><enum>(iii)</enum><text>the construction of tornado safe rooms;</text></clause><clause id="id1543011d75be427d91c2a3af47b65def"><enum>(iv)</enum><text>seismic retrofits;</text></clause><clause id="id2b20ee06ac144606aa776129294538f5"><enum>(v)</enum><text>wildfire retrofit and mitigation measures;</text></clause><clause id="ide5e46a6058b84c61843cefa900ce3e86"><enum>(vi)</enum><text>wind retrofits, including roof replacements, hurricane straps, and tie-downs; and</text></clause><clause id="id7b027ac3e9dd469b97693d19be7ee8dc"><enum>(vii)</enum><text>any other measures that meet the requirements of subparagraph (A), as determined by the Administrator. </text></clause></subparagraph></paragraph></subsection><subsection id="id6108aa459c134d01a7661157b3ad34ca"><enum>(b)</enum><header>Establishment</header><text>The Administrator shall carry out a residential resilience pilot program through the program established under section 203 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5133">42 U.S.C. 5133</external-xref>); and</text></paragraph><paragraph id="id56ed44dc57544cec8aae5658f6716cde"><enum>(4)</enum><text>any identified implementation challenges and recommendations for improvements to the pilot program.</text></paragraph></subsection><subsection id="id02685779416641dc96a7ec899cf29d9b"><enum>(g)</enum><header>Applicability</header><text>This section shall only apply to amounts appropriated on or after the date of enactment of this Act.</text></subsection></section><section commented="no" display-inline="no-display-inline" id="id7ed67cf3982943c4a88f85c223237399" changed="added" reported-display-style="italic" committee-id="SSGA00"><enum>5.</enum><header>Rule of construction</header><text display-inline="no-display-inline">Nothing in this Act or the amendments made by this Act shall be construed to affect any program other than the predisaster hazard mitigation program or the hazard mitigation revolving loan fund program established under section 203 or 205 of the Robert T.
