<section id="HDB62CECCF9E445A8873320BAA64CD800" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Arts Education for All Act</short-title></quote>.</text></section> <title id="H70784DDAEF734FE99B739D73DF202630"><enum>I</enum><header>Early Childhood Education Programs</header> <section id="H82D0A874299C445083874D58A3B0FA8B"><enum>101.</enum><header>Early childhood education programs</header><text display-inline="no-display-inline">The Child Care and Development Block Grant Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/9857">42 U.S.C. 9857 et seq.</external-xref>) is amended—</text> 
<paragraph id="H09FE382D387A4B3FBBAD9E1786D34E8D"><enum>(1)</enum><text>in section 658G(b)(1), by striking subparagraph (A) and inserting the following:</text> <quoted-block style="OLC" id="H90885B3D4AE049AE835E7258B8F712F4" display-inline="no-display-inline"> <subparagraph id="HB8FFD33F4FC1421FBC1729FB3FEB7E99"><enum>(A)</enum><text display-inline="yes-display-inline">offering training, coaching, or professional development opportunities for child care providers that relate to the use of evidence-based, developmentally appropriate and age-appropriate strategies to promote the social, emotional, physical, adaptive, communication, and cognitive development of children, including key programmatic strategies, and offering specialized training for child care providers caring for those populations prioritized in section 658E(c)(2)(Q), and children with disabilities;</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H5942027636094963A189BBCAF889B78C"><enum>(2)</enum><text display-inline="yes-display-inline">in section 658P, by adding at the end the following: </text> <quoted-block style="OLC" id="H1DC9A8E936F64C1D8067D97F91236D76" display-inline="no-display-inline"> <paragraph id="H9CE0D4D1396E4601AF1CF854352F646C"><enum>(16)</enum><header>Key programmatic strategies</header><text display-inline="yes-display-inline">The term <term>key programmatic strategies</term> means strategies related to—</text> 
<subparagraph id="HF480C9978D0A44FEAD3494C106FDC2C6"><enum>(A)</enum><text>nutrition and physical activity;</text></subparagraph> <subparagraph id="H9E2AB485983E48D09A7764AA0633E516"><enum>(B)</enum><text>recommended practices for age-appropriate exposure to screen media; and</text></subparagraph> 
<subparagraph id="HADD5139442A449698CC62A305DEFAD77"><enum>(C)</enum><text>the integration and utilization of instructional methods to assist learning across disciplines, including methods that use the arts, language, literacy, mathematics, science, and social studies.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></title> <title id="HE573219A5FCE464CB51EB4F1EEA30577"><enum>II</enum><header>Amendments to the Elementary and Secondary Education Act of 1965</header> <section id="H40B95651E37B4511AE9903BDB49A5C23"><enum>201.</enum><header>References</header><text display-inline="no-display-inline"> Except as otherwise expressly provided, whenever in this title an amendment or repeal is expressed in terms of an amendment to, or repeal of, a section or other provision, the reference shall be considered to be made to a section or other provision of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6301">20 U.S.C. 6301 et seq.</external-xref>).</text></section> 
<section id="HECDC6B8CABDF4047B5040364FE225AAE"><enum>202.</enum><header>State and local plans</header> 
<subsection id="HAB2358005330408EA7C2D1F2844A751A"><enum>(a)</enum><text display-inline="yes-display-inline">Section 1111(g) (<external-xref legal-doc="usc" parsable-cite="usc/20/6311">20 U.S.C. 6311(g)</external-xref>) is amended by adding at the end the following:</text> <quoted-block id="HF89C85B8958E482B9D26AD6F3C7472F8" style="OLC"> <paragraph id="H28BCCAA8B3074F9D9FEFA278134A8315"><enum>(5)</enum><header>Use of arts education to improve student achievement</header><text>Each State’s plan shall describe how the State educational agency will—</text> 
<subparagraph id="HAA952A756B27494D83DAF438303DC20B"><enum>(A)</enum><text>support and encourage the offering of a variety of arts education experiences to students as part of the State educational agency’s overall strategy to improve student achievement in the subjects described in section 8101(52);</text></subparagraph> <subparagraph id="H76A19AAD2A594C97A116867F0BF49901"><enum>(B)</enum><text>integrate arts education instruction into the curriculum;</text></subparagraph> 
<subparagraph id="H3CAB7DD4CC80402988DA125B25F19129"><enum>(C)</enum><text display-inline="yes-display-inline">increase the number of arts educators, including arts education specialists, in schools;</text></subparagraph> <subparagraph id="H29BBF811F52F45C7B992513F691C6A95"><enum>(D)</enum><text>utilize partnerships with specialized teaching artists to train teachers to augment creative thinking techniques into the instruction provided in math, reading, English language arts, science, and other subjects described in section 8101(52);</text></subparagraph> 
<subparagraph id="HBB37FE1974B84843B3A57F470CEC28E4"><enum>(E)</enum><text>ensure that arts instruction provided in the State is standards-based, as applicable, and sequential with arts courses offered in the grades 6 through 12 building upon such courses offered in earlier grades; </text></subparagraph> <subparagraph id="HBA98B77A778D452D84163A0A2B4A1005"><enum>(F)</enum><text display-inline="yes-display-inline">increase the number of classes taught by arts educators, including arts education specialists, with a particular focus on classes with high percentages of students who are low-income, students with disabilities, English learners, or students of color; and</text></subparagraph> 
<subparagraph id="HA7F030D06E4D424BBDF0FF966BB70779"><enum>(G)</enum><text display-inline="yes-display-inline">support partnerships that increase the amount of arts education and creative youth development available in afterschool and summer learning programs.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H631895D2D09F471EAA158DEB71C66C77"><enum>(b)</enum><text>Section 1112(b) (<external-xref legal-doc="usc" parsable-cite="usc/20/6312">20 U.S.C. 6312(b)</external-xref>) is amended—</text> 
<paragraph id="HBB990E13F5AD4FFB8B0FD67535BB981B"><enum>(1)</enum><text>in paragraph (12), by striking <quote>and</quote> at the end;</text></paragraph> <paragraph id="H31F50747BB4849E99C2226728B0296E6"><enum>(2)</enum><text>by redesignating paragraph (13) as paragraph (14); and</text></paragraph> 
<paragraph id="HAC92259D128D4046829932910D0F8BF0"><enum>(3)</enum><text>by inserting after paragraph (12) the following:</text> <quoted-block id="H553538D442F949E58266D3A237AFCF68" style="OLC"> <paragraph id="HE75408A57ECD4130BF635FE72BAA26B4"><enum>(13)</enum><text>how the local educational agency will support learning in the arts and encourage the use of the arts education to improve student achievement consistent with section 1111(g)(5); and</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section> 
<section id="H005C19F65186442196352D6E48B6086D"><enum>203.</enum><header>Report cards</header><text display-inline="no-display-inline">Section 1111(h)(1)(C) (<external-xref legal-doc="usc" parsable-cite="usc/20/6311">20 U.S.C. 6311(h)(1)(C)</external-xref>) is amended—</text> <paragraph id="HDF041ACABCE44CD887AAC278F3834938"><enum>(1)</enum><text>by redesignating clause (xiv) as (xv); and</text></paragraph> 
<paragraph id="HD90368E777F04EE8AEF4DB3565BE45B2"><enum>(2)</enum><text>by inserting after clause (xiii) the following:</text> <quoted-block id="H18999F9329984F28930050C726205735" style="OLC"> <clause id="H80BA99EDE5CB4BB4A2C5FCDBD37136BB"><enum>(xiv)</enum><text>Information on arts courses, including—</text> 
<subclause id="H40E4BA4D50824E6D90B055105D0D684A"><enum>(I)</enum><text>the number of, range, and sequence of course offerings;</text></subclause> <subclause id="HE06427CD887F4DC4A2BF493BB97CD218"><enum>(II)</enum><text>the average pupil-to-teacher ratio in such courses;</text></subclause> 
<subclause id="HA905111CBE444DFAA1FCD519D79BB083"><enum>(III)</enum><text>the average amount of instructional time in such courses; and</text></subclause> <subclause id="HD1408F74EC204915B290ACD2CE5A52BB"><enum>(IV)</enum><text>for each semester, the percentage (in the aggregate and dis­ag­gre­gated by high-poverty compared to low-poverty schools, which for the purpose of this subclause, means schools in the top quartile of poverty and the bottom quartile of poverty in the State) of—</text> 
<item id="H154E5D51A5D74E18B424AAE8D381CC21"><enum>(aa)</enum><text>schools offering arts courses;</text></item> <item id="H6CF23071DAAA4F1F85075063BDD232B9"><enum>(bb)</enum><text>students taking arts courses; and</text></item> 
<item id="HBCF4F284C22D4DE39F53A2BBC66A46B7"><enum>(cc)</enum><text>arts courses taught by arts teachers with full State certification or licensure. </text></item></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> <section id="HFE47C25501394E7DB21F160907729764"><enum>204.</enum><header>School improvement</header><text display-inline="no-display-inline">Section 1111(d)(2)(B) (<external-xref legal-doc="usc" parsable-cite="usc/20/6311">20 U.S.C. 6311(d)(2)(B)</external-xref>) is amended—</text> 
<paragraph id="H74A9F7D787CE42ED8776AB5259E35845"><enum>(1)</enum><text>in clause (iv), by striking <quote>; and</quote> and inserting a semicolon;</text></paragraph> <paragraph id="HC31B3CB1FBF140D49AAB1035E6BC2872"><enum>(2)</enum><text>by redesignating clause (v) as clause (vi); and</text></paragraph> 
<paragraph id="H9F817360DA134BCFB69D2F3755500979"><enum>(3)</enum><text>by inserting after clause (iv) the following:</text> <quoted-block id="H54AEE1FD092644248C34D18C668793B6" style="OLC"> <clause id="H7C4326C0EBEE46A8BAEA0DA04EF2E35D"><enum>(v)</enum> <subclause commented="no" display-inline="yes-display-inline" id="HA6936553D6CC4C1A9ECAB57B7609FEB4"><enum>(I)</enum><text>provides for an evaluation of the arts courses offered at such school during the school day and the certification, training and skills of staff that are teaching such courses including teaching artists; and</text></subclause> 
<subclause id="HBB5482F9D8A547A0BED678596D521D2A" indent="up1"><enum>(II)</enum><text>based on such evaluation, incorporate the offering of arts courses into the offerings of such school; and</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> <section id="H4F298E118BE042FE8EC4D6C4FCF0AAAF"><enum>205.</enum><header>Arts for neglected and delinquent children and youth</header><text display-inline="no-display-inline">Section 1415(a)(2)(B)(ii) (<external-xref legal-doc="usc" parsable-cite="usc/20/6435">20 U.S.C. 6435(a)(2)(B)(ii)</external-xref> is amended by inserting <quote>access to the arts and arts education and</quote> after <quote>improving</quote>.</text></section> 
<section id="H0AEEEE6427A5431A81D0353FF0CF5B40"><enum>206.</enum><header>Subgrants to local educational agencies</header> 
<subsection id="HE4422267AC704F4592B5CB0F82F6110E"><enum>(a)</enum><header>Local uses of funds</header><text>Section 2103(b)(3) (<external-xref legal-doc="usc" parsable-cite="usc/20/6613">20 U.S.C. 6613(b)(3)</external-xref>) is amended—</text> <paragraph id="H53CF4A531503490C9BAFA77A88B08ABF"><enum>(1)</enum><text>in subparagraph (O), by striking <quote>; and</quote> and inserting a semicolon;</text></paragraph> 
<paragraph id="H9B00092CCAF841D8B01AA07DE4C29D51"><enum>(2)</enum><text>by redesignating subparagraph (P) as subparagraph (Q); and</text></paragraph> <paragraph id="H2DAAAF82BCCA4BB4BD9BE8D2207938BD"><enum>(3)</enum><text>by inserting after subparagraph (O) the following:</text>

<subparagraph id="HAB68CA76199840E292E41A95F675AC47"><enum>(P)</enum><text>carrying out activities to increase pathways to obtain rigorous, high-quality teacher certification or licensure for individuals seeking to become teachers of the arts; and</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="H183C462AB4684C43B37DCE724055B5CD"><enum>(b)</enum><header>Professional development for arts teachers</header><text>Section 2103 (<external-xref legal-doc="usc" parsable-cite="usc/20/6613">20 U.S.C. 6613</external-xref>) is further amended by inserting at the end the following:</text>

<subsection id="H702521D3FBCB4BCD9A2D020E29974AD5"><enum>(c)</enum><header>Professional development for arts teachers</header><text>In carrying out the programs and activities described under subsection (a), a local educational agency shall provide professional development for teachers of the arts, as appropriate, to fulfill the needs of such agency and the schools of such agency.</text></subsection> <subsection id="HC1647B75B6A04932B9E89D7DE64A21BB"><enum>(d)</enum><header>Professional development for integration of the arts</header><text>In carrying out the programs and activities described under subsection (a), a local educational agency shall provide professional development for teachers to integrate the arts into their instruction in math, reading, English language arts, science, and other subjects described in section 8101(52).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section id="H61E6EAD06EA9415DA7E30DFD34C2EE69"><enum>207.</enum><header>21st century community learning centers</header> 
<subsection id="HE90FC63D6EE448B987DA9CB72E862052"><enum>(a)</enum><header>Arts organizations</header><text display-inline="yes-display-inline">Section 4205(a) (<external-xref legal-doc="usc" parsable-cite="usc/20/7175">20 U.S.C. 7175(a)</external-xref>) is amended—</text> <paragraph id="H9BABE61CC3A54CC6B1AB7C7B53AF60A0"><enum>(1)</enum><text>in paragraph (13), by striking <quote>; and</quote>;</text></paragraph> 
<paragraph id="H6537C1FC3D0A4FD9A8C8C49B2F039BDA"><enum>(2)</enum><text>in paragraph (14), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph> <paragraph id="HF630C292D563441A984B48557DD969D0"><enum>(3)</enum><text>by adding at the end the following:</text>

<title id="HAC459271F57F4EDEB0FC9228DF65EA59"><enum>III</enum><header>Amendments to the Juvenile Justice and Delinquency Prevention Act of 1974 and to the Omnibus Crime Control and Safe Streets Act of 1968</header> 
<section id="H6D1C8815A52A417D818330C131ADD92F"><enum>301.</enum><header>Amendments to the Juvenile Justice and Delinquency Prevention Act of 1974</header><text display-inline="no-display-inline">Section 223(a) of the Juvenile Justice and Delinquency Prevention Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5633">42 U.S.C. 5633(a)</external-xref>) is amended—</text> <paragraph id="H6737D95D8B174D7DA92E07817B676785"><enum>(1)</enum><text>in paragraph (32) by striking <quote>and</quote> at the end,</text></paragraph>

<paragraph id="HE8C105E88F364D72AF3EFB250EFFCB57"><enum>(34)</enum><text display-inline="yes-display-inline">describe how the State will coordinate services, activities for juvenile justice and delinquency prevention with State and local agencies and organizations, including State and local arts agencies, arts organizations, and organizations that further creative youth development.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> <section id="H3E9D6B0F3FAA4F37B9E2EF699448DA2B"><enum>302.</enum><header>Amendments to adult and juvenile offender demonstration projects and the State, tribal and local reentry courts programs</header><text display-inline="no-display-inline">The Omnibus Crime Control and Safe Streets Act of 1968 is amended in section 2976(b)(4)—</text> 
<paragraph id="H80D930B5DBEE402B85BF4C38E579C74B"><enum>(1)</enum><text>by striking <quote>; and</quote> in subparagraph (A);</text></paragraph> <paragraph id="H69F68DFA97374FECA5995E933F00814B"><enum>(2)</enum><text>after subparagraph (A), by inserting the following:</text>

<subparagraph id="HFB8B1277B34B47609BDC87D93D97C394"><enum>(B)</enum><text>use arts education programs and services to better facilitate reentry and reduce recidivism and connect offenders to educational opportunities and employment after reentry into the community; and</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> <paragraph id="H06909BD4DBAF4F9DA3412D866A7696D1"><enum>(3)</enum><text>by redesignating subparagraph (B) as subparagraph (C).</text></paragraph></section></title> 
<title id="H45E8E6FEE6434022863B40D19F87396C"><enum>IV</enum><header>Amendments to the Education Sciences Reform Act of 2002 and the National Assessment of Educational Progress Authorization Act</header> 
<section id="H1E5E1EB396F24255A9A5FA1FEFF6C3A2"><enum>401.</enum><header>Arts research</header><text display-inline="no-display-inline">Section 133 of the Education Sciences Reform Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/20/9533">20 U.S.C. 9533</external-xref>) is amended—</text> <paragraph id="HD8777842BC3E4237BA49CE9301DA2ABE"><enum>(1)</enum><text>in subsection (a)—</text> 
<subparagraph id="H2F47A12BA0D644518E1BA02F46288F74"><enum>(A)</enum><text>by striking <quote>; and</quote> at the end of subparagraph (10)(D);</text></subparagraph> <subparagraph id="HA1E3E6E1493B4489BDA3F9B9A3151D69"><enum>(B)</enum><text>by redesignating subparagraph (11) as subparagraph (12); and</text></subparagraph> 
<subparagraph id="H32AD7F310ABB4919BFC5CC2D0792A8AA"><enum>(C)</enum><text>by inserting after paragraph (10) the following:</text> <quoted-block id="H8F97588AE51C4691814047F9A1EC6FEF" style="OLC"> <paragraph id="H9F045C650A6648F4A158E79CE20C7F5B"><enum>(11)</enum><text>carry out research on the use of the arts and arts education that is rigorous, peer reviewed and large scale to determine which methods and uses of the arts and arts education are most effective, cost efficient and able to be applied, duplicated, and scaled up for the use in elementary and secondary classrooms, including in low-performing schools; and</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H9846820D2BC947FFBCFBBD615E7328E4"><enum>(2)</enum><text>in subsection (c)(2), by adding at the end the following:</text> <quoted-block id="H74CBE3C2D6C143DC88B90FDA113711E8" style="OLC"> <subparagraph id="H440E05B8BE9D44AEACBCAED79CBE7C59"><enum>(L)</enum><text>Use of the arts and arts education in improving elementary and secondary education.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="HF3F7C528202A4CD88C5CCC5097D2CF76"><enum>402.</enum><header>Arts statistical data</header><text display-inline="no-display-inline">Section 153(a)(1) of the Education Sciences Reform Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/20/9543">20 U.S.C. 9543(a)(1)</external-xref>) is amended—</text> <paragraph id="HAAA22EFE6CCC439CAD1FDB5B6A59E532"><enum>(1)</enum><text>in subparagraph (N), by striking <quote>; and</quote> and inserting a semicolon;</text></paragraph>
