R. 5430</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20230913">September 13, 2023</action-date><action-desc><sponsor name-id="A000377">Mr. Armstrong</sponsor> (for himself and <cosponsor name-id="C001068">Mr. Cohen</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend section 3661 of title 18, United States Code, to prohibit the consideration of acquitted conduct at sentencing.</official-title></form><legis-body id="H237A80555B0D40179AC8019C66B76E20" style="OLC"><section section-type="section-one" id="H44A71D1F79614701BD451FA665F456B9"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Prohibiting Punishment of Acquitted Conduct Act of 2023</short-title></quote>.</text></section><section id="H9F78CC99271847DB98073451B3B6862F"><enum>2.</enum><header>Acquitted conduct at sentencing</header><subsection id="H1FC181DDE7854BD0844D71B21FFB659F"><enum>(a)</enum><header>Use of information for sentencing</header><paragraph id="HFF77934389DA47A58CFAC6EE84D9DD16"><enum>(1)</enum><header>Amendment</header><text>Section 3661 of title 18, United States Code, is amended by inserting <quote>, except that a court of the United States shall not consider, except for purposes of mitigating a sentence, acquitted conduct under this section</quote> before the period at the end.</text></paragraph><paragraph id="H1D3C496171AC4193B7CB62AFC93D4BE4"><enum>(2)</enum><header>Applicability</header><text>The amendment made by paragraph (1) shall apply only to a judgment entered on or after the date of enactment of this Act.</text></paragraph></subsection><subsection id="HE80E951D553F4E3E9D82EBE83A75B804"><enum>(b)</enum><header>Definitions</header><text>Section 3673 of title 18, United States Code, is amended—</text><paragraph id="H9CADA181132748AEB457BFF59198C58F"><enum>(1)</enum><text>in the matter preceding paragraph (1), by striking <quote>As</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HCFBAE1C427694BB8B9E33B42A8081A1B"><subsection id="H4D9113C83E2E45C0B48A9107CD43EF37"><enum>(a)</enum><text>As</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H394EB6483E204E3C88A26909B42B36C8"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HB6E2A5052E2F4C918CD2B4680052EEC9"><subsection id="H432F3672514D48F5B690D690D1EAF592"><enum>(b)</enum><text>As used in this chapter, the term <term>acquitted conduct</term> means—</text><paragraph id="H981CCC5ADC544F90BE29A3A26DDE3B3F"><enum>(1)</enum><text>an act—</text><subparagraph id="H3805A1164F7447CCA47CBC21F70C2C92"><enum>(A)</enum><text>for which a person was criminally charged and with regard to which—</text><clause id="HDA3972018ABF4CCA8D48BE1723AAF481"><enum>(i)</enum><text>that person was adjudicated not guilty after trial in a Federal, State, or Tribal court; or</text></clause><clause id="H0BE641581E5445BCAA41BA9B30C749A1"><enum>(ii)</enum><text display-inline="yes-display-inline">any favorable disposition to the person in any prior charge was made, regardless of whether the disposition was pretrial, at trial, or post trial; or</text></clause></subparagraph><subparagraph id="H064DEE8AD6F4460096DA1701D4F12B5B"><enum>(B)</enum><text>in the case of a juvenile, that was charged and for which the juvenile was found not responsible after a juvenile adjudication hearing; or</text></subparagraph></paragraph><paragraph id="H0C8C0680056644CFACF9D785B0A7F5EF"><enum>(2)</enum><text>any act underlying a criminal charge or juvenile information dismissed—</text><subparagraph id="H208794CECF8D47688E0F9D3AA5F94424"><enum>(A)</enum><text>in a Federal court upon a motion for acquittal under rule 29 of the Federal Rules of Criminal Procedure; or</text></subparagraph><subparagraph id="H9D170305AAF14FDEB273F6B205193616"><enum>(B)</enum><text>in a State or Tribal court upon a motion for acquittal or an analogous motion under the applicable State or Tribal rule of criminal procedure.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></legis-body></bill>
