R. 5372</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20230908">September 8, 2023</action-date><action-desc><sponsor name-id="J000302">Mr. Joyce of Pennsylvania</sponsor> (for himself and <cosponsor name-id="P000608">Mr. Peters</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committee on <committee-name committee-id="HWM00">Ways and Means</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend Title XVIII of the Social Security Act to facilitate midyear formulary changes for biosimilars.</official-title></form><legis-body><section id="H95FEA4A6BBFC4C31BA9CA6745797080B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Expanding Seniors' Access to Lower Cost Medicines Act of 2023</short-title></quote>.</text></section><section id="id696807ca2af24e2392cb277c6ab47197"><enum>2.</enum><header>Facilitating midyear formulary changes for biosimilars</header><subsection id="id3ad0d40e129d4d07816b6ae5110daae8"><enum>(a)</enum><header>In general</header><text>Section 1860D–4(b) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-104">42 U.S.C. 1395w–104(b)</external-xref>) is amended by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id9bca8300be1d43ccab4cf3c61c160797"><paragraph id="id1b357e27555b4aae9e887d7f7a249f82"><enum>(5)</enum><header>Mid-year changes in formularies permitted for certain biosimilar biological products and the reference product of such biosimilars</header><text>If a PDP sponsor of a prescription drug plan uses a formulary (including the use of tiered cost-sharing), the following shall apply:</text><subparagraph id="idbbe87fa69c774c2d9db09275c7f720fa"><enum>(A)</enum><header>In general</header><text>For plan year 2025, and subsequent plan years, in the case of a covered part D drug that is the reference biological product (as defined in section 1847A(c)(6)(I)) with respect to a biosimilar biological product (as defined in section 1847A(c)(6)(H)), the PDP sponsor may, with respect to a formulary, at any time after the first 60 days of the plan year, subject to paragraph (3)(E), change the preferred or tiered cost-sharing status of such reference biological product if such PDP sponsor adds, before or at the same time, to such formulary such biosimilar biological product at the same or a higher preferred status, or to the same or lower cost-sharing tier, as that of such reference biological product immediately prior to such change.</text></subparagraph><subparagraph id="id9c44704b1c744a4b99c5c0f9873a3ff0"><enum>(B)</enum><header>Request for approval of change</header><text>Prior to making a change described in subparagraph (A), the PDP sponsor shall submit to the Secretary a request to make such change. If the Secretary approves the request or has not provided a decision to the PDP sponsor regarding such request within 30 days of receiving such request, such PDP sponsor may make such change.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idcf853b535b5e409e97e52bae293e1a00"><enum>(b)</enum><header>Administration</header><paragraph id="ided8d9f63d9964bdbb7870ce18e309ad2"><enum>(1)</enum><header>Implementation</header><text>Notwithstanding any other provision of law, the Secretary of Health and Human Services may implement the amendment made by subsection (a) by program instruction or otherwise.</text></paragraph><paragraph id="id87269ab2518f4ba1a9b1e4e378878786" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header>Non-application of the Paperwork Reduction Act</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/35">Chapter 35</external-xref> of title 44, United States Code (commonly referred to as the <quote>Paperwork Reduction Act of 1995</quote>), shall not apply to the implementation of the amendment made by subsection (a).</text></paragraph></subsection></section></legis-body></bill>
