<section id="H05C7F296515F4AD8B13F9FD2710F39B9" section-type="section-one"><enum>1.</enum><header>Department of Defense Military Housing Readiness Council</header>
<subsection id="H5D951FD0E4464EBE8C5AB111AC2E73B1"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">Subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/88">chapter 88</external-xref> of title 10, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/10/1781c">section 1781c</external-xref> the following new section:</text> <quoted-block style="USC" id="HCB64D680C4034845B19F8F0048EF9853" display-inline="no-display-inline"> <section id="H10FF551A20A845A0A2E60A078DB406BA"><enum>1781d.</enum><header>Department of Defense Military Housing Readiness Council</header> <subsection id="H09C45320B5104AED86B1FE5FACDE96D0"><enum>(a)</enum><header>In general</header><text>There is in the Department of Defense the Department of Defense Military Housing Readiness Council (in this section referred to as the <quote>Council</quote>).</text></subsection>
<subsection id="H84DE8FCD970F4267B2568DFDAC160E08"><enum>(b)</enum><header>Members</header>
<paragraph id="HD2B705EF221D4E21B49055BB4234210C" display-inline="yes-display-inline"><enum>(1)</enum><text>The Council shall be composed of the following members:</text> <subparagraph id="H1B80C879C5DB4FCA8B935823942C2826" indent="up1"><enum>(A)</enum><text>The Assistant Secretary of Defense for Energy, Installations, and Environment, who shall serve as chair of the Council and who may designate a representative to chair the Council in the absence of the Assistant Secretary.</text></subparagraph>
<subparagraph id="H90731882959C4F8EBC635955741F7A97" indent="up1"><enum>(B)</enum><text>One representative of each of the Army, Navy, Air Force, Marine Corps, and Space Force—</text> <clause id="H4FA607EDF11E4CB9A421F1BE0441BC8A"><enum>(i)</enum><text>each of whom shall be a member of the armed force to be represented; and</text></clause>
<clause id="HBFD96436805A49028FD40ED8E606B6C4"><enum>(ii)</enum><text>not fewer than two of whom shall be enlisted members.</text></clause></subparagraph> <subparagraph id="H43343E2796844294801545A55657338D" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">One spouse of a member of each of the Army, Navy, Air Force, Marine Corps, and Space Force on active duty, not fewer than two of whom shall be the spouse of an enlisted member.</text></subparagraph>
<subparagraph id="HA3DD663BF6934023A885DB2BA7B08EA9" indent="up1"><enum>(D)</enum><text display-inline="yes-display-inline">One representative that possesses expertise in State and Federal housing standards from each of the following areas:</text> <clause id="H461F5CD0A2994B07A7AE0812F59118A2"><enum>(i)</enum><text>Plumbing.</text></clause>
<clause id="HE5B6F634C6E2402E953E82D89EBEAD8A"><enum>(ii)</enum><text>Electrical.</text></clause> <clause id="H3D12513475034705BCB392CCB36888D9"><enum>(iii)</enum><text>Heating, ventilation, and air conditioning.</text></clause>
<clause id="H5FB91E2730004E59A96855A4C9B89FEE"><enum>(iv)</enum><text>Certified home inspection.</text></clause> <clause id="H87F3AEF00C0B4C0880FEBBD3792FD84A"><enum>(v)</enum><text>Roofing.</text></clause>
<clause id="HE94D9A72F57C4CB2A63902AC6E03E88B"><enum>(vi)</enum><text>Structural engineering.</text></clause> <clause id="HEC57344D704342A3B1FF42BE83DB0C2D"><enum>(vii)</enum><text>Window fall prevention and safety.</text></clause></subparagraph>
<subparagraph id="HABB42C33F4764A86BDF287F2EA6EE24F" indent="up1"><enum>(E)</enum><text>Two representatives of organizations that advocate on behalf of military families with respect to military housing.</text></subparagraph> <subparagraph id="H937F2912C2C94A758C3DEC8A99CCD1BC" indent="up1"><enum>(F)</enum><text>One individual appointed by the Secretary of Defense among representatives of the International Code Council.</text></subparagraph>
<subparagraph id="HA532B3CD3D4344E8BBBF28824154C51E" indent="up1"><enum>(G)</enum><text>One individual appointed by the Secretary of Defense among representatives of the Institute of Inspection Cleaning and Restoration Certification.</text></subparagraph> <subparagraph id="H13FCE6E9129142EFBC2A54B24CA712A4" indent="up1"><enum>(H)</enum><text>One individual appointed by the Secretary of Defense among representatives of a voluntary consensus standards body that develops construction standards (such as building, plumbing, mechanical, or electrical).</text></subparagraph>
<subparagraph id="HA773632E62684CD081A1819ED8ED7A13" indent="up1"><enum>(I)</enum><text>One individual appointed by the Secretary of Defense among representatives of a voluntary consensus standards body that develops personnel certification standards for building maintenance or restoration.</text></subparagraph> <subparagraph id="H9B155F9C828947BAA13BA255ABE62C44" indent="up1"><enum>(J)</enum><text>Two individuals appointed by the Chair of the Committee on Armed Services of the Senate, each of whom is not described in subparagraph (B), (C), or (D) and is not a representative of an organization specified in subparagraph (E), (F), (G), (H), or (I).</text></subparagraph>
<subparagraph id="HB8108C1A34F14484859E09C71AF087F0" indent="up1"><enum>(K)</enum><text display-inline="yes-display-inline">Two individuals appointed by the Ranking Member of the Committee on Armed Services of the Senate, each of whom is not described in subparagraph (B), (C), or (D) and is not a representative of an organization specified in subparagraph (E), (F), (G), (H), or (I).</text></subparagraph> <subparagraph id="H88BF6147AB7F4474A78155804644A26A" indent="up1"><enum>(L)</enum><text display-inline="yes-display-inline">Two individuals appointed by the Chair of the Committee on Armed Services of the House of Representatives, each of whom is not described in subparagraph (B), (C), or (D) and is not a representative of an organization specified in subparagraph (E), (F), (G), (H), or (I).</text></subparagraph>
<subparagraph id="H9B4E51827F3A431393094E3D141DE367" indent="up1"><enum>(M)</enum><text display-inline="yes-display-inline">Two individuals appointed by the Ranking Member of the Committee on Armed Services of the House of Representatives, each of whom is not described in subparagraph (B), (C), or (D) and is not a representative of an organization specified in subparagraph (E), (F), (G), (H), or (I).</text></subparagraph></paragraph> <paragraph id="H20B366937E4F43E9B9B11A0EEA3625B9" indent="up1"><enum>(2)</enum><text>The term on the Council of the members specified under subparagraphs (B) through (M) of paragraph (1) shall be two years and may be renewed by the Secretary of Defense.</text></paragraph>
<paragraph id="H05E298142E354889AC75A3384E4128FB" indent="up1"><enum>(3)</enum><text>The chair of the Council shall extend an invitation to all landlords for one representative of each landlord to attend such meetings of the Council as the chair considers appropriate.</text></paragraph> <paragraph id="HB0A4412F5A6C4F47AE3181279696EF5B" indent="up1"><enum>(4)</enum><text>Each member of the Council under paragraph (1)(D) may not be affiliated with—</text>
<subparagraph id="H28E05EE2C20248908760E7A692D0D24C"><enum>(A)</enum><text>any organization that provides privatized military housing; or</text></subparagraph> <subparagraph id="H9C75C12E1D3D42D38F8E41DA763F1D3C"><enum>(B)</enum><text>the Department of Defense.</text></subparagraph></paragraph></subsection>
<subsection id="H66DA4FDA659D400C873D23BA64239C85"><enum>(c)</enum><header>Meetings</header><text>The Council shall meet two times each year.</text></subsection> <subsection id="HD6691FCBE2E0497393236BA79DD3AAE7"><enum>(d)</enum><header>Duties</header><text>The duties of the Council shall include the following:</text>
<paragraph id="H2D53399964E9417183EFC464EA4C7245"><enum>(1)</enum><text display-inline="yes-display-inline">To review and make recommendations to the Secretary of Defense regarding policies for privatized military housing, including inspections practices, resident surveys, landlord payment of medical bills for health conditions of residents of housing units resulting from lack of maintenance of minimum standards of habitability, and access to maintenance work order systems.</text></paragraph> <paragraph id="HE27CA62CEF174B1EBA640A53AED090DA"><enum>(2)</enum><text>To monitor compliance by the Department of Defense with, and effective implementation by the Department of, statutory and regulatory improvements to policies for privatized military housing, including the Military Housing Privatization Initiative Tenant Bill of Rights developed under section 2890 of this title and the complaint database established under section 2894a of this title.</text></paragraph>
<paragraph id="H6E6EB4D9C33E4E5095D64A023ED93554"><enum>(3)</enum><text display-inline="yes-display-inline">To make recommendations to the Secretary of Defense to improve collaboration, awareness, and promotion of accurate and timely information about privatized military housing, accommodations available through the Exceptional Family Member Program of the Department, and other support services among policymakers, service providers, and targeted beneficiaries.</text></paragraph></subsection> <subsection id="HD45B65F77D53437089330EDEA99F291F"><enum>(e)</enum><header>Public reporting</header> <paragraph id="HB9B48AE0BE62474F9261D8205A6FFBBC" display-inline="yes-display-inline"><enum>(1)</enum><text>Subject to section 552 of title 5 (commonly known as the <quote>Freedom of Information Act</quote>), the records, reports, transcripts, minutes, appendices, working papers, drafts, studies, agenda, and other documents made available to or prepared for or by the Council shall be available for public inspection and copying at a single location in a publicly accessible format on a website of the Department of Defense until the Council ceases to exist.</text></paragraph>
<paragraph id="HA3531A36A6FD485598698F8D8D5AFA6E" indent="up1"><enum>(2)</enum>
<subparagraph id="H2A01AF98C2034666B43D9A833BA525A1" display-inline="yes-display-inline"><enum>(A)</enum><text>Detailed minutes of each meeting of the Council shall be kept and shall contain—</text> <clause id="H09EDDAEF21404BA696881B616DD0343E" indent="up1"><enum>(i)</enum><text>a record of the individuals present;</text></clause>
<clause id="H2FC8115949904285B4D8B7F538AD7A4D" indent="up1"><enum>(ii)</enum><text>a complete and accurate description of matters discussed and conclusions reached; and</text></clause> <clause id="H430E729464414637B0318FFE9C302C10" indent="up1"><enum>(iii)</enum><text>copies of all reports received, issued, or approved by the Council.</text></clause></subparagraph>
<subparagraph id="HAC73596F8FC4485A86445DA5112865FE" indent="up1"><enum>(B)</enum><text>The chair of the Council shall certify the accuracy of the minutes of each meeting of the Council.</text></subparagraph></paragraph></subsection> <subsection id="HBDC8CCF56805490E9683448091108B93"><enum>(f)</enum><header>Annual reports</header> <paragraph id="HC6C246B54D21472DB4149E66877EB751" display-inline="yes-display-inline"><enum>(1)</enum><text>Not later than March 1, 2024, and annually thereafter, the Council shall submit to the Secretary of Defense and the congressional defense committees a report on privatized military housing readiness.</text></paragraph>
<paragraph id="H938677334B444D659B27276B4830CDA8" indent="up1"><enum>(2)</enum><text>Each report under this subsection shall include the following:</text> <subparagraph id="H762E0B99F3B646678350967C0837A6AB"><enum>(A)</enum><text>An assessment of the adequacy and effectiveness of the provision of privatized military housing and the activities of the Secretary of Defense in meeting the needs of military families relating to housing during the preceding fiscal year.</text></subparagraph>
<subparagraph id="H8497A0E1BE0B46139F1F6F77B9D4EC13"><enum>(B)</enum><text>A description of activities of the Council during the preceding fiscal year, including—</text> <clause id="H17E802A1C53B4A9EB7F536D28B793BDC"><enum>(i)</enum><text>analyses of complaints of tenants of privatized military housing;</text></clause>
<clause id="H561CE5B90CAB4D8E81D8197BD08C3F4C"><enum>(ii)</enum><text display-inline="yes-display-inline">data received by the Council on maintenance response time and completion of maintenance requests relating to privatized military housing;</text></clause> <clause id="HA517147D34C245AD81B86FC2D39936C3"><enum>(iii)</enum><text>assessments of dispute resolution processes;</text></clause>
<clause id="HAB4B1CEF64DA499AB66A6BB095150468"><enum>(iv)</enum><text>assessments of overall customer service for tenants;</text></clause> <clause id="H924836E32A1C483390E5C4BED25893AD"><enum>(v)</enum><text display-inline="yes-display-inline">assessments of results of housing inspections conducted with and without notice; and </text></clause>
<clause id="HECF7FBCA1CD540E4B63B25667084B125"><enum>(vi)</enum><text>any survey results conducted on behalf of or received by the Council.</text></clause></subparagraph> <subparagraph id="H1F8DC3B8FBDB47F89382263F39229F13"><enum>(C)</enum><text>Recommendations on actions to be taken to improve the capability of the provision of privatized military housing and the activities of the Department of Defense to meet the needs and requirements of military families relating to housing, including actions relating to the allocation of funding and other resources.</text></subparagraph></paragraph>
<paragraph id="H43DFEF90854B46CB80840FE41C9468E1" indent="up1"><enum>(3)</enum><text>Each report under this subsection shall be made available in a publicly accessible format on a website of the Department of Defense.</text></paragraph></subsection> <subsection id="HA269A2B27DEA40A390B891749ADA31AC"><enum>(g)</enum><header>Definitions</header><text>In this section:</text>
<paragraph id="H7A13262EC0BD4DB09248E83EF0001CD4"><enum>(1)</enum><text>The terms <term>landlord</term> and <term>tenant</term> have the meanings given, respectively, in section 2871 of this title.</text></paragraph> <paragraph id="H07A437A6B5B546D1AD40D776F232AADC"><enum>(2)</enum><text>The term <term>privatized military housing</term> means housing provided under subchapter IV of chapter 169 of this title.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="HDAFEBB8162E9425597726A104DC893E0"><enum>(b)</enum><header>Briefing</header><text display-inline="yes-display-inline">Not later than March 1, 2024, the Secretary of Defense shall provide to the congressional defense committees a briefing on the annual report required under subsection (f) of section 1781d of title 10, United States Code, as added by subsection (a).</text></subsection></section> </legis-body></bill>
