which was referred to the <committee-name committee-id="HED00">Committee on Education and the Workforce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To establish a private right of action for parents with respect to the teaching of racial discrimination theory and other actions by covered schools, and for other purposes.</official-title></form><legis-body id="H9AE89CA3A768452FAE6D8E6685802B2B" style="OLC"><section id="H5FA6C180DFA248838DF285AFD095954B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Empowering Parents Act</short-title></quote>.</text></section><section id="H685035655BA343C18CBCD71D8E96F0C6"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="H6463642460DC4B29AC024F75E99829C2"><enum>(1)</enum><text display-inline="yes-display-inline">The family unit consisting of a mother, father, and child is the foundation of civil society.</text></paragraph><paragraph id="H111B80CE0D55487786E962A843C5D8E2"><enum>(2)</enum><text>The rights and authority of parents are God-given and self-evident.</text></paragraph><paragraph id="H95A3659C4AD14168AE9BB53DBF5A5ECD"><enum>(3)</enum><text>The rights and authority of parents do not derive from the government.</text></paragraph><paragraph id="H9CE3861643C04F3BAE59FDC272E7FA5B"><enum>(4)</enum><text>The rights and authority of parents should not be challenged or undermined by the government, but must be preserved and protected.</text></paragraph><paragraph id="H26D20FC7B5C343EC992823B4B09DE58B"><enum>(5)</enum><text>Parents are responsible for impressing faith, morals, and values upon their children; such responsibility does not belong to teachers, school board members, or politicians.</text></paragraph><paragraph id="H1AA60A72D71A453C8E1F21541348F6D9"><enum>(6)</enum><text>No teacher, school board member, or public official has the right to politicize or indoctrinate children.</text></paragraph><paragraph id="HE53D071C9B1D4D69BBD83882F177DA5A"><enum>(7)</enum><text>More than 70 percent of citizens of the United States support the ability of parents to choose where students attend school.</text></paragraph><paragraph id="H9203162B39C9471FA4770BABEE01F935"><enum>(8)</enum><text>It is contrary to the 10th Amendment of the Constitution and the principles of federalism espoused by the founding fathers for the Federal Government to supersede State or local authorities regarding the instruction and testing of students.</text></paragraph><paragraph id="HFEB971DE9FBA4F6088F3A6CB937AE792"><enum>(9)</enum><text display-inline="yes-display-inline">Taxpayers have a right to know what publicly funded schools are teaching students.</text></paragraph></section><section id="H227340154D2E459D817FCF412EF1DC10"><enum>3.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that—</text><paragraph id="HFF29EA43EF914EE5A8712D643E09D3FE"><enum>(1)</enum><text display-inline="yes-display-inline">a covered school should not—</text><subparagraph id="H514D613220864C7281B4D8E078AEA010"><enum>(A)</enum><text>deny a student the ability to attend school in person;</text></subparagraph><subparagraph id="H3B3F0A7AE5B14FC293E24B1CB6B9B2AD"><enum>(B)</enum><text display-inline="yes-display-inline">intentionally expose a student to racial discrimination theory;</text></subparagraph><subparagraph id="HF23F845116F647029C6DB533BB1D8F89"><enum>(C)</enum><text>intentionally expose a student to radical gender theory or sexually explicit content;</text></subparagraph><subparagraph id="HFFAE1944E9674108A040744FFB48EBDB"><enum>(D)</enum><text>require a biological woman to compete against a biological man in an athletic competition hosted or sponsored by such school;</text></subparagraph><subparagraph id="H971AAC63227049589E380AEE1AB87099"><enum>(E)</enum><text>require a biological woman and a biological man to share a private facility, including—</text><clause id="H8FEAF05393914F9993FF9022EBA5FFE9"><enum>(i)</enum><text>a restroom;</text></clause><clause id="HD3C13CC5AD8B470D8B13D9119B94D4F1"><enum>(ii)</enum><text>a locker room;</text></clause><clause id="H9B6BECE7CC204A60BDDF0BA55CE4A6C2"><enum>(iii)</enum><text>a shower facility; or</text></clause><clause id="H324F863B585D4F23981727709615A62A"><enum>(iv)</enum><text>a changing room; or</text></clause></subparagraph><subparagraph id="H87A5A148A3DD43F29E0817B62FE753A7"><enum>(F)</enum><text display-inline="yes-display-inline">require a student to abide by a health mandate without first obtaining parental consent or require, as a prerequisite for in-person school attendance—</text><clause id="H0A3844D9E4544591B5E56229AB3A2ECB"><enum>(i)</enum><text>wearing a mask;</text></clause><clause id="H3AD0864D5E0A4D87BE79E8ADBD8B4C52"><enum>(ii)</enum><text>receiving a COVID–19 vaccine; or</text></clause><clause id="HFC06E50DF8004B3D8741D4B9292902F6"><enum>(iii)</enum><text display-inline="yes-display-inline">subjecting to a medical screening;</text></clause></subparagraph></paragraph><paragraph id="HC9F65045AB7B4F00B2C2417787A9E0BF"><enum>(2)</enum><text>a covered school should—</text><subparagraph id="H61DC6518D0664A1A939059C1758CDE0F"><enum>(A)</enum><text display-inline="yes-display-inline">protect the personal information of every student, as required under section 444 of the General Education Provisions Act (commonly known as the <quote>Family Educational Rights and Privacy Act of 1974</quote> ) (<external-xref legal-doc="usc" parsable-cite="usc/20/1232g">20 U.S.C. 1232g</external-xref>); and</text></subparagraph><subparagraph id="HF6074B66FF43439591BDF08B3ED3FF52"><enum>(B)</enum><text>be parent-led and locally managed with State oversight;</text></subparagraph></paragraph><paragraph id="HD52262EF5FE04022AE3D7EB41F3FC465"><enum>(3)</enum><text>Federal law enforcement agencies should not target a parent for exercising First Amendment rights on school property or in school board meetings; and</text></paragraph><paragraph id="H928D30AEF2184E45A6536179AE43D2DD"><enum>(4)</enum><text display-inline="yes-display-inline">a parent should have the ability to choose the school that the children of such parent attend.</text></paragraph></section><section id="H3B47CE70530D4A69999AB83296C1082F"><enum>4.</enum><header>Prohibitions</header><subsection id="HF4095B7E6C214E96968110BFE46C8A66"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">A covered school may not—</text><paragraph id="H7A73394FF110482C9B2BE723BA3E67B6"><enum>(1)</enum><text display-inline="yes-display-inline">compel a teacher or student to adopt, affirm, adhere to, or profess—</text><subparagraph id="H51AFB403F4E248D7AE530C7FA2A5BF3B"><enum>(A)</enum><text>any academic discipline, program, or activity that is premised on the idea that—</text><clause id="H8FC3D6013E184D0B886D290ADAA78F7C"><enum>(i)</enum><text>the United States is a Nation founded on White supremacy and oppression, or that these forces are at the root of American society;</text></clause><clause id="HBA4E4539C4EA45CCB1287BD4D75F6BA4"><enum>(ii)</enum><text>one race or sex is inherently superior to another race or sex;</text></clause><clause id="H0426CD258D9849FC8842373ED6F0D819"><enum>(iii)</enum><text>the United States is fundamentally racist or sexist;</text></clause><clause id="HB59C673A5CFF4AA6A70402D3963B34CE"><enum>(iv)</enum><text>an individual, by virtue of his or her race or sex, is inherently racist, sexist, or oppressive, whether consciously or unconsciously;</text></clause><clause id="H8C4719D096B84AE089FB5D529A704040"><enum>(v)</enum><text>an individual should be discriminated against or receive adverse treatment solely or partly because of his or her race or sex;</text></clause><clause id="H502FE0DACD234452B9D230EC86DB2C1D"><enum>(vi)</enum><text>members of one race or sex cannot and should not attempt to treat others without respect to race or sex;</text></clause><clause id="HD3C6DF403E9A4E74BF71D4D064F4BD45"><enum>(vii)</enum><text>an individual’s moral character is necessarily determined by his or her race or sex;</text></clause><clause id="HC8E6DD73199641528E1BD89955ECA4E3"><enum>(viii)</enum><text>an individual, by virtue of his or her race or sex, bears responsibility for actions committed in the past by other members of the same race or sex;</text></clause><clause id="H5961AEABE8704BE9B810CD53FE1E4797"><enum>(ix)</enum><text>any individual should feel discomfort, guilt, anguish, or any other form of psychological distress on account of his or her race or sex; or</text></clause><clause id="HDD36D26D9CCA4981976DF29E625FBE36"><enum>(x)</enum><text>meritocracy or traits such as a hard work ethic are racist or sexist, or were created by a particular race to oppress another race; or</text></clause></subparagraph><subparagraph id="H85FF4522BB8D440CA16541C648B24B24"><enum>(B)</enum><text display-inline="yes-display-inline">an idea, where such compulsion violates title IV or title VI of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000c">42 U.S.C. 2000c et seq.</external-xref>);</text></subparagraph></paragraph><paragraph id="HE1EBCACD7DF049A0A7097E31940AD3C0"><enum>(2)</enum><text display-inline="yes-display-inline">compel a student to observe or espouse obscene or sexual materials without the consent of a parent of such student;</text></paragraph><paragraph id="H6DE047F3FC074550BDF3AA87CF329A58"><enum>(3)</enum><text display-inline="yes-display-inline">instruct or require an employee of such school to refer to a student using a pronoun not associated with the biological sex of such student, without obtaining consent to do so from a parent of such student;</text></paragraph><paragraph id="H6F3EC37A8A9B47C6B6BF387B0022D424"><enum>(4)</enum><text display-inline="yes-display-inline">act as the agent of a parent of a student enrolled in such school, for purposes of—</text><subparagraph id="H62EC0B08E4A0463BB866E7DD5C42985E"><enum>(A)</enum><text>providing verifiable parental consent; or</text></subparagraph><subparagraph id="HCB19B304F1BB4B488A3A8F3B1589D496"><enum>(B)</enum><text>receiving a notice or other information required to be provided to a parent of such student; or</text></subparagraph></paragraph><paragraph id="H2FAA90AA50B8488D8914F23740A2A5F0"><enum>(5)</enum><text display-inline="yes-display-inline">neglect to report sexual assault or sexual harassment on school property to the appropriate law enforcement authorities.</text></paragraph></subsection><subsection id="H71B7A24B87D9434DABBCA64A815FC8B6"><enum>(b)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in this section may be construed to prohibit a teacher or a student from discussing public policy issues or matters of public debate.</text></subsection></section><section id="H6A0B5D002CD849639265662994BEE5A2"><enum>5.</enum><header>Private right of action</header><subsection id="HB13C337F1E18478F8CDE5D6E9449F574"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">A parent aggrieved by a violation of section 4 may commence a civil action against the covered school responsible for the violation.</text></subsection><subsection id="H23946C92C863401EBA3385509323D67B"><enum>(b)</enum><header>Relief</header><text>In any action under subsection (a), the court may award appropriate relief, including—</text><paragraph id="H5C6529F0740B4F61B8B640843205BAA9"><enum>(1)</enum><text>temporary, preliminary, or permanent injunctive relief;</text></paragraph><paragraph id="HD5A8C1ABF960460D860CDE3A49676697"><enum>(2)</enum><text>compensatory damages;</text></paragraph><paragraph id="HCCCACA309FDF44BA9ED62C9A2F92E8E5"><enum>(3)</enum><text>punitive or exemplary damages; and</text></paragraph><paragraph id="H60FA0C5219474F6E9E59E31EBD5E6F0C"><enum>(4)</enum><text>reasonable fees for attorneys.</text></paragraph></subsection><subsection id="H1752BD5335404E1EBA8B8431174329CE"><enum>(c)</enum><header>Statute of limitations</header><text display-inline="yes-display-inline">An action under this section shall be brought not later than 30 days after the date on which the violation of section 4 occurred.</text></subsection><subsection id="H46400A6CBB90456FAAC734249E8AC619"><enum>(d)</enum><header>Attorney General</header><text display-inline="yes-display-inline">In a case in which a parent commences a civil action under subsection (a), the Attorney General shall have the exclusive authority to oversee, as appropriate, any investigation conducted by the Federal Government in connection with such action.</text></subsection></section><section id="H1F4863F78B704DF08C46B0161F861172"><enum>6.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H79425CAFF0464E138C1CD927F5A24738"><enum>(1)</enum><header>Biological man</header><text display-inline="yes-display-inline">The term <term>biological man</term> means an individual who is recognized as a male on the date of the birth of such individual, based on the genetic and reproductive biological characteristics of such individual.</text></paragraph><paragraph id="HFFFD4522A3B74E5AA9D508D4376F4A5C"><enum>(2)</enum><header>Biological sex</header><text display-inline="yes-display-inline">The term <term>biological sex</term> means the sex recognized on the date of birth of the individual based on the genetic and reproductive biological characteristics of such individual.</text></paragraph><paragraph id="H12FD2CAF56004517A6D435468CD69C1E"><enum>(3)</enum><header>Biological woman</header><text display-inline="yes-display-inline">The term <term>biological woman</term> means an individual who is recognized as a female on the date of the birth of such individual, based on the genetic and reproductive biological characteristics of such individual.</text></paragraph><paragraph id="H768C9ED2547A49C6B54D964C215A73B6"><enum>(4)</enum><header>Covered school</header><text>The term <term>covered school</term> means an elementary school or secondary school, as such terms are defined in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text></paragraph><paragraph id="HDD90F4BCF02843F193F0FD06A9169B67"><enum>(5)</enum><header>Obscene material</header><text display-inline="yes-display-inline">The term <term>obscene material</term> means material that, considered as a whole—</text><subparagraph id="HD64D01A5CC074C0788F5046868634958"><enum>(A)</enum><text>appeals to—</text><clause id="H9B630BC368AF41D89C539B8C8B05A097"><enum>(i)</enum><text>the prurient interest; or</text></clause><clause id="H2BAA2DBB434649328F9D79823EC8387E"><enum>(ii)</enum><text>a shameful or morbid interest in nudity, sexual conduct, sexual excitement, excretory functions or products thereof, or sadomasochistic abuse;</text></clause></subparagraph><subparagraph id="H9E22CD7FBD0342779B66C7F3B5F24932"><enum>(B)</enum><text>goes substantially beyond customary limits of candor in description or representation of the matters described in clause (A)(ii); and</text></subparagraph><subparagraph id="H9508B774878246A78CAD91A1FFB720F1"><enum>(C)</enum><text>does not have serious literary, artistic, political, or scientific value.</text></subparagraph></paragraph><paragraph id="HD802526C8BC44D0C99594EE73E4C9F4C"><enum>(6)</enum><header>Parent</header><text display-inline="yes-display-inline">The term <term>parent</term> has the meaning given such term in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text></paragraph></section></legis-body></bill>
