which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend section 1951 of title 18, United States Code (commonly known as the Hobbs Act), and for other purposes.</official-title></form><legis-body id="HF46E21DEE96C468F9CA4E12F5EE5CF57" style="OLC"><section display-inline="no-display-inline" id="H4BC2A13EC5D747A785A57298B7FC0ADE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Freedom From Union Violence Act of 2023</short-title></quote>.</text></section><section id="H4B4F96D193CA439AA3A03F22D3D87EAA"><enum>2.</enum><header>Interference with commerce by threats or violence</header><text display-inline="no-display-inline">Section 1951 of title 18, United States Code, is amended to read as follows:</text><quoted-block id="H7A0FC6C3E4934E0EB07AAA4CC7817536" style="USC"><section id="H073C95DAA99040EDB6F79D3D0323E3AB"><enum>1951.</enum><header>Interference with commerce by threats or violence</header><subsection id="H8A045CD8452748E8AECE97647A18AD27"><enum>(a)</enum><header>Prohibition</header><text>Except as provided in subsection (c), whoever in any way or degree obstructs, delays, or affects commerce or the movement of any article or commodity in commerce, by robbery or extortion, or attempts or conspires so to do, or commits or threatens physical violence to any person or property in furtherance of a plan or purpose to do anything in violation of this section, shall be fined not more than $100,000, imprisoned for a term of not more than 20 years, or both.</text></subsection><subsection id="H2697E4164F50490CAA1F9359C3BEB658"><enum>(b)</enum><header>Definitions</header><text>For purposes of this section—</text><paragraph id="H98D438BB8860456C88F50859BB073DE3"><enum>(1)</enum><text>the term <term>commerce</term> means any—</text><subparagraph id="H72B295218F6149308DEBD9FFAF332FDF"><enum>(A)</enum><text>commerce within the District of Columbia, or any territory or possession of the United States;</text></subparagraph><subparagraph id="H6CFFB446D72F40F1990F2A841A977FC7"><enum>(B)</enum><text>commerce between any point in a State, territory, possession, or the District of Columbia and any point outside thereof;</text></subparagraph><subparagraph id="H6AFD841D0D01498CBD73CDA39F2A90F1"><enum>(C)</enum><text>commerce between points within the same State through any place outside that State; and</text></subparagraph><subparagraph id="HED52C291441540D6953AD41D62C250D0"><enum>(D)</enum><text>other commerce over which the United States has jurisdiction;</text></subparagraph></paragraph><paragraph id="HDE28D46D684949318B8646A487589DB6"><enum>(2)</enum><text>the term <term>extortion</term> means the obtaining of property from any person, with the consent of that person, if that consent is induced—</text><subparagraph id="H42724435B4B64D11B422CDA673E88E7F"><enum>(A)</enum><text>by actual or threatened use of force or violence, or fear thereof;</text></subparagraph><subparagraph id="H6C817030C55742CFBEAA65168C951D0A"><enum>(B)</enum><text>by wrongful use of fear not involving force or violence; or</text></subparagraph><subparagraph id="H27ACF68797114B37BB0B9406D8FD7B28"><enum>(C)</enum><text>under color of official right;</text></subparagraph></paragraph><paragraph id="HA6776F3DB36D441B96062058072963C1"><enum>(3)</enum><text>the term <term>labor dispute</term> has the same meaning as in section 2(9) of the National Labor Relations Act (<external-xref legal-doc="usc" parsable-cite="usc/29/152">29 U.S.C. 152(9)</external-xref>); and</text></paragraph><paragraph id="HF60808B1231E416C8A623800038FA4D4"><enum>(4)</enum><text>the term <term>robbery</term> means the unlawful taking or obtaining of personal property from the person or in the presence of another, against his or her will, by means of actual or threatened force or violence, or fear of injury, immediate or future—</text><subparagraph id="HB19A4B3E6582457188FA2F73D6E08A39"><enum>(A)</enum><text>to his or her person or property, or property in his or her custody or possession; or</text></subparagraph><subparagraph id="H59498B6FD8FC4203822A7F39B6708EFB"><enum>(B)</enum><text>to the person or property of a relative or member of his or her family, or of anyone in his or her company at the time of the taking or obtaining.</text></subparagraph></paragraph></subsection><subsection id="H8C6468F44A67435DB1BA765EC37C686D"><enum>(c)</enum><header>Exempted conduct</header><paragraph id="H11D0C2EDE7334F5CB5C32EB7104BABC8"><enum>(1)</enum><header>In general</header><text>Subsection (a) does not apply to any conduct that—</text><subparagraph id="HBF82C6448D214CF4809D53084422CEBF"><enum>(A)</enum><text>is incidental to otherwise peaceful picketing during the course of a labor dispute;</text></subparagraph><subparagraph id="H3663B5ECDDC84256B005C74D23EB3C84"><enum>(B)</enum><text>consists solely of minor bodily injury, or minor damage to property, or threat or fear of such minor injury or damage; and</text></subparagraph><subparagraph id="H81E653A42EEF47549C659C58EDAC8D8C"><enum>(C)</enum><text>is not part of a pattern of violent conduct or of coordinated violent activity.</text></subparagraph></paragraph><paragraph id="H0BB29C28639547488771130F73177992"><enum>(2)</enum><header>State and local jurisdiction</header><text>Any violation of this section that involves any conduct described in paragraph (1) shall be subject to prosecution only by the appropriate State and local authorities.</text></paragraph></subsection><subsection id="H80F9210C42024973B596E62D4A9E92FE"><enum>(d)</enum><header>Effect on other law</header><text>Nothing in this section shall be construed—</text><paragraph id="HF6B6F1A82D3F40958B8FA185F051EC38"><enum>(1)</enum><text>to repeal, amend, or otherwise affect—</text><subparagraph id="H2880D971E61D4AA28825B8FBB61D960A"><enum>(A)</enum><text>section 6 of the <act-name parsable-cite="CLAY">Clayton Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/15/17">15 U.S.C. 17</external-xref>);</text></subparagraph><subparagraph id="H880E44BCBBE9423C81CF39B8B3046562"><enum>(B)</enum><text>section 20 of the <act-name parsable-cite="CLAY">Clayton Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/29/52">29 U.S.C. 52</external-xref>);</text></subparagraph><subparagraph id="H0EEADF411E0948CAA7EFBEBEF6463120"><enum>(C)</enum><text>any provision of the Norris-LaGuardia Act (<external-xref legal-doc="usc" parsable-cite="usc/29/101">29 U.S.C. 101 et seq.</external-xref>);</text></subparagraph><subparagraph id="H2551FC86546A45F18002BCC73AF0D9E9"><enum>(D)</enum><text>any provision of the National Labor Relations Act (<external-xref legal-doc="usc" parsable-cite="usc/29/151">29 U.S.C. 151 et seq.</external-xref>); or</text></subparagraph><subparagraph id="HF780E53780EB4AD79B59D38CC45F9A71"><enum>(E)</enum><text>any provision of the Railway Labor Act (<external-xref legal-doc="usc" parsable-cite="usc/45/151">45 U.S.C. 151 et seq.</external-xref>); or</text></subparagraph></paragraph><paragraph id="HA6EF9B85D7AE4BF9BA775FBCA39C8B35"><enum>(2)</enum><text>to preclude Federal jurisdiction over any violation of this section, on the basis that the conduct at issue—</text><subparagraph id="H2F78025A4F104DB791D54E410C7986F7"><enum>(A)</enum><text>is also a violation of State or local law; or</text></subparagraph><subparagraph id="H85DA21460393431692485C32A17DACD3"><enum>(B)</enum><text>occurred during the course of a labor dispute or in pursuit of a legitimate business or labor objective.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
