which was referred to the <committee-name committee-id="HAS00">Committee on Armed Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the National Defense Authorization Act for Fiscal Year 2021, to modify the prohibition on the acquisition by the Department of Defense of certain items containing a perfluoroalkyl substance or polyfluoroalkyl substance.</official-title></form><legis-body id="H03426303DC084DBDB2278A835A4B0938" style="OLC"><section id="H24F5E41845E24CF8BB01C08B26C76C8F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>PFAS Free Military Purchasing Act</short-title></quote>.</text></section><section id="HCEF0609DBBA245D2A744ACAD4EC02721"><enum>2.</enum><header>Restriction on Department of Defense acquisition of covered items containing or produced using certain substances</header><subsection id="H1014BAE8F8834290A2D96642399D805C"><enum>(a)</enum><header>Modification</header><text display-inline="yes-display-inline">Section 333 of the National Defense Authorization Act for Fiscal Year 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/116/283">Public Law 116–283</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/10/3062">10 U.S.C. 3062</external-xref> note; 134 Stat. 3531) is amended to read as follows: </text><quoted-block style="OLC" id="H49B5FCA511C540D99E9EF6772FAC056B" display-inline="no-display-inline"><section id="H2B6406EDB2C642BB966211CCC39661F7"><enum>333.</enum><header>Restriction on Department of Defense acquisition of covered items containing or produced using certain substances</header><subsection id="H51316E786AD64091B9F3E57182C8DDA2"><enum>(a)</enum><header>Prohibition beginning April 1, 2023</header><paragraph id="H8AD01BB846CB4BD69F96BE29AABB2F16"><enum>(1)</enum><header>Prohibition</header><text display-inline="yes-display-inline">During the period beginning on April 1, 2023, and ending on April 1, 2025, the Secretary of Defense may not acquire any covered item that contains perfluorooctane sulfonate (PFOS) or perfluorooctanoic acid (PFOA). </text></paragraph><paragraph id="H2322F879368D45498DBC123258FCE2E8"><enum>(2)</enum><header>Covered item defined</header><text>In this subsection, the term <quote>covered item</quote> means—</text><subparagraph id="HA53111DE9DEC4E24858AAEBEAF9A89FB"><enum>(A)</enum><text display-inline="yes-display-inline">nonstick cookware or cooking utensils for use in galleys or dining facilities; and</text></subparagraph><subparagraph id="H451EF8D89B07430DA3CB072342512B8F"><enum>(B)</enum><text>upholstered furniture, carpets, and rugs that have been treated with stain-resistant coatings.</text></subparagraph></paragraph></subsection><subsection id="H0103262F5D3746D0A61BA9D3EEE50723"><enum>(b)</enum><header>Prohibition beginning April 1, 2025</header><paragraph id="H541F2AF47FA742FAB65EF87A95CF71F9"><enum>(1)</enum><header>Prohibition</header><text>Beginning on April 1, 2025, the Secretary of Defense may not acquire any covered item that contains or is produced using any of the following:</text><subparagraph id="HC8F033BDD6F94CF0A5586A99FE8B5E4B"><enum>(A)</enum><text display-inline="yes-display-inline">Perfluorooctane sulfonate (PFOS). </text></subparagraph><subparagraph id="H9E753FB51FD948EC95A35A2805039620"><enum>(B)</enum><text>Perfluorooctanoic acid (PFOA). </text></subparagraph><subparagraph id="H0983090B8D5E4446AF3F9913E942AB1E"><enum>(C)</enum><text>Perfluorobutane sulfonate (PFBS).</text></subparagraph><subparagraph id="H392AC0508AD548058E22BC6690858D6E"><enum>(D)</enum><text>Perfluorobutanoic acid (PFBA).</text></subparagraph><subparagraph id="H963CB8339C3145E9B41E2D901D2D0BA1"><enum>(E)</enum><text>Perfluorohexanoic acid (PFHxA).</text></subparagraph><subparagraph id="H325547197C4B4D35AE5F2803E1495B37"><enum>(F)</enum><text>Perfluoroheptanoic acid (PFHpA).</text></subparagraph><subparagraph id="H388ECA15E19743DAA24073D5F416D881"><enum>(G)</enum><text>Perfluorohexanesulfonic acid (PFHxS).</text></subparagraph><subparagraph id="H26C22ED678EF4B5D8BD3D47BCC24FA5C"><enum>(H)</enum><text>Perfluoroheptane sulfonic acid (PFHpS). </text></subparagraph><subparagraph id="HA6A53B52732E45B1965FB4818C698327"><enum>(I)</enum><text>Perfluorononanoic acid (PFNA). </text></subparagraph><subparagraph id="HD23F8B158FA4462AB9CFAB56668B4BE9"><enum>(J)</enum><text>Perfluorodecanoic Acid (PFDA). </text></subparagraph><subparagraph id="HF2FD7CF8388249B1ACB126683B445FFA"><enum>(K)</enum><text>Perfluoroundecanoic acid (PFUnA).</text></subparagraph><subparagraph id="H6EBCC36BA20F45C8B81D03D216E911AC"><enum>(L)</enum><text>Perfluorododecanoic acid (PFDoDA). </text></subparagraph><subparagraph id="H4F94151DA9D6411E9E3B7EE6DA9FEACB"><enum>(M)</enum><text>Perfluorooctanesulfonamide (PFOSA or FOSA).</text></subparagraph><subparagraph id="H9C70F8B25CCA4A7EBD67957265C651CC"><enum>(N)</enum><text>Hexafluoropropylene Oxide (HFPO) Dimer Acid (GenX).</text></subparagraph></paragraph><paragraph id="H9B97FC628E564B27899563420DE7591C"><enum>(2)</enum><header>Implementation</header><text display-inline="yes-display-inline">In carrying out this subsection, the Secretary shall include the prohibition under paragraph (1) as a term in any contract or other agreement entered into on or after April 1, 2025, by the Secretary for the acquisition of a covered item.</text></paragraph><paragraph id="H08F4979C92F946069019F8CA8C39B955"><enum>(3)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in this subsection shall be construed as—</text><subparagraph id="H35FC7A6F9D134D9CAE39E3D7399D5319"><enum>(A)</enum><text display-inline="yes-display-inline">requiring the disposal of, or otherwise affecting, covered items acquired by the Secretary of Defense prior to April 1, 2025; or</text></subparagraph><subparagraph id="H11B32B4F6628407C84606517A1B579D2"><enum>(B)</enum><text display-inline="yes-display-inline">imposing an obligation on the Secretary to test covered items to confirm the absence of perfluoroalkyl substances or polyfluoroalkyl substances.</text></subparagraph></paragraph><paragraph id="H57C87675F37F4992A965CDD1F5824653"><enum>(4)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph id="H6E13B9F6A50B4284B6828ACCA80F8ACD"><enum>(A)</enum><text>The term <term>covered item</term> means—</text><clause id="H1F5E8266E8F0471CB790FA5FD41B0B0C"><enum>(i)</enum><text>non-stick cookware or food service ware for use in galleys or dining facilities;</text></clause><clause id="H71C518ADFE184E66A093944B6342B177"><enum>(ii)</enum><text>food packaging materials;</text></clause><clause id="H0B53E5BBEA224749BD1DE5E8E7673F69"><enum>(iii)</enum><text>cleaning products, including floor waxes;</text></clause><clause id="H4F98E36D84E54AD09E963225A7ABC257"><enum>(iv)</enum><text>carpeting;</text></clause><clause id="HFE0921907C264456B8AD41B106EAECAF"><enum>(v)</enum><text>rugs, curtains, or upholstered furniture;</text></clause><clause id="H514809655DE042BA87C5DAE4B15B08F3"><enum>(vi)</enum><text>sunscreen;</text></clause><clause id="HCE54F5CDFBE74CC7AA10EC801828B8D4"><enum>(vii)</enum><text display-inline="yes-display-inline">shoes and clothing for which treatment with a perfluoroalkyl substance or polyfluoroalkyl substance is not necessary for an essential function; and</text></clause><clause id="HBC08E5CA9E83447086C76037CA51F96B"><enum>(viii)</enum><text>such other items as may be determined by the Secretary.</text></clause></subparagraph><subparagraph id="H6F187A3C197A470C967497FD6F5B76FB"><enum>(B)</enum><text>The term <term>perfluoroalkyl substance</term> means a man-made chemical of which all of the carbon atoms are fully fluorinated carbon atoms.</text></subparagraph><subparagraph id="H99E5D3589C4E424699655D6CCC055CC2"><enum>(C)</enum><text display-inline="yes-display-inline">The term <term>polyfluoroalkyl substance</term> means a man-made chemical containing at least one fully fluorinated carbon atom and at least one nonfluorinated carbon atom.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HBB5AB1620C1A483B87720B1A18E8F538"><enum>(b)</enum><header>Annual reports</header><paragraph id="H0891475652904319901780C0FF91C9E3"><enum>(1)</enum><header>Reports</header><text>Not later than 270 days after the date of the enactment of this Act, and annually thereafter, the Secretary of Defense shall submit to the Committees on Armed Services of the House of Representatives and the Senate a report containing a detailed description of the following:</text><subparagraph id="H1D82324715694757B595860C6300B04F"><enum>(A)</enum><text display-inline="yes-display-inline">Steps taken to identify covered items acquired by the Secretary of Defense that contain or are produced using perfluoroalkyl substances or polyfluoroalkyl substances.</text></subparagraph><subparagraph id="H5789A14EA4C94EF093F0065D5DB0D7FA"><enum>(B)</enum><text display-inline="yes-display-inline">Steps taken to limit the acquisition by the Secretary of covered items that contain or are produced using perfluoroalkyl substances or polyfluoroalkyl substances.</text></subparagraph><subparagraph id="H8ABFE883CEB946B1B9DC4580E4FAEBD9"><enum>(C)</enum><text display-inline="yes-display-inline">Planned steps of the Secretary to limit the acquisition of covered items that contain or are produced using perfluoroalkyl substances or polyfluoroalkyl substances.</text></subparagraph></paragraph><paragraph id="H5D9E08BB86DD49C181F2F0A4BC2C2163"><enum>(2)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this subsection, the terms <quote>covered item</quote>, <quote>perfluoroalkyl substance</quote>, and <quote>polyfluoroalkyl substance</quote> have the meanings given those terms in section 333(b) of the National Defense Authorization Act for Fiscal Year 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/116/283">Public Law 116–283</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/10/3062">10 U.S.C. 3062</external-xref> note; 134 Stat. 3531), as amended by subsection (a).</text></paragraph></subsection></section></legis-body></bill>
