which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name>, and in addition to the Committees on <committee-name committee-id="HWM00">Ways and Means</committee-name>, <committee-name committee-id="HAG00">Agriculture</committee-name>, <committee-name committee-id="HED00">Education and the Workforce</committee-name>, <committee-name committee-id="HIF00">Energy and Commerce</committee-name>, and <committee-name committee-id="HBA00">Financial Services</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To extend immigration benefits to survivors of domestic violence, sexual assault, human trafficking, and other gender-based violence, and for other purposes.</official-title></form><legis-body id="H986BB8F0D212463FAD37BC7DDD35D7DA" style="OLC"><section id="HC43C331B995B4DF4BD31350E66D537A0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Working for Immigrant Safety and Empowerment Act of 2023</short-title></quote> or as the <quote><short-title>WISE Act of 2023</short-title></quote>.</text></section><section id="H74BAFD83D1D14AA28084074393CD2FB2"><enum>2.</enum><header>Purpose; sense of Congress</header><subsection id="H743B958134A94944B680848750DF493C"><enum>(a)</enum><header>Purpose</header><text display-inline="yes-display-inline">The purpose of this Act is to remove barriers to immigration status for non-citizen survivors of domestic violence, sexual assault, human trafficking, and other crimes who may be eligible for protections under the Violence Against Women Act of 1994 (VAWA) and the Trafficking Victims Protection Act of 2000 (TVPA) and other vulnerable immigrants.</text></subsection><subsection id="H7E1FB5A67D4E436AA7D73DA30C868F34"><enum>(b)</enum><header>Sense of Congress</header><text display-inline="yes-display-inline">It is the sense of Congress that the Secretary of Homeland Security should reduce barriers to, and provide victims timely access to the immigration protections such as those created in VAWA and the TVPA, as well as refrain from deporting crime victims before their applications for humanitarian relief are fully adjudicated, as it undermines critical bi-partisan protections created in VAWA and the TVPA. </text></subsection></section><section id="H16CE9292B12146C99DBBB0F28191147A"><enum>3.</enum><header>U visa reform</header><subsection id="H3767B5ADA4C8434CA8C549D534D2640B"><enum>(a)</enum><header>Physical or mental abuse</header><text display-inline="yes-display-inline">Section 101(a)(15)(U)(i)(I) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)(U)(i)(I)</external-xref>) is amended by striking the semicolon after <quote>criminal activity described in clause (iii)</quote> and inserting the following: <quote>or civil violations described in clause (iv); and</quote>.</text></subsection><subsection id="H21954ACA9C6347579F0CDF3F578F698C"><enum>(b)</enum><header>Removal of certain bases</header><text display-inline="yes-display-inline">Section 101(a)(15)(U)(i) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)(U)(i)</external-xref>) is amended by striking subclauses (II) and (III). </text></subsection><subsection id="H539CF6DD90674A5E808126FFAE96932E"><enum>(c)</enum><header>Inclusion of civil violations</header><text display-inline="yes-display-inline">Section 101(a)(15)(U)(i)(IV) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)(U)(i)(IV)</external-xref>) is amended—</text><paragraph id="HD57F388C1C6A4DA39433D3350D2A96EE"><enum>(1)</enum><text>by striking <quote>(IV)</quote> and inserting <quote>(II)</quote>; and</text></paragraph><paragraph id="H49CB57D3C9E441B1A669A2E3E5141DE4"><enum>(2)</enum><text>by inserting after <quote>criminal activity described in clause (iii)</quote> the following: <quote>or civil violations described in clause (iv)</quote>.</text></paragraph></subsection><subsection id="HDDC03E7723734B1F9AE9C61E6BB2986B"><enum>(d)</enum><header>Civil violations described</header><text display-inline="yes-display-inline">Section 101(a)(15)(U)) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)(U)</external-xref>) is amended—</text><paragraph id="HA4881D80F73B4D88BE0C6A5BEDCD01F2"><enum>(1)</enum><text>in clause (ii)(II), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="H004DCDCB93B1491BBD718F06041159CE"><enum>(2)</enum><text>in clause (iii), by striking <quote>or</quote> at the end and inserting <quote>and</quote>; and </text></paragraph><paragraph id="HF303F384659E40C4A5BA6131E066DD4D"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="HB87F03500B0149B7B95D865EEDA62B14" display-inline="no-display-inline"><clause id="H444CCEA07107464D97D4188789141EC6"><enum>(iv)</enum><text display-inline="yes-display-inline">the term <term>civil violations</term> refers to violations related to the activities described in clause (iii) that may give rise to a civil or administrative investigation, proceeding or adjudication; or</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H4AC27C90B8FB403F9A1E5968FD2E60A6"><enum>(e)</enum><header>Adding qualifying crimes and civil violations</header><text>Section 101(a)(15)(U) of the Immigration and Nationality Act, as amended by this Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)(U)</external-xref>), is further amended—</text><paragraph id="HCEEB238D94774C98B6F514522F2EC877"><enum>(1)</enum><text>by moving clause (iii) 2 ems to the left; and</text></paragraph><paragraph id="H33679F91A27943DB900BC42F54C68E29"><enum>(2)</enum><text>in clause (iii), by inserting after <quote>fraud in foreign labor contracting (as defined in section 1351 of title 18, United States Code)</quote> the following: <quote>; hate crime acts; child abuse; elder abuse;</quote>.</text></paragraph></subsection><subsection id="H9B04C279A6FB41308A3A8E887C076C2C"><enum>(f)</enum><header>Certifications</header><text display-inline="yes-display-inline">Section 214(p)(1) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184(p)(1)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" id="H4BD0B938B21E445B83144127B7C8C63F" display-inline="no-display-inline"><paragraph id="HCB5EE06E08264381B280EAD44D584BC7"><enum>(1)</enum><header>Petition filing</header><text display-inline="yes-display-inline">A petition filed by the alien under 101(a)(15)(U)(i) shall be filed with the Secretary of Homeland Security. </text></paragraph><after-quoted-block>. </after-quoted-block></quoted-block></subsection><subsection id="HB80CC0DBF6A54F858D77CE5E74C42F61"><enum>(g)</enum><header>Eliminating annual U visa numerical limitation</header><text display-inline="yes-display-inline">Section 214(p) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184(p)</external-xref>) is amended by striking paragraph (2).</text></subsection><subsection id="H38D9C87FD3A94222B5A9B3FC4C18738C"><enum>(h)</enum><header>Employment authorization</header><text display-inline="yes-display-inline">Section 214(p) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184(p)</external-xref>) is amended—</text><paragraph id="H4A883695ADFE48CDB566DBA6F7409C98"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (3)(B), by striking <quote>during the period those aliens are in lawful temporary resident status under that subsection, provide the aliens with employment authorization</quote> and inserting <quote>provide the aliens with employment authorization pursuant to paragraph (8)</quote>;</text></paragraph><paragraph id="HFA426F4252794BB7B23E2B019622E179"><enum>(2)</enum><text>in paragraph (6)—</text><subparagraph id="HB1B6A5E597F74C968F9D18DE3291703C"><enum>(A)</enum><text display-inline="yes-display-inline">in the first sentence by striking <quote>than 4 years</quote> and all that follows through the period;</text></subparagraph><subparagraph id="HB753A1509E4544B2919A3AC6654CBA7B"><enum>(B)</enum><text>in the second sentence, strike <quote>exceptional</quote> and insert <quote>compelling</quote>; and</text></subparagraph><subparagraph id="HC1407EF1B4B74403B19CB614AC8E764C"><enum>(C)</enum><text>by striking the last sentence; and</text></subparagraph></paragraph><paragraph id="H617A124183D7406197353A405A1F4855"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="HA686365AA29B421DB5927CC1E354E180" display-inline="no-display-inline"><paragraph id="H2489919D691945E3BD5EBF5CD67DA1C2"><enum>(8)</enum><header>Work authorization</header><text display-inline="yes-display-inline">The Secretary of Homeland Security shall grant employment authorization to an alien who has filed an application for nonimmigrant status under section 101(a)(15)(U) on the date that is the earlier of—</text><subparagraph id="HAD410C27B2D5449BBA084992F033108E"><enum>(A)</enum><text>the date on which the alien’s application for such status is approved; or </text></subparagraph><subparagraph id="H273C690DE03941F28C13140D29095546"><enum>(B)</enum><text>a date determined by the Secretary that is not later than 180 days after the date on which the alien filed the application.</text></subparagraph><continuation-text continuation-text-level="paragraph">Eligibility for work authorization in the United States under another provision of this Act does not preclude the issuance of work authorization under this paragraph. Such employment authorization shall continue in effect while the alien has temporary resident status under section 101(a)(15)(U).</continuation-text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H54AC633379AC4ED9B96A2BDCD3DF4B30" commented="no"><enum>(i)</enum><header>Parole for U visa waitlist</header><text display-inline="yes-display-inline">The Secretary shall, when appropriate, grant parole to petitioners for a visa under section 101(a)(15)(U) and qualifying family members abroad who seek parole while the petitions are pending.</text></subsection><subsection id="H63B892C629954D81AFEFEF4952C94485"><enum>(j)</enum><header>Eliminate Civil Penalties for Failure To Depart</header><text>Section 240B(d)(2) of the Immigration and Nationality Act (8 USC 1229c(d)(2)) is amended to read as follows:</text><quoted-block style="OLC" id="H00615EEE9A764994A64C03D217354715" display-inline="no-display-inline"><paragraph id="H09B21C1FCDB74DA5A7518ED989073E9D"><enum>(2)</enum><header>Application of VAWA and TVPA protections</header><text display-inline="yes-display-inline">The restrictions on relief under paragraph (1) shall not apply to relief under section 240A or section 245 on the basis of—</text><subparagraph id="H8670085AFA34440094382087A568356C"><enum>(A)</enum><text>a petition filed under section 101(a)(15)(U);</text></subparagraph><subparagraph id="H7E46B6D2C2DE409D83F3AADCE09F027C"><enum>(B)</enum><text>a petition filed under section 101(a)(27)(J);</text></subparagraph><subparagraph id="HBF593CE4074443B2A8CFB9F6D9F32F49"><enum>(C)</enum><text>adjustment of status application filed under section 245(h);</text></subparagraph><subparagraph id="H2024767F7043447AA3C450EA3B9274FC"><enum>(D)</enum><text>a petition filed under section 101(a)(15)(T);</text></subparagraph><subparagraph id="HDB7F9D6B6D7E45CDA34F417D56A9CEC8"><enum>(E)</enum><text display-inline="yes-display-inline">a petition or application referred to under section 101(a)(51) filed by a VAWA self-petitioner; or</text></subparagraph><subparagraph id="HCBA2DF4FE41E4EDA94692D49AEE3D924"><enum>(F)</enum><text>a petition filed under section 240A(b)(2), or under section 244(a)(3) (as in effect prior to March 31, 1997).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HFA9EC37AE56D45C48F7DEB3104E3092E"><enum>(k)</enum><header>Aging out determinations</header><paragraph id="H5627148FFD1040209F480AE77C84AEBD"><enum>(1)</enum><text>Section 214(p)(7)(A) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184(p)(7)(A)</external-xref>) is amended—</text><subparagraph id="HD53D1E911F9C44B3BEB087970DEBFD1E"><enum>(A)</enum><text>by striking <quote>unmarried</quote>; and</text></subparagraph><subparagraph id="HF11739FADB5146E2B2302DEFB3871F21"><enum>(B)</enum><text>by striking <quote>but while it was pending</quote>.</text></subparagraph></paragraph><paragraph id="HB8C6BB15AB354E569F7553EA54E577E7"><enum>(2)</enum><text>Section 214(p)(7)(B) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184(p)(7)(B)</external-xref>) is amended by striking <quote>but while it is pending</quote>.</text></paragraph><paragraph id="HB1990DF9981E4E25B69FDE41B5012465" commented="no"><enum>(3)</enum><text>Section 245(m)(3) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1255">8 U.S.C. 1255(m)(3)</external-xref>) is amended—</text><subparagraph id="H8759D7E45A6449E0B6DF0588D2CE3E94"><enum>(A)</enum><text>by inserting <quote><header-in-text level="subparagraph" style="OLC"><enum-in-header>(A)</enum-in-header><enum-in-header> In</enum-in-header> general.</header-in-text>—</quote> before <quote>Upon approval</quote>; and </text></subparagraph><subparagraph id="H7904E073AB124B0BB7000A39634456D0"><enum>(B)</enum><text>by adding at the end the following: </text><quoted-block style="OLC" id="H3C5FD99D1A374DAD95BF9AB7699346C2" display-inline="no-display-inline"><subparagraph id="H57E3FC4DAC28431F8FB21CA9FBADE2FB" commented="no" indent="up1"><enum>(B)</enum><header>Children</header><text display-inline="yes-display-inline">An alien who seeks to adjust status or obtain an immigrant visa based upon a parent’s application for adjustment of status, and who was under 21 years of age on the date on which such parent applied for adjustment of status, shall continue to be classified as a child for purposes of this paragraph, if the alien attains 21 years of age after such parent's petition was filed.</text></subparagraph><subparagraph id="H4307E638CA3947B88DD3C64F75CE0E54" commented="no" indent="up1"><enum>(C)</enum><header>Principal aliens</header><text>A parent described subparagraph (A) shall continue to be treated as a parent for purposes of this paragraph if the alien child attains 21 years of age after his or her application for status under paragraph (1) of such section is filed.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="HB7F35D76BB224E369451E537F1422D81" commented="no"><enum>(l)</enum><header>Effective date</header><text>The amendments made by this section shall take effect as if enacted as part of the Victims of Trafficking and Violence Protection Act of 2000 (<external-xref legal-doc="public-law" parsable-cite="pl/106/386">Public Law 106–386</external-xref>; 114 Stat. 1464) for all those who were not otherwise admitted into the United States in under section 101(a)(15)(U) (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)(U)</external-xref>). </text></subsection></section><section id="HBDE9BFCB04B04D27A729C86193D83D35" section-type="subsequent-section" display-inline="no-display-inline"><enum>4.</enum><header>Immigration status for certain battered spouses and children</header><subsection id="HDE42B2AF5F7340EEBA873372A4389929"><enum>(a)</enum><header>Nonimmigrant status for certain battered spouses and children</header><text>Section 101(a)(51) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(51)</external-xref>) is amended—</text><paragraph id="HA38C6338ED1D4590895C9F4F951CA717"><enum>(1)</enum><text>in subparagraph (F), by striking <quote>or</quote> at the end;</text></paragraph><paragraph id="H0D10A84F11444C7D8DD6A3F2D81C9ED6"><enum>(2)</enum><text>in subparagraph (G), by striking the period at the end and inserting <quote>; or</quote>; and</text></paragraph><paragraph id="H0AEB12F5578F435298CD05DB6B18B291"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HAB05F00AF6684D1D8A2D8DBCB4208172" style="OLC"><subparagraph id="H3E1311CD3EC74051A6607D72FD9549E6"><enum>(H)</enum><text>section 106 as an abused derivative alien.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HC89D352758E54F0CB9A4BCF3A0BC6B58"><enum>(b)</enum><header>Relief for abused derivative aliens</header><paragraph id="H8660D542FF1D405FAD5408071CC35740"><enum>(1)</enum><header>Amendment</header><text>Section 106 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1105a">8 U.S.C. 1105a</external-xref>) is amended to read as follows:</text><quoted-block display-inline="no-display-inline" id="HE1CCB8F731C44140B819A8A9A6104E75" style="OLC"><section id="H0B43F01FB9A24C86AA1DBD324E7309A4"><enum>106.</enum><header>Relief for abused derivative aliens</header><subsection id="H8EF4E77710114DF2B028BC49D2C48A7F"><enum>(a)</enum><header>Abused derivative alien defined</header><text>In this section, the term <term>abused derivative alien</term> means an alien who—</text><paragraph id="HF62A5B1D3E144D58A4A07EAE2E7FD0D7"><enum>(1)</enum><text>is a spouse or child admitted under section 101(a)(15);</text></paragraph><paragraph id="H3D09AC5DEC2B4E9887F6BDB8D6584346"><enum>(2)</enum><text>is accompanying or following to join a principal alien admitted under such section; and</text></paragraph><paragraph id="HD5152EE6B158490F9E79C1FB71ED7322"><enum>(3)</enum><text>has been subject to battery or extreme cruelty by such principal alien.</text></paragraph></subsection><subsection id="H6322C1437EDA42D4BEBA4A915B908463"><enum>(b)</enum><header>Relief for abused derivative aliens</header><text display-inline="yes-display-inline">The Secretary of Homeland Security—</text><paragraph id="H71F7BBA1EAAD473F9BE18462C30DA652"><enum>(1)</enum><text display-inline="yes-display-inline">shall consider an abused derivative alien and any child of that alien be admissible and eligible to extend the period of admission for the period for the period that is the longer of—</text><subparagraph id="H396699CC459D484090DDE5B5E6CBC546"><enum>(A)</enum><text>the same period for which the principal alien was initially admitted; or</text></subparagraph><subparagraph id="HFF8D8027C5074A6F8EFA839781BBBFD5"><enum>(B)</enum><text>3 years;</text></subparagraph></paragraph><paragraph id="HA26F305C5D2C45048E16E0645D00DC15"><enum>(2)</enum><text>may extend any period of admission under paragraph (1) as the Secretary determines appropriate;</text></paragraph><paragraph id="H96514DFB07BA466ABA37756C2AF5AC8D"><enum>(3)</enum><text>shall grant employment authorization to an abused derivative alien and any eligible child of that alien; and</text></paragraph><paragraph id="HD571A2AD63CE4ED88707D7E611FC0E2A"><enum>(4)</enum><text>may adjust the status of an alien admitted or whose admission is extended under this section to that of an alien lawfully admitted for permanent residence if—</text><subparagraph id="HA42B718A6C1C48C28764FC3E8391927E"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="H230425A2F90D400D872019853BDA21B7"><enum>(i)</enum><text>the abused derivative alien is not inadmissible under section 212(a); or</text></clause><clause id="H4494380C1DDD4A4EB28C0A0AC5885F6F" indent="up1"><enum>(ii)</enum><text>the Secretary of Homeland Security determines that the continued presence in the United States of the abused derivative alien is justified—</text><subclause id="H1AE39905DAB946D48B6B7163FC16FBC7"><enum>(I)</enum><text>on humanitarian grounds;</text></subclause><subclause id="H06EF924A09EE4B0B8B0F2A2DC45B9107"><enum>(II)</enum><text>to ensure family unity; or</text></subclause><subclause id="H2702CFAECE2643B691084F1D055F27E5"><enum>(III)</enum><text>is otherwise in the public interest; and</text></subclause></clause></subparagraph><subparagraph id="H90EBCC267EC9450CB9E7798229A9881D"><enum>(B)</enum><text>the status under which the principal alien was admitted to the United States would have potentially allowed for eventual adjustment of status.</text></subparagraph></paragraph></subsection><subsection id="H70CC5EF5AADF4CC6B84946F1977DBEC5"><enum>(c)</enum><header>Provisions for Children</header><paragraph id="H5EBDB7F3DE0B46FCBA077E6DE3520467"><enum>(1)</enum><header>In general</header><text>An alien whose parent adjusted status to that of a lawful permanent resident under this section, and who was under 21 years of age on the date on which such parent petitioned for such adjustment, shall continue to be classified as a child if the alien attains 21 years of age after such parent’s petition was filed.</text></paragraph><paragraph id="H471FB31A1F0D4815B4E601A44DDA0F8F"><enum>(2)</enum><header>Constructive filing</header><text display-inline="yes-display-inline">For purposes of this section, an individual who qualified to file a petition under this section as of the day before the date on which the individual attained 21 years of age, and who did not file such a petition before such day, shall be deemed as having filed a petition under this section as of such day if a petition is filed before the individual attains 25 years of age and the individual shows that the battery or extreme cruelty described in subsection (a)(3) was a primary cause for the delay in filing.</text></paragraph></subsection><subsection id="HD52DA98B7B0C4AD8A1546374723850C8"><enum>(d)</enum><header>Relationship considerations</header><paragraph id="HB1A16C848B4C4517AB11001EDFEB27EB"><enum>(1)</enum><header>In general</header><text>The death of the principal alien shall not affect the status of an abused derivative alien under this section.</text></paragraph><paragraph id="H917A78BADF4B4C73A7C1AB2E67326802"><enum>(2)</enum><header>Effect of loss of status or termination of relationship</header><text>The principal alien’s loss of status or the legal termination of the abused derivative alien’s familial or marital relationship with principal alien shall not affect the status of an abused derivative alien under this section if battery or extreme cruelty by the principal alien was one central reason for such termination or loss of status.</text></paragraph><paragraph id="HD26202B0FC2F40C2A388D675E4C5F2CA"><enum>(3)</enum><header>Good faith belief in marriage</header><text>In the case of an alien who—</text><subparagraph id="HF24821DBB7F2467F9671DB4B8998B48D"><enum>(A)</enum><text>believed that he or she had married the principal alien;</text></subparagraph><subparagraph id="HF9E5AFD207C946EE84EFB595FD0E20EA"><enum>(B)</enum><text>participated in a marriage ceremony with the principal alien that was actually performed; and</text></subparagraph><subparagraph id="HDB5E526CCCEF438FB7FF18A24946A5B8"><enum>(C)</enum><text>who otherwise meets any applicable requirements under this Act to establish the existence of and bona fides of a marriage,</text></subparagraph><continuation-text continuation-text-level="paragraph">that alien may not be considered not to be the spouse of such principal alien for purposes of this section solely because the marriage to the principal alien was invalid on the basis of bigamy.</continuation-text></paragraph></subsection><subsection id="H4DA84A97003E417F9FAC74A1FB03FBE2"><enum>(e)</enum><header>Procedures</header><text display-inline="yes-display-inline">A request for relief under this section shall be handled under the procedures that apply to an alien seeking relief under—</text><paragraph id="HDA8519FBABD1407B8280F7837EE6A1CD"><enum>(1)</enum><text>any of clauses (iii) through (viii) of section 204(a)(1)(A);</text></paragraph><paragraph id="HF54EA75942C546019807B31D6A84C669"><enum>(2)</enum><text>any of clauses (ii) through (v) of section 204(a)(1)(B); or</text></paragraph><paragraph id="HAC33B4FB12E345519273CCE26C3AF102"><enum>(3)</enum><text>subparagraph (C) or (D) of section 204(a)(1).</text></paragraph></subsection><subsection id="H325C0875657C43C0B09C14B3A226D976"><enum>(f)</enum><header>Derivatives of abused derivative aliens</header><paragraph id="H763692B814C24C1DAFA5D663830AAE01"><enum>(1)</enum><header>Derivative status</header><text display-inline="yes-display-inline">Upon approval of adjustment of status of an abused derivative alien, the Secretary of Homeland Security may, to the extent necessary to avoid extreme hardship to the abused derivative alien or a covered derivative of the abused derivative alien, adjust the status of a covered derivative of the abused derivative alien to that of an alien lawfully admitted for permanent residence or issue an immigrant visa to such covered derivative.</text></paragraph><paragraph id="H2A1348906E214E7BB059BB0813B252AC"><enum>(2)</enum><header>Recording</header><text display-inline="yes-display-inline">Upon the approval of adjustment of status under paragraph (1), the Secretary of Homeland Security shall record the alien's lawful admission for permanent residence as of the date of such approval.</text></paragraph><paragraph id="H1FD98326A34F4561B71F9D5362EEBF0F"><enum>(3)</enum><header>Definition</header><text display-inline="yes-display-inline">For purposes of this subsection, the term <term>covered derivative</term> means, with respect to an abused derivative alien, a spouse, a child, or, in the case that the primary alien is an alien child, a parent who did not receive status pursuant to this section.</text></paragraph></subsection><subsection id="H92C593E02A8A4ACCA3678403A61B7543"><enum>(g)</enum><header>No effect on other eligibilities</header><text display-inline="yes-display-inline">Admission and eligibility for adjustment of status under subsection (b) shall not preclude adjustment of status based on other grounds for which the alien is eligible.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="HA05156E5E8C444BBBEAA012FC79E372C"><enum>(2)</enum><header>Clerical amendment</header><text>The table of contents preceding section 101 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref>) is amended by striking the item relating to section 106 and inserting the following:</text><quoted-block id="HD1AAD9E0D32A4E249416DE4E3AC35A56" style="OLC"><toc><toc-entry idref="H0B43F01FB9A24C86AA1DBD324E7309A4" level="section">Sec. 106. Relief for abused derivative aliens.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H632529B383F14F0482D790DA3EC3C23F" commented="no"><enum>(c)</enum><header>Survival rights to self-Petition</header><text display-inline="yes-display-inline">Section 204(h) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1154">8 U.S.C. 1154(h)</external-xref>) is amended in the second sentence by amending to read as follows: <quote>Remarriage or marriage of a VAWA self-petitioner who has filed an application or petition for relief under any provision referred to section 101(a)(51) shall have no effect on approval of such petition or application and shall not be the basis for revocation of an petition under section 205.</quote>.</text></subsection><subsection id="H8AA106A9B325420DB36D973A8A9F572B" commented="no"><enum>(d)</enum><header>Effective date</header><text>The amendments made by this section shall take effect on the date of the enactment of this Act and shall apply to VAWA self-petitioners filing applications before, on, or after the date of the enactment of this Act.</text></subsection></section><section id="H9DDD286D74C3476D9189E267D4DDA1F8"><enum>5.</enum><header>Prohibition on detention of certain victims with pending or approved petitions and applications</header><text display-inline="no-display-inline">Section 236 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1226">8 U.S.C. 1226</external-xref>) is amended by adding at the end the following:</text><quoted-block id="H50FCA7A3DC0747378ADE2411F24F7BB4" style="OLC"><subsection id="H9818F77CA1C344F189D67116D6BF906E"><enum>(f)</enum><header>Prohibition on detention of certain victims with pending or approved petitions and applications</header><paragraph id="H68029B8E2BB148009ED246B03D4D1D9D"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this Act, there shall be a presumption that the alien described in paragraph (2) shall be released from detention without conditions. The Secretary of Homeland Security may rebut the presumption if the Secretary determines, based on clear and convincing evidence that is retained in the record, including credible and individualized information, that the use of alternatives to detention will not reasonably ensure the appearance of the alien at removal proceedings, or that the alien is a danger to another person or the community. The fact that an alien has a criminal charge pending against the alien or dismissed may not be the sole factor to justify the continued detention of the alien.</text></paragraph><paragraph id="H65C93510997A408584CEB078380DC037"><enum>(2)</enum><header>Alien described</header><text>An alien described in this paragraph is an alien who—</text><subparagraph id="H598AD6AEA47940839F3CF97EB42A7CD6"><enum>(A)</enum><text>has a pending application under section 101(a)(15)(T), 101(a)(15)(U), 106, 240A(b)(2), or 244(a)(3) (as in effect on March 31, 1997); </text></subparagraph><subparagraph id="HA573E78B45E34DA9834602DB72E81579"><enum>(B)</enum><text>is a VAWA self-petitioner with a pending application for relief under a provision referred to in one of subparagraphs (A) through (G) of section 101(a)(51); or</text></subparagraph><subparagraph id="H00B43058543D44DE8E7387A883A563D6"><enum>(C)</enum><text display-inline="yes-display-inline">has a pending or approved petition under section 101(a)(27)(J) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(27)(J)</external-xref>). </text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H94B9C6D06604455586C4EFB2E5384D47"><enum>6.</enum><header>Access to certain information</header><text display-inline="no-display-inline">Section 384 of the Illegal Immigration Reform and Immigration Responsibility Act of 1996 (8 U.S.C 1367) is amended as follows:</text><paragraph id="HF6354A11421646EBA8B0C6BD0ED74946"><enum>(1)</enum><text>in subsection (a)(1)—</text><subparagraph id="HCDF065F395A447B9A98991B4E6944A4D"><enum>(A)</enum><text>by striking <quote>solely</quote> after <quote>furnished</quote>; and</text></subparagraph><subparagraph id="HBDF6A3E69DC748D084CD02EEDD11A708"><enum>(B)</enum><text>by striking <quote>or</quote> at the end;</text></subparagraph></paragraph><paragraph id="HF91A6ED60314478485102460F019B3D0"><enum>(2)</enum><text>in subsection (a)(2)—</text><subparagraph id="HFE80607476824B008DC3B316CEA2DEBD"><enum>(A)</enum><text>by inserting <quote>, files, or records,</quote> after <quote>information</quote>; </text></subparagraph><subparagraph id="HFD4C39EAF41040539ABA9A6B1454A450"><enum>(B)</enum><text>by striking <quote>relates</quote> and inserting <quote>relate</quote>; or</text></subparagraph><subparagraph id="HAC3DE8E1234749B5A012855E5D9C4EBE"><enum>(C)</enum><text>by striking the period at the end and inserting <quote>; or</quote>;</text></subparagraph></paragraph><paragraph id="H1D2811D3C2564443BBE26AA3810FD0BC"><enum>(3)</enum><text>in subsection (a), by adding at the end the following: </text><quoted-block style="OLC" id="HEE9DD8F8749F4ECC8A40E96D884C2E8B" display-inline="no-display-inline"><paragraph id="H01E5AC9CF5824D75A3AC5993AAFF6EA7"><enum>(3)</enum><text display-inline="yes-display-inline">except as provided in this subsection—</text><subparagraph id="H5CD820B2DF394909AE3FB9C5D91E2E1D"><enum>(A)</enum><text>use the information furnished by the applicant pursuant to an application or petition filed under paragraph (15)(T), (15)(U), (27)(J), or (51) of section 101(a) of the Immigration and Nationality Act, or section 240A(b)(2) of such Act, for any purpose other than to make a determination on the application, or for enforcement of subsection (c) of this section;</text></subparagraph><subparagraph id="HE74BCC98BB234DFCBED5989934B839A6"><enum>(B)</enum><text>make any publication whereby the information furnished by any particular individual would permit the individual to be identified or located; or</text></subparagraph><subparagraph id="H87FE32780DEA4C79BC69F5734CC725A7"><enum>(C)</enum><text>permit anyone other than the sworn officers and employees of the Department or bureau or agency to examine individual applications.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="H84D2F43856754CC4AFD9F7C32C922B26"><enum>(4)</enum><text>in subsection (b)(2), by striking <quote>legitimate law enforcement purpose,</quote> and inserting <quote>a criminal investigation or prosecution,</quote>;</text></paragraph><paragraph id="H06D0EF86CC334D3EB126E01573EE526E"><enum>(5)</enum><text>in subsection (b)(4), to read as follows: </text><quoted-block style="OLC" id="HA5B9B64A2D73473384DEF53CCD01167A" display-inline="no-display-inline"><paragraph id="HB5FE01E4F6C74E8DA6D41F1598A00763"><enum>(4)</enum><text display-inline="yes-display-inline">Paragraphs (2) and (3) of subsection (a) shall not apply if all the individuals in the case are adults and they have all waived, in writing, the restrictions of such subsection.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="HA6005A02C00D4CBBB64D17576AAD97C6"><enum>(6)</enum><text>in subsection (c) by striking <quote>5,000</quote> and inserting <quote>10,000</quote>; </text></paragraph><paragraph id="HE1CCA460FCA14480B219FA2A19ACD44A"><enum>(7)</enum><text>in subsection (d) by adding at the end the following: <quote>The Attorney General, Secretary of State, and the Secretary of Homeland Security shall provide Congress with an annual report regarding training provided to officers and employees, number of investigations opened for violations of paragraphs (1) through (3) of subsection (a), and the results of those investigations.</quote>; and</text></paragraph><paragraph id="H5B32569529EA47BEA64437A0E76676F1"><enum>(8)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="HD3271AF41FD04DB1BDC9129CE5D7B7EF" display-inline="no-display-inline"><subsection id="H9038BCC111E241E48C99ACAF88552509"><enum>(e)</enum><header>Remedial measures</header><text display-inline="yes-display-inline">The Attorney General, Secretary of State, and the Secretary of Homeland Security shall make rules not later than 120 days after the date of enactment of this subsection to establish a process, for the benefit of individuals harmed by violations of this section, to determine whether there has been a violation of this section, and to remedy any such violation. Such process shall include an appeal process for any determination that a violation did not occur.</text></subsection><subsection id="H507648FB1F204FE188F3ECBF8BDE0F07"><enum>(f)</enum><header>Cause of action</header><text>An individual who is injured by a violation of this section may bring a civil action for appropriate relief, including an order to strike any information obtained or provided in violation of this section from the appropriate records.</text></subsection><subsection id="H472B44927F01413A8469B22DD8A8322C"><enum>(g)</enum><header>Annual report</header><text display-inline="yes-display-inline">Each year the Attorney General, Secretary of State, and the Secretary of Homeland Security shall each report on the number of employees sanctioned for violations of this section.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H3F8925227A764DB985C24B11A83D725A" display-inline="no-display-inline"><enum>7.</enum><header>Powers of immigration officers and employees at protected areas</header><text display-inline="no-display-inline">Section 287 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1357">8 U.S.C. 1357</external-xref>) is amended by adding at the end the following:</text><quoted-block id="HDD40427760C64CD09915A4B6ACF9C42F" style="OLC"><subsection id="H7C0E5735F2404DC9A6CB717D19641669"><enum>(i)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H820476D0EACD44D6A93B39F0183B82AD"><enum>(1)</enum><text>In this subsection:</text><subparagraph id="H6676FFD2D43441D38BF37343F6759927" indent="up1"><enum>(A)</enum><text>The term <term>appropriate committees of Congress</term> means—</text><clause id="HB6352257FE534E958708199950703E48"><enum>(i)</enum><text>the Committee on Homeland Security and Governmental Affairs of the Senate;</text></clause><clause id="HFDEF593661044DDEBCCD856EFF30F82D"><enum>(ii)</enum><text>the Committee on the Judiciary of the Senate;</text></clause><clause id="H7F18DA19E6594C1DBF6AFB17A8AEA945"><enum>(iii)</enum><text>the Committee on Homeland Security of the House of Representatives; and</text></clause><clause id="H54B95834B0764665A1B07B2689A58343"><enum>(iv)</enum><text>the Committee on the Judiciary of the House of Representatives.</text></clause></subparagraph><subparagraph id="H9B827A44BEBB447C81C118825E40194A" indent="up1"><enum>(B)</enum><text>The term <term>enforcement action</term>—</text><clause id="H9F66E0976E984A1284939D093A44CCFD"><enum>(i)</enum><text>means an apprehension, arrest, interview, request for identification, search, or surveillance for the purposes of immigration enforcement; and</text></clause><clause id="H13256A54E5A144FD95EA239EDE275D33"><enum>(ii)</enum><text>includes an enforcement action at, or focused on, a protected area that is part of a joint case led by another law enforcement agency.</text></clause></subparagraph><subparagraph id="H2512368B0B3C45FCBD8A5D527A0BE5A0" indent="up1"><enum>(C)</enum><text>The term <term>exigent circumstances</term> means a situation involving—</text><clause id="H1BD4CA213707452B89BABED0B99CCC7A"><enum>(i)</enum><text>a threat to the national security of the United States;</text></clause><clause id="H686818DE66A240F58BD564F343AB2BE1"><enum>(ii)</enum><text>the imminent risk of death, violence, or physical harm to any person;</text></clause><clause id="H3E87BD5D358A489399A86EB6B62BA913"><enum>(iii)</enum><text>the immediate arrest or pursuit of an individual who poses a public safety threat; or</text></clause><clause id="H2E716EB767E64584BCABF275DFBD609B"><enum>(iv)</enum><text>the imminent risk of destruction of evidence that is material to an ongoing criminal case.</text></clause></subparagraph><subparagraph id="HF416FB460E7248109EDED769C2EC5926" indent="up1"><enum>(D)</enum><text>The term <term>prior approval</term> means—</text><clause id="HC3FBF630B78F4BAFBAF3C396C216D76E"><enum>(i)</enum><text>in the case of officers and agents of U.S. Immigration and Customs Enforcement, prior written approval to carry out an enforcement action involving a specific individual or individuals authorized by—</text><subclause id="H7FBBDB4408F84A26AABE65F0299FB799"><enum>(I)</enum><text>the Assistant Director of Operations, Homeland Security Investigations;</text></subclause><subclause id="H8EFA9B8A3B4545D994CC282EAD4FD265"><enum>(II)</enum><text>the Executive Associate Director of Homeland Security Investigations;</text></subclause><subclause id="H7D886567D508434B84EF692F61A7EF3E"><enum>(III)</enum><text>the Assistant Director for Field Operations, Enforcement and Removal Operations; or</text></subclause><subclause id="H08C16EC8DBBC40F48A8ABF20DC194757"><enum>(IV)</enum><text>the Executive Associate Director for Field Operations, Enforcement and Removal Operations;</text></subclause></clause><clause id="H0DCA236018B64411A4B28B82E868C301"><enum>(ii)</enum><text>in the case of officers and agents of U.S. Customs and Border Protection, prior written approval to carry out an enforcement action involving a specific individual or individuals authorized by—</text><subclause id="HA8F6C82F916A4D2D8A23C31628CD00CF"><enum>(I)</enum><text>a Chief Patrol Agent;</text></subclause><subclause id="HB3E68F702E0144958498F3C42E0D71FD"><enum>(II)</enum><text>the Director of Field Operations;</text></subclause><subclause id="HDFA2FA7D3A00403085EDC27B67593ABC"><enum>(III)</enum><text>the Director of Air and Marine Operations; or</text></subclause><subclause id="HE5671FB269D54A2EB56BFD11BA74BB13"><enum>(IV)</enum><text>the Internal Affairs Special Agent in Charge; and</text></subclause></clause><clause id="H0FE2C83A49DC45FAAE9C9A59DA653DE0"><enum>(iii)</enum><text>in the case of other Federal, State, or local law enforcement officers, to carry out an enforcement action involving a specific individual or individuals authorized by—</text><subclause id="H5F4EBFAABAE343908D6F0C6E2AA9FE32"><enum>(I)</enum><text>the head of the Federal agency carrying out the enforcement action; or</text></subclause><subclause id="H13BE434C0F154F97A2FE21A8366C3DA2"><enum>(II)</enum><text>the head of the State or local law enforcement agency carrying out the enforcement action.</text></subclause></clause></subparagraph><subparagraph id="H3800CDA784984BCE96583C73525C3F28" indent="up1"><enum>(E)</enum><text>The term <term>protected area</term> includes all of the physical space located within 1,000 feet of—</text><clause id="H4F0772F9DE2D4EFFBB79B564B9B59B77"><enum>(i)</enum><text display-inline="yes-display-inline">any medical or mental health treatment or health care facility, including any hospital, doctor’s office, accredited health clinic, alcohol or drug treatment center, site that serves pregnant individuals, vaccination or testing site, emergent or urgent care facility, or community health center;</text></clause><clause id="H5888C074F9A140199C7F2A659934956D"><enum>(ii)</enum><text>any public or private school, including any known and licensed day care facility, preschool, other early learning program facility, primary school, secondary school, postsecondary school (including colleges and universities), or other institution of learning (including vocational or trade schools);</text></clause><clause id="HA5F647CD48B942788F6AA4CA69E30334"><enum>(iii)</enum><text>any scholastic or education-related activity or event, including field trips and interscholastic events;</text></clause><clause id="HF3C9450E6C93475CAB05085EEDC3F9D5"><enum>(iv)</enum><text>any school bus or school bus stop during periods when school children are present on the bus or at the stop;</text></clause><clause id="H2E763FD43C4B4B47BCD5DD53CE7BB8BD"><enum>(v)</enum><text display-inline="yes-display-inline">any place where children gather, such as a playground, recreation center, childcare center, before- or after-school care center, foster care facility, or group home for children;</text></clause><clause id="HC2ED89364AD342589B03EE4E4EF9AAE2"><enum>(vi)</enum><text>any organization that—</text><subclause id="H0431650DE4A14D17863FF36E01392B2A"><enum>(I)</enum><text>assists children, pregnant individuals, victims of crime or abuse, or individuals with significant mental or physical disabilities; or</text></subclause><subclause id="HF0DBCCEC16AB4BC49399AC0857FAC58D"><enum>(II)</enum><text>provides disaster or emergency social services and assistance;</text></subclause></clause><clause id="H0D5AF4F3102B49ADB92117C05593EC71"><enum>(vii)</enum><text>any church, synagogue, mosque, or other place of worship, including buildings rented for the purpose of religious services, retreats, counseling, workshops, instruction, and education;</text></clause><clause id="H6B82DAFB9AB74B38A89F03A6187D023B"><enum>(viii)</enum><text>any Federal, State, or local courthouse, including the office of an individual’s legal counsel or representative, and a probation, parole, or supervised release office;</text></clause><clause id="HEA026AD725264C14B5FE0B49A75BDD9E"><enum>(ix)</enum><text>the site of a funeral, wedding, or other religious ceremony or observance;</text></clause><clause id="H1E8D317B05F0486BA0A5ABDF1CD51BDD"><enum>(x)</enum><text>any public demonstration, such as a march, rally, or parade;</text></clause><clause id="HBD1FC4CB8E754A1D862C0537B5BD705C"><enum>(xi)</enum><text>any domestic violence shelter, rape crisis center, supervised visitation center, family justice center, or victim services provider;</text></clause><clause id="HFDE9C40E685E44F295FCCD0375D1321D"><enum>(xii)</enum><text display-inline="yes-display-inline">any youth or teen homeless shelter; or</text></clause><clause id="H3526412835D1435CAE28A05A651AEEFC"><enum>(xiii)</enum><text>any other location specified by the Secretary of Homeland Security for purposes of this subsection.</text></clause></subparagraph></paragraph><paragraph id="H995F572DCAC44D16A69EE1ACB0ED35BE" indent="up1"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H831A95D13023431D93C86756FC4FC218"><enum>(A)</enum><text>An enforcement action may not take place at, or be focused on, a protected area unless—</text><clause id="HFEF0FE439D89419DACEF714693CEEC2B" indent="up1"><enum>(i)</enum><text>the action involves exigent circumstances; and</text></clause><clause id="H07058B9972C24EE692778E9DC7AB0EDD" indent="up1"><enum>(ii)</enum><text>prior approval for the enforcement action was obtained from the appropriate official.</text></clause></subparagraph><subparagraph id="H5C0DC92CA1424EABAEE6BB504ABA35E0" indent="up1"><enum>(B)</enum><text>If an enforcement action is initiated pursuant to subparagraph (A) and the exigent circumstances permitting the enforcement action cease, the enforcement action shall be discontinued until such exigent circumstances reemerge.</text></subparagraph><subparagraph id="HF6D60EDAC0174B7C994C704A83AB6394" indent="up1"><enum>(C)</enum><text>If an enforcement action is carried out in violation of this subsection—</text><clause id="HEE07BE233F604B98A192D8C7171DA63D"><enum>(i)</enum><text>no information resulting from the enforcement action may be entered into the record or received into evidence in a removal proceeding resulting from the enforcement action; and</text></clause><clause id="H830E94D8BD0547C993CF521AECF67E79"><enum>(ii)</enum><text>the alien who is the subject of such removal proceeding may file a motion for the immediate termination of the removal proceeding.</text></clause></subparagraph></paragraph><paragraph id="H0DE46650834C4943900E469DF26C601C" indent="up1"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HA72E33F486DA4B5A865618F67337EB49"><enum>(A)</enum><text>This subsection shall apply to any enforcement action by—</text><clause id="H3C54C5235CA64957A96EE0D557121F39" indent="up1"><enum>(i)</enum><text>officers or agents of U.S. Immigration and Customs Enforcement;</text></clause><clause id="HEAEEAF373263456885BEBFC6FDB79983" indent="up1"><enum>(ii)</enum><text>officers or agents of U.S. Customs and Border Protection; and</text></clause><clause id="H6E90C48696A4442AAC402B0DC4B2D788" indent="up1"><enum>(iii)</enum><text>any individual designated to perform immigration enforcement functions pursuant to subsection (g).</text></clause></subparagraph><subparagraph id="H339907DCF9A44995B24DF86CEEDF11C9" indent="up1"><enum>(B)</enum><text>While carrying out an enforcement action at a protected area, officers and agents referred to in subparagraph (A) shall make every effort—</text><clause id="H6AF54D7570694909B1F679370DE7973F"><enum>(i)</enum><text>to limit the time spent at the protected area;</text></clause><clause id="H9886BB94D9B64986A3517720E412B957"><enum>(ii)</enum><text>to limit the enforcement action at the protected area to the person or persons for whom prior approval was obtained; and</text></clause><clause id="H0502E81B8A55408588F8C88BFEEBD6D3"><enum>(iii)</enum><text>to conduct themselves discreetly.</text></clause></subparagraph><subparagraph id="HBD730DFD646E4542BB5EA9BD8627E6AE" indent="up1"><enum>(C)</enum><text>If, while carrying out an enforcement action that is not initiated at or focused on a protected area, officers or agents are led to a protected area, and no exigent circumstance and prior approval with respect to the protected area exists, such officers or agents shall—</text><clause id="H7BDBC0C39A4B4F5EA88E4B05221AB47E"><enum>(i)</enum><text>cease before taking any further enforcement action;</text></clause><clause id="HD6DA1AC5432E4E25824FC2EFEF75F935"><enum>(ii)</enum><text>conduct themselves in a discreet manner;</text></clause><clause id="H5F043A7D29B74B93A749248EDD3EE366"><enum>(iii)</enum><text>maintain surveillance; and</text></clause><clause id="H83E4700F9E1344C98D3036FFC36EAE59"><enum>(iv)</enum><text>immediately consult their supervisor in order to determine whether such enforcement action should be discontinued.</text></clause></subparagraph><subparagraph id="HDCC5EAC677394BFE999E0DAFC3DDD63C" indent="up1"><enum>(D)</enum><text>The limitations under this paragraph shall not apply to the transportation of an individual apprehended at or near a land or sea border to a hospital or health care provider for the purpose of providing medical care to such individual.</text></subparagraph></paragraph><paragraph id="H7B239188D7AA4466BAE094E021B340C3" indent="up1"><enum>(4)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H3F285440630E4C67BF5A9746BEBBB51E"><enum>(A)</enum><text>Each official specified in subparagraph (B) shall ensure that the employees under the supervision of that official receive annual training on compliance with—</text><clause id="H4220968D2AA14CD59234FF88D80ABCB6" indent="up1"><enum>(i)</enum><text>the requirements under this subsection in enforcement actions at or focused on protected areas and enforcement actions that lead officers or agents to a protected area; and</text></clause><clause id="H18B7568FE273479B9120EFCAAFC525C0" indent="up1"><enum>(ii)</enum><text>the requirements under section 239 of this Act and section 384 of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/8/1367">8 U.S.C. 1367</external-xref>).</text></clause></subparagraph><subparagraph id="H47AABEA22BD348A1A8EA337C5AFAE3EE" indent="up1"><enum>(B)</enum><text>The officials specified in this subparagraph are—</text><clause id="H5373B1C5CF2B466E8EF9253CEE391336"><enum>(i)</enum><text>the Chief Counsel of U.S. Immigration and Customs Enforcement;</text></clause><clause id="H3FAED470064344AD80E452FCFC3CAE01"><enum>(ii)</enum><text>the Field Office Directors of U.S. Immigration and Customs Enforcement;</text></clause><clause id="H0E2EFD918F4D450598A309F087054B78"><enum>(iii)</enum><text>each Special Agent in Charge of U.S. Immigration and Customs Enforcement;</text></clause><clause id="H326DE8F1A91946C599070657DD69AB7F"><enum>(iv)</enum><text>each Chief Patrol Agent of U.S. Customs and Border Protection;</text></clause><clause id="HB31A124085374AC994520AB8A6D2AB7B"><enum>(v)</enum><text>the Director of Field Operations of U.S. Customs and Border Protection;</text></clause><clause id="H3839755673D048D59E0585DF279B55E4"><enum>(vi)</enum><text>the Director of Air and Marine Operations of U.S. Customs and Border Protection;</text></clause><clause id="HBB0660F428EB46B2AF82FAA31B1A1D3D"><enum>(vii)</enum><text>the Internal Affairs Special Agent in Charge of U.S. Customs and Border Protection; and</text></clause><clause id="H1EC1E49455A3499A92A6BC196706FF30"><enum>(viii)</enum><text>the chief law enforcement officer of each State or local law enforcement agency that enters into a written agreement with the Department of Homeland Security pursuant to subsection (g).</text></clause></subparagraph></paragraph><paragraph id="H3AF58578AD1F4D8FAB82CD1455D4E472" indent="up1"><enum>(5)</enum><text>The Secretary of Homeland Security shall modify the Notice to Appear form (I–862)—</text><subparagraph id="H56BDA383483B418CB4D1955CBD32A9AF"><enum>(A)</enum><text>to provide the subjects of an enforcement action with information, written in plain language, summarizing the restrictions against enforcement actions at protected areas set forth in this subsection and the remedies available to the alien if such action violates such restrictions;</text></subparagraph><subparagraph id="HF7D84D37AAC24E2EB4FED28FC9FD0AA6"><enum>(B)</enum><text>so that the information described in subparagraph (A) is accessible to individuals with limited English proficiency; and</text></subparagraph><subparagraph id="H4804A1A7529F407EA5A30C9F2010CB40"><enum>(C)</enum><text>so that subjects of an enforcement action are not permitted to verify that the officers or agents that carried out such action complied with the restrictions set forth in this subsection.</text></subparagraph></paragraph><paragraph id="HA35C5611A9F44247B9B9019BEE029381" indent="up1"><enum>(6)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H9AE8479FA47243719C4D73D96744E34F"><enum>(A)</enum><text>The Director of U.S. Immigration and Customs Enforcement and the Commissioner of U.S. Customs and Border Protection shall each submit an annual report to the appropriate committees of Congress that includes the information set forth in subparagraph (B) with respect to the respective agency.</text></subparagraph><subparagraph id="H43B2D8834A0442BBAA73FFED398454FE" indent="up1"><enum>(B)</enum><text>Each report submitted under subparagraph (A) shall include, with respect to the submitting agency during the reporting period—</text><clause id="H3B19E4B0CE8440098AD3AD666BBD29E9"><enum>(i)</enum><text>the number of enforcement actions that were carried out at, or focused on, a protected area;</text></clause><clause id="H0494CB54765D4E06B080BD9CD8B0B7A5"><enum>(ii)</enum><text>the number of enforcement actions in which officers or agents were subsequently led to a protected area; and</text></clause><clause id="HBD87668417FB491B83768894EEC0F876"><enum>(iii)</enum><text>for each enforcement action described in clause (i) or (ii)—</text><subclause id="H735DDEFBAF2F48B89EBF39FC0518ABEE"><enum>(I)</enum><text>the date on which it occurred;</text></subclause><subclause id="HC7727B758AFD40C7A383375DF6081412"><enum>(II)</enum><text>the specific site, city, county, and State in which it occurred;</text></subclause><subclause id="H20D0E64A74904049B7F49105F2B205A4"><enum>(III)</enum><text>the components of the agency involved in the enforcement action;</text></subclause><subclause id="H5692F1FE9BD24B19A49AEA72FA775737"><enum>(IV)</enum><text>a description of the enforcement action, including the nature of the criminal activity of its intended target;</text></subclause><subclause id="HAE1B5D71FD934F59A832DDA2BED432C0"><enum>(V)</enum><text>the number of individuals, if any, arrested or taken into custody;</text></subclause><subclause id="H70B4DBCA65B34AE4AA9CBFC7A4D1600E"><enum>(VI)</enum><text>the number of collateral arrests, if any, and the reasons for each such arrest;</text></subclause><subclause id="H5245BD8AB71F4C0F861F3370654739FF"><enum>(VII)</enum><text>a certification whether the location administrator was contacted before, during, or after the enforcement action; and</text></subclause><subclause id="HE4E61AE4E27C4D73BDFAA8DE34BB02D9"><enum>(VIII)</enum><text>the percentage of all of the staff members and supervisors reporting to the officials listed in paragraph (4)(B) who completed the training required under paragraph (4)(A).</text></subclause></clause></subparagraph></paragraph><paragraph id="H47BB4EC54235427890017C6045400FE3" indent="up1"><enum>(7)</enum><text>Nothing in the subsection may be construed—</text><subparagraph id="H1D29674D99D145C9BC4EC651AD702A12"><enum>(A)</enum><text>to affect the authority of Federal, State, or local law enforcement agencies—</text><clause id="HC5DBCE0B14B741ABAF65BB6E5BCE3F0F"><enum>(i)</enum><text>to enforce generally applicable Federal or State criminal laws unrelated to immigration; or</text></clause><clause id="HA72E4CDD66BA4D06B6A654F81B7060C6"><enum>(ii)</enum><text>to protect residents from imminent threats to public safety; or</text></clause></subparagraph><subparagraph id="HA17B6EB358FF45339A9488F3F849CAD1"><enum>(B)</enum><text>to limit or override the protections provided in—</text><clause id="H3636AC63744040B7B5F341D54B6E8B19"><enum>(i)</enum><text>section 239; or</text></clause><clause id="H9D55171410984BFD804F242C82D2D0A1"><enum>(ii)</enum><text>section 384 of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/8/1367">8 U.S.C. 1367</external-xref>).</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H2D7ACD6C97CD4E1580BE61A0870AB856"><enum>8.</enum><header>Protections and relief for domestic violence survivors</header><subsection id="H3A355B7F7A254313BB4662023112DB4D"><enum>(a)</enum><header>Eligibility for cancellation of removal for domestic violence survivors</header><text>Section 240A(b)(2)(A)(iv) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1229b">8 U.S.C. 1229b(b)(2)(A)(iv)</external-xref>) is amended to read as follows: </text><quoted-block style="OLC" id="H1980EF8DCFDE4112AFE13B9BC6EA46D9" display-inline="no-display-inline"><clause id="H21EB4FE98A7347ECB594A4BF1008AFCA"><enum>(iv)</enum><text display-inline="yes-display-inline">the alien is not inadmissible under section 212(a)(2)(G), section 212(a)(2)(H), or section 212(a)(3) and is not deportable under section 237(a)(2)(A)(v) or section 237(a)(4); and</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HF2FA78C012CA4522B6EF94C5F8090BD9"><enum>(b)</enum><header>Judicial review in VAWA cases</header><paragraph id="HC3EF6CCCF83C44A89D538A803C142A24"><enum>(1)</enum><header>Cancellation of removal of domestic violence survivors</header><text>Section 240A(b)(2) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1229b">8 U.S.C. 1229b(b)(2)</external-xref>) is amended by adding at the end the following:</text><quoted-block id="HA3B943724BD14C669CC874FA69CB1801" style="OLC"><subparagraph id="H3B9706B4484B404AA37CE2FCA314EE3D"><enum>(E)</enum><header>Judicial review of determination for domestic violence survivors</header><text>A determination of whether an individual is eligible for or entitled to relief under this paragraph or any prior provision of law providing comparable relief, shall be subject to judicial review.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H169E54086CC0423493129E9F73F63D97"><enum>(2)</enum><header>Review of orders of removal of domestic violence survivors</header><text>Section 242(a)(1) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1252">8 U.S.C. 1252(a)(1)</external-xref>) is amended to read as follows:</text><quoted-block id="H06381B2148CA488DB6F2F9A5560F6301" style="OLC"><paragraph id="H3FA1DF06D6044F87AC8DE5DC3603DDB1"><enum>(1)</enum><header>General orders of removal</header><subparagraph id="H3BB984AE079944349F3A42BEDAFC0410"><enum>(A)</enum><header>In general</header><text>Judicial review of a final order of removal (other than an order of removal without a hearing pursuant to section 235(b)(1)) is governed only by <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/158">chapter 158</external-xref> of title 28 of the United States Code, except as provided in subparagraph (B) or subsection (b), and except that the court may not order the taking of additional evidence under section 2347(c) of such title.</text></subparagraph><subparagraph id="H0B16A59D007C4B518E0128B89B53BB57"><enum>(B)</enum><header>Domestic violence survivors and crime victims</header><text display-inline="yes-display-inline">A final order for the removal of a nonimmigrant described in section 101(a)(15)(T) or section 101(a)(15)(U), a VAWA self-petitioner (as defined in section 101(a)(51)), an applicant for relief under section 240A(b)(2), an applicant or petitioner for relief under sections 101(a)(27)(J) or 245(h), or under any prior status providing comparable relief, shall be subject to de novo review by the court.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H40D89E15E4DD4B94B64065E1D5515314" display-inline="no-display-inline"><enum>(c)</enum><header>Availability of basic assistance to lawfully present noncitizens</header><paragraph id="H92B3582F8B8947F5914F77A96F943461"><enum>(1)</enum><header>Elimination of arbitrary eligibility restrictions</header><text>Sections 402, 403, 411, 412, 421, and 422 of the Personal Responsibility and Work Opportunity Reconciliation Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/8/1612">8 U.S.C. 1612</external-xref>, 1613, 1621, 1622, 1631, and 1632) are repealed.</text></paragraph><paragraph id="HA260484ADF914249A42F48CBB6FC2241"><enum>(2)</enum><header>Notification and information reporting</header><text>Section 404 of the Personal Responsibility and Work Opportunity Reconciliation Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/8/1614">8 U.S.C. 1614</external-xref>) is amended by striking <quote>, 402, or 403</quote>.</text></paragraph><paragraph id="HD1918BB7369E4A9ABDD3C02D26F11948"><enum>(3)</enum><header>Qualified noncitizens</header><text>Title IV of the Personal Responsibility and Work Opportunity Reconciliation Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/8/1601">8 U.S.C. 1601 et seq.</external-xref>) is amended—</text><subparagraph id="H9BF8C638E2044530A1BB33B0AC08ECD9"><enum>(A)</enum><text>in the header, by striking <quote><header-in-text level="title" style="OLC">Aliens</header-in-text></quote> and inserting <quote><header-in-text level="title" style="OLC">Noncitizens</header-in-text></quote>; or</quote>; and</text></clause><clause id="H1B9777A60B9844C49675C1A68D65AA1D"><enum>(iv)</enum><text>by inserting after paragraph (4):</text><quoted-block id="H8A9D939DE72A4FEB865DF75A2650B6A2" style="OLC"><paragraph id="HB65F5D223CCB40E7818AF96A48B50A52"><enum>(5)</enum><text>a noncitizen—</text><subparagraph id="H3457C83A53F54BAD8E15F6BA97A0F53F"><enum>(A)</enum><text>in a category that was treated as lawfully present for purposes of section 1101 of the Patient Protection and Affordable Care Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/42/18001">42 U.S.C. 18001</external-xref>);</text></subparagraph><subparagraph id="H58154634721342A9ABE6D29FC7A97207"><enum>(B)</enum><text>who met the requirements of section 402(a)(2)(D) of the Personal Responsibility and Work Opportunity Reconciliation Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/8/1612">8 U.S.C. 1612(a)(2)(D)</external-xref>) on or before January 1, 2021;</text></subparagraph><subparagraph id="HE7B577657ACF4CB1ABFB84424F37A39F"><enum>(C)</enum><text>who is granted special immigrant juvenile status as described by section 101(a)(27)(J) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(27)(J)</external-xref>);</text></subparagraph><subparagraph id="H1A3A65EB3B734EA0A2C2BDBB3B2FC99F"><enum>(D)</enum><text display-inline="yes-display-inline">who has a pending, bona fide application for nonimmigrant status under section 101(a)(15)(U) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(1)(15)(U)</external-xref>); </text></subparagraph><subparagraph id="H45FF4F151E1647AC8793E9D421E379BB"><enum>(E)</enum><text>who was granted relief under the Deferred Action for Childhood Arrivals program; or</text></subparagraph><subparagraph id="H19426281951A4DCE882080BD0F6DF2A2"><enum>(F)</enum><text>any other person who is not a citizen of the United States but who resides in a State or territory of the United States and is Federally authorized to be present in the United States.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="H22924FEBC58E4F1FB80BB85DEA4B85B9"><enum>(C)</enum><text>by adding at the end the following new subsection: </text><quoted-block style="OLC" id="HFCAD262CC3D74E35B4264205E3BA21D4" display-inline="no-display-inline"><subsection id="HAECAB9F29F1B4A12BD2E8AEFEA7FEF00"><enum>(d)</enum><header>Noncitizen</header><text display-inline="yes-display-inline">For the purposes of this section, the term <term>noncitizen</term> means any individual who is not a citizen of the United States.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H1FB85ED6F21543B283D86E6499F76E84"><enum>(5)</enum><header>Child nutrition programs</header><text>Section 742 of the Personal Responsibility and Work Opportunity Reconciliation Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/8/1615">8 U.S.C. 1615</external-xref>) is amended—</text><subparagraph id="H4B507272C8F24F31B9B009C86140478C"><enum>(A)</enum><text>in subsection (a)—</text><clause id="H569986BACDAE4328B31F21F21CFFBD39"><enum>(i)</enum><text>in the header by striking <quote><header-in-text level="subsection" style="OLC">School lunch and breakfast programs</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="OLC">Child nutrition programs</header-in-text></quote>;</text></clause><clause id="H0D1BC2A1941C47A3875D8103D00F018E"><enum>(ii)</enum><text>by striking <quote>the school lunch program</quote> and inserting <quote>any program</quote>; and</text></clause><clause id="HA46B05369AA24B0FA82E1FA9E63920E8"><enum>(ii)</enum><text>by striking <quote>paragraph (2)</quote> and inserting <quote>paragraph (2) on the basis of an individual’s citizenship or immigration status</quote>. </text></clause></subparagraph></paragraph><paragraph id="H9187F761B8804FBFA845FE8726D2C893" commented="no"><enum>(6)</enum><header>Exclusion of medical assistance expenditures for citizens of freely associated States</header><text>Section 1108(h) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1308">42 U.S.C. 1308(h)</external-xref>) is amended—</text><subparagraph id="H9C55208836924A47912D5DE1CEA31687" commented="no"><enum>(A)</enum><text>by striking <quote>Expenditures</quote> and inserting:</text><quoted-block style="OLC" id="HB66109AEC2EC47AAB542326ED33437DC" display-inline="no-display-inline"><paragraph id="H7959741B039A400BA99168A918F18561" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">Expenditures</text></paragraph><after-quoted-block>; and </after-quoted-block></quoted-block></subparagraph><subparagraph id="HF813830AB89B4E4EA400194AC0E2B606" commented="no"><enum>(B)</enum><text>by adding at the end the following new paragraph:</text><quoted-block style="OLC" id="H0AF38747FA8A4790839C0C457B75B40B" display-inline="no-display-inline"><paragraph id="H4D9CBDC98C6848958CA88D422A94C7CF" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">With respect to eligibility for benefits for the designated Federal program defined in paragraph (3)(C) (relating to the Medicaid program), paragraph (1) shall not apply to any individual who lawfully resides, in accordance with the Compacts of Free Association between the Government of the United States and the Governments of the Federated States of Micronesia, the Republic of the Marshall Islands, and the Republic of Palau, in any of the several States or the District of Columbia and shall not apply, at the option of the Governor of Puerto Rico, the Virgin Islands, Guam, the Northern Mariana Islands, or American Samoa as communicated to the Secretary of Health and Human Services in writing, to any individual who lawfully resides in the respective territory in accordance with such Compacts.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H3EB4E0359E0847BC9C15DFB39A2EE08F"><enum>(7)</enum><header>Child health insurance program</header><text display-inline="yes-display-inline">Section 2107(e)(1) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1397gg">42 U.S.C. 1397gg(e)(1)</external-xref>) is amended—</text><subparagraph id="HF8DE0182C5124B049595C0D60583DAC7"><enum>(A)</enum><text>by striking subparagraph (O); and</text></clause><clause id="HDFE00D07223440AA93618ACD40C697CF"><enum>(iii)</enum><text>by striking <quote>alien</quote> wherever it occurs and inserting <quote>noncitizen</quote>. </text></clause></subparagraph><subparagraph id="HA161D4C081DB4581A9618B5D3623A4EE"><enum>(E)</enum><header>Assistance not treated as debt absent fraud</header><text>Section 213A(b)(1)(A) of the Immigration and Nationality Act is amended by striking <quote>benefit,</quote> and inserting <quote>benefit by fraud,</quote>.</text></subparagraph></paragraph><paragraph id="H98F2A1B9D7CF4CCCA91281FC16EAAF9C" commented="no"><enum>(9)</enum><header>Preserving access to health care</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/36B">Section 36B(c)(1)(B)</external-xref> of the Internal Revenue Code of 1986 is amended to read as follows: </text><quoted-block style="OLC" id="HBFCEAE56E56246C4A9A6881BFBBE87B3" display-inline="no-display-inline"><subparagraph id="H67B2EB237D51408C996CE534C2891A30" commented="no"><enum>(B)</enum><header>Special rule for certain individuals lawfully present in the United States</header><text display-inline="yes-display-inline">If—</text><clause id="H3686399A39544A6EA4CBD2429868F09D" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">a taxpayer has a household income which is not greater than 100 percent of an amount equal to the poverty line for a family of the size involved,</text></clause><clause id="HA6C9192854DA4F78BAE394F0BB6458F6" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">the taxpayer is a non-citizen lawfully present in the United States,</text></clause><clause id="H1FA80E4206E94C3EB995EF5E565D1A23" commented="no"><enum>(iii)</enum><text display-inline="yes-display-inline">the taxpayer is ineligible for minimum essential coverage under section 5000A(f)(1)(A)(ii), and</text></clause><clause id="H8053B149B4B249D496477C6351C618DF" commented="no"><enum>(iv)</enum><text display-inline="yes-display-inline">under the Medicaid eligibility criteria for non-citizens in effect on December 26, 2020, the taxpayer would be ineligible for such minimum essential coverage by reason of the taxpayer’s immigration status, </text></clause><continuation-text continuation-text-level="subparagraph" commented="no">the taxpayer shall, for purposes of the credit under this section, be treated as an applicable taxpayer with a household income which is equal to 100 percent of the poverty line for a family of the size involved.</continuation-text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H5E4B0FA20CD545B1A68A2B2B059D5EDD" commented="no"><enum>(10)</enum><header>Federal agency guidance</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, each Federal agency, as applicable, shall issue guidance with respect to implementing the amendments made by this section.</text></paragraph><paragraph id="HEEE7B08816C140E98AF54C7F67827F2B"><enum>(11)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this subsection shall take effect on the date of enactment of this Act and shall apply to services furnished on or after the date that is 180 days after the date on which any guidance is issued pursuant to paragraph (10). </text></paragraph></subsection><subsection id="H9B49FAAED9694C8C925E8198F9A0701F" commented="no"><enum>(d)</enum><header>Relief from certain restrictions on adjustment of status</header><paragraph id="H66FDC763DF364C33AD596BA2B9DADD73" commented="no"><enum>(1)</enum><header>Relief from certain restrictions for domestic violence survivors</header><text display-inline="yes-display-inline">Section 245(d) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1255">8 U.S.C. 1255(d)</external-xref>) is amended by inserting before the period at the end the following: <quote>, unless the alien is the spouse of an alien lawfully admitted for legal permanent residence or of a citizen of the United States and is a VAWA self-petitioner</quote>.</text></paragraph><paragraph id="H03D11F1CF9CF42719FF8FD8ED3DD8B15" commented="no"><enum>(2)</enum><header>Conforming application in cancellation of removal</header><text display-inline="yes-display-inline">Section 240A(b)(2)(A)(i) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1229b">8 U.S.C. 1229b(b)(2)(A)(i)</external-xref>) is amended—</text><subparagraph id="H5A73261E77FB4CCFA48B3FF4A55EADFF" commented="no"><enum>(A)</enum><text>in subclause (II), by striking <quote>or</quote> at the end; </text></subparagraph><subparagraph id="H3582311528654CC199C937CFDAE0703C" commented="no"><enum>(B)</enum><text>in subclause (III), by adding <quote>or</quote> at the end; and </text></subparagraph><subparagraph id="HDBBA2B8FDCB746ED8C6917F0B088C3C8" commented="no"><enum>(C)</enum><text> by adding at the end the following: </text><quoted-block style="OLC" id="HCB45575EDF7446869F79DACAEE798567" display-inline="no-display-inline"><subclause id="H7EBB143EE2B742B6BB5B067A30910870" commented="no"><enum>(IV)</enum><text display-inline="yes-display-inline">the alien entered the United States as an alien described in section 101(a)(15)(K) with the intent to enter into a valid marriage and the alien (or the child of the alien who is described in such section) was battered or subject to extreme cruelty by the United States citizen who filed the petition to accord status under such section;</text></subclause><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H36BC7B45C96E446491982090A6F0B024" commented="no"><enum>(3)</enum><header>Application under suspension of deportation for domestic violence survivors</header><text display-inline="yes-display-inline">The Secretary of Homeland Security or the Attorney General may suspend the deportation of an alien who is in deportation proceedings initiated prior to March 1, 1997, and adjust to the status of an alien lawfully admitted for permanent residence, if the alien—</text><subparagraph id="HCBF56B9F5F95422191134392CF4511C4" commented="no"><enum>(A)</enum><text>has been physically present in the United States for a continuous period of not less than 3 years immediately preceding the date of such suspension; </text></subparagraph><subparagraph id="H0780F07E61624C00A1D3D9C0DADE68A3" commented="no"><enum>(B)</enum><text>has been battered or subjected to extreme cruelty in the United States by a spouse or immediate family member who is a United States citizen or a lawful permanent resident, or the alien entered the United States as an alien described in section 101(a)(15)(K) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)(K)</external-xref>) with the intent to enter into a valid marriage and the alien was battered or subject to extreme cruelty by the United States citizen who filed the petition to accord status under such section, or the child of the alien who is described in this subparagraph; </text></subparagraph><subparagraph id="HA071C18061FF4FE0A45060C361BE54C7" commented="no"><enum>(C)</enum><text>demonstrates that during all of such time in the United States the alien was and is a person of good moral character; and </text></subparagraph><subparagraph id="H5B92401D60EF4170BD1773C73DF8F8B5" commented="no"><enum>(D)</enum><text>is a person whose deportation would, in the opinion of the Secretary or Attorney General, result in extreme hardship to the alien or the alien’s parent or child.</text></subparagraph></paragraph><paragraph id="HF2C6AF860BE442B4A4AF500709646D5C" commented="no"><enum>(4)</enum><header>Effective date</header><text>This subsection and the amendments made by this subsection shall take effect on the date of the enactment of this Act and shall apply to aliens who entered the United States before, on, or after such date.</text></paragraph></subsection><subsection id="HC228CCC6E37A44CC90E17DBACFC9B9AE"><enum>(e)</enum><header>Work Authorization for survivors</header><paragraph id="H5E3A623614764E70BB160A19CE77FA28"><enum>(1)</enum><header>T visas</header><text>Section 214(o) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184(o)</external-xref>) is amended by adding at the end the following: </text><quoted-block style="OLC" id="HB785D8E51ADC49DFA98457248F289461" display-inline="no-display-inline"><paragraph id="HC1132E56A1E04608B5ABE1040C63BF5A"><enum>(8)</enum><text display-inline="yes-display-inline">Notwithstanding any provision of this Act granting eligibility for employment in the United States, the Secretary of Homeland Security shall grant employment authorization to an alien who has filed an application for nonimmigrant status under section 101(a)(15)(T) on the date that is the earlier of—</text><subparagraph id="HEEC24B01371E4A259D7F037CEBE64387"><enum>(A)</enum><text>the date on which the alien’s application for such status is approved; or</text></subparagraph><subparagraph id="H45F04DA163E94AF48D71F2A71F1ACCF0"><enum>(B)</enum><text>a date that is not later than 180 days after the date on which the alien filed the application.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H237ABF3A09F349BABCF452155174DF4B"><enum>(2)</enum><header>VAWA self-petitioners</header><text>Section 204(a)(1)(K) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1154">8 U.S.C. 1154(a)(1)(K)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" id="H80FE0137014B4613A6A956EC72C59E55" display-inline="no-display-inline"><subparagraph id="H1A2EF90E4B7C4F08B5508A62912642CA"><enum>(K)</enum><clause commented="no" display-inline="yes-display-inline" id="H820F444DB2D248569C51C6227C64F323"><enum>(i)</enum><text>Upon the approval of a petition as a VAWA self-petitioner, the alien is eligible for work authorization.</text></clause><clause id="H2C00411F08014112B4412688082A1149" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">Notwithstanding any provision of this Act restricting eligibility for employment in the United States, the Secretary of Homeland Security shall grant employment authorization to such an alien on the date that is the earlier of—</text><subclause id="H70433A1027EE4CE6ACC5B179CB65A563"><enum>(I)</enum><text display-inline="yes-display-inline">the date on which the alien’s application for lawful permanent resident status is approved; or</text></subclause><subclause id="HC5FAF963F0F74422BE43D63E1B6508A3"><enum>(II)</enum><text display-inline="yes-display-inline">a date determined by the Secretary that is not later than 180 days after the date that is the earlier of the date on which the alien filed the application or the alien’s petition as a VAWA self-petitioner is approved.</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H1C3D76C9C4D94B56BA755E9D4652014B"><enum>(3)</enum><header>Special immigrant juveniles</header><text>Section 204(a)(1) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1154">8 U.S.C. 1154(a)(1)</external-xref>) is amended by adding at the end the following: </text><quoted-block style="OLC" id="HD7DB4136EBA14A648F924F9DCA0B5E92" display-inline="no-display-inline"><subparagraph id="H02ECDF730E534F0BB2D0FAF36B1704CA"><enum>(M)</enum><header>Work authorization for certain special immigrants</header><text display-inline="yes-display-inline">Notwithstanding any provision of this Act granting eligibility for employment in the United States, the Secretary of Homeland Security shall grant employment authorization to an alien who is otherwise eligible to be employed, and who has a petition for special immigrant status under section 101(a)(27)(J) that is pending or approved on the date that is the earlier of—</text><clause id="H7C19D591995A4EC6B4EAA68FA070F3FB"><enum>(i)</enum><text>the date on which the alien’s petition for such status is approved; or</text></clause><clause id="H2ECFE376FE07444FB43247C2E0B1EDD8"><enum>(ii)</enum><text>a date that is not later than 180 days after the date on which the alien filed the petition.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="HEDFA963FBBE84AFE9E0C0D0E036603B8"><enum>9.</enum><header>Relief for domestic violence survivor visa waiver entrants</header><subsection id="HD8041044EA794515A4AD38B9784F4E9F"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 217(b)(2) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1187">8 U.S.C. 1187(b)(2)</external-xref>) is amended by inserting <quote>, an application or petition described in section 101(a)(51), an application for relief under section 101(a)(15)(T), section 101(a)(15)(U), section 240A(b)(2), section 101(a)(27)(J), section 245(h), or under any prior provision of law providing comparable relief,</quote> after <quote>asylum,</quote>.</text></subsection><subsection id="H7817171665334A2994788898F6749746"><enum>(b)</enum><header>Effective date</header><text>The amendment made by subsection (a) shall take effect on the date of the enactment of this Act and shall apply to waivers provided under section 217(b)(2) of the Immigration and Nationality Act before, on, or after such date as if it had been included in such waivers.</text></subsection><subsection id="H983B1B78F6214CD08D3D1D90C5792C86" commented="no"><enum>(c)</enum><header>Applicability of section 212(<enum-in-header>e</enum-in-header>) to spouses and children of J–1 exchange visitors</header><text display-inline="yes-display-inline">A spouse or child of an exchange visitor described in section 101(a)(15)(J) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)(J)</external-xref>), applicants approved for nonimmigrant status under section 101(a)(15)(T) of such Act, section 101(a)(15)(U) of such Act, VAWA self-petitioners, as defined in section 101(a)(51) of such Act, and special immigrant juveniles under section 101(a)(27)(J) of such Act shall not be subject to the requirements of section 212(e) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(e)</external-xref>). </text></subsection></section><section id="H0912F67E56ED467AB2B0558BC1F9123A"><enum>10.</enum><header>Strengthen waivers for humanitarian need, family unity, or public interest</header><subsection id="HB2DE7FD6FA98446795DA6C9D3365120E"><enum>(a)</enum><header>Exception for VAWA self-Petitioners</header><text display-inline="yes-display-inline">Section 212(a)(9)(B)(iii)(IV) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)(9)(B)(iii)(IV)</external-xref>) is amended by striking <quote>would be described in paragraph (6)(A)(ii) if <quote>violation of the terms of the alien's nonimmigrant visa</quote> were substituted for <quote>unlawful entry into the United States</quote> in subclause (III) of that paragraph.</quote> and inserting <quote>is a VAWA self petitioner.</quote>.</text></subsection><subsection id="H2C48DCEEDDFE4436895EF48C56A0A033"><enum>(b)</enum><header>Waivers for abused aliens</header><paragraph id="HA18BD3BBA68049ADBEDBFABC9A90C5CA"><enum>(1)</enum><header>In general</header><text>Section 212(a)(9)(C)(iii) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)(9)(C)(iii)</external-xref>) is amended—</text><subparagraph id="H474DFFBCBAC6462C8D2FB41B59411C5F"><enum>(A)</enum><text>by inserting <quote>or the Attorney General</quote> after <quote>Secretary of Homeland Security</quote>; and</text></subparagraph><subparagraph id="H4CE1B10F08EF4C46805C090994BD81B9"><enum>(B)</enum><text>by striking <quote>in the case of</quote> and all that follows through <quote>United States.</quote> and inserting <quote>for humanitarian purposes, to assure family unity, when it is otherwise in the public interest, or in the case of an alien who is applying for or has a claim of relief as a VAWA self-petitioner (as defined in section 101(a)(51)).</quote>. </text></subparagraph></paragraph><paragraph id="H14E64DBC8B7A42B9A5A9E74DB3157426"><enum>(2)</enum><header>Effective date</header><text>The amendments made by this section shall take effect on the date of the enactment of this Act and shall apply regardless of whether the alien’s application was filed before, on, or after such date. </text></paragraph></subsection><subsection id="H9BFDD9BFC6694040B8A9E61FD73EACA4"><enum>(c)</enum><header>Waivers for false claims to United States citizenship</header><text>Section 212(a)(6)(C)(ii) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)(6)(C)(ii)</external-xref>) is amended by adding at the end the following new subclause:</text><quoted-block style="OLC" id="HD562EE6932674B809CBC275A2C15238E" display-inline="no-display-inline"><subclause id="H64F70F688A6B471EAEED23245D357FA0"><enum>(III)</enum><header>Exception</header><text display-inline="yes-display-inline">An alien who is a VAWA self-petitioner shall not be considered to be inadmissible under any provision of this subsection based on such representation.</text></subclause><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HA7D54146F85349BC95572E35890EFB6B"><enum>(d)</enum><header>Definitions</header><text>Section 101(f) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(f)</external-xref>) is amended by striking <quote>or violation that he or she was a citizen,</quote> and inserting <quote>violation that he or she was a citizen, or the alien is a VAWA self-petitioner</quote>.</text></subsection><subsection id="H9B955ED7629E42F29D421E0E788E6BEA"><enum>(e)</enum><header>Waiver for certain VAWA self-Petitioners</header><text>Section 212(d)(11) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(d)(11)</external-xref>) is amended by adding at the end the following: <quote>The Attorney General may waive the application of clause (i) of subsection (a)(6)(E) in the case of an alien who is a VAWA self petitioner.</quote>.</text></subsection><subsection id="HFFECD33BA6B24079AFED5030AB7B516E"><enum>(f)</enum><header>EWI exemption for vawa, U visas, T visas, SIJs</header><text>Section 212(a)(6)(A)(ii) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)(6)(A)(ii)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" id="H45F1A51A34194909BB088108A5373C2F" display-inline="no-display-inline"><clause id="H33D33ACC046E454CA851B3958E826D18"><enum>(ii)</enum><header>Exception for certain battered women and children and victims</header><text display-inline="yes-display-inline">Clause (i) shall not apply to an alien who demonstrates that the alien—</text><subclause id="H562A082D9081437C89EC662863B43122"><enum>(I)</enum><text>is a VAWA self-petitioner (as defined in section 101(a)(51) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(51)</external-xref>)); or</text></subclause><subclause id="H5AF4EC05C72E4C7ABD8C5CB12747150D"><enum>(II)</enum><text display-inline="yes-display-inline">qualifies for relief under subparagraph (T) or (U) of section 101(a)(15)(T), section 240A(b)(2), section 244(a)(3) (as in effect on March 31, 1997), or section 101(a)(27)(J).</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H49C757F7AC1A4336B67C2207803F3368"><enum>11.</enum><header>Prohibition on Removal of Survivors of Violence</header><text display-inline="no-display-inline">Section 240 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1229a">8 U.S.C. 1229a</external-xref>) is amended by adding at the end the following: </text><quoted-block style="OLC" id="H920DC12C236E464C8E9F789360580219" display-inline="no-display-inline"><subsection id="H566A9963BB1A46C5A3546E044F4CCEB8"><enum>(f)</enum><header>Prohibition on Removal of Survivors of Abuse or Violence</header><paragraph id="H49E4252265AA4D348DA0A956C27C1414"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">An individual described in paragraph (2) shall not be removed from the United States under this section or any other provision of law until the date on which there is a final denial of the individual’s application for status, after the exhaustion of administrative or judicial review.</text></paragraph><paragraph id="HD97983827D944D6AB826037AF54CF7C4"><enum>(2)</enum><header>Individual described</header><text display-inline="yes-display-inline">An individual described in this paragraph is an individual who—</text><subparagraph id="H5B903B3FA5B54BE1A5B6A2EC4FB540FC"><enum>(A)</enum><text>has a pending petition for special immigrant juvenile status under subparagraph (J) of section 101(a)(27); </text></subparagraph><subparagraph id="H5BDAB98115374BB39CC997EE562B6FC0"><enum>(B)</enum><text>has an approved petition for special immigrant juvenile status under subparagraph (J) of section 101(a)(27) and has not yet adjusted status to that of a lawful permanent resident;</text></subparagraph><subparagraph id="H079576200BDA49AB88361F2A8EA9B4AF"><enum>(C)</enum><text>is a VAWA self-petitioner (as defined in section 101(a)(51) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(51)</external-xref>)); or</text></subparagraph><subparagraph id="HDB29AFA77F2546639DD8EB5190B614F8"><enum>(D)</enum><text display-inline="yes-display-inline">qualifies for relief under subparagraph (T) or (U) of section 101(a)(15)(T), section 240A(b)(2), or section 244(a)(3) (as in effect on March 31, 1997).</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HBA590583268C4C97A2284FFF00DC4458"><enum>12.</enum><header>Exception to reinstatement</header><text display-inline="no-display-inline"> Section 241 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1231">8 U.S.C. 1231</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H4989942905D542DAB9DC61B448E7D2D6" display-inline="no-display-inline"><subsection id="HC049F9A6B59A451DB4A3A89E7C92D5C8"><enum>(h)</enum><text display-inline="yes-display-inline">Any alien with a pending application under clause (i) or (ii) of section 101(a)(15)(T), clause (i) or (ii) of section 101(a)(15)(U), section 101(a)(51), section 240A(b)(2), or section 244(a)(3) (as in effect on March 31, 1997), or a pending or approved petition under (101)(a)(27)(J), shall not be ordered removed under this section.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HF0E5F1866A2E4961A7BD410F19F1EB80" commented="no"><enum>13.</enum><header>Protections for stepchildren</header><subsection id="HF341ED1AD8AB4FAA9A038DD802952D1E" commented="no"><enum>(a)</enum><header>United states citizen parent</header><text>Section 204(a)(1)(A)(iv) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1154">8 U.S.C. 1154(a)(1)(A)(iv)</external-xref>) is amended by adding at the end the following: </text><quoted-block id="H75404640DC0F4531A05DFAE47EA5A349" style="OLC" display-inline="yes-display-inline"><text>For purposes of this clause—</text><subclause id="HD2847E9236894CA386E94DD3F753BE6D" indent="up3" commented="no"><enum>(I)</enum><text>residence includes any period of visitation; and</text></subclause><subclause id="H7F389D7A6AC54DF2AC3C0A50B9700689" indent="up3" commented="no"><enum>(II)</enum><item commented="no" display-inline="yes-display-inline" id="H49CD2FF6C2CC474DB3B58E8D20635999"><enum>(aa)</enum><text>the term <term>citizen parent</term> includes <quote>citizen step-parent</quote>; and</text></item><item id="HABF6BE10B41E4637A512CA72F1EE94AF" indent="up1" commented="no"><enum>(bb)</enum><text>none of the following shall affect the ability of a step-child who was battered or subjected to extreme cruelty to file a self-petition or have the self-petition favorably adjudicated and shall not lead to revocation of an approved VAWA self-petition—</text><subitem id="H4DD4C98F946E4B929714559748334ED4" commented="no"><enum>(AA)</enum><text>death of the step-child self-petitioner’s natural parent;</text></subitem><subitem id="HD62E2EA20B58459BAC5C8176B21ADA30" commented="no"><enum>(BB)</enum><text>death of the step-child self-petitioner’s step-parent; or</text></subitem><subitem id="HF0C9DA7DB24C4B7DA9E3648151012EEF" commented="no"><enum>(CC)</enum><text>divorce between the step-child VAWA self-petitioner’s parent and step-parent.</text></subitem></item></subclause><after-quoted-block>;</after-quoted-block></quoted-block></subsection><subsection id="H0F161D114CBA4E68922E8A78A03716AF" commented="no"><enum>(b)</enum><header>Lawful permanent resident parent</header><text>Section 204(a)(1)(B)(iii) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1154">8 U.S.C. 1154(a)(1)(B)(iii)</external-xref>) is amended by adding at the end the following: </text><quoted-block style="OLC" id="H98FCF5F2DFC54AC5B1DCCCB90FB27B05" display-inline="yes-display-inline"><text>For purposes of this clause:</text><subclause id="H06AC65C5E1ED4456AD754B9436232F73" indent="up3" commented="no"><enum>(I)</enum><text>residence includes any period of visitation; and</text></subclause><subclause id="H0D1DD59F6B014FE480489678B60B2999" indent="up3" commented="no"><enum>(II)</enum><item commented="no" display-inline="yes-display-inline" id="H22F025FE14674EC2BC0C8B8F3F3DB860"><enum>(aa)</enum><text>the term <term>permanent resident parent</term> includes <quote>permanent resident step-parent</quote>; and</text></item><item id="H8FB4F4F432DA476BB08D0C513676EDCE" indent="up1" commented="no"><enum>(bb)</enum><text>none of the following shall affect the ability of a step-child who was battered or subjected to extreme cruelty to file a self-petition or have the self-petition favorably adjudicated and shall not lead to revocation of an approved VAWA self-petition—</text><subitem id="H6B383BEE2D274C1F90B2CB6D5B07F32D" commented="no"><enum>(AA)</enum><text>death of the step-child self-petitioner’s natural parent;</text></subitem><subitem id="HE44BFE8ACEE0411C84F700A824DAF9E9" commented="no"><enum>(BB)</enum><text>death of the step-child self-petitioner’s step-parent; or</text></subitem><subitem id="H928606A3A0FE44FAA6929E63C56BFE67" commented="no"><enum>(CC)</enum><text>divorce between the step-child VAWA self-petitioner’s parent and step-parent.</text></subitem></item></subclause><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HF3BF941727F44B948C7A0759E1FC4FE7" commented="no"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall take effect on the date of the enactment of this Act and shall apply to VAWA self-petitions filed before, on, or after the date of the enactment of this Act.</text></subsection></section><section id="HD1129435397A4A0DA861190FB8852DBE"><enum>14.</enum><header>Waiver of monetary penalty</header><text display-inline="no-display-inline">Section 274D of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1324d">8 U.S.C. 1324d</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="HB10A0F6055294877B33B355483E39B17" display-inline="no-display-inline"><subsection id="HD26BAF774EA34C82998EADC90613E18D"><enum>(a)</enum><header>Exception</header><text display-inline="yes-display-inline">Subsection (a) shall not apply to an alien who is a VAWA self-petitioner, as defined in section 101(a)(51), or who has filed an application for nonimmigrant status under subparagraph (T) or (U) of section 101(a)(15) or a petition for Special Immigrant Juvenile status under section 101(a)(27)(J).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H147D8E6A849B49ACA9B4283404030663" commented="no"><enum>15.</enum><header>Technical correction</header><text display-inline="no-display-inline">Section 240(c)(7)(C)(iv) of the Immigration and Nationality Act is amended—</text><paragraph id="H33ECE52E6C194B07AFFED4326704B299" commented="no"><enum>(1)</enum><text>by amending the heading to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H9FD821F1BFAF4335AC7C68BEF871C9F0"><clause id="H55AE49A36FFD47F195F0F135DC4BB7A9" commented="no"><enum>(iv)</enum><header>Special rule for battered spouses, children, and parents</header></clause><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="H826E5266EAA4467390020DA58AB44ED9" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">in subclause (I), by striking <quote>or section 240A(b)(2)</quote> and inserting <quote>, section 240A(b), or section 244(a)(3) (as in effect on March 31, 1997)</quote>; and</text></paragraph><paragraph id="H155355D73B024C7BBFA310EB87C3A137" commented="no"><enum>(3)</enum><text>in the matter following subclause (IV), by striking <quote>(as defined in section 431(c)(1)(B) of the Personal Responsibility and Work Opportunity Reconciliation Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/8/1641">8 U.S.C. 1641(c)(1)(B)</external-xref>)</quote> and inserting <quote>(as defined in section 431(c)(1)(B) of the Personal Responsibility and Work Opportunity Reconciliation Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/8/1641">8 U.S.C. 1641(c)(1)(B)</external-xref>))</quote>.</text></paragraph></section><section id="H7B8ED70484484181A4A5733A249961F3"><enum>16.</enum><header>Permit immigration judges to grant inadmissibility waivers</header><text display-inline="no-display-inline">Section 212(d)(14) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(d)(14)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" id="H50B281E51DF54618B97A7A669455B399" display-inline="no-display-inline"><paragraph id="H0F0B7E204BA348F190D0A61BC78F0736"><enum>(14)</enum><text display-inline="yes-display-inline">The Secretary of Homeland Security shall determine whether a ground of inadmissibility exists with respect to a nonimmigrant described in section 101(a)(15)(U). The Secretary of Homeland Security or an immigration judge may waive the application of subsection (a) (other than paragraph (3)(E)) in the case of a nonimmigrant described in section 101(a)(15)(U)), if the Secretary of Homeland Security or immigration judge considers it to be in the public or national interest to do so.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HADA78786A2574D2AAEA9AB12AB6781F2"><enum>17.</enum><header>Elimination of visa caps for abused, abandoned, or neglected children</header><subsection id="HC8414EA282334D06B805C59562646A92"><enum>(a)</enum><header>Worldwide level</header><text display-inline="yes-display-inline">Section 201 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1151">8 U.S.C. 1151</external-xref>) is amended in subparagraph (b)(1)(A) by striking <quote>subparagraph (A) or (B)</quote> and inserting <quote>subparagraphs (A), (B), or (J)</quote>.</text></subsection><subsection id="HC32E9D71F2FC4B70AF3B583AE77E1773"><enum>(b)</enum><header>Per-Country limitation</header><text display-inline="yes-display-inline">Section 202(a)(2) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1152">8 U.S.C. 1152</external-xref>) is amended by inserting after <quote>Subject to paragraphs (3), (4), and (5),</quote> the following: <quote>and except for special immigrants described in section 101(a)(27)(J),</quote>.</text></subsection><subsection id="HEA614358438C4271AEF3D472AAD513FA"><enum>(c)</enum><header>Allocation</header><text display-inline="yes-display-inline">Section 203 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1153">8 U.S.C. 1153</external-xref>) is amended in subparagraph (b)(4) by striking <quote>subparagraph (A) or (B)</quote> and inserting <quote>subparagraphs (A), (B), or (J)</quote>.</text></subsection></section><section id="HA44C97F6EBA446B49DC75B9CE467FF60"><enum>18.</enum><header>Elimination of general consent standard for abused, abandoned, or neglected children</header><text display-inline="no-display-inline">Section 101(a)(27)(J) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(27)(J)</external-xref>) is amended—</text><paragraph id="H46C9B20B245D40FC9E18B8FE6B0C1A45"><enum>(1)</enum><text>in clause (i), by inserting at the end <quote>and</quote>; </text></paragraph><paragraph id="H18A1406563B04A3CB31C86EA811A1038"><enum>(2)</enum><text>in clause (ii), by striking <quote>; and</quote> and inserting the following: </text><quoted-block style="OLC" id="H5F7CFC2A04B942348E6B78E0F3E23D79" display-inline="yes-display-inline"><text>, except that—</text><subclause id="HC2FDCF0488504454BCB5B849E0EB8347"><enum>(I)</enum><text display-inline="yes-display-inline">no juvenile court has jurisdiction to determine the custody status or placement of an alien in the custody of the Secretary of Health and Human Services unless the Secretary of Health and Human Services specifically consents to such jurisdiction; and</text></subclause><subclause id="H5D5B537752FA490C8F7F7899F5D96484"><enum>(II)</enum><text>no natural parent or prior adoptive parent of any alien provided special immigrant status under this subparagraph shall thereafter, by virtue of such parentage, be accorded any right, privilege, or status under this Act; and</text></subclause><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H66B5B238459B4F49896BA1CF10AE4202"><enum>(3)</enum><text>by striking clause (iii).</text></paragraph></section><section id="H798B81E1A0F44C6BBFB8521AF9EEAA01"><enum>19.</enum><header>Deadline for motions to reopen orders of removal</header><text display-inline="no-display-inline">Section 240(c)(7)(C) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1229a">8 U.S.C. 1229a(c)(7)(C)</external-xref>) is amended by adding at the end the following: </text><quoted-block style="OLC" id="H82563DCE4DBC49C790018F56DED09CA1" display-inline="no-display-inline"><clause id="H3BDFE4DE46504FEA8ECA37623B420ECD"><enum>(v)</enum><header>Special immigrant juvenile status petitioners or beneficiaries</header><text display-inline="yes-display-inline">There is no time limit on the filing of a motion to reopen by an individual who has a pending or approved petition for special immigrant juvenile status under section 101(a)(27)(J) if the basis of the motion is to apply for adjustment of status. An individual who has a pending or approved petition for special immigrant juvenile status under such section may file one motion under this clause notwithstanding any numerical limitation that might otherwise apply. The filing of a motion to reopen under this clause shall stay the removal of an individual with a pending or approved petition for special immigrant juvenile status pending the final disposition of the motion, including exhaustion of all appeals. An immigration judge or the Board of Immigration Appeals may hold such a motion in abeyance, or grant such a motion, as appropriate, so that the individual may wait for an available visa.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H6D513FFDE2314FCD869F3821A33BA0F7" commented="no"><enum>20.</enum><header>Naturalization</header><subsection id="H8D57387A075D49919E7645A2AA44F588" commented="no"><enum>(a)</enum><header>In general</header><text>Section 319(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1430">8 U.S.C. 1430(a)</external-xref>) is amended to read as follows:</text><quoted-block id="HB95935D3DAC145D6B76FD208059B7AA8" style="OLC"><subsection id="HE975941F8CE443C9B3F99933415994F1" commented="no"><enum>(a)</enum><paragraph commented="no" display-inline="yes-display-inline" id="HA4EDEC890E3A46CEA54E1A692470B6B5"><enum>(1)</enum><text>A person described in this paragraph is—</text><subparagraph id="H9ADE11C1176E419E9F15693C4048D49D" indent="up1" commented="no"><enum>(A)</enum><text>a spouse of citizen of the United States; or</text></subparagraph><subparagraph id="H1B3651893C7344479887BFE2E3A89997" indent="up1" commented="no"><enum>(B)</enum><text>any lawful permanent resident and who was battered or subjected to extreme cruelty by a United States citizen who is or was a spouse, parent, son or daughter.</text></subparagraph></paragraph><paragraph id="HD4C596F1CB4C49C69439ADB8CEB7D514" indent="up1" commented="no"><enum>(2)</enum><text>A person described in paragraph (1) may be naturalized—</text><subparagraph id="HB720648195044FBA951893A6A918270B" commented="no"><enum>(A)</enum><text>upon compliance with all the requirements of this title except the provisions of paragraph (1) of section 316(a);</text></subparagraph><subparagraph id="H8F9BBBB11FF844D0AC36AA7061E0063A" commented="no"><enum>(B)</enum><text>if such person, immediately preceding the date of filing that person’s application for naturalization has resided continuously, after being lawfully admitted for permanent residence, within the United States for at least three years;</text></subparagraph><subparagraph id="HD7BCBC2611F04A91A5FF979F30164EAE" commented="no"><enum>(C)</enum><clause commented="no" display-inline="yes-display-inline" id="H07C949897FA84E3FA381BC5DE0EF08D0"><enum>(i)</enum><text>during the three years immediately preceding the date of filing such application has been living in marital union with their citizen spouse who has been a United States citizen during all of such period; or</text></clause><clause id="H62243A0A14CB4573954FB4B6B3C1289E" indent="up1" commented="no"><enum>(ii)</enum><text>in the case of a person who has been battered or subjected to extreme cruelty by a United States citizen spouse, parent, son or daughter, the requirement of subparagraph (C)(i) shall not apply regardless of whether the person’s lawful permanent resident status was obtained on the basis of such battery or cruelty;</text></clause></subparagraph><subparagraph id="H918ADB925E31425583EB1ACEEB9A38D2" commented="no"><enum>(D)</enum><text>has been physically present in the United States for periods totaling at least half of the time referred to in subparagraph (C);</text></subparagraph><subparagraph id="H25AB1FC73BC149C4A1C5C3BE87D4D7AD" commented="no"><enum>(E)</enum><text>has resided within the State or district of the Service in the United States in which the applicant filed such application for at least 3 months; and</text></subparagraph><subparagraph id="HFB3E12F23A7C43F497E0F9647C0A682F" commented="no"><enum>(F)</enum><text display-inline="yes-display-inline">the provisions of section 204(a)(1)(J) and section 384 of the Illegal Immigration Reform and Immigration Responsibility Act of 1996 shall apply in acting on an application under this subsection in the same manner as they apply in acting on petitions referred to in section 101(a)(51).</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HB28DF5EE4047410DAC3B4A4EA162F073" commented="no"><enum>(b)</enum><header>Effective date</header><text>The amendments made by this section shall take effect on the date of the enactment of this Act and shall apply to applications for naturalization filed before, on, or after the date of the enactment of this Act.</text></subsection></section></legis-body></bill>
