Means</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Internal Revenue Code of 1986 to impose an additional 1,000 percent excise tax on the sale of large capacity ammunition feeding devices and semiautomatic assault weapons, and for other purposes.</official-title></form><legis-body id="H1304167FCA6F42F481A1A3C00A4DC12E" style="OLC"><section id="H7B9096FEC0004D2FA3996911D9B5AD88" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Assault Weapons Excise Act</short-title></quote>. </text></section><section id="HA431F8B1FF9F4F1093D4BEEE8BD76571"><enum>2.</enum><header>Imposition of additional excise tax on large capacity ammunition feeding devices and semiautomatic assault weapons</header><subsection id="HA9F8852FD715483C8EC556AC4FC094C1"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/4181">Section 4181</external-xref> of the Internal Revenue Code of 1986 is amended—</text><paragraph id="H120E0AF351DB4899908B549234ABC5A9"><enum>(1)</enum><text>by striking <quote>There is hereby</quote> and inserting the following:</text><quoted-block style="OLC" id="H5E98ED5C96A24B2A883E9CAEFD88A6AB" display-inline="no-display-inline"><subsection id="HBA554D6C0DA84A3D8DB968950CBCD1AD"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">There is hereby</text></subsection><after-quoted-block>, and</after-quoted-block></quoted-block></paragraph><paragraph id="H9B3175A5EB37407B998E64B6127C1636"><enum>(2)</enum><text>by adding at the end the following new subsection:</text><quoted-block style="OLC" id="HEE19A74E3C9E483DBECEDE104B311D11" display-inline="no-display-inline"><subsection id="H32027E601F2E47A2A540F444CB99D3E6"><enum>(b)</enum><header>Additional tax on large capacity ammunition feeding devices and semiautomatic assault weapons</header><paragraph id="HDEBBE7B9DAF74BEBB7C7028A7E0E0C17"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">In addition to the tax imposed by subsection (a), there is hereby imposed upon the sale by the manufacturer, producer, or importer of any of the following articles a tax equivalent to 1,000 percent of the price for which so sold:</text><subparagraph id="HE28A7CF63C1D4DF2BFD692E2C419FC56"><enum>(A)</enum><text>Large capacity ammunition feeding devices.</text></subparagraph><subparagraph id="H13854265268541ADA4A72A4FB3A41CC7"><enum>(B)</enum><text>Semiautomatic assault weapons.</text></subparagraph></paragraph><paragraph id="H409866295A3B4447BD040C34D123B534"><enum>(2)</enum><header>Large capacity ammunition feeding device</header><text>For purposes of this subsection—</text><subparagraph id="H402C28B3AD21400DBB92DEB7AA34CA9E"><enum>(A)</enum><header>In general</header><text>The term <quote>large capacity ammunition feeding device</quote> means a magazine, belt, drum, feed strip, or similar device, including any such device joined or coupled with another in any manner, that has an overall capacity of, or that can be readily restored, changed, or converted to accept, more than 10 rounds of ammunition. </text></subparagraph><subparagraph id="H802583D3A860477A82AFABEE5DA5DF2D"><enum>(B)</enum><header>Certain devices not included</header><text>Such term does not include an attached tubular device designed to accept, and capable of operating only with, .22 caliber rimfire ammunition.</text></subparagraph></paragraph><paragraph id="H1B83CFED22394270BE54EA10A35E0114"><enum>(3)</enum><header>Semiautomatic assault weapon</header><text display-inline="yes-display-inline">For purposes of this subsection—</text><subparagraph id="H8FC41E8C6BD64C389E901D415C942EFD"><enum>(A)</enum><header>In general</header><text>The term <term>semiautomatic assault weapon</term> means any of the following:</text><clause id="H0C5C94C7FE4D4D56A7F9EB3CBE390256" display-inline="no-display-inline"><enum>(i)</enum><text>A semiautomatic rifle that—</text><subclause id="H61118286C92B429CB7C1506EDD9776B8"><enum>(I)</enum><text>has the capacity to use a magazine that is not a fixed magazine, and</text></subclause><subclause id="HD496C890D0C34BD6A0F628A9CF2A005F"><enum>(II)</enum><text>has any of the following:</text><item id="H83557E1267154D4AA4979E7EC768BE8E"><enum>(aa)</enum><text>A pistol grip.</text></item><item id="H4312A852DCC84EFBBDCED8FE4B24C6D3"><enum>(bb)</enum><text>A forward grip.</text></item><item id="H3B407E5B6E2644EE8E6129CB4B29F5EB"><enum>(cc)</enum><text>A folding, telescoping, or detachable stock, or the ability to otherwise fold or adjust in a manner that operates to reduce the length, size, or any other dimension, or otherwise enhance the concealability, of such rifle.</text></item><item id="HC3F3CECD218541548E156CBA972249E8"><enum>(dd)</enum><text>A functional grenade launcher.</text></item><item id="H4C07572B30C94DD3B3D9CD5FA6020F33"><enum>(ee)</enum><text>A barrel shroud.</text></item><item id="H39FF718E50EC4EEC9E6C20FCE5EA8EAB"><enum>(ff)</enum><text>A threaded barrel.</text></item></subclause></clause><clause id="HDA6E5034AF5F442E9E5DB7D5B4727018"><enum>(ii)</enum><text>A semiautomatic rifle that has a fixed magazine with the capacity to accept more than 10 rounds, except for an attached tubular device designed to accept, and capable of operating only with, .22 caliber rimfire ammunition.</text></clause><clause id="H1542DF545DEC4ABC8F0EF0073EE9CA1A"><enum>(iii)</enum><text>Any part, combination of parts, component, device, attachment, or accessory that is designed or functions to accelerate the rate of fire of a semiautomatic firearm but not convert the semiautomatic firearm into a machinegun.</text></clause><clause id="HBBBE9EB0F27742B584FFD4998AB90216"><enum>(iv)</enum><text>A semiautomatic pistol that—</text><subclause id="H00A1E41A60164009BA9C0314ECAE4167"><enum>(I)</enum><text>has the capacity to use a magazine that is not a fixed magazine, and</text></subclause><subclause id="H203FE943A31B4B8485BB24C7AEE6126E"><enum>(II)</enum><text display-inline="yes-display-inline">has any of the following:</text><item id="HE749CADA9BD14305A409DA73A3CCDD77"><enum>(aa)</enum><text>A threaded barrel.</text></item><item id="HCA9FADCD09DB45518424D9C4B2C09155"><enum>(bb)</enum><text>A second pistol grip.</text></item><item id="H59644F7C522746B5B0D18E13FE992B3C"><enum>(cc)</enum><text>A barrel shroud.</text></item><item id="HCC3AA0FA6FC9479D9C4E4952E4DBBD1B"><enum>(dd)</enum><text>The capacity to accept a detachable magazine at some location outside of the pistol grip.</text></item><item id="H0509961D49BC4F5592267632090FEDF4"><enum>(ee)</enum><text display-inline="yes-display-inline">A design which is identical to, or nearly identical to, a design intended for a machinegun. </text></item><item id="H1497AB173AD84BEAB3ADA57717935738"><enum>(ff)</enum><text>A manufactured weight of 50 ounces or more when unloaded.</text></item><item id="H270F361B57184581BBB71BD2210E820C"><enum>(gg)</enum><text>A stabilizing brace or similar component.</text></item><item id="H7A41E191588C431D90E91E29D7F3A2C7"><enum>(hh)</enum><text display-inline="yes-display-inline">A buffer tube or other part that protrudes horizontally behind the pistol grip.</text></item></subclause></clause><clause id="HCA65CA37A7AD43D4934470EC7C66E6B1"><enum>(v)</enum><text>A semiautomatic pistol with a fixed magazine that has the capacity to accept more than 10 rounds.</text></clause><clause id="H8A7138DE1B53428391474A209B5385C4"><enum>(vi)</enum><text>A semiautomatic shotgun that—</text><subclause id="HE8DDB7EAA650463BAE6CB76F2E49E9EA"><enum>(I)</enum><text>either—</text><item id="H68785F61445C452189A9B6DD8B05D7C2"><enum>(aa)</enum><text>has a fixed magazine with the capacity to accept more than 5 rounds, or</text></item><item id="HA793C51DCE454BF0A8A345ADA46B45BD"><enum>(bb)</enum><text>does not have a fixed magazine, and </text></item></subclause><subclause id="H9C22B33479504930875C2493A5EEFA49"><enum>(II)</enum><text>has any of the following:</text><item id="H5D7F08DA37F641158E46F73FE64314C4"><enum>(aa)</enum><text display-inline="yes-display-inline">A folding, telescoping, or detachable stock.</text></item><item id="HFB1D6FC9E9604676A5D9C1931A48096A"><enum>(bb)</enum><text>A pistol grip or bird's head grip.</text></item><item id="H1BC990D019FC4B3097613307899D6F26"><enum>(cc)</enum><text>The ability to accept a detachable magazine.</text></item><item id="HC79A9ED59B20497EB390A9B491DEEC14"><enum>(dd)</enum><text>A forward grip.</text></item><item id="H28F67951BEEF487DA91C5115617C6D77"><enum>(ee)</enum><text>A functional grenade launcher.</text></item></subclause></clause><clause id="H47714DD0809448C0A9C6969CEA9CF733"><enum>(vii)</enum><text>Any shotgun with a revolving cylinder.</text></clause><clause id="HF7E19886E0264439B98D0AA9057EA71B"><enum>(viii)</enum><text>All belt-fed semiautomatic firearms, including TNW M2HB and FN M2495.</text></clause><clause id="HDDC0791D9F54425092FCA6DEA8DFB398"><enum>(ix)</enum><text>Any combination of parts from which a firearm described in clauses (i) through (viii) can be assembled.</text></clause><clause id="H65FC1E92893B424494CF2A7A90E93C1B"><enum>(x)</enum><text display-inline="yes-display-inline">The frame or receiver of a rifle or shotgun described in clause (i), (ii), (iii), (vi), or (viii). </text></clause></subparagraph><subparagraph id="H58D71B4DA0AE45F39C154A431CB8CDAC"><enum>(B)</enum><header>Certain firearms not included</header><text display-inline="yes-display-inline">Such term does not include any firearm that is manually operated by bolt or lever action, or that is only capable of firing rimfire ammunition.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HAB36A17136F54C6A90848BCA202AB93F"><enum>(b)</enum><header>Exemption from additional tax for articles acquired by the United States</header><text>Section 4182 of such Code is amended by redesignating subsection (d) as subsection (e) and by inserting after subsection (c) the following new subsection:</text><quoted-block style="OLC" id="HA6BAD2E36D8248BC97E408E9F7466485" display-inline="no-display-inline"><subsection id="H1DBDC3DEA1FF4A949C5495397A75F555"><enum>(d)</enum><header>Exemption from additional tax for articles acquired by the United States</header><text display-inline="yes-display-inline">The tax imposed by section 4181(b) shall not apply to any article which is purchased by the United States or by a State or local government. </text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H425364575D3C4439B0DEC4AB6C3F03EB"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply to sales after the date of the enactment of this Act.</text></subsection></section></legis-body></bill>
