<section id="H457E67BC136F4CFB8DE9F508DFD61559" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Terry Technical Correction Act</short-title></quote>.</text></section> <section id="HBAB46E56B93E4204B64FFFBE02139CB4" section-type="subsequent-section"><enum>2.</enum><header>Application of Fair Sentencing Act of 2010</header><text display-inline="no-display-inline">Section 404 of the First Step Act of 2018 (<external-xref legal-doc="usc" parsable-cite="usc/21/841">21 U.S.C. 841</external-xref> note) is amended—</text>
<paragraph id="H5E9E85D2D9FB4EBA8AB8DA750B511855"><enum>(1)</enum><text>in subsection (a)—</text> <subparagraph id="H9FD76FA30E4E458A892569B3223947CE"><enum>(A)</enum><text>by striking <quote><term>covered offense</term> means</quote> and inserting the following:</text>

<paragraph id="HA396DA5C4DAE407C80BFE1BC90C17E19"><enum>(1)</enum><text>means</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph> <subparagraph id="H00ACBF61346A4287AF513992658C5BEC"><enum>(B)</enum><text>by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph>
<subparagraph id="H9F023A40417E4CA1AD91EC64B4E84038"><enum>(C)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H543E4876A1F947589DB0AB1021E889D2"> <paragraph id="H6B5D3BBDA7CD4EAAB5B406C082F61021"><enum>(2)</enum><text>includes a violation, involving cocaine base, of—</text>
<subparagraph id="H6B50A9EFD7144063A5FE027D9E167BF8"><enum>(A)</enum><text>section 3113 of title 5, United States Code; </text></subparagraph> <subparagraph id="H7E830F2D7F2D47C09B7A0DC29154C8D1"><enum>(B)</enum><text>section 401(b)(1)(C) of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/841">21 U.S.C. 841(b)(1)(C)</external-xref>);</text></subparagraph>
<subparagraph id="HCA9E5EC3158E4409835EA028FE1D4921"><enum>(C)</enum><text>section 404(a) of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/844">21 U.S.C. 844(a)</external-xref>);</text></subparagraph> <subparagraph id="H46B557DD2FBA4CFE97514BA0D861A1D3"><enum>(D)</enum><text>section 406 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/846">21 U.S.C. 846</external-xref>);</text></subparagraph>
<subparagraph id="H001F22A472C840F892E51C1DDB30F872"><enum>(E)</enum><text>section 408 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/848">21 U.S.C. 848</external-xref>); </text></subparagraph> <subparagraph id="H22A570F09C954AF98138B16616863EF7"><enum>(F)</enum><text>subsection (b) or (c) of section 409 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/849">21 U.S.C. 849</external-xref>);</text></subparagraph>
<subparagraph id="HF799CD32DDA7410C92D8F1CF7661658D"><enum>(G)</enum><text>subsection (a) or (b) of section 418 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/859">21 U.S.C. 859</external-xref>);</text></subparagraph> <subparagraph id="H3D9DE08D641A4646AE2B5F8A5D38EE4D"><enum>(H)</enum><text>subsection (a), (b), or (c) of section 419 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/860">21 U.S.C. 860</external-xref>);</text></subparagraph>
<subparagraph id="H1891484E903B485C8B28C8C994627220"><enum>(I)</enum><text>section 420 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/861">21 U.S.C. 861</external-xref>); </text></subparagraph> <subparagraph id="H5DEC21DA1AA14BCEB290FCC7142ED134"><enum>(J)</enum><text>section 1010(b)(3) of the Controlled Substances Import and Export Act (<external-xref legal-doc="usc" parsable-cite="usc/21/960">21 U.S.C. 960(b)(3)</external-xref>); </text></subparagraph>
<subparagraph id="HE6BECD05D7924088AEF17D7448F56B6E"><enum>(K)</enum><text>section 1010A of the Controlled Substances Import and Export Act (<external-xref legal-doc="usc" parsable-cite="usc/21/960a">21 U.S.C. 960a</external-xref>); </text></subparagraph> <subparagraph id="HD1B2262DE0B54B4DB0BD11C587BFF7FF"><enum>(L)</enum><text>section 90103 of the Violent Crime Control and Law Enforcement Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/34/12522">34 U.S.C. 12522</external-xref>);</text></subparagraph>
<subparagraph id="HD9F375FBDF214CFA85BA9D98DA7C7387"><enum>(M)</enum><text>section 70503 or 70506 of title 46, United States Code; or </text></subparagraph> <subparagraph id="H3A840E6CAEC3410A9F68BFBFD57384DA"><enum>(N)</enum><text>any attempt, conspiracy or solicitation to commit an offense described in subparagraphs (A) through (M).</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph>
<paragraph id="H4792D670D35E41E4BF234215A01BE5D4"><enum>(2)</enum><text>in subsection (c), by inserting <quote>A motion made under this section that was denied after a court determination that a violation described in subsection (a)(2) was not a covered offense shall not be considered a denial after a complete review of the motion on the merits within the meaning of this section.</quote> after the period at the end of the second sentence.</text></paragraph></section> </legis-body></bill>
