R. 5071</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20230728">July 28, 2023</action-date><action-desc><sponsor name-id="B001298">Mr. Bacon</sponsor> (for himself, <cosponsor name-id="C001112">Mr. Carbajal</cosponsor>, <cosponsor name-id="B001291">Mr. Babin</cosponsor>, <cosponsor name-id="L000582">Mr. Lieu</cosponsor>, and <cosponsor name-id="L000564">Mr. Lamborn</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HAS00">Committee on Armed Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 10, United States Code, to authorize the Secretary of the Air Force to designate certain separated members of the Air Force as honorary separated members of the Space Force.</official-title></form><legis-body id="H435413B10CE948979DBA9F013C5AA099" style="OLC"><section id="H45DDAE54DD424E218FC8200B3E590081" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Space Force Legacy Guardian Recognition Act</short-title></quote>.</text></section><section id="HB41E9EEBB35C45338FA0E134E1E6C3BB" section-type="subsequent-section"><enum>2.</enum><header>Authority to designate certain separated members of the Air Force as honorary separated members of the Space Force</header><text display-inline="no-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/933">Chapter 933</external-xref> of title 10, United States Code, is amended by adding at the end the following new section:</text><quoted-block style="USC" id="H8AE41AB715414553A9349D8A4AD47F3D" display-inline="no-display-inline"><section id="HEF6CD617FAE743BC88975EC969797BFD"><enum>9254.</enum><header>Authority to designate certain separated members of the Air Force as honorary separated members of the Space Force</header><subsection id="H8CB3A15D0B2E489CAEF42BE0C972B2E7"><enum>(a)</enum><header>Authority</header><text display-inline="yes-display-inline">The Secretary of the Air Force may prescribe regulations that authorize an eligible individual to be designated as an honorary separated member of the Space Force. An eligible individual so designated may be referred to as a <quote>Legacy Guardian</quote>.</text></subsection><subsection id="H86CB4DC4DBFD4983AC565E7893697418"><enum>(b)</enum><header>Elements</header><text>Regulations prescribed under this section may include the following elements:</text><paragraph id="H425EC05B64B04088B6DA43E7322EAA8F"><enum>(1)</enum><text display-inline="yes-display-inline">Eligibility criteria, including applicable dates of service and constructive service credit, for designation under this section.</text></paragraph><paragraph id="H0AEBE1C6C4184EBC8598884CB80A7782"><enum>(2)</enum><text display-inline="yes-display-inline">An application process through which an eligible individual, or a survivor of a deceased eligible individual, may apply for such designation of such eligible individual.</text></paragraph><paragraph id="HA558F68B2D934D6D9EB39B905CC399D4"><enum>(3)</enum><text>A certificate, approved device, or other insignia of such designation.</text></paragraph></subsection><subsection id="HA27A3C2C926E4E88BDBCF953B76167A8"><enum>(c)</enum><header>Rule of construction</header><text>Designation of an eligible individual under this section shall not be construed to entitle such eligible individual to any benefit in addition to those established by this section or pursuant to regulations prescribed under this section.</text></subsection><subsection id="H7C2BDF16273D4CBF90B70833A565E609"><enum>(d)</enum><header>Eligible individual defined</header><text display-inline="yes-display-inline">In this section, the term <quote>eligible individual</quote> means an individual—</text><paragraph id="H98B4D5EC29A24D0E92E04CBCCDCF03F8"><enum>(1)</enum><text display-inline="yes-display-inline">whom the Secretary of the Air Force determines served in support of space operations as a member of the Air Force; and</text></paragraph><paragraph id="H8F26F15D7FED4F488936540426846ED8"><enum>(2)</enum><text>who separates (or previously separated) from the armed forces as a member of the Air Force.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
