which was referred to the <committee-name committee-id="HBA00">Committee on Financial Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Fair Credit Reporting Act to prohibit the use of consumer credit checks against prospective and current employees for the purposes of making adverse employment decisions.</official-title></form><legis-body id="H28550FCED23E46CD8095828BFC0B95BE" style="OLC"><section id="HBC3271374B184F1A88E6F3DE984EBECB" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Equal Employment for All Act of 2023</short-title></quote>.</text></section><section id="H7D0CAFD8E7C849E2AA813D62032E540E"><enum>2.</enum><header>Use of credit checks prohibited for employment purposes</header><subsection id="H1DDD30C8E13F41B0BC6CBBF9514045A5"><enum>(a)</enum><header>Prohibition for employment and adverse action</header><text>Section 604 of the Fair Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681b">15 U.S.C. 1681b</external-xref>) is amended—</text><paragraph id="HFBE3BB2FDA004932A0849AF43055EFBB"><enum>(1)</enum><text>in subsection (a)(3)(B), by inserting <quote>within the restrictions set forth in subsection (b)</quote> after <quote>purposes</quote>;</text></paragraph><paragraph id="H2B008D7188A747479F1B8FF354BC9BC0"><enum>(2)</enum><text>by redesignating subsections (b) through (g) as subsections (c) through (h), respectively; and</text></paragraph><paragraph id="H71C3960D34234A22BCF2C9F7CC2C47A5"><enum>(3)</enum><text>by inserting after subsection (a) the following new subsection:</text><quoted-block display-inline="no-display-inline" id="H7C7C12A868524A40A1438324B14843E0" style="OLC"><subsection id="H44D389251BEF493A9ADE7F424A85E4AC"><enum>(b)</enum><header>Use of certain consumer report prohibited for employment purposes or adverse action</header><paragraph id="H2528B8A3B56945B2962B8E5F3B6E3546"><enum>(1)</enum><header>General prohibition</header><text>Except as provided in paragraph (3), a person, including a prospective employer or current employer, may not use a consumer report or investigative consumer report, or cause a consumer report or investigative consumer report to be procured, with respect to any consumer where any information contained in the report bears on the creditworthiness, credit standing, or credit capacity of the consumer—</text><subparagraph id="H425C9B6618A8490CB32065EF5F2CB0D1"><enum>(A)</enum><text>for employment purposes; or</text></subparagraph><subparagraph id="HB726EAC063C84437AFCEA82286EA71EF"><enum>(B)</enum><text>for making an adverse action, as described in section 603(k)(1)(B)(ii).</text></subparagraph></paragraph><paragraph id="HD5EA87256C1C4E768830192D3D03109E"><enum>(2)</enum><header>Source of consumer report irrelevant</header><text>The prohibition described in paragraph (1) shall apply even if the consumer consents or otherwise authorizes the procurement or use of a consumer report for employment purposes or in connection with an adverse action with respect to the consumer.</text></paragraph><paragraph id="H8B863CE7E40D44569FCA4B8D31CB76E9"><enum>(3)</enum><header>Exceptions</header><text>Notwithstanding the prohibitions set forth in this subsection, and consistent with the other sections of this Act, an employer may use a consumer report with respect to a consumer in the following situations:</text><subparagraph id="HF9027617BD3D4265BEC4098AB0422F9C"><enum>(A)</enum><text>When the consumer applies for, or currently holds, employment that requires national security clearance.</text></subparagraph><subparagraph id="H46EF60BA395842AC808910D7D8A1EF1B"><enum>(B)</enum><text>When otherwise required by law.</text></subparagraph></paragraph><paragraph id="H2DDF5C928BA441CE8A86A38E2ED00535"><enum>(4)</enum><header>Effect on disclosure and notification requirements</header><text>The exceptions described in paragraph (3) shall have no effect upon the other requirements of this Act, including requirements in regards to disclosure and notification to a consumer when permissibly using a consumer report for employment purposes or for making an adverse action against the consumer.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H6426FBC6FE1A4CF3AE780FC5E28E7BD5"><enum>(4)</enum><text>in subsection (c), as so redesignated—</text><subparagraph id="H8B2C3D664FCA438B81F49E4B4CF125AF"><enum>(A)</enum><text>in paragraph (1)—</text><clause id="H6FF80BA340E848328766F1C65A0F0B4C"><enum>(i)</enum><text>by amending the paragraph heading to read as follows: <quote><header-in-text level="subsection" style="OLC">Use of consumer reports for employment purposes</header-in-text></quote>;</text></clause><clause id="H3A1B943E6EB6439B96C30986A0E26E52"><enum>(ii)</enum><text>in subparagraph (A), by redesignating clauses (i) and (ii) as subclauses (I) and (II), respectively, and by moving such subclauses two ems to the right;</text></clause><clause id="HB980AB48051D46B298B10A98F56D9305"><enum>(iii)</enum><text display-inline="yes-display-inline">by redesignating subparagraphs (A) and (B) as clauses (i) and (ii), respectively, and by moving such clauses two ems to the right;</text></clause><clause id="HE798916AE9564A2FA63B6E0C782D4603"><enum>(iv)</enum><text>by striking the period at the end of clause (ii) (as so redesignated) and inserting <quote>; and</quote>;</text></clause><clause id="HCBD69BC9204B407195439DD45000794A"><enum>(v)</enum><text>by striking <quote>agency may furnish</quote> and inserting</text><quoted-block display-inline="yes-display-inline" id="H1365F064ABBA4047822420FF3237E2A4" style="OLC"><text>agency—</text><paragraph id="HC01AFF7A869E42E7A3507070E5E55428"><enum>(A)</enum><text display-inline="yes-display-inline">may furnish</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause><clause id="HE73553543A474D40882DB82437294EEF"><enum>(vi)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block display-inline="no-display-inline" id="H5FD2B2293B34413E8D4F26A449F38A6B" style="OLC"><subparagraph id="HC5E9A8AD773143ECA47BFA2E796EAA9D"><enum>(B)</enum><text display-inline="yes-display-inline">except as provided in paragraph (5), may not furnish a consumer report with respect to any consumer in which any information contained in the report bears on the consumer’s creditworthiness, credit standing, or credit capacity to an employer if the employer seeks to use such information in a denial of employment or any other decision made for employment purposes.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="H9F63A7A4B59441ACAC28B5FCB2D9F76F"><enum>(B)</enum><text>by adding at the end the following new paragraph:</text><quoted-block id="H16DC201584694746B0A74F9F07122FE8" display-inline="no-display-inline" style="OLC"><paragraph id="H9B2F0B1E3865498393DD82270A6C5E1A"><enum>(5)</enum><header>Requirements for consumer reports bearing on the consumer’s creditworthiness, credit standing, or credit capacity</header><subparagraph id="H8758C742A0854140BB5638925FD45D20"><enum>(A)</enum><header>Exceptions</header><text>An employer may use a consumer report with respect to any consumer in which any information contained in the report bears on the consumer’s creditworthiness, credit standing, or credit capacity in a decision made for employment purposes or before taking an adverse action for employment purposes only if the consumer authorizes the procurement of the report as described in paragraph (2)(A)(ii) and—</text><clause id="H7560C59B70914F57B9EA00AB13565EB6"><enum>(i)</enum><text>the consumer applies for, or currently holds, employment that requires the consumer to be eligible for access to classified information; or</text></clause><clause id="H7FFDC2BB62A44C46B47CCA2D26E20237"><enum>(ii)</enum><text>when otherwise required by law.</text></clause></subparagraph><subparagraph id="H07E3566871E743CD969726D93C27030D" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header>Limitation</header><text display-inline="yes-display-inline">A person who seeks to obtain or use a consumer report with respect to any consumer in which any information contained in the report bears on the consumer’s creditworthiness, credit standing, or credit capacity may not deny employment to the consumer or make any other decision for employment purposes with respect to the consumer because the consumer has not authorized the procurement of the report as described in paragraph (2)(A)(ii).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="HDB6B54C87FC4465B9DB9910217C7FC8A"><enum>(b)</enum><header>Conforming amendments and cross references</header><text>The Fair Credit Reporting Act is further amended as follows:</text><paragraph id="H7CC18DAA752D4C07A4C7375AE3A40BF7"><enum>(1)</enum><text>In section 603 (<external-xref legal-doc="usc" parsable-cite="usc/15/1681a">15 U.S.C. 1681a</external-xref>)—</text><subparagraph id="H4B3D31FA0F8740FA801D9CC4582A2873"><enum>(A)</enum><text>in subsection (d)(3), by striking <quote>604(g)(3)</quote> and inserting <quote>604(h)(3)</quote>; and</text></subparagraph><subparagraph id="H7E45A56B201E4FAF8B179477EF5F8B28"><enum>(B)</enum><text>in subsection (o), by striking <quote>A communication</quote> and inserting <quote>Subject to the restrictions set forth in subsection 604(b), a communication</quote>.</text></subparagraph></paragraph><paragraph id="H6CB113DAF94A4B75840C08CA461DA589"><enum>(2)</enum><text>In section 604 (<external-xref legal-doc="usc" parsable-cite="usc/15/1681b">15 U.S.C. 1681b</external-xref>)—</text><subparagraph id="H38D9DC6AE8964D09B0170E05C7FE2507"><enum>(A)</enum><text>in subsection (a), by striking <quote>subsection (c)</quote> and inserting <quote>subsection (d)</quote>;</text></subparagraph><subparagraph id="H91CDACEF0BD14DA187B144CEB50451AC"><enum>(B)</enum><text>in subsection (c), as redesignated by subsection (a)(2) of this section—</text><clause id="HD9EDB62C02424314B3E6FA66C39F1013"><enum>(i)</enum><text>in paragraph (2)(A), by inserting <quote>and subject to the restrictions set forth in subsection (b)</quote> after <quote>subparagraph (B)</quote>; and</text></clause><clause id="H36483980B46848AB843EF33D522611BC"><enum>(ii)</enum><text>in paragraph (3)(A), by inserting <quote>and subject to the restrictions set forth in subsection (b)</quote> after <quote>subparagraph (B)</quote>;</text></clause></subparagraph><subparagraph id="HB46048068F3B4B0BBBA393D59FA7F96C"><enum>(C)</enum><text>in subsection (d)(1), as redesignated by subsection (a)(2) of this section, by striking <quote>subsection (e)</quote> in both places that term appears and inserting <quote>subsection (f)</quote>; and</text></subparagraph><subparagraph id="H56DDCEAF1489421C9F8F230CF6F6D09B"><enum>(D)</enum><text>in subsection (f), as redesignated by subsection (a)(2) of this section—</text><clause id="HA74D1E3BA1E4422198FF9B9A688F3B84"><enum>(i)</enum><text>in paragraph (1), by striking <quote>subsection (c)(1)(B)</quote> and inserting <quote>subsection (d)(1)(B)</quote>; and</text></clause><clause id="HA43DE7962DC549E2BEB5A7B3449A0E02"><enum>(ii)</enum><text>in paragraph (5), by striking <quote>subsection (c)(1)(B)</quote> and inserting <quote>subsection (d)(1)(B)</quote>.</text></clause></subparagraph></paragraph><paragraph id="HE1E4226D4C8C473E951D564E32E7D5C0"><enum>(3)</enum><text>In section 607(e)(3)(A) (<external-xref legal-doc="usc" parsable-cite="usc/15/1681e">15 U.S.C. 1681e(e)(3)(A)</external-xref>), by striking <quote>604(b)(4)(E)(i)</quote> and inserting <quote>604(c)(4)(E)(i)</quote>.</text></paragraph><paragraph id="H6470D14DAE8C444AA83F72A8BADE923B"><enum>(4)</enum><text>In section 609 (<external-xref legal-doc="usc" parsable-cite="usc/15/1681g">15 U.S.C. 1681g</external-xref>)—</text><subparagraph id="HB47B1E9A42E042F9A616D13D6737940C"><enum>(A)</enum><text>in subsection (a)(3)(C)(i), by striking <quote>604(b)(4)(E)(i)</quote> and inserting <quote>604(c)(4)(E)(i)</quote>;
