which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 23, United States Code, to require the Secretary of Transportation to conduct an economic impact study for certain proposed toll facilities and projects, and for other purposes.</official-title></form><legis-body id="H97598A323BE44BC899423E88094D7C7F" style="OLC"><section id="HBA93F18D9F114191A3489E191AFC8765" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Tolling Transparency Act of 2023</short-title></quote>.</text></section><section id="H2B1DD90862C84D79B8DA1E5056EF753C"><enum>2.</enum><header>Requirements for tolling</header><subsection id="HEAA63D15CD364AF9B0C4659F1532D773"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 129(a) of title 23, United States Code, is amended—</text><paragraph id="H6CB06F1022EA4D01822CD68FC58E7680"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (3)(B)(i), by striking <quote>paragraph (9)(C)</quote> and inserting <quote>paragraph (10)(C)</quote>;</text></paragraph><paragraph id="H1AA5D2CB751448D591D75C84C04F8495"><enum>(2)</enum><text>in paragraph (6), by striking <quote>paragraph (3)</quote> and inserting <quote>paragraph (4)</quote>;</text></paragraph><paragraph id="H74845DE3F04141A78145755CEB770247"><enum>(3)</enum><text>in paragraph (9)(C)(i)(II), by striking <quote>paragraph (3)(B)</quote> and inserting <quote>paragraph (4)(B)</quote>;</text></paragraph><paragraph id="H5F62DE47633B4E1B902D7EA0DA40D5D2"><enum>(4)</enum><text>by redesignating paragraphs (3) through (11) as paragraphs (4) through (12), respectively; and</text></paragraph><paragraph id="H4F3C6BBFECB0418DB7C35533A1C51D81"><enum>(5)</enum><text>by adding after paragraph (2) the following:</text><quoted-block style="USC" id="H09F7BF162B4043999E3C75D821568480" display-inline="no-display-inline"><paragraph id="H6F55DF31EA4447EBB87D6F58DB853DD9"><enum>(3)</enum><header>Economic impact study included in NEPA review</header><subparagraph id="HF585888583A6403D90E738163ACC635E"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">As part of any review process that may be required by the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>) for a proposed toll facility under this subsection or a proposed project that uses tolls carried out under subsection (d), the Secretary shall conduct an economic impact study examining—</text><clause id="HE7F5C5DEF5404ED3A02212A34A4C30EE"><enum>(i)</enum><text display-inline="yes-display-inline">the impact of such toll facility or project on businesses and communities;</text></clause><clause id="H63955778617D462ABF355D9803617D1E"><enum>(ii)</enum><text>significant impacts due to the diversion of traffic onto county and city roadways;</text></clause><clause id="H61CD58911B7A4D7D9FC974C1292A6B0D"><enum>(iii)</enum><text>the level of confidence that any negative impacts of such toll facility or project can or will be adequately mitigated, or that any suggested mitigation will be implemented in time to prevent significant impacts when tolling is scheduled to begin;</text></clause><clause id="H23E34AAA89744D42BADAF5CE310DDBF2"><enum>(iv)</enum><text>the level of confidence in modeling analysis completed for such toll facility or project; and</text></clause><clause id="HE9A954026EF54E1CB02EF4B508F6D7B3"><enum>(v)</enum><text>the impact of such toll facility or project on low-income residents and seniors.</text></clause></subparagraph><subparagraph id="HD74588BCB1F4467C9774368225D3B61F"><enum>(B)</enum><header>Limitation on tolling</header><clause id="H6EB9D4A3EF6942EBA2780C76E3EF61AE"><enum>(i)</enum><header>In general</header><text>A public authority with jurisdiction over a toll facility or project described in subparagraph (A) may not collect a toll of any kind for any purpose unless the economic impact study described in subparagraph (A) is completed.</text></clause><clause id="H89C60B60613941079F011585C5A829E1"><enum>(ii)</enum><header>Discretion of Secretary</header><text display-inline="yes-display-inline">If the Secretary determines that the results of such economic impact study indicate that such toll facility or project would have an unreasonable adverse impact, the Secretary may prohibit such toll facility or the use of tolls in such project. </text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H22F41429A18C43D1AF336AAE91041E8C"><enum>(b)</enum><header>Conforming changes</header><paragraph id="HF9D5783B61864E3AA35768A107107B4B"><enum>(1)</enum><header>Congestion relief program</header><text display-inline="yes-display-inline">Section 129(d)(6)(B)(v) of title 23, United States Code, is amended by striking <quote>subsection (a)(3)</quote> and inserting <quote>subsection (a)(4)</quote>.</text></paragraph><paragraph id="H11EDEDE9B11148E8BED1E63C1CE5ED95"><enum>(2)</enum><header>HOV facilities</header><text display-inline="yes-display-inline">Section 166(c)(2) of title 23, United States Code, is amended by striking <quote>section 129(a)(3)</quote> and inserting <quote>section 129(a)(4)</quote>.</text></paragraph><paragraph id="HA835B6B2B7774E328B2EB082AEE2D6ED"><enum>(3)</enum><header>Applicability of provisions for international bridges</header><text display-inline="yes-display-inline">Section 535f of title 33, United States Code, is amended by striking <quote>section 129(a)(3)</quote> and inserting <quote>section 129(a)(4)</quote>.</text></paragraph></subsection></section></legis-body></bill>
