<official-title display="yes">To prohibit owners of covered dwelling units from assessing or collecting certain fees from tenants, and for other purposes.</official-title>

<section id="H0EDEB61A645A429CABFEB5B670D8B940" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>End Junk Fees for Renters Act</short-title></quote>. </text></section> <section id="H1CC6B36AD61A4951B250A72840D1FEA5"><enum>2.</enum><header>Rental Junk Fees</header> <subsection id="H10C75012ADF34059991C7332F405C335"><enum>(a)</enum><header>Application fees</header><text display-inline="yes-display-inline">The appropriate regulator shall prohibit the owner of a covered dwelling unit from assessing or collecting a fee or charge, from any household in connection with the submission of an application for rental of such dwelling unit.</text></subsection>
<subsection id="HB37F6D0D2B9648D08C818B690CA74A3A"><enum>(b)</enum><header>Tenant screening fees</header><text display-inline="yes-display-inline">The appropriate regulator shall prohibit the owner of a covered dwelling unit from assessing to or collecting from any household applying to rent such dwelling unit any fee or charge for costs of conducting any criminal history, tenant screening, consumer report, or other background check of such household.</text></subsection> <subsection id="HEF896157ADE44CDC82168D266FF76D0E"><enum>(c)</enum><header>Late fees</header><text display-inline="yes-display-inline">The appropriate regulator shall prohibit the owner of a covered dwelling unit from assessing to or collecting from any fee or charge in connection with the late payment of rent for such dwelling unit unless the amount of such late fee is applied to the amount of rent due the following month as a credit.</text></subsection>
<subsection id="H739DC9E4196A4438B3C0195509D67399"><enum>(d)</enum><header>Use of consumer reports</header><text display-inline="yes-display-inline">The appropriate regulator shall prohibit the owner of a covered dwelling unit from, when screening a potential tenant, using—</text> <paragraph id="H3F8281D0E69849EDAABB4BA9E4371248"><enum>(1)</enum><text>a credit score (as such term is defined in section 609(f) of the Fair Credit Reporting Act); and</text></paragraph>
<paragraph id="HEB04010B89ED440EB3277D3FCAF3E0FD"><enum>(2)</enum><text display-inline="yes-display-inline">any consumer report by any consumer reporting agency that compiles and maintains files on consumers on a nationwide basis (as such term is defined in section 603(p) of the Fair Credit Reporting Act). </text></paragraph></subsection> <subsection id="H11235ECFAB664F0B9B7256A31344684E"><enum>(e)</enum><header>Required disclosures</header><text display-inline="yes-display-inline">The appropriate regulator shall require each owner of a covered dwelling unit to disclose to the tenant before a lease is signed—</text>
<paragraph id="HC9E132D03FBB4489811CB0C0C250A7DC"><enum>(1)</enum><text display-inline="yes-display-inline">the total amount due each month, including any fees;</text></paragraph> <paragraph id="HF27B5CBA65184BF1B3BC2381767BB6A1"><enum>(2)</enum><text>to the degree practicable, a summary of any past litigation between the such owner and any former or current tenants;</text></paragraph>
<paragraph id="HB564C0EB745E4B5CA34674695B56A81D"><enum>(3)</enum><text display-inline="yes-display-inline">a description of any ongoing pest and maintenance issues; and</text></paragraph> <paragraph id="H9E36B0EDDBD94827B475EE8BFCCB44B0"><enum>(4)</enum><text display-inline="yes-display-inline">the amount rent increase for the property in each of the 10 previous years.</text></paragraph></subsection>
<subsection id="H4E7B5694564E44E9AC179CE21EA82805"><enum>(f)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text> <paragraph id="H95BFF7A61ADB4771A2D94A2D698A6241"><enum>(1)</enum><header>Appropriate regulator</header><text>The term <quote>appropriate regulator</quote> means—</text>
<subparagraph id="HDC569827C07E4B3292BE28BFC2FCEDF1"><enum>(A)</enum><text>the Secretary of Housing and Urban Development, with respect to covered dwelling units described in—</text> <clause id="HBB35E2AD14BA46BABDC5A77FBA2C1852"><enum>(i)</enum><text>paragraph (2)(A);</text></clause>
<clause id="H11E5F90E39404DBD8703FA45A16B2A54"><enum>(ii)</enum><text>paragraph (2)(B), to the extent the Federally backed mortgage loan referred to in such paragraph is described in subparagraph (A), (B), or (C) of paragraph (3); or</text></clause> <clause id="HE52B78346E0C478EA4D1A04560D05189"><enum>(iii)</enum><text display-inline="yes-display-inline">paragraph (2)(B), to the extent the Federally backed mortgage loan referred to in such paragraph is described in paragraph (4) and is made in whole or in part, or insured, guaranteed, supplemented, or assisted in any way under or in connection with a housing or urban development program administered by the Secretary of Housing and Urban Development;</text></clause></subparagraph>
<subparagraph id="H3BE90EFDDA5B4E0AAF7C833D2E09700B"><enum>(B)</enum><text display-inline="yes-display-inline">the Secretary of Veterans Affairs, with respect to covered dwelling units described in paragraph (2)(B), to the extent the Federally backed mortgage loan referred to in such paragraph is described in—</text> <clause id="H486842A1EE544DE78729554F01FE1780"><enum>(i)</enum><text display-inline="yes-display-inline">paragraph (3)(D); or</text></clause>
<clause id="H1AF3D94844274CDE834FD62F9E1C702D"><enum>(ii)</enum><text display-inline="yes-display-inline">paragraph (4) and is made in whole or in part, or insured, guaranteed, supplemented, or assisted in any way, by the Secretary of Veterans Affairs or under or in connection with a housing or related program administered by Secretary of Veterans Affairs;</text></clause></subparagraph> <subparagraph id="H09D165B5DE854D7388C0990DD4943BE4" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">the Secretary of Agriculture, with respect to covered dwelling units described in paragraph (2)(B), to the extent the Federally backed mortgage loan referred to in such paragraph is described in—</text>
<clause id="HE32CC38F1A4B4E7ABC67A544886CF5A5"><enum>(i)</enum><text display-inline="yes-display-inline">subparagraph (E) or (F) of paragraph (3); or</text></clause> <clause id="HDD83258A5D7049F2A8F4723D37CF63C9"><enum>(ii)</enum><text display-inline="yes-display-inline">paragraph (4) and is made in whole or in part, or insured, guaranteed, supplemented, or assisted in any way, by the Secretary of Agriculture or under or in connection with a housing or related program administered by Secretary of Agriculture; and</text></clause></subparagraph>
<subparagraph id="HFD0439FFC04A499F8C5B30B876367A9D" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">the Director of the Federal Housing Finance Agency, with respect to covered dwelling units described in paragraph (2)(B), to the extent the Federally backed mortgage loan referred to in such paragraph is described in—</text> <clause id="H5ED6323B8BD5473FBE71431F76634973"><enum>(i)</enum><text display-inline="yes-display-inline">paragraph (3)(G); or</text></clause>
<clause id="H38B0054C1AAB46A19FC622761EBD440E"><enum>(ii)</enum><text display-inline="yes-display-inline">paragraph (4) and is purchased or securitized by the Federal Home Loan Mortgage Corporation or the Federal National Mortgage Association.</text></clause></subparagraph></paragraph> <paragraph id="H5BE66E6E5E8C4559BB0078F4CF9DCBFE"><enum>(2)</enum><header>Covered dwelling unit</header><text>The term <quote>covered dwelling unit</quote> means a dwelling unit that—</text>
<subparagraph id="H4037B9BC4AA7464D8E3F34BF1C244F7F"><enum>(A)</enum><text>is provided assistance within the jurisdiction of the Department, as such term is defined in section 102(m) of the Department of Housing and Urban Development Reform Act of 1989 (<external-xref legal-doc="usc" parsable-cite="usc/42/3545">42 U.S.C. 3545(m)</external-xref>); or</text></subparagraph> <subparagraph id="H916E7003B43E445D86E00AC835E2D11E"><enum>(B)</enum><text display-inline="yes-display-inline">is subject to, or is on or in a property that is subject to a Federally backed single-family mortgage loan or a Federally backed multifamily mortgage loan.</text></subparagraph></paragraph>
<paragraph id="H64838984CBA44AE380E88BCC8C971967"><enum>(3)</enum><header>Federally backed single-family mortgage loan</header><text display-inline="yes-display-inline">The term <quote>Federally backed single-family mortgage loan</quote> includes any loan that is secured by a first or subordinate lien on residential real property (including individual units of condominiums and cooperatives) designed principally for the occupancy of from 1- to 4-families that is—</text> <subparagraph id="H2B3BD58191FE43AF845B499F83FE5EF6"><enum>(A)</enum><text>insured by the Federal Housing Administration under title II of the National Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1707">12 U.S.C. 1707 et seq.</external-xref>);</text></subparagraph>
<subparagraph id="H8B9A6C9104A340CC8E1BAF0F0C5C6D5D"><enum>(B)</enum><text>insured under section 255 of the National Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1715z-20">12 U.S.C. 1715z–20</external-xref>);</text></subparagraph> <subparagraph id="HE0829EBA1C3046D883F1E4724F687FF8"><enum>(C)</enum><text>guaranteed under section 184 or 184A of the Housing and Community Development Act of 1992 (12 U.S.C. 1715z–13a, 1715z–13b);</text></subparagraph>
<subparagraph id="H73D403A5C93A4F8492BD6D121FB62CA4"><enum>(D)</enum><text>guaranteed or insured by the Department of Veterans Affairs;</text></subparagraph> <subparagraph id="HF2085971AC7848F8AD5B60652E626F64"><enum>(E)</enum><text>guaranteed or insured by the Department of Agriculture;</text></subparagraph>
<subparagraph id="HC82EE6F5E86A48F7A389FD42D8C3AB40"><enum>(F)</enum><text>made by the Department of Agriculture; or</text></subparagraph> <subparagraph id="H7740C7F51DC74CBDA1CF1D18CAA46BCF"><enum>(G)</enum><text>purchased or securitized by the Federal Home Loan Mortgage Corporation or the Federal National Mortgage Association.</text></subparagraph></paragraph>
<paragraph id="HBF80D644843B4DF68B03C13E1745A774"><enum>(4)</enum><header>Federally backed multifamily mortgage loan</header><text display-inline="yes-display-inline">The term <quote>Federally backed multifamily mortgage loan</quote> includes any loan (other than temporary financing such as a construction loan) that—</text> <subparagraph id="HC9BA73262C024015BA66DD77E74965D1"><enum>(A)</enum><text>is secured by a first or subordinate lien on residential multifamily real property designed principally for the occupancy of 5 or more families, including any such secured loan, the proceeds of which are used to prepay or pay off an existing loan secured by the same property; and</text></subparagraph>
<subparagraph id="HB1587A542387462EBD3E870F6B33E83B"><enum>(B)</enum><text>is made in whole or in part, or insured, guaranteed, supplemented, or assisted in any way, by any officer or agency of the Federal Government or under or in connection with a housing or urban development program administered by the Secretary of Housing and Urban Development or a housing or related program administered by any other such officer or agency, or is purchased or securitized by the Federal Home Loan Mortgage Corporation or the Federal National Mortgage Association.</text></subparagraph></paragraph> <paragraph id="HE204D24F93ED4A17A69A65903DD3D109"><enum>(5)</enum><header>Owner</header><text display-inline="yes-display-inline">The term <quote>owner</quote> means, with respect to a dwelling unit, any private person or entity, including a cooperative, an agency of the Federal Government, or a public housing agency, having the legal right to lease or sublease the dwelling unit.</text></paragraph></subsection></section>
<section id="H55DEB4097E80405BA50E2C26B8199C1C"><enum>3.</enum><header>Rulemaking</header><text display-inline="no-display-inline">The Bureau of Consumer Financial Protection shall, not later than 180 days after the date of the enactment of this section issue a rule that—</text> <paragraph id="HAD7E5A79F1864AA3A52EF51CF907FED4"><enum>(1)</enum><text>defines the term <quote>junk fee</quote> with respect to rental housing; and </text></paragraph>
<paragraph id="H50095F018A2E42F2B613809F3C3B1F45"><enum>(2)</enum><text>finds the furnishing of any information about a unpaid junk fee (as such term is defined pursuant to paragraph (1)) to a consumer reporting agency to be a unfair or unconscionable means to collect or attempt to collect debt in violation of section 808 of the Fair Debt Collection Practices Act. </text></paragraph></section> </legis-body> </bill>
